Sen. Schumer’s ‘Three Branches’ of Government No Longer Includes Judiciary

While sitting in on CNN’s “State of the Union” this morning, New York’s Senator Chuck Schumer was ringing alarm bells on what he perceives as a GOP threat to shut down the government this Spring during the upcoming Debt Ceiling debate and the Congressional battle over various elements of government funding. This tactic was nothing new as both sides traditionally use extreme examples to make their point. What surprised me was Sen. Schumer’s explanation of the three branches of our American system of government.

As I have always understood it, and as outlined in the Constitution, we have a brilliantly balanced government that provides checks and balances between the three branches; Legislative, Executive, and Judicial. It is a very simple concept graphically displayed here from the website USA for Kids (a site managed by the U.S. Consulate General in Hong Kong).

The visual of the graphic makes it quite clear, but a simple text explanation follows as well;

“the framers wrote the Constitution to provide for a separation of powers, or three separate branches of government. Each has its own responsibilities and at the same time they work together to make the country run smoothly and to assure that the rights of citizens are not ignored or disallowed. This is done through checks and balances. A branch may use its powers to check the powers of the other two in order to maintain a balance of power among the three branches of government.

The three branches of the U.S. Government are: Legislative, Executive, Judicial”

In the new Schumer model, the Judicial Branch has apparently been removed. Also disturbing was that CNN host Candy Crowley did not raise an eyebrow at this significant error. One wonders just how much time Chris Matthews will dedicate on Monday’s Hardball program to denigrating the Senator’s lack of understanding of the Constitution and what the Founding Fathers meant when they created the Three Branches of U.S. Government.

The planned, systematic destruction of our republic continues. They rewrite history, distort the present and the masses, dumbed down by their education system, don’t even realize what is happening. Their media doesn’t even question the obvious absurdities. We all sit here typing messages to each other while our country as we knew it vanishes. Oh ……we can just wait till election day 2012……sure!

Maybe New York and California can work something out. In reality, its no better here in Philadelphia. Sen. Schumer has a link on his own website (http://schumer.senate.gov/) FOR STUDENTS that links to bensnsguide.gpo.gov. If he can’t read the Constitution, or if he can’t read the big words like the kids in grades 3-5, maybe he should read his own website!!

While I don’t agree with Mr. Schumer’s position on many (most) issues, I understand mis-speaks and am willing to cut the Senator a little slack. What bothers me is the consistent lack of knowledge and understanding of the Constitution that shows up amongst our elected representatives.

I’d love to require a test for each new congress that would weed out the pretenders. If you fail, you get sent home and your state/district has to come up with a new Per or Senator. It shouldn’t matter whether you are an incoming freshman or a (shudder) 40 year veteran. Alternately, maybe part of the nominating process should involve a ‘Are You Smarter Than A 2nd Grader?’ public appearance for each candidate with questions from History, Constitution, Economics, Ethics, and Basic Math.

  I agree, but would go one step further: I would also like to see the age of voting for EVERY American citizen raised to 35, UNLESS the potential voter can pass a very difficult test proving knowledge of the constitution and the way our government is supposed to function. You don’t pass the test, you don’t vote until you are 35! Test would not be required if one joins the military and serves honorably. Those guys and gals get to vote after they join up. Then we should have the best of both worlds, an informed electorate and informed representation…

Schumer needs to be neutered. He, and people of his ilk are extremely dangerous to the American way of life, as perceived by, still, the majority, along with the founders.

What this idiot can’t yet grasp is that the majority of Americans don’t believe half-wits like Schumer are more able to make decisions for themselves than they are. While the numbers are probably shrinking with each passing year, the good guys are still the majority.

First i would like to say that Schmuck Stumer has never regarded the judical branch of goverment, the second think i would like to say is that it would the the U.S. a world of good to shut the goverment down for a week or so… send them all home let them think about why they were elected to office in the first place. these clowns think they are CEO’s they don’t realize WE THE PEOPLE are the CEO’s they are only employees and we call the shots ….

