14 States Move to Deny ‘Anchor Babies’ Citizenship

PHOENIX (AP) — Lawmakers in at least 14 states are collaborating on proposed legislation to deny U.S. citizenship to children of illegal immigrants, according to lawmakers, including the sponsor of Arizona’s 2010 law targeting illegal immigration.

“We’re taking a leadership role on things that need to be fixed in America. We can’t get Congress to do it,” Republican state Sen. Russell Pearce, of Mesa, said Tuesday. “It’s a national work group so that we have model legislation that we know will be successful, that meets the constitutional criteria.”

The efforts by the state legislators come amid calls to change the U.S. Constitution’s 14th Amendment, which grants automatic citizenship to U.S.-born children of illegal immigrants. Supporters cite costs to taxpayers for services provided to illegal immigrants and their children.

Pennsylvania state Rep. Daryl Metcalfe, the founder of a national group of legislators critical of illegal immigration, said the 14th Amendment “greatly incentives foreign invaders to violate our border and our laws.” He had a news conference Tuesday in Harrisburg, Pa., on the multistate endeavor.

The effort could run afoul of the language in the 14th Amendment and lead to a court battle over the constitutionality of the law. But Metcalfe said providing birthright citizenship to children of illegal immigrants is an “ongoing distortion and twisting” of the amendment.

Metcalfe’s office said lawmakers in at least 12 other states besides Arizona and Pennsylvania said they were making their own announcements about working on the citizenship legislation. Those other states: Alabama, Delaware, Idaho, Indiana, Michigan, Mississippi, Montana, Nebraska, New Hampshire, Oklahoma, Texas and Utah. Legislators from a total of 41 states are involved in a Metcalfe-founded group concerned with immigration issues.

Pearce was the main sponsor of an Arizona law that would require police enforcing other laws to question people about their immigration status if there‘s reason to suspect they’re in the United States illegally. It was to go into effect this summer, but a judge put on hold key provisions pending the resolution of a legal challenge.

Pearce also was the chief sponsor of a 2007 state law targeting employers who knowingly hire illegal immigrants.

He and fellow Arizona legislators plan a Tuesday afternoon news conference to formally announce the effort.

Pearce said the legislation has yet to be drafted, and he declined to comment on possible approaches, including whether it would focus on the issuance of state birth certificates.

“We’re going to address the issue of the unconstitutional declaration of citizenship to those born to non-citizens,” Pearce said. “It is a violation of the 14th Amendment.”

Arizona Gov. Jan Brewer, who signed the 2010 law and who is championing the state’s legal defense of it against a court challenge mounted by the U.S. Justice Department, was noncommittal when asked whether lawmakers should approve legislation on citizenship.

However, Brewer said she was “always concerned” by the possibility of involving the state in a court fight. “No one wants to be in court. No one wants to be fighting the federal government,” she said.

      Problems here is that many cities are “sanctuary cities” and if an illegal makes it to one of these cities – they never get sent back no matter what happens. Austin is one of those sanctuary cities and it is really hurting all of our social services. http://maboulette.wordpress.com

    im a pretty liberal guy, this makes pretty good sense to me.
    im not really sure what the argument against this would be..
    Theres no room for illegal immigrants in this country. Especially their babies, theyre supposed to have the same rights as me? i dont think so.

    Why could they not recognize the citizenship of the child yet deport the family anyway, including the child? Since the child is a minor it cannot live in the US without legal guardianship, and its parents aren’t legal, so it must go with them until it chooses to return idependently as an adult. The courts may not like it but they would have no constitutional ground for forbidding the states doing it.

    Of course, when have the courts let lack of constitutional grounds get in their way?

    I, too, think something needs to be done about the 14th Amendment. Revise, amend…whatever. Until then, perhaps these states should tell the illegal parents “Either the child can stay and you can go, OR you all go. You all don’t get to stay.” And MEAN it. They should also refuse to recognize any amnesty cases from California (because you know it’s coming. Between Pelosi, Newsom and Brown)
    I’m not anti-immigrant by any stretch; I’m anti-ILLEGAL immigrant. Get in line, get yer papers and come on in! Sneak across the border? Here’s yer one-way back home.

    I sure hope GA is one of the states involved…I am so tired of seeing 15, 16 & 17 year olds turning up at the house across the street, having their babies and then moving to their own homes ON WELFARE, with their new little citizens. I‘ve watched it for almost 15 years and the county tells me there’s nothing they can do because….wait for it……they’re family! In the Hispanic tradition, men & women have different last names….so if the girls’ names match up to one of the people living in the house…it’s ok! And no one wants to check to see if they’re legal!!! The whole thing makes me sick to my stomach!!!

      I hear and see the same thing time and time again. I have actually had people tell me I was lying about it. It is so frustrating to see. The Social Services Dept. assists these folks in obtaining services. There are classes in Mexico telling people which states are the best to go to, and how to obtain every service they can. That info comes from a former neighbor who went through it. Thankfully, she took the steps to become a citizen. To most though, why bother? Less services and MUCH harder to obtain if you are legal.

