Jefferson County resident Jonathan Stewart said he laughed in shock after the Federal Emergency Management Agency (FEMA) claimed the house his family lost in the deadly April 27 twister was ‘not unsafe to live in’.
Displaced families in tornado-ravaged Alabama are outraged after being denied federal aide to rebuild their flattened homes – due to ‘insufficient damage’.
The devastating reality is the house is now a concrete slab surrounded by rubble.
Mr Stewart told AL.com a FEMA inspector saw first-hand the Pleasant Grove residence he shared with his wife, Lisa, and their two children was ripped from the ground.
Three days after the visit, however, he received a letter reading: ‘Based on your FEMA inspection, we have determined that the disaster has not caused your home to be unsafe to live in.‘Although the disaster may have caused some minor damage it is reasonable to expect you or your landlord to make these repairs. At this time you are not eligible for FEMA housing assistance.’
Mr Stewart told the website: ‘Lisa and I looked at the letter and laughed.’
While he has since found out his insurance coverage will replace his house, the family is not alone.Lashunta Tabb’s home 15 miles away in North Smithfield Manor was stripped of its siding, and more than half of her roof blew off with tornado-force winds.
She too, received a letter claiming there was ‘insufficient damage’ – the number one reason in Alabama the people are determined ineligible for FEMA grants, worth up to $30,200.
It is not yet known how many Alabama tornado victims received the letter.
FEMA deputy branch director for individual assistance Lynda Lowe said finding of insifficient damage are often correct, and many of those who filed for assistance did not have damage.
FEMA officials encourage whose who believe they were wrongly declared ineligible to file for an appeal through local disaster recovery centres.
Spokesman Renee Bafalis said: ‘If you have a question why you received a determination of ineligibility, go in there and let them look it up and help you file an appeal.’
A report issued on Wednesday, however, revealed few disaster victims follow through.
It showed less than one percent of the 25,081 applicants initially declared ineligible for any reason had appealed, leaving the potential for millions of dollars in federal aide to go unclaimed.
An applicant has 60 days from the date of the determination letter to appeal.
It was not known at press time how many applicants were declared ineligible in Alabama due to insufficient damage. However, similar findings have occurred after nearly every recent disaster.
THE BUREAUCRACY BEHIND APPLYING FOR FEMA AIDE:
When a disaster victim applies for a FEMA grant, an inspector is dispatched to the applicant’s property.
Inspectors carry laptops connected to a database called NEMIS (National Emergency Management Information System), which guides them through measuring rooms and assessing damage.
Items marked for repair or replacement are priced depending on the geographic region.
Letters are issued based on the computerised report, telling an applicant whether he qualifies for FEMA assistance.
An applicant has 60 days from the date of the determination letter to appeal.
What qualifies as ‘insufficient damage’ remains unclear.
A pending lawsuit accusing FEMA of improperly denying thousands of farm workers in Texas money to repair their homes after Hurricane Dolly struck in 2008 based on the insufficient damage finding claims that FEMA used a concept called ‘deferred maintenance’ to back the rejections.
Deferred maintenance is not referenced in any regulation, Jerry Wesevich, an attorney with Texas Rio Grande Legal Aid who represents the plaintiffs, told AL.com.
Mr Wesevich described deferred maintenance as a ‘shorthand term that FEMA uses when it determines somehow that a condition of a home prior to the disaster caused the damage after the storm’.
An Alabama inspectors’ coordinator for FEMA said deferred maintenance is no longer used in assessing damage, although there is a place for inspectors to note ‘pre-existing’ conditions.

There were NO: Homes, no churches, no banks, no grocery stores, no utilities, no water, limited cell service, roads were under curfew and guard. It was two weeks before we were allowed to return to…where our homes used to be. Two weeks after that to find our insurance agent (his home was gone also) and close to one year before any work began on our homes..

