A San Antonio judge says the Texas Constitution’s ban on same-sex marriage is illegal according to the U.S. Constitution.
The allegation is that the 14th Amendment guarantees equal protection of the law are violated by disallowing gay couples from marrying.
I say the ruling defies logic and explains how there is nothing discriminatory about the Amendment, voted in by the people of Texas in 2005, which states, “Article 1, Section 32, which provides that 'Marriage in this state shall consist only of the union of one man and one woman.'”
By the way, the judge made the ruling then put a hold on overturning the state’s amendment saying it is clear this fight will continue to a higher court.