Maybe she had one of the “new” history/government text books when she was in college in VA and that is why she doesn’t know there are three branches of government, or maybe her listening audience is so stupid she figures they will never know the difference.

  8JRTS, I’m goinjg to contact my Republican senators (Isakson and Chambliss) and ask them to tell Democrat Senator Shumer that he needs to read the Constitution, the document read in the House of Representatives for a reason, and find out that there is a Judicial Branch and a Legislative Branch.

  We can see now that the congress is all but irrelevent due to Obama and the Progressives making the changes via regulation reformation so why would they also not seek to make the judicial branch irrelevent as well.
  
  The only other conclusion is to figure that Senator Schumer does not have any clue as to how the nation, let alone the part of government he works in, actually works.
  
  Also for the CNN host to ‘not raise an eyebrow’ over this total disregard for the constitutional system and glaring errors of the senator, shows to no end the contempt of reality CNN holds along with the progressive spin machine they have become.

  The system only works when the right people with the right values are in those 3 branches. You can’t put a bunch of activist judges, lying congressmen and senators, and Commies in the White house and expect the system to work no matter how well it was designed. It works only with the right people and that primarily is the responsibility of the people themselves to be diligent to elect the right people or else it is doomed to failure.   Um…just a suggetion as to the headline topic…MAYBE he mis-spoke “three branches of government” rather than leave out the Judiciary. Meaning, the law MAKING branches of government, defending his still-in-the-majority democrat Senate, and ripping on the republican House. Shumer may be a commie, but he ain’t stupid. Just a thought.
  BUT what is underlying here is the point he is trying to make and how he’s making it. Same ole same ole, but worth mentioning. The sore loser libs are still playing the “party of no” card, and they still don’t get it. We are NOT the party of “no”, but the party of “HELL no!!”. And we are NOT going to “compromise” in order that your little revolution trickles instead of snowballs.

  Wow. That is hard core out-of-the-box thinking, and great suggestions! However, May I suggest so changes:
  1) I believe that the IQ of an idividual can be determined during the various debates, and smart people will know the difference between a smart guy and a Gump. See South Carolina Senate race last year.
  Rather, make them take a Costitution quiz with randomly determined questions some time in the election process before they are determined the winner, like during the primaries. I would suggest given to them by their party’s chair, but the dems would probably fudge that…well, maybe both sides would. Maybe administered by the state Supreme Court from which they are running?
  
  2) The original Constitutional requirement was that only landholders could vote. I do not agrre with this at all, and I’m not really sure how I feel about letting everyone vote. On one hand, how do you determined who is easily duped without squashing their rights as citizens? And to make the claim that welfare recipiants will vote to “get their check on” is nonsense. EVERYONE voting has an ulterior motive for their canidate of choice. Disallowing welfare recipients only furthers YOUR (and my) agenda of the tiniest government possible, and even the lazy have the right to be lazy and want their free cheese.
  So I don’t know.
  3) Best idea I’ve EVER heard, however, one important fact comes to mind. That would require a Constitutional Amendment, which requires…2/3? of both House and Senate and 3/4ths of the states to make happen. That means 13 states is the max that can vote no to deny the Amendment. How many states are close to default? Probably more than 13? And how many House reps are from those states? It has gone too far for that.
  Great ideas, and we need more critical thinking like that! Keep truckin’, bro!

  It was not a mistake when Newt Gingrich did it – we see that because the Progressive spinsters were able to snow the People, we have an even bigger, intrusive government today.
  
  There are only two sound options: 1) cut spending in such a way that shrinks the government dramatically, or 2) default on our debts now, because it will be worse for us later.

  What he is saying is that the President(executive)and the Attorney General(judicial)are joined at the hip, so there are really only two branches of government. Soon even the legislative will be out of the picture because he’ll use executive orders and appoint whoever he wants to whatever seat he wants filled whenever he wants too. We can only hope that we will be allowed to vote, oh scratch that thought, he’ll just stuff the ballot boxes. Rep. D. Issa has a lot of investigative work on his hands and he’ll be fighting Colburn at the same time.