    A pointless gesture. If we’re going to deport illegal alien residents, then do so. The citizenship of the minor children in their custody is no barrier, any more than a US citizen child can sue in federal court to stop his citizen parents from movign to another state. You’re a minor, you‘re in somebody’s custody, when you’re 18 you can choose your own path. If they’re deported then you go too.

    This has to be a move to impel the Congress to propose such an amendment in the future. It would not pass constitutional muster otherwise. States cannot decide US citizenship status, and I‘m a very big states’ rights guy. I ssume the states are trying to force the feds to step up and deal with the issue.

      Be prepared for a new wave of lawsuits from the DOJ against the states proposing this. Look at what has happened in Arizona. I bet these new lawsuits will incorporate all the countries of the world like the AZ lawsuit allowing Mexico and Guatemala etc to file “civil rights’ complaints against AZ.

      Obama’s administration is all about globalization with the United (Arab) Nations leading the charge. He won’t rest until America is a 3rd world country..oops, I mean, nothing special compared to say, Zimbabwe or Rhodesia. George Soros should be very proud of his protegee

    The 14th amendment was initially passed to insure citizenship for newly freed slaves and their children…This is no longer an issue…the law is now used to encourage illegal immigration and should be changed.

      I don’t know about your state but Texas is host to 60,000 illegal babies born each year. I call this insanity. And there is NO guarantee in our Constitution to illegals babies granting citizenship. By the way, if it is so, that the baby is the citizen of an illegal, then the baby should become a ward of the state, and the illegal parents sent back to their home country.

    So an anchor baby born in CA applies for state aid in one of these 14 states for college…what happens? I think this issue is properly decided by the federal government, given its authority over immigration issues and the invariable confusion that would arise from cases like the one I raise. Better to just amend the Constitution, IMHO. But we’ll see how the courts decide this thing.

      Psychosis, hey genius, how will you know the difference between a CA anchor baby and any other CA-born student applying as a more recent resident of one of those 14 state’s public colleges? Your partisan buddies will support you no matter what nonsense you spew–just like your mother–but it still doesn‘t mean that you’ve offered a workable solution. Please enlighten me on how this will get done? If CA chooses to produce the same birth certificate for all its citizens, including anchor babies, then those people will move to GA, AL or wherever and be viewed just like non-anchor-baby applicants to public schools.       Yes, its better to have the problem FIXED by the Federal Government, but don’t you get it(?), like the unsecure border, the Feds won’t do their job, and the states are fed up (no pun intended) with their dereliction of duty.

      So, the answer is, WHATEVER THE STATE WANTS TO DO TO VERIFY THE APPLICANT ISN’T AN ANCHOR BABY! Until the feds get off their a** and do their job. People with honor get tired of people offering barriers or hurdles to us regaining our honor. Hurdles like “it will be hard to do”, or “how can you make it 100% effective”.

      Look, you tell people to quit whining, so, when they do and try to get as much done to restore our honor as possible, my advice to you is… lead (get the feds to do it), follow, or get out of the way.

      If they apply for any type of loan, they MUST show their parents tax returns. Happened with me, happened with my kids.
      I wonder how many defaulted loans are from illegal residents? I’ll have to look into that.
      In my daughter-in-law’s nursing program, she said about 30% of the students cannot speak English. There’s a Spanish translator for every three non-English speakers.

    Here we go once again, somethig indeed does need to be done on the matter of the illegal imigration and it will honestly not be easily solved. Most likely it will take many steps to deal with especially these critical parts…

    1. Cut off the border crossing and secure it completely as possible.
    2. No amnesty bill – no matter how they call it – NOT TO HAPPEN!!!
    3. Have a consensus on the cause by ALL the states in a national constitutional convention to let the people deal with the problem, as the feds sure as heck have not.
    4. Make sure it can withstand scrutiny and decision by the Supreme Court on the constitutionality of it – not as these progressive activist judges declare by their own divine fiat.

    We need to deal with this before the feds and the progressives come up with another hair brained back door deal that stabs us in the back and sells off our own country.

    And mind you, I am the son of an imigrant mother who came to our country legally!!!

    We have a proper and established way of doing it, so lets get it fixed and working the way it should.

    Go for it! About time! Bet the courts won’t uphold any attempt to deny Anchor Babies citizenship, the “Progressive” Demos would lose too many votes.

    By the way were about the only country in the world which has this law. It was passed after the Civil War to guarantee Afrrican American salves citizenship. Should have been repealed thirty years later.

      Actually – there are many countries that have this law – that is a “Beck fact” that is untrue – in fact there are other countries in the world which have this law. In addition to the United States, there are 33 countries that offer automatic, unconditional citizenship to children born within their borders – PolitFact. com as well as NumbersUSA.com.

      English is the national language. Immigration issues have to be carried out on a federal level. It is unreasonable to think that the US should have 50 different immigration policies. Remember we are “one nation under God”.