Oddly, if you had a loan on your home, you were required by the lender to carry insurance. So for FEMA to only pay to those without insurance is in opposition to the papers the borrowers signed at closing.

Thanks for the clarification. So people who actually work for a living and pay their insurance and their TAXES are not eligible for assistance from FEMA. Only irresponsible, lazy, blood sucking n’er-do-wells are eligible for government issued credit cards and mobile homes for over two years courtesy of those who pay TAXES. I was the youngest of 5 and my Father made me get up and go to work at 3 am (as a waitress) when i was 15. I am so glad he did that to me (it was actually for me). But its true, the majority of people who get free help are the lazy, not willing to work, rather sit on their as s and drink beer or stick a needle in their arm people who don’t deserve anything but a kick in the rear! They were having a ball till they found out I was there for Corps of Engineers Blue Roof assistance. Turned out I was the wrong color for FEMA. However, the callousness of the FEMA letter is at question and the article is correct when it poses the question of what “insufficient damage” means. One must wonder if the FEMA inspector made an error, considering the number of applicants and homes they inspect in disaster situations like this.

If my house gets torn down by a tornado, I’ll be calling friends and family for support not demand money from FEMA or the federal government. I have a good insurance company. Someone from my last unit had his house burn down on him. They gave him cash to stay at a hotel and they were settled and moved into a new house within a month.

There’s more to this story, I suspect.
Suppose you had a $200k house. Suppose you had $400k insurance (contents, etc.)
Why should FEMA grant you 30k in assistance? Your insurance will cover it.
Now, suppose you had a $60k home with no insurance. FEMA may decide it should help you get some sort of shelter and offer $30k in asssitance.
That makes more sense to me.
Wait for the rest of the facts before judging this one, folks.

Just think how much money they are saving because not everyone will keep fighting and take their initial verdict as gospel. People should warn the Victims of this kind and tell everyone to ignore FIRST letter and automatically file a repeal. This process is also used with disability ins. unless you are of the ‘”Chosen” people you have to get an attorney to help make a claim, and then most still can’t get it. THIS IS JUST WRONG !!!!!!!

That is why whenever possible we should try to deal with smaller entities. Small government, small business, etc. All that said, the Federal government sucks. According to your theory they should have received a denial based on over-sufficient insurance as opposed to being denied based on insufficient damage.
You can falsely attribute your made up motivations to what ever fantasy you can concoct in you head, but unless having insurance is cause for being denied a FEMA grant, and FEMA says that’s why they were denied…it’s all BS.

Jun. 13, 2011 at 10:48am@Tom – it makes sense IF the letter stated something to the effect of ‘you don’t qualify due to your financial resources’ or ‘insufficient need’. However, the letters are telling them they have insufficient damage and/or a habitable home, which is clearly not the case.
I’m inclined to believe that this is SOP – always deny the claim, then just handle the appeals. Of course, this may only be SOP in certain areas, like red states.

Not sure what the insurance problem is, but they should pay off if the people had tornado coverage.

Which is what I thought FEMA was for. Not to really rebuild your house, but to help in an emergency. Shelter and Food.

He goes all over the world to hand out money we don’t have, for oil projects (Brazil (Soros)); a 2nd bailout for Greece, etc.; and ignores (intentionally) the needs here! Perhaps this is another delay tactic by the administration… They know people either won’t dispute letter, or they will and end up spending money they don’t have on attorneys; and the process will be dragged out for months, if not years!

When was it FEMA’s job to aid in any kind of rebuilding efforts? Why are they giving out free money for this? This is exactly what insurance is for, isn’t it? How is this the tax payers responsibility?

The letter is what is absolutely wrong. If the letter stated FEMA has determined your ins is sufficient to cover your home, that would be different than a letter saying that FEMA didn’t see any damage that would make the home unsafe.

The US Government issues the flood insurance but the people being flooded can’t get it. We need a clean sweep of these regulations and policies and replace them with good old “Common Sense”.

