14 Kids Fathered With Free Sperm: Feds Tell Man to Stop

FDA Issues Man Giving Away Sperm for Free on Website Cease and Desist Order

SAN FRANCISCO (The Blaze/AP) — Trent Arsenault, 36, is being made an example of, and it’s not for his generosity in donating his sperm for free to sire 14 children with four more on the way.

Physicians and the federal government are using the example of this San Francisco Bay area man to show the risks posed by the informal market for sperm donations, which doctors consider unsafe but some people call a civil liberties issue.

Arsenault offers his sperm for free to women he meets through his website. The U.S. Food and Drug Administration have issued him an order to cease and desist, which he is contesting.

While sperm bank donors remain nameless and some men offer their sperm through anonymous ads on Craigslist, Arsenault’s site is filled with photographs of the trim, blond Midwest native. In its letter, the agency describes Arsenault’s service as a business. Arsenault disagrees.

“This is not a business or a clinic. It’s just people partnering up to have a baby out of compassion,” he said.

Arsenault says he donates sperm out of a sense of service to help people who want to have children but can’t afford conventional sperm banks. The 36-year-old minister’s son has four more children on the way.

“I always had known through people praying at church that there’s fertility issues,” Arsenault told The Associated Press. “I thought it would just be a neat way of service to help the community.”

The FDA sent Arsenault the letter late last year telling him he must stop because he does not follow the agency’s requirements for getting tested for sexually transmitted diseases within seven days before giving sperm. The FDA did not immediately respond to requests for comment.

Violators of FDA regulations on human cells and tissues face up to a year in prison and a $100,000 fine, according to guidelines published on the agency’s website.

Arsenault gets tested regularly, but following the FDA’s rules would make it impossible to keep offering his sperm for free, he said.

“The regulations may be little bit strict, but I think that’s appropriate,” said Dr. Mitchell Rosen, director of the University of California, San Francisco Fertility Preservation Center.

Rosen said it’s not uncommon for women to use donated sperm from someone they know. But trusting a donor who is being honest about his background is no substitute for screening for diseases that could be passed on to the mother or child, he said.

A sperm bank will also isolate the actual sperm cells from the donor’s semen, which reduces the risk of passing along pathogens, Rosen said. “In this situation there’s no reduction of risk. It‘s just as if they’re going out and having a one night stand.”

At the time of the FDA letter, the Silicon Valley computer security specialist had made 328 sperm donations to 46 women, a number he said is now higher. He can continue to donate sperm while the case is pending.

Experts say the volume of sperm donations by Arsenault creates risks for future generations. They say the greater the number of children, the greater the chances of spreading a genetic defect. Children who don‘t know they’re related could also unwittingly have sex, though unlike the anonymous sperm donor system used by sperm banks, Arsenault keeps careful track of his offspring.

“There‘s a danger of accidental incest or inbreeding if you’re the father of 14 children” and a habitual sperm donor, said bioethicist Arthur Caplan at University of Pennsylvania. “Nobody should be involved as a sperm donor on that level. It’s not safe.”

Caplan said the FDA may have a tough time asserting its authority over this kind of informal activity, though. Other medical experts think the agency may have a case since it deals with the safety of public health.

“He should not be allowed to do it unless he gets himself tested” and follow the same rules as sperm banks, said Dr. Stanley Korenman, associate dean of ethics at the UCLA David Geffen School of Medicine.

The difference between asking a friend to donate sperm and the San Francisco case is a matter of volume, experts says.

“This guy is doing it commercially. He’s turning out a lot of babies. If you have a friend doing it once or twice it’s not a big deal,” Korenman said.

The oldest child Arsenault has fathered is now 4. He and the recipients, whom he describes as “intimate partners,” sign a legal agreement ahead of time stripping him of any custody rights and absolving him of any financial responsibility for the children.

But he says that part of the reason of making himself publicly visible as a sperm donor rather than remaining anonymous, as is typical with sperm banks, is because he and some of the families hope and expect he will have some involvement in the children’s lives in the future.

He says he believes his case comes down to constitutional issues of a right to privacy and reproductive choice.

“It’s not that much more different than a couple knowing each other who want to have a baby,” Arsenault said. “It’s just from me it comes in a cup versus sex.”

      If he was actually having sex with women who wanted a baby would the FDA still issue a “cease & desist” order? Last time I checked sex between two consenting adults was perfectly legal and didn’t require a FDA approval.

      The FDA has slipped down the slope of looking idiotic! The FDA attempts to ban or control semen in a medical environment but doesn‘t and can’t do anything about the millions of free sperm swaps that occur on a daily basis. How foolish can they make themselves look?

      Actually some judges might consider this gifting of gametes a SEXUALLY INTIMATE PARTNERSHIP (SIP) or = SEX. If the guy gave his semen fresh in a cup to the recipient and the Babymama inseminated herself without a doctor actually doing the “method of conception”…… then it is no different than a ruthless women hell bent on getting pregnant taking fresh semen out of a condom. And She can go after the sperm donor for child support. Certain questions about the transactions and methods of insemination are not being disclosed. Is there a reason why this Donor may soon have DCSS knocking down his door for his debts to society. Unless we once and for all start holding single mothers truly accountable for their procreation choices 1

Just the FDA telling you outright (an arm of the fed gov) to stop and desist is another example of the soft tyranny America is atleast for now. When they lock this young man up, you will know how bad it really is. People are having sex and running out on their partners everyday leaving them to fend for themselves, in these cases the gov steps in with funds for the now single mom….think their jealous?