Look at how much those leaches are costing us in more ways than one. I say, make it imposible for them to survive here. Then they will go back to where they belong. Once ‘home’ if they want to build better lives here and, they want to contribute to society, let them apply for entry and eventually citizenship as did many of their countrymen before them. Let them pay income taxes and financially support the programs and benefits they now take advantage of while not supporting those entitlements.

      I’m not opposed to people learning Spanish as a second language, but English needs to be made the official language of the US with no catering to other languages.
      During the turn of the century 110 years ago when immigrants were flocking to the US from all over the world, they had to learn English to adapt to American life. It should be that way today. Dual languages is a big contributor to dividing a nation.

      Don’t know about the rest of you, but about an hour ago, a couple of men came to my front door and asked if we lived in a “Spanish-speaking” home. When I said no, they asked if there was anyone else in the building that was “Spanish-speaking”. They said they had some literature for people who spoke Spanish. This is the second time this has happened, the first was back in the late winter (Jan/Feb).

      Anyone else have the same thing happen?

      Shouldn’t this be a state issue? The US does not have an official language but it is the de facto language. You are incorrect in saying that during the turn of the century immigrants had to learn English in order to assimilate into the US culture. Major cities throughout the US had sections based on nationality, for example “Little Italy”. As a result they did not have to learn english, they spoke their native language and that can be seen today. This english only speaking cause is ridiculous, lets concentrate on single payer health care, and breaking big banks.

      The 13 Amendment was put in because Democrats in the South wanted to send Black babies back to Africa. It was NOT put in for Mexicans to roll over the border and have a Baby “An American baby.”

      In 2005 the DOD instituted a policy making it illegal for US Service Members to engage in LEGAL prostitution activities in foreign nations. This regulation supports the idea that since US Military personnel are paid by the federal government, if while on or off duty, or while on approved leave, engage in paying for sex, even if it is a legal and respected trade within a host nation, completes an indirect support of human trafficking and or the trafficking of women.

      As noted at http://www.usfk.mil/usfk/Uploads/120/pht.pdf “Since late 2006, patronizing prostitution is a specific, chargeable offense for service members under Article 134 of the U.S. military’s statutory criminal law, the Uniform Code of Military Justice (UCMJ).”

      The publication further states

      Besides being a major human rights violation, modern day slavery is a global health threat and undermines International security by fueling the growth of organized crime. Human trafficking is closely connected with money laundering, document forgery, and human smuggling. Where organized crime flourishes, governments and the rule of law are undermined and weakened. It is therefore crucial that military groups avoid behavior that counters law and order and creates security gaps.”

      For the most part I agree with these statements and if the same logic is applied to the 14th amendment issue, I think it becomes quite clear that, by allowing illegal immigrants to utilize federally and state subsidized medical facilities, doctors, medicine, equipment etc, in order to give birth to a baby who would then be granted instantaneous citizenship and then further entitled to more federal and state government subsidies, ie food stamps, welfare, housing assistance etc. we are providing the very incentives to assist organized crime in the trafficking of humans from depraved third world countries to our own.

      I say pursue a 14th amendment remedy but a serious focus needs to be placed on the argument above, we need to de-fund the incentives producing “THE TRAFFICKING OF WOMEN AND CHILDREN” as a matter of conscience and morality.

      Anyone see what I am getting at?

      The precedents are out there, the data is clear, we must stop the crime against humanity that is the trafficking of women and children across our southern border. To do this we need to craft and pass legislation in all 50 states that denies funding for health care services to illegal immigrants as well as ALL federal and state monies that would incentivize the horrendous and dubious crimes against humanity taking place across our borders. Unless of course you are all for the trafficking of women and children so you can pimp them out as prostitutes !!! I mean it is either or right? You cant have it both ways can you?       Thanks to dedicated public servants like PA Rep. Daryl Metcalf, AZ State Senator Russel Pierce and Kris Kobach, this issue is finally being addressed… I believe that America is the only country in the world that allows this massive “Anchor Baby” loophole to be exploited. Even Canada closed its baby loophole last year!

      GBECK2012, if you had a decent knowledge of the amendment and what its authors said it was for, you wouldn’t appear to be so smug in your put down of Tea Partiers, or anyone else who supports holding the 14th amendment to its original purpose. It was never meant to be used for anchor babies. It was passed in 1866 for the purpose of granting citizenship to slaves born on American soil. One of the Senators involved stated that it did not apply to babies of foreigners born on our soil. That pretty well takes away the anchor baby argument doesn’t it?

      The 14th does not apply to foreign nationals illegally in the U.S. Foreign nationals are not “subject to the jurisdiction of the United States.” U.S. citizens are subject to the jusrisdiction of the U.S. anywhere in the world. Foreign nationals are under the jurisdiction of the U.S. only while in the U.S. or for actions taken while in the U.S. Sorry, but there is a major difference, and it is written into the 14th.
