Trump’s lawyer to file complaint against Comey for releasing Trump memos

President Donald Trump’s lawyer reportedly plans to file a complaint against ousted FBI Director James Comey over his decision to leak memos of his conversations with the commander in chief.

Marc Kasowitz, Trump’s personal lawyer, is expected to file the complaint with the Justice Department Inspector General and the Senate Judiciary Committee, CNN reported Friday. The complaint from Kasowitz will focus on Comey’s testimony before the Senate Intelligence Committee Thursday morning.

Shortly after being fired by Trump, Comey asked “a close friend” at the Columbia University Law School — later determined to be professor Dan Richman — to leak a memo detailing a conversation he had with the president, the former FBI chief admitted Thursday.

“I asked a friend of mine to share the content of the memo with a reporter,” Comey said. “I didn’t do it myself for a variety of reasons, but I asked him to, because I thought that might prompt the appointment of a special counsel.”

The New York Times first reported on the memo on May 16. Two days later, former FBI Director Robert Mueller was appointed as the special counsel for the ongoing Russia investigation.

Comey made the decision to share the memos of his interactions with Trump after the president tweeted that he may have tapes of their conversations.

“My judgment was I needed to get that out into the public square, so I asked a friend of mine to share the content of the memo with a reporter,” Comey explained.

When Trump’s lawyer plans to file the complaint is not yet known, according to CNN. Furthermore, the Justice Department has limited options when it comes to former employees.

While the agency can investigate the matter, the only remedy — if evidence of wrongdoing is discovered — would be to add a note to Comey’s file, should he ever seek to be employed by the Justice Department in the future.

In his statement Thursday, Kasowitz rebuked Comey for leaking the Trump memos to a friend. He said the former FBI director “unilaterally and surreptitiously made unauthorized disclosures to the press of privileged communications with the president.”

He went on to say Comey’s leaking of his communications with Trump was “entirely retaliatory.”

For his part, Trump tweeted Friday morning that Comey’s testimony was “total and complete vindication” from reports suggesting he was personally under FBI investigation. The president also accused Comey of being “a leaker.”