      Until the FDA also starts tracking the private actions of ghetto daddies and rednecks who are doing the same thing and creating more welfare babies on Medicaid, perhaps they should mind their own business.

      Ask yourself who filed the complaint. Him or the mommas? Nope! I‘d say the primary objection is probably from people who are making a fortune off of sperm donation and don’t like the precedent of people doing this in an organized fashion without their involvement. Clinics don’t keep track of the babies they make and who they date, but this guy does. So their stated fear is actually a bigger problem with the way they do business. Their real objection is the cash they aren’t making and the idea that they are being cut out of the loop.

    The paranoia about incest is unfounded. Anyone with any experience in animal husbandry knows that virtually all domesticated species be it barred rock chickens or beagles come from a very small (typically a handful) of individuals. Even if a set of half siblings reproduced its very unlikely they would have problems. Typically inbreeding issues only pop up after several generations of very close ( father daughter or full sibling) breeding.
    I bet if you look at some of the “elite” families in the east cost, you would find less genetic diversity than between two of this mans offspring.
    Its a shame that we have let our government regulate every aspect of our lives, all the way down to how we distribute and acquire our seed.

      Homosexual men and women can‘t conceive and that is this guy’s target population. Without very current disease testing it is possible for the recipient to contract a disease. It says alot that people are opting for “free” sperm, placing themselves in danger, and risking the health of an unborn child.

      What is going to happen when these people realize that it is much more expensive to raise a child than they previously thought and sue for child support? What is going to happen when these children start asking about their father? What if genetic issues do arise as a result of this man‘s DNA fusing with the recipient’s? This man shouldn’t be playing God.

    Conceiving children outside of the necessary familial support structure is not in the best interests of the child. Study after study shows that the children born to married mothers and fathers have a much better chance of success in life.

    With that said, the government’s prosecution of the donor is hypocritical. They now teach in the schools that even minors are sexually “autonomous” and that their parents are to have little or no say in their sexual activities. Worse, when unmarried mothers and fathers run around having litters of children, the government mails them a check.

      If you listen to the rabid left, yes he gave the FDA consent to peek in his bedroom by the fact that both he and his recipients travel on the tax-payer’s roads in the process of sharing their DNA.

      Of course, he does have a work-around available to him. All he needs do is donate the old-fashioned way and the government will likely defend his “right” to keep doing basically the same thing.

      Sadly, as with most things the government does, it’s more concerned about the process than the end result.

      Welfare Queens aren’t limited to being Black only. They come from all races; and they are only doing the popping out of babies, so their welfare checks get bigger. I have known several Welfare Queens who aren’t black, and any one of them would be willing to have babies by this guy, just to make their checks bigger.
      Personally, I don‘t see where the FDA has any right to tell him he can’t do this, even if they are calling it a business. As to that, it could be a business, but one in which the only party that benefits, is the mother of the child. He is giving his sperm away free. She is accepting it in order to have the child.
      My question would be: “How many of these women are married to a man who shoots blanks? Who’s sperm is sterile?”

      With any kind of procreation there is the possibility of incest. But, why does this bother you so much? If two people have the same father and grow up in different households and never learn of one another until they meet in public as an adult, and then don’t find out about their relation until after they fall in love, who are you to tell them they can’t marry and have children? And I’m being entirely serious here. How many adopted siblings or cousins have you ever know who ended up marrying a person from inside the family? How is that any better? I know your response will be that because they have no blood relation it is safe, but let me remind you that there is an infinite amount of variation in every generation. Even if these two people share one parent, there is no more statistical chance that they will pass on a fatal genetic trait to their children. It is simply a falsehood that has been repeated enough times that some people think it is true.

      Personally, I’d feel alot less queasy about a couple with the same father but who never met until adulthood marrying than I would about a couple who were always cousins with the caveat that one was adopted from a foreign nation. Why do people like you feel the need to stick your nose where it doesn’t belong? This man isn’t out there murdering children like the doctors at the FDA. He is helping women (and some may be married w/ impotent husbands) have children.

    The only issue this is about is protecting the financial interests of SPERM BANKS !

    It is competition, it threatens the multi-million dollar industry who writes the rules through lobbying and special interests ! In CA. the law says (Family code 7613 b) … As long as a supervising physician does the method of insemination and known donor is not a natural parent or liable for child support. Supported by case law Steven S. v Deborah D. (CA. 2005 ? )
    Now the State may claim that children are their #1 interests, but that is a lie. As proven by the cited case the #! liberty interest in CA. is the right for women to choose to have a child or not. What a mother wants regardless of the rights of the child is what the courts rule with. The superior liberty rights of the MOTHER. So if she wants a sperm donor, warts and all…… the State can not stop her. It violates her constitutional rights. And the FDA is guilty of COLOR of LAW abuses under CA. civil code 52, and under US codes Title 18 ss 241,242 and Title 42 ss 1983 an 14141.

Maybe that will be the the best way to reduce the number of people on welfare going foreward –Just a thought….

      Actually when it comes to kids 1974.They passed CAPTA,right after a meeting with jordon on the state of childrens affairs.Think the mid east isn’t running the show by fiat ,think again.
