Obama Admin. Argues Suspending NDAA’s ‘Indefinite Detention’ Provision Does Irreparable Harm to U.S.

Obama Admin. Argues Suspending NDAAs Indefinite Detention Provision Does Irreparable Harm to U.S.

(AP)

Less than 24 hours after a federal judge in New York ruled the federal government could not indefinitely detain “suspected” terrorists, the Obama administration asked a court to suspend the ruling.

U.S. District Judge Katherine Forrest on Wednesday struck down the anti-terrorism law, passed as a part of the National Defense Authorization Act for 2012, that she called unconstitutional in its provisions for indefinite military detention.

The law allows detention of people suspected of “substantially” or “directly” providing support to groups such as al-Qaida or the Taliban. A group of political activists, journalists and scholars took the federal government to court over the law, citing concerns they could end up being held for exercising their First Amendment rights.

Government lawyers called such concerns unfounded, but Forrest said in her ruling Wednesday that she found them legitimate.

In court papers filed Friday, the U.S. attorney’s office in Manhattan asked for a stay of the decision while the government appeals.

The law concerns “the president’s exercise of his commander-in-chief power in the context of the United States’ current combat operations against al-Qaida, the Taliban and their associated forces,” Assistant U.S. Attorneys Benjamin Torrance and Christopher Harwood wrote. “The court’s injunction against the exercise of those war powers … should be stayed.”

From Huffington Post:

In a stay request signed by New York’s Southern District U.S. Attorney Preet Bharara, Assistant Attorney General Stuart Delery and Department of Defense General Counsel Jeh Johnson, the government argued that the injunction was an “unprecedented” trespass on power of the president and the legislature that by its very nature was doing irreparable harm.

One of the plaintiffs’ lawyers, Bruce Afran, said the judge’s ruling should stand. He noted that enforcement has been on hold since May, when the judge issued an earlier decision.

“There’s no basis for the government to get permission now to use the law,” Afran said, saying he was concerned that the government might plan to start making immediate use of the law.

The issue of “indefinite detention” has been one of the few that has been able to bring both ultra conservatives and the far left together in pursuance of a common goal.

An official with the U.S. attorney’s office refused to comment on the case.

The judge, in her ruling this week, said she realized the gravity of the government’s anti-terrorism work and said courts should afford the administration considerable deference on national security.

But she called the law that’s under scrutiny “unconstitutionally overbroad,” questioning whether it could be applied to a news article if it were perceived as favorable to the Taliban.

“Where is the line between what the government would consider ‘journalistic reporting’ and ‘propaganda?’” the judge wrote. “Who will make such determinations?”

Pulitzer Prize-winning journalist Christopher Hedges, who has interviewed al-Qaida members and reported on 17 groups named on a Department of State list of known terrorist organizations, testified at a March hearing that the law was so vague that it was impossible to know what might be illegal.

The judge noted that the government can use another law that permits indefinite detention of people connected to the Sept. 11 terrorist attacks or others picked up on the field of battle.

THE BLAZE HAD DELETED THIS POST ONCE? Having quotes from our founding fathers and bragging about how many firearms we own and how tough we are is fine. WE all need to “be involved” prepare yourself spiritually, prepare yourself with food, supplies and security. Be prepared to assist your neighbor, get involved with your community make it known where you stand on issues, dont be afraid to speak your mind but do not be stupid it is what they want. Go to oath keepers.org learn what the oath means if you do not know. Read the US Constitution and make sure you know before anything happens what the truth is. Government wants all of us to think that in an emergency the Constitution goes out the door WRONG that is the time we need it most. Buy Pocket constitutions and hand them out they cost .30 each buy them at http://www.nccs.net/pocket_constitution.html It our responsibility to share with others. If many would forgo buying i tunes for a month, a couple less StarBucks they could afford $120.00 for 400 Pocket Constitutions That is one way to do your part. Japanese Americans during WWII were detained obviously we forget what our Government is capable of.

The obama administration is investigating the maker of the film the the whitehouse claims is responsibl for the riots in the middle east, even though he has committed no crime, instead of standing up for the man’s constitutional rights. But today, if the Ruling was suspended, he could hold him indefinately as a “suspected” terrorist? And never have to charge him.

