New Book Says Justice Scalia Was ‘Enraged’ at John Roberts Over Health Care Decision

A new book details how Supreme Court Chief Justice John Roberts sided with the liberal wing of the court to uphold President Barack Obama’s health care overhaul and says Justice Antonin Scalia was “enraged” at him for doing so.
CNN legal analyst Jeffrey Toobin’s “The Oath: The Obama White House and the Supreme Court” says the other four conservative justices on the court wanted to “kill off the entire health care law,” alienating Roberts who sought out a “middle ground,” according to excerpts of the book published Saturday by Politico.
A lifelong Republican, Roberts originally intended to vote to overturn the law, but it became apparent to the other justices in April and May that he was going “wobbly,” Toobin wrote:
“The four conservatives had overplayed their hand with the chief justice. By demanding that Roberts kill off the entire health care law, they prompted him to look for some kind of middle ground. … [Justice Antonin ] Scalia was enraged at the chief.”
“Wobbly,” incidentally, is the same word sources used to describe Roberts in a major CBS News story published just days after the court announced its decision.
Part of the reason for Roberts’ switch, according to Toobin, is that he had two goals for his tenure as chief: “to push his own ideological agenda but also to preserve the court’s place as a respected final arbiter of the nation’s disputes.”
A complete nullification of the health care law on the eve of a presidential election would put the Court at the center of the campaign … Democrats, and perhaps Obama himself, would crusade against the Court, eroding its moral if not its legal authority. … Gradually, then with more urgency, Roberts began looking for a way out. …
Despite conservative outrage over Roberts’ vote, Toobin said his opinion “is a potentially significant long-term gain” for the movement.:
[F]or Roberts personally and the conservative cause generally, his vote and opinion in the health care case were acts of strategic genius. … Roberts at a minimum laid down a marker on the scope of the commerce clause. … Roberts’s opinion is potentially a significant long-term gain for the conservative movement. … Roberts bought enormous political space for himself for future rulings. … Did Roberts, by his late switch in the health care case, poison his relations with his conservative allies on the Court? That is very unlikely.”
Scalia told CNN’s Piers Morgan in an interview over the summer there was no truth to reports that relationships between the justices had strained over the decision, saying, “No, I haven’t had a falling out with Justice Roberts.”
“The Oath: The Obama White House and the Supreme Court” is due out on Tuesday.

Take the 10% penalty, if you have to. The IRS will leave no stone unturned to get their Revenue. Bury it somewhere like a dog buries a bone!

The only ones who are “not over it” are the ones who realize the value of this country and of holding to the Constitution. Wake up. This is only the beginning. If the Chief Justice of the Supreme Court can be bullied (and he was) the hope that our country will survive is diminishing fast. The best we can hope for from this whole opinion is that Roberts will no longer be confused as being a conservative justice. He is beholden to something other than his oath as is Obama.

Instead, we now have unlimited taxing authority instead of the commerce clause. It didnt meet the criteria of a tax and roberts actually inaccurately used precedence to find a reason for his actions. It’s judicial activism. Find whatever you can to support the decision you want. The only reason they have lifetime appointments is to avoid being pressured politically. I agree there is not much we can do about the decision now but isnt letting it go the same as condoning the corruption and letting tyranny rule rather than our constitution? Since it is a “tax” we can overturn it so letting it fade from our memories would be a mistake until it’s repealed.

Posted on September 16, 2012 at 9:59amI wish Roberts wasin in the regular Medical world like the rest of us. My Dr. at age 55 retired because of Medicar and Medicade. He told me it didn’t pay half of his operating expenses. I now have a new young Dr. that take 2 months to get in to see. I learned from my 3 sons, Go to Emergancy One that only takes cash or regular insurence unless you need surgery. Untill I got wise and went to the hospital and waited 4 hrs. to get a prescription, it now only takes up to 1/2 Hr. My good union insurence has changed that part of policy and sent us a letter that come Jan. 1 St we will join the Government prescription program after saying just the opposite after Obama cramed this down our mouths.

He took a clearly unconstitutional law and twisted it to pass muster because he was worried more about HIS reputation at the DC cocktail parties than he was about the Constitution and the people of the United States .Now we may well be doomed and we have him to thank for it .

He will appoint 1 or 2 MORE activist liberal supreme court judges in his second term which will change this country forever and there won’t be any more discussion about “constitutionality”. Liberals (democrats) hate the Constitution because as Obama stated “it doesn’t say what the government should do on the behalf of people, only what government can’t do to them”. Should they now take up cases to toss out Social Security, Medicare, Medicaid, food stamps, home mortgage deductions, business subsidies, highway funding, research and education grants, etc. I think you get the idea. While many of us may feel these are outside the constitution, it is what it is and if we want to change it, there will need to be several Constitutional Amendments to reel in congressional spending and power. As much as we may dislike the current President, he could only sign the bills at the end, congress is where we need to make the changes, first through elections, eventually through the amendment process.