I live in Florida. I own a home. Most financial advisors and adjusters would consider me over insured. Other than a terrorist attack, I can’t think of any other disaster my home isn’t covered for.
However the government is still taxing me on the premise I may need their FEMA programs. Since I know I will never need their assistance, why should I be placed in the program? I mean, if they are going to exempt me from payouts because I have insurance shouldn’t I get some exemptions on my income taxes in the same amounts I pay for insurance?
I’ll answer my own question, because other people who don’t want to prepare themselves want the pubic coffers to do that for them. And since there are so many with that “please you do it for me attitude” I am forced to fund that philosophy because of their votes. So it’s not a problem with government, it’s just the way lazy America has gotten, and I have pledged my allegiance to accept such a mindset. However, I have also pledged allegiance to that America can be changed through our civil processes. I just hope that people will realize, it’s better to do things on your own. Independence is always more satisfying and fulfilling than dependence. To hold that dependent mindset with out even realizing it, man, that’s got be a very frustrating life. Never knowing why it is others get ahead. Never realizing why it is others, many who don’t even seem to have as much, are more satisfied with their pursuits of happine

That is not what Federal Aid is for, Federal Aid should be a Stop Gap between the event and the time people can get organized and contact their insurance companies, Providing Temp Shelter and Food during those limited days.

Jun. 13, 2011 at 10:21pmThis is just bureacrats flexing their muscles. We had a terrific windstorm in our town a year ago in March and over 2,000 trees came down. People were without electricity for almost five days in some areas of town. Our two high schools were disaster preparedness evacuation centers, one of which was a real problem because so many trees came down on that street, people couldn’t get to it. The schools were closed for four days because those that did have electricity needed it for people who didn’t, and the rest either had no power, no light or no parking lots due to the trees that were down. There were dangling wires all over the place. The Superintendent of Schools pointed out that the buses couldn’t get through the streets to pick up the kids and they didn’t want them walking because of the number of downed power lines. Our lovely State Department of Education refused to allow the District to trim back the number of school days for the year. The students lost the Easter vacation and were in school all the way until June 28th. It was totally absurd.

IF YOU HAVE INSURANCE, IT WILL MAKE YOU WHOLE, YOU DO NOT NEED FEMA ON TOP OF THAT.
If my house burns to the ground, my insurance makes me whole, not FEMA. The reason FEMA steps in is that there is an IMMEDIATE need for food, shelter, clothing, toilets, etc. while the cleanup begins. The money is brought in because there are so many UNINSURED – which is their own fault. But, I’m compassionate, so I’m not personally griping about it.
I DO believe that states/communities should maintain a fund that is used for such things. fema should only step in when the state has insufficient funds, and even then, IT SHOULD BE A LOAN. Why should taxpayers have to pay for someone’s house who didn’t buy insurance on their house? Personally, when a member of a local community has such a loss, our community chips in, and the community donates time, money, food, clothing, building materials, etc. We help each other – no government involved. Now, when the SCALE (number of losses) is so HUGE, it is impossible for a community to do this for the thousands of uninsured homes.
Insurance companies should pay the bill. FEMA payouts are nothing more than INSURANCE COMPANY BAILOUTS.
Don’t forget the millions of dollars of fema cards after Katrina that were used to buy designer luggage, video games, etc.
FEMA aid should be a LOAN – for a house, it would be an individual loan – for a highway/levee/etc., it should be a loan to the state.

I, like most people on theblaze, am awake enough to see the obvious inequities between how obama’s fema treats Alabama/Mississippi in a flood, vs a MASSIVE wildfire in TX or AZ, or a MASSIVE tornado in MO. It smacks of bias toward blue (or even purple) states and against red states.
Not wanting to rush to judgement, I simply suggest we wait for the rest of this story before we all judge the facts, in spite of how glaring these inequitites seem.

An attempt to further polarize these blocks and galvanize his base while activating the militant activists amongst them?