  In defense of Sen Shumer, I believe he was getting the Good and Plenty clause mixed up the 3 branches of Gove. According to the Dems, everything is legal under the Good and Plenty clause, that gives them the right to impose mandates on everyone, except those who the grant waivers. The Judicial branch isn’t on of the branches, they are simply a means to override any challenges to the Good and Plenty clause. Therefore, in his twisted world, he is correct.

  You might just want to read up on HOW amendments come to pass into law.
  
  No one party can effect the making – or alteration – of ANY amendment. It MUST be ratified by three-quarters of ALL the states governments.
  
  In the case of the 17th Amendment – it took 330 days from proposal to ratification,and with the agreement of the State Houses of ALL the States of the then USA – with the exception of ONLY ONE state. The State that didn’t want the amendment was UTAH!
  
  Maybe Glenn hasn’t explained all this to you so you might just want to Google it – and get educated.

  You terribly misunderstand his point. in 1913, the progressive movement was in full swing as was their propaganda machine. It took ordinary Americans til just this year to understand due to Beck’s teachings of history just how bad it was. But VerySeniorCitizen I believe you missed the point by BOOGER71 which was very valid. That the 17th amendment took a A SERIOUS chunk of power away from th states themselves and invalidated their authority as “sovereign states” among the several states to do their business, and allowed the Federal government to excise more authority than was originally given by the founders. This was just another foul bit of business, duping the Congress at the time, which was an unconstitutional act.
  And one of many (Patriot Act) that I would love to be reviewed and judged by our current Supreme Court to judge the constitutionality of such.
  Reckon they can claear their “McDonald’s” coffee spill docket long enough to hear these types of Constitutional cases and help us resore the country?
  You listening, there, Judge Roberts, Scalia, Thomas and Alito? You all have powers given to you by the People to cheak and balence, do your jobs. The POTUS making presidential mandates without judicial review? SERIOUSLY? Is this not an affont to your constitutional power as THE Supreme Court?

  The one thing that the government, be they Dem or GOP, has truely forgotten is that the citizens are the sovereign in this country. We do not live and survive at the whim of those who believe themselves superior. Those few that believe themselves to be elite. Our lives are our own. There are those rights that the founders say, as I believe, are unalienable. They are ours by right of life, not by right of government. Free men and free women have these rights because they are born not because a select few say we have them. Yet both sides are playing us against ourselves. We fight here between ourselves while they change rules and erase laws on the basis of being out dated. How can something that is mine by right of life be out dated? How can one side claim moral superiourity and yet revert back to the same tactics that got us here in the first place? I do not like politicians. I don’t care whose side they are on. Anyone that wants to be a politician as a career is not right in the head. As I see it that just means a desire for power over others or simply put just plain old greed.

  Great points, I would have to agree with you on the 3 points, 1st 2 points open up too much for fraud and discrimination. I would love to see any state that went bankrupt losses their statehood until they pay it off. A state such as California would most likely come back into the union as 2 or 3 states, a popular idea for those in the state that live up north.

  Really? This is a simple MIS-SPEAK. I don’t care for Chuckie, but lets not go crazy on this one. Let’s focus on shutting down the government. It is going to take painful drastic action to get this budget under control and once more, it does not appear that anyone in DC wants to take the necessary steps. The cutting must be across the board. Just like in business, cut the fat until you get to the muscel then shave a bit more, wait awhile and see if the patient lives.

  The lack of education in civics and the history of our elected leaders no longer surprises. The have demonstrated this lack of knowledge on many occasions. And…………After Obama’s SOTU speech in 2010 it should not come as a surprise that the democrats lack respect for the Supreme Court. As George Bernard Shaw once said, “He who can, does. He who cannot, teaches.” Obama need to go back to teaching and his students should be all of the people who are still waiting for their “Obama Money!”

  I recall the federal government shutting down in the 90′s. Had I not heard about it on television, I never would have noticed. Shutting it down again sounds pretty good, maybe it’ll stay closed for a while this time. We’ll still have state, county and municipal overlords to keep us all safe and suckled.