The only answer is to keep it out of civil court and in military hands for non-citizens. If citizens are accused of domestic terrorism, it certainly seems a law would apply. Habeas Corpus, due process etc. Time hold the legislative branch accountable for ensuring current laws are enforceable / being enforced prior to passing.

For those who wish to know ‘who you are,’ please study the Law of the Flag — Skip the ‘conspiracy crap,’ and understand from the SOURCE what that Gold Fringe means on EVERY US/State flag in your post offices, court rooms, and other govt buildings — Then — Study the LAWS themselves from their source…
Understand what exactly Admiralty Law is, where it comes from, how it applies (if it applies) – concurrently understand what military/maritime/equity courts are; Understand the Common Law – IF we still have it (that would be the Republic’s Constitution, y’all) – This ain’t no David Copperfield ‘majik show,’ but it does give the illusion. Be VERY aware of the flags on uniforms also — inverted and mirrored ‘us’ flag MEANS something — find out WHICH Constitution the Oath of Office is sworn to, at ALL levels. Here’s a good starting point with quite a few original sources to follow for due diligence… —>http://www.barefootsworld.net/admiralty.html

If you’re comfortable voting for someone that is going to swear to uphold the Constitution, but has been on record saying that he really thinks little of it, that’s on you. I’d personally suggest you stand up for what’s right so we can purge the GOP of it’s progressive authoritarian dickwads (fascists) like Twitt Romney and the Neocons. Most of what Mr Paul says makes very good sense.

The trouble is that he is not carrying enough of the country with him. He has said himself that he does not expect to be elected to the presidency, but wishes to use the platform to move America closer to its founding pinciples.

I agree with him. His supporters constitute a substantial voting block and this forces the GOP to move in his direction to capture it. He is interested in getting the USA away from the big government philosophy and returning it to the ideals which made it great.

He has played his hand very astutely and unselfishly, and I think that his stated objective will eventually be acheived.

@ JUST_ANGRY: JUST SHUT UP. Your Liberal paid for lies don’t float here. MITT doesn’t NEED to be President like the arrogant jackass in the WH now or the hysterical RON PAUL boys.. but he knows he can help AMERICA. I believe him. HE’S so much better than you can or are capable of understanding. Maybe that’s because it’s been a while since a real GENTLEMAN which CHARACTER and ETHICS and a LOVE FOR FREEDOM was on the scene. We are so used to watching money-grubbing politicians. Like PELOSI, like FEINStEIN, like CLINTONS, like REID, Like most of the rest of them who came to DC with a 6 figure worth and left with 7 or 8 figure wealth.
What the world needs now is GOD. SATAN is having a field day. Those poor ignorant pre-historic animals roaming 21 M.E. Countries throwing rocks, screaming and fist-bumping the sky are being used. Name the last time a LEADER built a real school, not an indoctrination/brain washing center for kids. Name the last time a LEADER built a hospital; stood up for our AMERICAN HISTORY and our FOUNDING FATHERS? OUR WORLD has dissolved into a snake pit of grubby, lying politicians and the dastardly Muslims creeping over the hill salivating over the prospect of flying a black flag over the WHITE HOUSE. This is our last election if we lose. This is the end of all types of FREEDOM, if we lose. There is no more luxury of time …we hopefully are just awakened in time!!!

Patti, 8 witnesses put Romney at the Bilderberg conference. Ryan has written articles for the CFR. The media that you let do you thinking for you all has CFR membership. Romney is on record supporting every un-American anti-Constitutional bill Obama and Bush have signed post 9/11. I’ve posted CFR assessments of Romney’s positions on here numerous times and there’s no way he loves the America you and I love. No person that supports the legislation that this article references gives a rat’s ass about you or any other American for that matter. They appall freedom and the Constitution. As for your perspective on the boogie men in the Middle East… well it comes from the CFR. All the talking heads and news outlets you watch have CFR membership. You have brainwashed by the globalist propaganda. I have posted many times what I’ve seen when I was over there, and how I don’t believe it matches the media and politicians rhetoric. Yes, there are a lot of crazies that hate us over there. Some have good reasons because one man’s “collateral damage” is another man’s child and we’re killing those people so a few men can steal their resources. They are militarily weak and unable to attack us here if we adopt common sense immigration policies, which Romney and Ryan are against. The first sentence of your post is a hysterical lie based on what? Let me give you a tip, sweetie… Romney supporters are liberals if they aren’t admittedly only voting the lesser of two

All this really proves is that it’s all about how the Media presents the issue.. It’s so unfortunate but the masses both Conservative and Liberal are all led by the Media.

