Texas Cop Shoots Suspect 41 Times — And Police Confiscate Cellphone With Photos of It All
A police officer in Garland, Texas, is under investigation after he he shot a man 41 times. But as if that wasn’t controversial enough, a witness who took images and video with a cellphone is angry after police confiscated the memory card containing the possibly damaging evidence.
The Dallas Morning News reports that the incident occurred after midnight on Aug. 31 when Officer Patrick Tuter spotted a white GMC pickup truck driven by Michael Allen who was involved in a police chase . Allen turned into a dead end, and trapped by Garland police was first reported to have hit a squad car as officers were trying to prevent his escape. It was this that lead Tuter, fearing for his life, to open fire.

This week though, review of the squad car’s dashcam reveals it was the police vehicle, not Allen’s truck, that did the smashing. A witness in the neighborhood, Mitchell Wallace, said he heard the commotion, heard the officers yelling for Allen to get out of his vehicle and they opened fire before he emerged:
After Allen pulled into a driveway at the end of a cul-de-sac in an attempt to make a U-turn, his truck was pinned between two police cars with one of the police cars striking Allen’s truck from the front, said Wallace’s 17-year-old son, Cameron.
“From the time they yelled, ‘Get out, get out,’ they didn’t give him three seconds to get out,” Mitchell Wallace said, adding that he counted about 20 bullet holes in Allen’s truck.
The Dallas Morning News reports by the time Wallace and his wife made it to their porch to see the scene, Allen was being taken out of the car by a police dog that allegedly bit him on the neck and jaw, according to Wallace’s account. Allen was killed in the events of that night but an autopsy has yet to determine cause of death.

It was Wallace who took cellphone photos and video after the shooting had stopped. The Dallas Morning News reports Wallace saying police took his phone and returned it four days later — without pictures or video. In a separate report, though, the Dallas Morning News reports police saying they did not delete the content, but are in possession of the memory chip that still has the images and video still intact.
Carlos Miller, with the blog Photography Is Not a Crime, takes issue with the authorities confiscating Wallace’s camera, which he writes under state law requires a court order unless it was used in the crime. Miller writes other circumstances where it could be taken without a court order would be if there were a “strong belief that the witness will destroy the photos, therefore destroying evidence.”
TheBlaze has reported on Miller before when he was arrested at an Occupy event earlier this year, which he was documenting as a photojournalist. Miller, who advocates for the right to film police in public, took footage of his arrest, which he then says was deleted from his camera. He was able to recover the footage and is now suing the Miami-Dade Police Department for these actions.
As for Allen’s case, Tuter’s attorney John Snider told the Dallas Morning News that “at some point, while trying to prevent the suspect from making an escape, Officer Tuter did feel in fear for his life and was justified in firing his weapon.”
Tuter is reported as the only officer on the scene who fired any shots and he did have to reload to get off 41 rounds.
The Dallas Morning News reports Garland police spokesman Joe Harn saying that an investigation is underway to “find out exactly why he started shooting” in the first place.

Posted on October 1, 2012 at 11:12pm@ProtectNextgen – there are a few pistols used by police that will accept a 20-round magazine. Usually those magazines are only available to LE officers though. The Glock 9mm Model 17 holds 17 rounds in a standard configuration. One can get an extended floorplate to add +2 rounds in civilian markets so it’s possible that one magazine change (plus one round chambered) was all it took.
My questions would be why the officer wasn’t making hits (I doubt all 41 shots hit home) and why he opened fire so quickly once the guy was boxed in. Lousy marksmanship is inexcusable unless one is being fired on.

I’m not generally afraid of the police, as I’m a late 30′s clean cut looking guy who drives a conservative vehicle and doesn’t draw a lot of attention to myself… but if I’m pulled over I immediately hand over my CHL and keep my hands where they can see ‘em, b/c concealed is harder when you’re sitting in a car with a seat belt, and the last thing I want is to be shot for the perception of moving towards my gun over a speeding ticket, but if it happened it’d probably happen 33 times (with a reload) and be justifiable. You literally have to be asleep to not hear or see the examples of over the top behavior on the part of the police. How many dogs have been shot by police in the last 6 months for virtually no reason, what about the woman (not black) slammed into the ground not once, but twice (the story ran on The Blaze) for “resisting” well seems like an awful lot can be construed to be resisting, and darn it–I’m just not sure that all of it would jive with original intent or civil rights.

You see, the officer knows if you ram his car with yours, you have committed assault with a deadly weapon on a law enforcement officer, a pretty heavy felony that warrants the use of deadly force. If the suspect did not hit the officer’s car as the officer stated, then he committed a false statement to justify the use of deadly force. Which is it?

Posted on September 13, 2012 at 4:21pmI’ve seen them protect and serve a lot actually. Most police officers get bad wraps because of a few bad apples. Granted, they should not be on the force in the first place (and that is the responsibility of the department), but most cops are good people. In this situation, we don’t know what happened. Maybe he was wrong, maybe he was justified. Right now the only people who know are him and the Man Upstairs.
A little story for you. My buddy was a narcotics officer for the Army out of El Paso a few years ago and shot a man 16 times. The man was high on PCP and had a gun in his hand the entire time. He was court marshaled for Excessive Use of Force and found not guilty. Now he was justified, but the headlines could have easily read “Soldier Under Investigation For Shooting Suspect 16 Times.”
Just saying, don’t jump to conclusions until you have all of the facts.

