Sean Combs Could Sue City After Winning Open Carry Gun Case

While some anti-gun enthusiasts may find it unpalatable, in many states it is not illegal to openly carry a gun while walking down the street. And when stopped and asked about it, one doesn’t have to produce ID to inquiring officials.

So is the case in Michigan. And 18-year-old Sean Combs is educating plenty of people on the issue after a jury sided with him last week following an arrest for carrying his loaded M-1 rifle down Michigan streets and refusing to initially show identification when questioned by police.

It happened on April 13 in Birmingham, Mich. At the time, Combs was stopped by police after having the vintage rifle strapped to his back. He was told to show ID but refused. The Observer and Eccentric has more on what happened next:

Michigan is an open carry state that does not require a person to produce ID when stopped by the police. In this case, however, the three officers involved in the arrest each testified they wanted to see some ID from Combs because he did not appear to be 18, the legal age to openly carry a firearm.

When he refused to produce ID, they arrested him. He was charged with brandishing a firearm in public, disturbing the peace and obstructing a police officer. Judge Marc Barron of the 48th District Court dismissed the third charge on a lack of evidence.

“Michigan law does not require anyone to produce ID on demand,” Combs’s attorney, Jim Makowski, told the local CBS affiliate. ‘They were rude and disrespectful to my client from the get-go.

“Nobody called 911, nobody was following him … That was it, he was minding his own business,” he said, and added that the crowd formed because the police were “harassing” Combs.

“I was just exercising my rights,” Combs, a recent high school graduate, testified in the case. “Freedom of expression, freedom of speech.”

And the jury agreed.

“We upheld the law,” Rev. Julius DelPino, a jury member, told the local Patch site. “Based on how the law is written, (Combs) was not breaking the law.”

But while jurors rejected the city’s argument, at least one juror thinks the law should be changed.

“I think there’s a hole in the statute,” told the Observer and Eccentric. “To me, I think the legislature needs to couple this open carry law with a requirement that people show ID when they’re asked to show it. We have such laws for drinking or for getting a driver’s license. I think if you’re going to carry a gun around, it seems reasonable that you should have to identify yourself if there’s a requirement that you have to be 18.”

As a result of the verdict, Combs is considering a civil suit against the city. Combs’s lawyer explained that he requested several times that the case be dismissed, but the city refused.

“We tried to get the city to see reason on over a half-dozen occasions, we asked them to dismiss the case, we said ‘We’ll absorb out attorney fees, just dismiss the case.’ The city chose to go forward anyway,” Makowski said.

“I can tell you one thing, we offered to dismiss this case without any cost to the city of Birmingham on over six occasions, they chose not to,” he told the local CBS affiliate. “If there is a civil suit, I think people need to ask ‘Why wasn’t this case dismissed before trial?’”

While many people may not know it, open carry is permitted in numerous states, including Arizona, Montana, and Virginia. Some may be surprised to know open carry is not permitted in historically gun-friendly states such Oklahoma and Texas.

If I see some punk kid walking down the street with a military rifle on his back, you can count on me calling the cops. Someone else may take matters into their own hands.     I conceal carry here in Utah. Whenever I have had contact with a police officer, out of courtesy, I tell them I am armed. They have always thanked me. It is about being responsible. The judge should throw out the case. Where the hell are this kids parents?

      I live in an open carry state that forgot for a while it was. But we have a large number of citizens that are reminding the people it is their duty to be armed at all times to protect themselves. In order to create an atmosphere where criminals (the biggest being overbearring gov’t) realize everyone is armed and to leave them alone, we must actually act that way.
      And don’t forget what Jesus Says in Luke 11:21 “When a strong man, fully armed, guards his own palace, his goods are safe;”

      That the problem. We all freak out when people have guns. Back not to long ago everyone carried a gun. What happen when you drive down the road and see a pickup with a rifle in the back window. Its funny my home town has around 150.000 people and is the murder capital in the USA. Dallas and Fort Worth have like 2.5 Million and allot fewer murders then Flint Michigan.       I don’t “lick the boots” of the fine men and women who enforce our public laws. I respect them for being the everyday heroes they are. They lay their live on the line for us every day. Sure there may be one or two who have stepped over the line of authority, but for the most part they are honorable people who hold the law in the highest respect.

      I absolutely understand it is a right to open carry. Around here it is actually fairly common. I was just at the store not two hours ago and a gentleman was kind enough to tell me my shirt had come up over my firearm. It was a courtesy. No one is upset that we carry guns. Most people respect that right and are not intimidated. The point I have been trying to make is that this kid is doing it to cause a stir and for no other reason.

      I would love to see a gun on the side of everyone walking the street. But as long as there are disrespectful idiots like this kid running around, they will continue to seek to take away our rights. He was just being a jerk, not exercising his rights.

      Put yourself in that officers shoes. Do you let this kid go and find out he goes Cleabold and Harris on the local high school? Or do you check him out thoroughly? The officer did what was right by detaining him. They should have let him go when the realized he wasn’t a threat.