All these Republicans hated on Dr. Paul for telling them the truth.. Now that some of their “Israel firsters” in the Media highlight the issue they fall in line and all of suddenly they see the dangers.. lol

Like I said it’s unfortunate that people are so dense but at least they finally see the dangers.. Maybe they will eventually come around on other concerns/issues of Dr. Paul and the US Constitution… Or maybe they are waiting on Mr. Beck and Hannity to show them the way? lol

@PattyHenry, You sit there and call Just Angry liberal, but you are the one that sounds like a liberal. Liberals do nothing but bash people for their views, get all bent out of shape and end up sounding irrational, just like you are doing. If everyone would look at the big picture and see that both parties are the enemy tody, we could start making plans to fix our country. It was quite apparent that both parties ignored the voice of the people at the conventions and pushed through their agenda against the nays of their delegates. If this has not made all of you open your eyes to what is really going on, I do not think you ever will and our country is dead as we know it. Romney is for the Patriot Act and the NDAA as it was written and signed by Obama. These two bills are against everything our founders fought against in drafting our Constitution and Bill of Rights. Any American who would vote for anyone that is for these two Unconstitutional laws are not thinking like Constitutional Americans in my eyes.

Just as the Germans finished burying their explosives in the sand, John C. Cullen, a young U.S. Coast Guardsman, came upon them during his regular patrol of the beach …

To preserve wartime secrecy, President Franklin D. Roosevelt ordered a special military tribunal consisting of seven generals to try the saboteurs”

      http://www.history.com/this-day-in-history/german-saboteurs-executed-in-washington

Now if the Germans had been caught, because we read radio intercepts, would we be obliged to reveal sources & methods at a trial in 1942 or would we be able to hold them indefinitely.

Could we have a secret trial today? Or would the civilian attorney give away everything? Attorneys will assist the worst criminals there was one that illegally assisted one of the 1993 World Trade Center bombers.

Walkabout, you miss the point. Nobody is arguing about foreign enemy combatants and spies, at least I’m not. The concern is about indefinite suspension of American citizens without charges, a lawyer, or a jury of their peers at the whim of the President, or if this were to occur, the dictator. The NDAA smacks of citizens being wisked off the streets by the secret state police, or Geheimne Staats Polizei, a.k.a, GeStaPo. This is unamerican. That puts you (& the rest of us) between a rock & a hard place. Awlaki was an American citizen. He was in contact with Abdul Nidal Hassan, the Fort Hood workplace violence guy. If the CIA & NSA have to give up how they track & intercept messages in court to prove he is guilty then how are we going to win? Suppose we had captured Awlaki instead have killed him in a drone attack, it would not be a moot point about indefinite detention.? So one day so as to not violate the concept of indefinite detention we let Awlaki go. Further since we never charged him with anything we have to let him travel. He travel to Canad, Mexico Europe or the Middle East, somewhere safe for him. He is debriefed & the jihadis fought out how they were tracked. They changed methods. The NSA & CIA do what exactly now?

When our friends in the COMPLICIT Media reported that we could track satellite phones in 2001 or 2002, Al Qaeda stopped using them. If we would let a person like Awlaki goat some point he would be debriefed. The terrorists would change methods faster.

Obama has shown the capacity to use executive orders to go around Congress law or no law.

If you want to hamstring the U.S. & complain about the NDAA, I might have to pull a Karzai. It might be safer working for the other side. That is harsh but some of you people seem suicidal.

He ran on closing gitmo. Not indefinite detention was unconstitutional for terrorist, because even he knows they are foreign and our constutition does not apply. There was a convention in Geneava that everyone use to take seriously . Congress released the letters where it was Obama pushing for indefinite detention. But the neocons like Ghram and Mccain were right there with him. Despite what republicans think, neoconservative war hawk foreign policy is not some ron paul kooky thing, it is very real and very dangerous outcome. The Global Elite want to track their livestock that they acquired in 1933.

The Creditor’s Security Bond – The Social Security Card, is outdated.