Actually he was using a Sig P226 9mm and is one of the best shots I know (myself included). The problem is the 9x18mm Parabellum rounds. It being a super sonic round causes it to travel through the first thing it hits. Plus, since he was using ball ammunition (standard issue), there was no additional stopping power as opposed to hollow points. Shooting center mass with that ammo will not knock your target down and since he was high on PCP, he didn’t feel a thing.

Sadly, this has been going on for at least 30 years with the cops cultivating an “us vs. them” attitude towards the public. Statements like yours only serve to reinforce that idea in their heads. It’s their belief that most civilians _have no idea_ what cops have to endure every day. They believe people like you are itching at the chance to “hang one” at the first rumored allegation of possible wrongdoing.
We see and read about decent cops doing things FOR people every day. Burning car rescues, saving a drowning child, delivering babies and even risking the encounter with a protective dog to rescue an old woman with a heart condition (yes, without shooting the dog).
I’m more worried about the militarization of the police, drone use and the over-use of SWAT teams to serve traffic warrants or mere misdemeanor warrants. I worry about the police administrations that support officers who come off as aggressive and threatening to ordinary civilians (i.e. people they know have no wants, warrants or records). I worry about people who think police should have more power almost as much as those who think cops should treat them the same deference as a restaurant waiter. If cops will arrest and ticket people and say “there’s no excuse” for doing something wrong, then they should be held to that same standard very rigidly.

Research has shown that for police officers firing their weapons in the line of duty, the best hit-rates are about 20%…meaning that only about 2 out of every 10 bullets hit the perp. If he actually hit the guy 41 times, most likely he fired far more than 41 rounds, although it is theoretically possible he pulled the trigger 41 times and hit the guy 41 times.
Many questions. What prompted him to fire so many rounds? What prompted him to stop at 41? Why not 31? Or 51?

Or an old school 1911 with 4 10 round magazines. or just randomly stopped once he thought he was being watched or filmed as most officer sidearms have a 16-18 round magazine plus two spares.

Back in the late ’70s and early ’80s while viewing training films on police shootings, I can remember the interviews of cops who had unloaded their weapons into armed suspects who had attempted to kill them. One in particular was a state trooper who while conducting a traffic stop had a driver who said his wallet was in other clothes in the trunk of his car. He allowed the driver to enter his trunk then spotted him pulling a weapon and began to spin his body to face the trooper. The trooper drew his weapon and fired until empty, and was still pulling the trigger as his back up approached. That is how scared crapless he was during the event. That could happen to anybody, but there was an outcry about him committing overkill. He had after all fired all six of the cartridges in his issue revolver. Six rounds was seen as overkill then. I saw nothing in this story about a weapon being recovered from the perp’s truck. This has become madness, and the cities, counties, and states making laws about video recording police is even more frightening. I was taught back in my day to even expect to be video taped at any kind of involvement with the public, and to be on my best behavior at all times, regardless of what happens. When the laws cover their collective butts, some cops will think they can get away with anything….obviously.

I’ve never refused. But, I also knew I didn’t have anything to worry about. I haven’t been asked in a long time, though, and my mindset has changed a lot. So, if you read about me being shot dead by the police, don’t refuse a search request….

It was right after Fort Hood and i had my flag upside down and apparently a mason told his vietnam veteran brother and he come over drunk and threatened me. The police made extra rounds of my house and upheld my right to display my flag upside down. I must have gotten a good one. We righted the flag when Walker got elected. We’ve wanted to hang it back upside down, but apparently it gives the Vietnam vets flashbacks, so out of respect for them, we don’t hang it at all. It is at half mast right now for our Ambassador.

Posted on September 13, 2012 at 3:16pmThere were so many bullets, you have to determine which one caused the death – could it be the punctured lung, heart, arteries, etc. Sadly he could have missed or landed most of those bullets in non vitals and then the dog could have coup de graced since it said the dog was chewing on the guys chin/neck. So many things could have done it – most of it that officers fault dont get me wrong.
I think it’s less paperwork for every shot that hits in comparison to every shot that misses, I wonder how busy this guy is going to be after this?

So i think either;
1. the cop had a mental breakdown/issue (not an excuse)
2. there was a reason that many shots were needed.
I don’t think it was just a bad cop being a dick and murdering someone cause he’s got a badge.

Posted on September 13, 2012 at 3:04pmLOL I watched Tulare County Sherriffs Dept. murder Shane Mariott in my backyard on my 12th birthday. He was accidently released from jail and they thought he had a gun. LOL I watched to whole thing he was running they were shooting. He didn’t have any weapons on him. This happens all the time. In 2010 3.23% of the convicted murderers were police officers while only less than a thousandth percent of American citizens were convicted of murder.