      For the most part I agree with you on everything you said about our police. Where I disagree is where you say sure there might be on or two who have steped out of the line. There is alot more stepping out of the line everyday. They think they can harass people and that the laws dont apply to them. In north Texas the cops are great. Sure there are a few bad ones. but for the most part its cops in cities like New York and LA and Seattle. Seattle has horrible cops. They slap pregnant women and all sorts of stuff. I use to live up there. I dont have to show my papers if im standing at a gas station or I dont have to let you search my car. These rights are here to protect the people. But our police have become militarzied. Its all out of control. Im on the side of civil liberties.

      Was he testing the waters, or stirring up trouble as some have said? Well, in a way, yes. You see, it is perfectly legal to openly carry firearms, as it is a baseball bat, or bowling ball. Our rights are being taken away. It’s our own fault for not exercising them.

    I live in a state where open carry is legal, and the only reason a person needs a concealed carry permit is to carry concealed in a town, city, or railroad or logging camp . Out hiking or hunting or just wandering around outside of one of those places carry a gun any way you want. I’m sure that this upsets some people, but they’re still outnumbered here. We can also carry concealed guns in our vehicles without a permit as well. I can’t imagine a cop here stopping someone for open carry.

    Does anyone want to join my “printing” campaign? It goes like this: In states that have concealed carry laws, you can usually be arrested for printing, or having the print of your gun visable through your clothes. In my campaign, we would carry empty holsters and allow them to print. When the cops question you, you reveal your empty holster (carefully!) and threaten legal action.

    I was stopped in Red Square a few years ago by a Russian policeman, who demanded my ID. I showed him my passport, and he went through it, and gave it back and went away. I asked my Russian friend why I was stopped, and was told it was because I had brown eyes, I kid you not… I might have been a Chechniyan ! Most Russians have blue or green eyes.

    I said if a policeman in America did that, , I’d take his badge number and the policeman would be in hot water… my Russian friend was amazed that Americans aren’t afraid of policemen.

    But then, that was ten years ago.

      If you actually did get a chl, which I doubt seriously, they made a mistake. Shooting someone with a rifle strapped to their back is insane. A chl is designed to protect someone in immediate fear of their life. A rifle legally strapped to someone’s back doe not fall into that and you are truly pathetic for even thinking that way.

    I’m never big on suing people but in this case, I say bring it on.
    The police should have used their brains a little more and their “power” a bit less. Just like we tell little kids when they start to cry and stomp their feet “ use your words”. They probably could have found out everything they needed to know had they been a bit nicer and not so “cop like”.

    My step son was running in the park, preparing for USMC boot camp, wearing a 40 lb weight vest; The vest is filled with sand.

    A local cop stopped him and asked him why he was running with a bullet proof vest

    He immediately asked the cop if he was under arrest or suspected of a crime. The cop answered no and then asked for a ID. My step son said told him it was not a bullet proof vest and even if it was it is not illegal to run with one in the park. He said that he would not give the police his ID because he did nothing wrong and further more he doesn’t even have to talk with him at this point. He then told the cop he was leaving because he is not guilty of any crime or was not under arrest. And he left….

    The cop did nothing.

    Police and prosecutors think that they are God and can do anything they want to do. They think that they, being the authorities, are not subject to the law. They see themselves as being above the law, a law unto themselves, and not subject to it. Although the public pays for their mistaken and presumptive assumption, I hope that he does sue them. Not only the city, but the cops individually also. This is the only thing that will teach these tyrants a lesson.

    That is correct here in Texas. You can carry concealed weapon with a permit and concealed without a permit within a car. I used to see people open carrying in Arizona. I always admired those who were not afraid to do this. Most people would not do that, however. Businesses could stop people from carrying guns into their stores. You would sometimes see people walking around in those stores with empty holsters on their belts, having left their gun in their car.
    There was a fellow from out of state who told me that he once went into a bar in Arizona and after ordering a drink, he looked around and discovered that he was the only one in the bar who wasn’t carrying a pistol on his side. Some states don’t allow carrying guns into an establishment whose major business concerns liquor. As you can see from Arizona, liquor, drinking, and guns together pose no problem. To refute this, a cop once said to me that the biggest problems he had at bars was with someone who was carrying a gun. He failed to see that if everyone was able to legally carry a gun in the bar, that the problem would not exist.

      I believe here in Az you can carry in an establishment that serves liquor/beer as long as you are not drinking and as long as the establishment does not post a sign saying no. When I moved here many years ago it surprised me the first few times I saw people open carrying. Now many people do it. The Governor recently within the past couple of years signed constitutional carry, people do not need permits to carry concealed here anymore.

    Personally, I hope this guy sues the cops and/or the city. I also love the one juror who whined about wanting the law changed so you have to show ID; what are the chances that this same whiner has a problem with requiring ID at voting polls? And would this juror support Arizona checking IDs of people pulled over or call it “racist”? Why is it liberals want law-abiding citizens to be treated like criminals but think anything implemented to actually catch criminal behavior is a violation of “human rights”?
