Woman Sues 13-Year-Old Little Leaguer Who Accidentally Hit Her With Baseball During Warm-ups…for $150,000

Elizabeth Lloyd Sues Little Leaguer Matthew Migliaccio Over Baseball Hit to the FaceMANCHESTER TOWNSHIP, N.J. (The Blaze/AP) — It’s a case that many will surely scoff at. A New Jersey woman who was struck in the face with a baseball at a Little League game is suing the young catcher who threw it.

Elizabeth Lloyd, the woman at the center of the incident, is seeking more than $150,000 in damages (the Asbury Park Press claims this number isΒ actuallyΒ $500,000) to cover medical costs from the Manchester Little League game two years ago. She’s also seeking an undefined amount for pain and suffering.

Lloyd was sitting at a picnic table near a fenced-in bullpen when she was hit with the ball. Catcher Matthew Migliaccio was 11 years old at the time and was warming up a pitcher.

β€œI ran over to see if she was all right,” Matthew said in an interview with the Asbury Park Press. β€œShe said she was OK. I was just on with warming the pitcher up, and I was not horsing around.”

The incident and the lawsuit have made the family decide to step back from the league. Bob Migliaccio [Matthew's father] said he has taken a break from coaching, while his wife, Sue, has stepped down as manager of the league’s snack stand.

Matthew continues to play, his father said.

β€œMatthew still plays, but we want to step back because we did not want it to be uncomfortable for anyone,” Bob Migliaccio said.

Migliaccio hopes the incident does not affect his son’s love of the game.

β€œHe never stops playing,” Migliaccio said. β€œBaseball is what defines him at this time.”

A Little League spokesman says their insurance doesn’t cover spectators.

Lloyd’s lawyer could not be reached.

      Agreed… but the possibility of being hit by a ball at a park is an easily forseeable hazard of attending a baseballgame. This will be thrown out, but you’re right, its going to cost the family some money to resolve and the plantiff or her counsel shold be responsible.

      This is why most smart parks have signs disavowing claims of injury or damage at ball games. It is an inherent danger which all are aware of.
      If you watch people most are not paying attention to any of the action, and young ball players have a tendency to not always be in control of the ball, or bat.

      I was born in 1947, and never heard about things like this. Actually, never even considered the possibility of lawsuits. We played hard, got hurt, got bones set, healed, and went on with our life.

      As an example….after picking strawberries for market was over each spring, my mom and aunt let people go into the field and pick their own for 10 cents a quart. Now, you’d be taking a real chance doing that.

      Things like this take away our freedom. We become worried about lawsuits, so we don’t let the neighbors kid ride his dirt-bike on our farm, or we don’t let even the neighbors teenage kid in our pool without worring that they might slip on the cement apron and break a bone. All of the lawsuits you read about have a real-life impact on what we do, what we are allowed to do.

      If you think our government’s anti-Americanism/one world theology has changed things so far, hang on. These lawsuits play into the agenda of people taking away the freedoms we once took for granted

      “Did you go to the game of your own accord?”

      “Yes, your Honor.”

      “Did you wear protective headgear (like a helmet or full body armor) at the game to protect yourself against being hit by a stray ball?”

      “No, your Honor.”

      “You’re an idiot. Case dismissed.”

    Lawyers are licking their thin, money hungry, lips right now. They are already into sports but now they can get into little league. By the time they get through baseball will be shut down…along with every other sport.

      long gone are the good old days of fun. no more sledding no more baseball. my child cannot play tag, flag football, run, play war cops or robbers, etc at recess. they seriously deflate the bouncy balls half way to minimize risk of facial injury and have now also taken down the tether ball for risk of strangulation. We wonder why all the young men are fruit cakes these days. too bad the school doesn’t know my child at 7 was sport shooting, fly fishing and team roping off a full size quarter horse. someone may have wet themselves in fear of injury who knows maybe I will be sued for endangering him by allowing him to help with farm chores.

    This is what’s wrong with our country… we allow stupidity and greed to not only file these suits, but in so many cases, win. Then, this entices more ambulance-chasers to convince others to file just as crazy of lawsuits so they can money-grub even more.

