Sandra Fluke in 2011: Mandate Paying for Sex Changes Next

When Georgetown Law student Sandra Fluke spoke in front of an informal Congressional hearing organized by House Democrats early this year, only to be slammed by conservatives and labeled a “slut,” a liberal star was born. And now that Fluke is speaking at the Democratic National Convention as something of a war hero, that star looks likely to rise in the Democratic firmament.

But like all sudden, unexpected celebrities, Fluke has baggage. As we’ve already documented, Fluke is a leader of one of the more radically pro-abortion groups in America. However, quite aside from this obvious association, her academic background may also be a potential minefield for social moderates within the Democratic party. Charles C. Johnson of the Daily Caller has already uncovered at least one of the mines Democrats might have to tiptoe around if Flukes continues her ascendancy:

Fluke and co-editor Karen Hu advocated remaking U.S. law to remove what they called a “gender bias” at the root of denying coverage for “transgender medical needs,” describing it as “a prime example of direct discrimination.”

“Transgender persons wishing to undergo the gender reassignment process frequently face heterosexist employer health insurance policies that label [gender-reassignment] surgery as cosmetic, or medically unnecessary and therefore uncovered,” Fluke and Hu wrote for the Georgetown Journal of Gender and the Law.

The review article was titled “Employment Discrimination Against LGBTQ Persons” and appeared in print in 2011.

By some estimates, sex change operations can cost between $15,000 and $20,000; the cost for some procedures can be as high as $50,000. Fluke and other advocates want insurers to cover all such operations. In general, assuming the costs of new coverage mandates tends to raise rates for all enrollees in a given health-care plan.

There is precedent for requiring insurers to cover these procedures. In Wisconsin, transgender prison inmates sued in federal court and won under the Eighth Amendment to overturn a law that barred public funding of sex changes. The Supreme Court declined to hear the case in March, allowing the decision to stand.

While many state legislatures may not be likely to follow suit, Fluke and Hu wrote that they hope left-leaning courts will expand the meaning of Title VII of the Civil Rights Act of 1964 to include Americans who do not self-identify with what they call traditional “gender identity” or “gender norms.” The Act prohibits discrimination on the basis of race, color, religion, sex, or national origin.

Fluke was also thanked and acknowledged in the 2003 book, “Gender, Justice, and Law: From Asylum to Zygote-Issues and Resources for Judicial, Legal, and Continuing Legal Education.“ The book was published by the National Judicial Education Program, a project of the National Organization for Women’s Legal Defense and Education Fund, where Fluke was employed.

That’s right. Fluke doesn’t only want contraception (by many accounts, a relatively low-cost form of medication) foisted on insurance companies by law. She also wants them to be forced to cover sex change operations that could cost up to $50,000. Why? Because not doing so would apparently constitute discrimination against people who feel they were born with the wrong gender, and want to “transition” out of it, hence the word “transgender.”

It is improbable that the Democrats will accept this particular plank of Fluke’s ideology just yet, however it is something to keep in mind when Fluke takes the stage at this week’s DNC.

      Interesting to note that the author did not bother to either purchase the referenced paper or provide any details regarding the context around the legal assertion. If one considers cases of gender identity issues surrounding hormonal imbalances, then it would seem there is a case for providing similar health insurance coverage to that which is provided to the obese patients who have thyroid related issues. Again, to me the issue of coverage would depend on the issue causing the gender identity symptoms. If there gender identity problem was merely a choice than I would say not it should not be covered. In that same feign individuals who are obese due to their own eating habits rather than hormonal issues should similarly be denied health insurance coverage. People need to show the ability to think intelligently beyond their ideology here. But then again, there are more than a few folks here that still assert the earth and everything on it is 10,000 years old. LOL

    There’s a Method to Flukk’s Madness.

    Remember, one of the bigger Pro-Abortion planks is : “We want to be able to kill the baby late term if it looks like it’s going to be a girl”.

    This seems odd for a Misandrist, Gender Feminist-Superiority agenda, at first.

    Until you remember that there are so many other Progressive Planks that “need” to be tackled.

    And as such, the only way to convince emasculated, beaten-down, submitting men that they can be part of the “winning” side? Sex changes, so they can feel like they have an escape route from all the Misandrist propaganda they’ve been inundated with ever since they started school. That they don’t have to be the “Evil, stupid oppressor” anymore. That now they’re enlightened and cosmopolitan and “on the right side of history”.

    Or in some cases, some just want to escape the expectations of responsibility and serious-mindedness that comes with being a man. Self-loathing Misandrists performing _Misogyny_, of all things, on their imagined future-”female”-self.

    So many levels of wicked screwed-up psychological claptrap, there.

    Going down a very dangerous path here….

    Abortion is an elective surgery, unless during the actual birth, the mother’s health suddenly is in jeopardy and the doctor is unable to use any other means to save both the mother and baby, then something would have to be done, otherwise abortions are elective.

    Sex change is totally elective, I don’t care about the whole “mental health” argument, go take some zoloff and buy some high heels and a padded bra or for the other way around, cut your **** and buy some illegal steroids or whatever.

    If you go down this route of making a mandate of elective surgeries, then breast implants, **** transplants, penis enlargement and so forth will all have to be covered as well, this will bankrupt the entire medical health system and funds and resources for emergent care will dry up and people will die from REAL health issues, but surgical cosmetic changes.

    We are already there. A state court recently ruled that a convicted murderer serving a life sentence will be given a sex change operation, tax payer paid. If a lifer has the right to the operation, I can imagine it being ruled that anyone who wants a sex change operation will have a right to it at tax payer expense.

    Still remember the great Greek guy I used to work for because he always had a hard time picking up gals. He came to work and started his story of a girl that was attracted to him at the bar. They left together and parked on a dark road. Then he said I reached up her dress and She had the same thing I did! He stated this person ran out terrified of what he could be yelling in Greek. Now this is where personal responsibility should come in. My Greek friend with his inability to attract woman, just might have footed the bill before leaving with this person that night.
