NYC Officially Bans Super-Sized Sodas & Other Sugary Drinks

NEW YORK (AP) — New York City’s Board of Health opened up a new, experimental front in the war on obesity Thursday, passing a rule banning sales of big sodas and other sugary drinks at restaurants, concession stands, and other eateries.

The regulation, which was proposed in the spring by Mayor Michael Bloomberg and approved by panel of health experts after several months of review, puts a 16-ounce size limit on cups and bottles of non-diet soda, sweetened teas, and other calorie-packed beverages.

The ban will apply in fast-food joints, movie houses and Broadway theaters, workplace cafeterias, and most other places selling prepared food.

It doesn’t cover beverages sold in supermarkets or most convenience stores.

The restaurant and beverage industries have assailed the plan is misguided. They say the city’s health experts are exaggerating the role sugary beverages have played in making Americans fat.

“I am still skeptical. This is not comprehensive enough,” Caro said.

Some New Yorkers have also ridiculed the rule as a gross government intrusion and tens of thousands signed a petition, circulated by the industry, voicing their opposition.

The unprecedented regulation would follow other ambitious health moves on Bloomberg’s watch.

Some have proven to be national pacesetters, such as making chain restaurants post calorie counts prominently on their menus; McDonald’s announced Wednesday that it would start displaying the information nationwide next week, before a federal requirement that could force all major chains to do so next year.

New York City also has barred artificial trans fats from restaurant food and taken aggressive steps to discourage smoking. Starting this month, dozens of city hospitals are asking mothers of newborns to listen to talks about why they should breast-feed instead of use formula.

Bloomberg and other advocates for the soda plan – who include a roster of doctors and such food figures as chef Jamie Oliver – see it as another pioneering step for public health.

They say the proposal strikes at a leading cause of obesity simply by giving people a built-in reason to stop at 16 ounces: 200 calories, if it’s a regular Coke, compared to 240 in a 20-ounce size. For someone who drinks a soda a day, the difference amounts to 14,600 calories a year, or the equivalent of 70 Hershey bars, enough to add about four pounds of fat to a person’s body.

Beyond the numbers, some doctors and nutrition experts say the proposal starts a conversation that could change attitudes toward overeating. While there are many factors in obesity, “ultimately it does come down to culture, and it comes down to taking some first steps,” said Dr. Jeffrey Mechanick, a Mount Sinai School of Medicine professor who has studied the effect of government regulation on the obesity epidemic.

Soda makers and sellers say the plan unfairly singles out soft drinks as culprits for the nation’s fat problem, represents an overweening government effort to regulate behavior and is so patchy as to be pointless. Because of the web of who regulates what, it would affect a belly-buster regular soda sold at a sports arena but not a 7-Eleven Big Gulp, for instance.

An average New Yorker goes to the movies about four times per year and buys concessions only twice, said Sun Dee Larson, a spokeswoman for the AMC Theatres chain.

“We firmly believe the choices made during the other 363 days have a much greater impact on public health,” she said in a statement.

Thursday’s vote is unlikely to be the final word on the proposal.

A soft-drink industry sponsored group called New Yorkers for Beverage Choices – which says it has gathered more than 250,000 signatures on petitions opposing the soda plan – is considering a lawsuit and exploring legislative options for challenging the plan if it passes, spokesman Eliot Hoff said. It’s not clear what legislative routes there may be: City Council Speaker Christine Quinn said Wednesday she’s not interested in trying to block the expected health board vote, though she has said she isn’t a fan of the soda idea.

The rule wouldn’t apply to lower-calorie drinks, such as water or diet soda, or to alcoholic beverages or drinks that are more than half milk or 70 percent juice.

Enforcement would be conducted by an existing corps of city restaurant inspectors. A violation would lead to a $200 fine.

    this is so silly. i guess i can buy two 16 oz drinks instead of 1 32 oz. what about the places that give free refills. at that point the cup size does not matter. if it wasn’t so sad, i’d be laughing right now.

Glad I don’t live in NY and have no plans to ever go. Not because I have to have a 32oz soda but because the damned government has no right to tell me that I can’t have it.       As for standing up, I think there are plenty of people waiting to stand up and are just waiting for the right straw. Maybe if Obama wins in Nov, that might be it. Of course, if Romney wins, that may be the last straw for the leftists since Romney will start undoing some of the crap that Obama has put in place.

      Now you know why unemployment here in Oklahoma is under 7%. In our little town it is 3.9%. Our Home Depot is hireing and Solo Cup has a permanent sign up and you would think the job listing is from the Dallas Morning news. Most of these places start at $8.50 an hour and have insurence. This is a college town and before Obama the kids worked at the fast food places but not anymore. They get grant money and free dorms so why work when you can party. NYC companys are moving to OK City and Tulsa and even with our small state income tax they save a fortune.

