Family of Border Patrol Agent Brian Terry Filed $25 Million Suit Against Bureau of Alcohol, Tobacco, Firearms and ExplosivesThe family of murdered Border Patrol agent Brian Terry has reportedly filed a $25 million wrongful death suit against the Bureau of Alcohol, Tobacco, Firearms and Explosives – claiming Terry was killed with AK-47s that were knowingly sold under the Fast and Furious gunrunning probe to a straw purchaser for drug cartels.

Fox reports:

In a 65-page complaint, attorneys for the family claim ATF “wrongdoing” in Fast and Furious.

“ATF’s failures were not only negligent but in violation of ATF’s own policies and procedures,” the complaint claims.

The family has also filed suit against the Lone Wolf Trading Company seeking unspecified damages for selling the weapons to the straw purchaser.

The suit says Lone Wolf knowingly sold “hundreds of weapons” to various straw purchasers and realized “hundreds of thousands of dollars in profits from these sales.”

The suit alleges that “but for defendants’ negligent and illegal sales … Brian Terry would not have been murdered in the Arizona desert on December 14, 2010.”

The family is seeking a jury trial.

      I was sorry to see the Lone Wolf Trading Company on there…The government hoodwinked them into the sales..I understand why they are on there, but I really feel sorry for the guy..Unless it comes out that he was knowingly selling them before F&F. If not he needs a suit of his own…What a mess.

      I despise frivolous lawsuits – but this suit is 100% justified – I wish the amount was for $100 Million. No amount will ever replace the pain this family feels. All because Obama and Holder wanted to take our guns away. What Obama and Holder did with F&F is Un-American and shameful beyond belief.

      Keep your fingers crossed folks. The state of GA has tried to get Obama into court but both he and his lawyer refuse to go. The judge hopefully will rule against them for not appearing. If the state of GA., wins their case, they will remove Obama from the ballot this year. I understand that a half dozen other states are taking the same approach as GA.

      @SHOWMESTATEGUY, that os not exactly correct. The individual immunity does not hold id the individual involved breaks the law or govt; regulations in his actions as could be argued here. Anyway my bet is that they will settle…….even for $25M. After all, ti’s YOUR money and thay can not permit ‘discovery’ to take place. No, they will settle…..or just ‘take out’ those involved in the tort. Heck, now they can just label them terrorists, kids & all, and have the Army snatch them up in the middle of the night, never to be heard from again. Perfectly ‘legal’ according to the NDAA.

      Obama is commander in chief so the 25 million needs to come from his one bllion$$ re-election stash. He is already diverting money from it to his hidden retirement stash so he won’t miss it.       I’m in no way defending this program, but all of you seem oblivious to the fact that it was started under Bush. Yet, all of you only point your anger at Obama and Holder. Thus, the comments on here should also directed anger at Bush, Gonzalez, and Mukasey. Clearly you haven’t been doing your own homework like Glenn tells you.

      But then again, this is the Blaze and you guys hate everything associated with Obama, regardless of its origins or success.

      The Bush admin was working with the mexican Gov to nab the runners as they crossed the border but Mexico didnt hold up their end of the bargain (surprise) Then I believe they tried a GPS tracking system that didnt work out so they prretty much nixed the operation. They didnt just let the weapons walk accross the boarder like these assclowns (Obama, Holder) etc. Know your facts before you spew

      The point is, under both administrations guns have been going into the hands of Mexican cartels. Being upset with only one administration for the exact same thing shows how biases of people like you and other Blazers.

      So, just to be clear, you don’t care that guns ended up in Mexico because of Bush era policies and you only think there is a problem with the policies and operations of the Obama administration. Got it.

      Responding Wednesday to Issa, Cole said it is neither fair nor accurate to equate Breuer’s suggestion to the risky “gun-walking” that the Phoenix division of the Bureau of Alcohol, Tobacco, Firearms and Explosives allowed to take place in several gun-smuggling investigations that dated back to 2006 when Republican George W. Bush was president.

    I am glad they are doing this and I wish them every luck in the world.. Brian’s death was a result of arrogance and treason and the ATF needs to squirm.. why Eric Holder isn’t behind bars makes me madder than a hen.. him and who ever else was in on this Fast and Furious. I hope the family gets every last dime of the 25 million and that finally ISSA will do something more than play like he is doing something. He knows and everyone else knows that Holder is an accessory to the murder of Brian and probably lots of Mexican’s. God help us!

    A petition should be passed around Arizona urging the district attorney to bring Holder and Obama up on MURDER charges. I know they have or would have complete immunity, but they would be technically guilty of murder (they both knew beforehand and there was a reasonable possibility that someone would get hurt). These TRAITORS need to be held accountable. The courts will not do it, so maybe poblic scorn is the best that this poor family can hope for!!!

    He was an American. $25 million isn’t enough. Give the family all of those boxes of cash they found in Iraq when Bush sent our troops there in 2001. I think it was about $165 million. Quick, beform Obama uses it for his campaign.

    Hmmmm. Suing the ATF I can definitely understand, but suing the Gun Store is a bit of a stretch. The store owner did not want to make these sales, he was told to by the ATF as I understand it. I deeply feel for this family and understand their anger and frustration but it should be limited to our government and the ATF.

      If by troll, you mean someone with different political opinions then yes, I guess I am. I read the site everyday. It’s an excellent source of humor for me. Every once in a while, I’ll comment when something goes from funny to pathetic. Time after time I have read you loons write the mantra I wrote. He was a border agent which carries with it an inherit risk. The person that killed him would have shot him with any gun. But because this story gives you people the excuse to write comments about hanging the president and attorney general, all the sudden it’s the guns fault.

      Inanimate objects are not inherently culpable, people are. That’s why we have accessory laws as in “accessory to murder.” There also needs to be malicious intent, for which a gun, car or any other inanimate object has no ability to posess. The day a memo from a gun manufacturer is found advocating an unjust killing of a person by a product they intend to manufacturer will be the day we all turn in our arms from that manufacturer, but not until then.

    It’s a tragedy, no question. I think those responsible should be punished, but I don’t think the tax payers should be held accountable. You have to figure if they win, some lawyer will get half of those tax dollars, perhaps more.

I think God had a hand it that… nevertheless, the ATF needs to feel some much needed heat. Holder is a reject from hell and like Obama won’t take the blame for anything.
