Obama Admin. Argues Suspending NDAA’s ‘Indefinite Detention’ Provision Does Irreparable Harm to U.S.
Less than 24 hours after a federal judge in New York ruled the federal government could not indefinitely detain “suspected” terrorists, the Obama administration asked a court to suspend the ruling.
U.S. District Judge Katherine Forrest on Wednesday struck down the anti-terrorism law, passed as a part of the National Defense Authorization Act for 2012, that she called unconstitutional in its provisions for indefinite military detention.
The law allows detention of people suspected of “substantially” or “directly” providing support to groups such as al-Qaida or the Taliban. A group of political activists, journalists and scholars took the federal government to court over the law, citing concerns they could end up being held for exercising their First Amendment rights.
Government lawyers called such concerns unfounded, but Forrest said in her ruling Wednesday that she found them legitimate.
In court papers filed Friday, the U.S. attorney’s office in Manhattan asked for a stay of the decision while the government appeals.
The law concerns “the president’s exercise of his commander-in-chief power in the context of the United States’ current combat operations against al-Qaida, the Taliban and their associated forces,” Assistant U.S. Attorneys Benjamin Torrance and Christopher Harwood wrote. “The court’s injunction against the exercise of those war powers … should be stayed.”

In a stay request signed by New York’s Southern District U.S. Attorney Preet Bharara, Assistant Attorney General Stuart Delery and Department of Defense General Counsel Jeh Johnson, the government argued that the injunction was an “unprecedented” trespass on power of the president and the legislature that by its very nature was doing irreparable harm.
One of the plaintiffs’ lawyers, Bruce Afran, said the judge’s ruling should stand. He noted that enforcement has been on hold since May, when the judge issued an earlier decision.
“There’s no basis for the government to get permission now to use the law,” Afran said, saying he was concerned that the government might plan to start making immediate use of the law.
The issue of “indefinite detention” has been one of the few that has been able to bring both ultra conservatives and the far left together in pursuance of a common goal.
An official with the U.S. attorney’s office refused to comment on the case.
The judge, in her ruling this week, said she realized the gravity of the government’s anti-terrorism work and said courts should afford the administration considerable deference on national security.
But she called the law that’s under scrutiny “unconstitutionally overbroad,” questioning whether it could be applied to a news article if it were perceived as favorable to the Taliban.
“Where is the line between what the government would consider ‘journalistic reporting’ and ‘propaganda?’” the judge wrote. “Who will make such determinations?”
Pulitzer Prize-winning journalist Christopher Hedges, who has interviewed al-Qaida members and reported on 17 groups named on a Department of State list of known terrorist organizations, testified at a March hearing that the law was so vague that it was impossible to know what might be illegal.
The judge noted that the government can use another law that permits indefinite detention of people connected to the Sept. 11 terrorist attacks or others picked up on the field of battle.

If citizens are accused of domestic terrorism, it certainly seems a law would apply. Habeas Corpus, due process etc. Time hold the legislative branch accountable for ensuring current laws are enforceable / being enforced prior to passing.

Government is a process for the very reason just demonstrated. There is no perfect candidate and they are all politicians and FAR too many have a JD behind their names for my liking. Bottom line is there is only one solution and that is to win more elections. The result is more judgeships…

The trouble is that he is not carrying enough of the country with him. He has said himself that he does not expect to be elected to the presidency, but wishes to use the platform to move America closer to its founding pinciples.
I agree with him. His supporters constitute a substantial voting block and this forces the GOP to move in his direction to capture it. He is interested in getting the USA away from the big government philosophy and returning it to the ideals which made it great.
He has played his hand very astutely and unselfishly, and I think that his stated objective will eventually be acheived.

If everyone would look at the big picture and see that both parties are the enemy tody, we could start making plans to fix our country. It was quite apparent that both parties ignored the voice of the people at the conventions and pushed through their agenda against the nays of their delegates. If this has not made all of you open your eyes to what is really going on, I do not think you ever will and our country is dead as we know it. Romney is for the Patriot Act and the NDAA as it was written and signed by Obama. These two bills are against everything our founders fought against in drafting our Constitution and Bill of Rights. Any American who would vote for anyone that is for these two Unconstitutional laws are not thinking like Constitutional Americans in my eyes.

The concern is about indefinite suspension of American citizens without charges, a lawyer, or a jury of their peers at the whim of the President, or if this were to occur, the dictator. The NDAA smacks of citizens being wisked off the streets by the secret state police, or Geheimne Staats Polizei, a.k.a, GeStaPo. This is unamerican. Do you really want to give communist Obama that power? Are we crazy?

That puts you (& the rest of us) between a rock & a hard place. Awlaki was an American citizen. He was in contact with Abdul Nidal Hassan, the Fort Hood workplace violence guy. If the CIA & NSA have to give up how they track & intercept messages in court to prove he is guilty then how are we going to win? Suppose we had captured Awlaki instead have killed him in a drone attack, it would not be a moot point about indefinite detention.? So one day so as to not violate the concept of indefinite detention we let Awlaki go. Further since we never charged him with anything we have to let him travel. He travel to Canad, Mexico Europe or the Middle East, somewhere safe for him. He is debriefed & the jihadis fought out how they were tracked. They changed methods. The NSA & CIA do what exactly now?
When our friends in the COMPLICIT Media reported that we could track satellite phones in 2001 or 2002, Al Qaeda stopped using them. If we would let a person like Awlaki goat some point he would be debriefed. The terrorists would change methods faster.
Obama has shown the capacity to use executive orders to go around Congress law or no law.
If you want to hamstring the U.S. & complain about the NDAA, I might have to pull a Karzai. It might be safer working for the other side. That is harsh but some of you people seem suicidal.

Given how Obama has routinely ignored matters of law when it does not suit him at all, he will probably have the ‘unlimited detention’ of US Citizens done by executive order whenever he wishes to begin.