    Let’s see….Mayor appoints all the health board members. All of them (except the one who knew how stupid this is) vote for the Mayor’s proposal. Cab fares have gone up. Metrocard costs are going to go up. Let’s find some other way to make life in NYC more aggravating than it has to be.

      Gee-MILKSHAKES are made with milk–and a LOT of corn syrup and usually start at about twice the calories of soda. Will the police be walking around with little tests strips to see if your drink is diet? What if you fill a 32oz cup 3/4 of the way with cranberry juice then fill the rest with reg. 7-up? Will they have to send it to a lab to determine if it 70% and not 69%??? So basically I can have 3 snickers bars and a diet soda and I’ll lose weight right? Do I get to sue the city for the harm artificial sweetners do? Is there even a shred of logic in the board’s collective brain, let alone any sense of freedom?

    This, by far, is the stupidest law I have ever heard of. Do these idiots really think anyone is going to loose weight because they can’t get a big gulp? If you are thirsty, and cannot get a big gulp, all you have to do is buy 2 drinks! All this law does is waste money. Every person involved in this law, including Bloomberg should be fired for incompetence!

    All this makes me wonder what happened to Bloomberg to go along with this. He never seemed like an idiot to me, but he sure looks like one now. What motivated him to push this?

      First….they are not the fattest nor the poorest if you average the white Americans in those states. A lot of southern states are populated by large groups of minorities. They pull down school scores and up the obesity rates. They also add to crime rates.

      Increases in SNAP caseloads between June 2011 and June 2012 occurred in 40 states and the District of Columbia. The states registering the highest over-the-year percentage increases were Hawaii (10.6 percent), Florida (9.7 percent), New Jersey (7.6 percent), Delaware (7.5 percent), California (7.3 percent), Iowa (6.9 percent), Georgia (6.5 percent), Colorado (6.4 percent), Rhode Island (6.4 percent), and Oregon (6.0 percent).

      9/10 of those states voted for Barack Obama in 2008, and 7 of them are known as “blue” states.

      The case load of government support benefit recipients of each state is a true gauge of how the actual economy of each state is doing, and the higher the load, the worse the economy.

      As far as fatness is concerned, the stats on “obesity” are based on the BMI, which is a slanted and non-scientific method of gauging obesity. It does not take into account things like muscle mass and defectively addresses height, so naturally states that have populations whose lineage comes from people that are typically taller or bigger by the very nature of their genes will be considered “fat”. It is simply not true.

      One that is a proven fact, is the “food insecurity/obesity” paradox, that states “where food insecurity is highest, so is obesity”.

      Based on that, which is straight from the ERS/USDA, then the states with the highest food insecurity, IE most caseloads for SNAP benefits, would then in fact be the most obese.

      and based on my research, red/blue politics of each state play no legitimate factor in why states collect SNAP, WIC, EBT, or are Obese, who which graduate the most college students.

      It seems that the higher population states have the most obesity, the highest graduating students (factor in also that many students go to school away from the state they are a citizen of), more SNAP recipients, and more WIC participants.

      %’s mean nothing here, because a smaller, lower population state with a higher SNAP participation rate will be a lesser expense than that of say, CA, which has 3,600,000 people on SNAP, which is right behind Texas @ around 4,000,000.

      So, it would appear that the polemic argument that “GOP” states are poorer, fatter, and dumber is just not accurate, and that state population totals have a greater determining factor in these particular things than state political leanings.

      Bottom line: All states take Federal Assistance and we have a systemic problem in the US with entitlements and redistributive programs. With over 47 million people collecting SNAP benefits, there are more people at a higher percentage of the population collecting food supplementary benefits than ever before in US history. That is a serious problem, and not designated to a select few states that may be “red” or “blue”

    I’m thinking that the soda companies are loving life right now. Let’s see,,,,If you are a BIG soda drinker that means you will buy “TWO” 16 oz drinks, right? Hmmm, now more soda will need to be sold, more cups will need to be purchased and SALE tax! WTG Doomberg! Happy all around!, oh except for the consumer! Do you really believe people are that stupid to think that you give a rat’s rear end about how FAT people are?! L O L! really loud!

    NY is just the prototype for what is coming for all of us. Obamacare/Romneycare is the vehicle. We’ve opened the pandora’s box. NOTHING is off the table in collectivism. The rationale is that “if WE have to pay for YOUR poor decisions then that isn’t fair…so, WE should be able to regulate what YOU do so as to mitigate OUR obligations”

    There is no backstop on this logic. BONUS: Now we have this really kick-@SS police state to enforce all of this. We have cameras and drones and tracking software and a bunch of unthinking, order following union goon cops who will do anything the state asks.

    OK, just so we’re transparently clear on this, let me see if I have this right. Nanny Bloomberg doesn’t believe there should be any restrictions, absolutely none what so ever, on the practice of abortion – but that the consumption of soda is such an immediate health hazard that it must be strictly regulated by his government.

    Do I have that about right?

    Because if so, regardless of what one thinks about abortion, that’s pretty freaking whacked.