      Yes……….but now ask yourself this………what two large groups of people are responsible for hindering any meaningful reform that would help to correct these problems.

      I would argue that one of those groups is also largely responsible for creating the problems.

      Certainly politicians who are in many cases lawyers. Thus the reason I have consistently been trying to help people understand how imperative it is that each and every one of us attend every possible meeting they can be it city, town, village and city councils, school boards and more, and then speak out, respectfully, but firmly. In addition, ‘normal’ ‘average’ people need to run for these positions over and over until they can get in and begin to straighten this mess out. It didn’t happen overnight and it will not be fixed overnight, but there will come a point that we’re past the point of no return and I fear that point is getting awfully close.

      And, therefore, my call of WOLVERINES! (not a sports team — a resistance fighting team, i.e. ‘Red Dawn’).

      Sorry for the late response and I hope you get still find it. Doing a little prep work in case the storm in the Gulf turns into a Hurricane and heads my why. It’s been raining for days. Had an interview scheduled for a job about 40 miles away and it was canceled. I guess they found someone closer. Have a phone interview scheduled for early next week and very close to home. As for the other… from me to GB to Congress in a little over 24 hours. Have fingers crossed.

      How are things with you? BTW, MBE was granted a reprieve and given a second chance.The other one has tried several new ones and vanquished each time. The best to you and yours. : )

    If the judge were to rule in her favor they should be thrown from the bench, as well as all these other “judges” who have done the same stupid thing. No one should be given money for stupidity, she sat too close it’s her fault.

      If I were a betting man I can only see one picture in my thoughts. here is a overly large rotund potato chip eating soda sucking woman sitting in the shade and Wham she is smacked with a ball because she was sitting next to the Bull Pen. Where this young kid tossed a ball back to the pitcher and now is screaming for hundreds of thousands of dollars. I actually hope she chokes on a hot dog at the next game and that no person will assist her for fear of being litigated. Irony rules…

    This is ridiculous. it was a accident and this lady is pathetic! My question is this.. did the lady stay for the est of the game.. did she wait for 2 years before she filed a lawsuit?? In any case this lady needs to grow up.. suing i child is childish. At least this boy went over and apologized and asked her if she was okay. Which is commendable! This woman, “stupid is, as stupid does”! Give me a break!

      My car insurance had a bigger deductable than the windshield cost from a great hit to the middle of the parking lot by a 12 year old. Just happened. The leagues do not cover this stuff and signs are up you are at your own risk. No one on God’s precious earth can tell what can happen when kid’s are playing. Yhis suit is just wrong-hope there is some common sense where they live. This woman is bat….stuff. Hope it doesn’t wreck the kid.

    Disgusting. Accidents happen. Plaintiffs should have to pay all costs in litigious lawsuits. Sorry you chose to sit too close to the warmup area, lady. Most intelligent people are even careful where they park their cars at Little League games, and much more careful where they park themselves.

    Absolutely Absurd. This is PURE greed at it’s finest( or worst). When I was growing up, my friends and I played all over the neighborhood we scraped up our knees, broke arms, legs, cut our heads open and then went home and our mom would take us to the hospital or throw an ice pack or bandage on us, with no thought of retribution towards anybody. That’s life, get over yourselves. It’s pure greed. It’s time to have loser pays in the American court system. These ridiculous lawsuits would dissipate faster than water on asphalt in the summer.

    I was in the shower the other day and got shampoo in my eye. The pain was intolerable. It made my eye tear up. I still have nightmares. I’m gonna sue the shampoo company for millions.

      Why stop there, sue the plastic maker who provided the plastic for the bottle, sue the tv/print/media/advertisers who promoted the product, and sue the place that sold you the shampoo for even carrying it in their store. And sue the water company for providing you the water to take a shower with. Just remember, they are the ones who are responsible for it getting in your eyes and you are just a victim and have no responsibility in the whole ordeal….even though you probably had your eyes open while the shampoo went into your eyes.

    The best response a judge could provide for such stupidity is just to sit there and laugh while he tosses it into the shredder. As a matter of fact if I was made a judge I would do just that to anything that doesn’t pass the muster of common sense…that is why we have judges in the first place.
