PHOENIX (AP) — A federal appeals court is refusing to lift a stay blocking major parts of a tough Arizona law targeting illegal immigrants from taking effect.
The 9th U.S. Circuit Court of Appeals on Monday turned down an appeal filed by Gov. Jan Brewer. The governor asked them to lift an injunction imposed by a federal judge in Phoenix the day before the law was to take effect on July 29, 2010.
The U.S Justice Department sued to block the law. It argued it violates the constitution because enforcing immigration law is a federal issue.
Brewer’s lawyers said the federal government hasn’t effectively enforced immigration law and that the state law will assist federal authorities.
The law would require police to check immigration status when enforcing other laws, among other provisions.

Where did these judges come from and how much longer do we have to wait til they get replaced? Case after case they rule against common sense. They constantly rule against the people and this nation, has anyone looked into any of these judges. Has anyone investigated them to see whether or not they are in direct contact with special interests? Has anyone investigated to see if they are being paid off. Nothing is impossible or unimaginable anymore in this country. The government is doing neither. Arizona shouyld cut off all federal tax dollars and use the tax dollars to support it’s own state agencies and borders. Using the logic put forth by the 9th circuit court if it was the federal governments job to control crime Arizona wouldn’t have the right to stop crime within it’s state and would have to allowing it to keep happening.

Apr. 11, 2011 at 5:34pmThis is the way the legal system works. The State of Arizona can ask the US Supreme Court to review the 9th Circuit’s decision. Also, federal judges are nominated by the President and confirmed by the Senate. Their appointments are for life. They are not elected.
To fix the problem in Arizona all we need to do is hire a lot more border patrol agents. Oh, wait. The federal government is slashing $38 billion from the budget and tax revenues are stagnant. Oh well, we can spend money we don’t have.

Ok. He (she) is correct that this Arizona law may violate the 4th Amendment, and should be sensibly reviewed by a fair court of judges. That being said, the 9th Circuit ain’t that body of fairness.
I also agree that the Supreme Court, with Chief Justice Roberts would be the best place for this law to be argued, given that Chief Justice Roberts is HYPER Constitutionalist and would be a fair judge, as would Justice Alito. HOWEVER!
If it truely is soley in the hands of the Fed to protect our borders, and they FAIL to make that happen, I’d say the border states THEN have a right to have their case heard against the Fed for deralliction of duty, and then have their case heard before the Senate.
And since we are talking about the obama admin, I reckon the next step would be passing this bill and telling the fed to eff off.

No, that is incorrect. Officers, as it stands now, DO have the right to ask for ID given probable cause.
Extreme example: If police are cruising a neighborhood, and a bloody man runs to them and screams “I JUST BEEN SHOT”, AND THE POLICE FOLLOW HIS BLOOD TRAIL TO A CLOSED HOUSE DOOR, THEY DON’T HAVE TO WAIT FOR A WARRENT TO BUST THE DOOR IN.
I ain’t retyping that. Just mark it up as a capsfail.
That is an example of probable cause taking precident over the 4th Amendment. What I was alluding to, was asking for an ID based on race, and here’s the tricky part. Once they illegally cross that border, they are then, as an unknown individual entity, considered a citizen of the United States. Given that there is a HUGE population of legal hispanics on the border, we really can’t just ask for IDs based on race. They have to find another solution.
I would suggest a massive pressence of their National Guards, under direct order of their respective Governors along the border. That is something the Fed cannot touch.
Except of course when the prez decides to gank them to fight a National war overseas….
Like in Lybia.
Time for the 50 Governors to have a conference and stand together. I believe this is the only glue which will hold our Great Nation together, piecing back together our shredded Constitution.

If any officer refuses, fire them on the spot, and bring charges of dereliction of duty… after-all they did swear to defend and up-hold both the US Constitution and your State Constitution….

Apr. 12, 2011 at 7:52pmIn that case AZ should stop enforcing ALL FEDERAL LAWS. Bank robbery, Murder, Etc. Funny because when Texas went to the feds (Homeland Insecurity???) they were told it was a states repsoonsability to enforce the border/illegals themselves. This government is out of control, violating the very laws in deed and spirit, acting outside of the constitutional restaints and limits placed upon it. Thieves, thugs and liars from the potus on down. Take back America and jail all who are acting in a criminal manner. 9th circuit court is a good enough place to start as any I suppose.