Nevada doesn’t have enough prostitutes… just implement the affordable ****** act and charge a tax to everyone wo doesn’t have a ****** policy. Posted on September 16, 2012 at 3:43pmsoybomb315_II I feel the Obamacare bill should have been made impotent, however, given that the US Constitution clearly stipulates that the House of Representatives is the place where taxes can originate and that the Obamacare “tax” originated in the US Senate, not the House of Representatives, Obamacare may, once again, appear before SCOTUS and ultimately be declared unconstitutional. There is still such a court challenge which has been filed and awaits action by SCOTUS.

Roberts may have helped the cause by making it a tax rather than a penalty.

I do believe Mitt Romney and Paul Ryan are the best candidates to accomplish this. I’ll put my efforts into the campaigns that will take the Senate, House and Presidency.

The justices did not do their job. This law was passed illegally, is in clear conflict with the powers outlined for the federal government, and is more than a tax. It is an open door to regulate everything we do in the name of maintaining better health. Outrageous that the voters have to correct congress, the president and the court as well.

1. There are no longer limits to what a Congress can impose on the American citizen if it is delivered as part of a tax scheme.
2. The Commerce Clause is rendered irrelevant as Congress will act within its now unlimited power to tax.
obama and roberts managed to do what our enemies throughout our history have been unable to accomplish – the absolute surrender of American Liberty to a centralized government with a ruling class who live by a preferred set of rules.
Because of this ruling the Congress and a dictatorial Executive Branch can impose any limit on the American citizen through the power of taxation or executive order. The Judiciary has claimed “open season” on the American Citizen, as well, by “legal” agreement with such Unconstitutional government action; and with this decision codifying THAT power of the government over every detail of every American citizen’s personal life – once the government gets around to passing such laws and regulations.
Toobin is a legal lightweight incapable of providing accurate and truthful analysis.

Posted on September 16, 2012 at 5:10amThe problem here is that if the people fail, and give in to the desire of an all powerful government (or at least it likes to fashion itself as all powerful, too often they realize there are very real physical limits to their power) to take care of them, then there is no longer any bulwarks. “Strategic” and “clever” tactics of the supreme court will give carte blanche to our downfall if the election does not turn out the way he hopes.
Simply put, if President Obama is reelected, and the liberals from both sides of the aisle are returned to power, the nation is over. All we will have left is a corpse.

That is EXACTLY the logic that the earliest Progressives used to convince others that the Constitution was outdated and needed to be ignored. I think it would be a much more sound course of action to first get back to true Constitutional fidelity before we call for any further reforms. Liberals (like women) also base their decision making on emotion not logic or reason . This is why the bulk of their solutions just do not work and make the problems worse .
Conservative minded people use logic and reason to come up with real solutions to solve problems that really work .
Politicians ( both Liberal and Conservative and male or female ) are often influenced by personal monetary gain or desire to remain in office as long as possible (for more monetary gain ) in their decision making process resulting in more laws, higher taxes , more national debt , etc.without ever solving the original problem

As a woman, Engineer, and a BUSINESS OWNER, I have no doubt that the reason why you think of men as so far superior is because you are retaining some pent up frustration over not being able to find a woman that is far less intelligent than yourself and that can deal with your less than average peenie. When I run across men like you, I always find that same common thread in their modus operandi. They always fear/hate women that make more than them, and they would rather have their wifes barefoot and pregnant, than out in the workforce and risking the chance that their wife might come home one day to announce that they just received a raise that would bring in more money than yourself or that they leave you for someone else that they met at work that has way more to offer.
When I took over a small engineering firm in 2004, owned by a man, it went from absolutely no growth in clients/employees/income to doubling in size and income EVERY SINGLE YEAR for the past 7 yrs. That success didn’t come from making “emotional” decisions moron! If I made all of my decisions in my life on “Emotion”, I would have ran this thing in the ground before the 5th yr when most small businesses fail and close their doors.

Many of the folks posting here are clearly “misogynistic”, yet not smart enough to understand the “GOP war on women” or why about 60% of women, in every poll, are voting Democratic.
Reminds me of the people who have “support our troops” bumper magnets next to those saying “taxed enough already”. They loved it when we became the first civilization in history to go to war and reduce the taxes collected from it’s people, yet they cry about the national debt. Conservatives use “reason and logic” an earlier poster said as he was belittling women, yet it was Rick Santorum that had it right in his speech yesterday: “…smart people will never be on our side”.

With the attitude that REALITY shows, I am not surprised that he has never found an intelligent woman who wouuld give him a second look. Or perhaps he is just a kid, whose sole experience with women is his baby sister.

Where did it go? That money enough to pay the entire infrastructure of America, more money than funded two world wars, at the military hardware of history, money spent to send us to the moon and then create a shuttle system, additional money to build all government infrastructure and buildings and fund the payroll of all those that have worked since the founding of our nation. What happened? Surely the last three years with so much spent, there must be something to show for such.
Unless, you wanted to bribe the unions, political leaders, banking and others to do your bidding, change the direction of government by influencing them with such a stimulus package.
When the government cannot allot for such and there are such drastic changes of principles, it makes you wonder…

It may be that I cannot face the reality of the facts of what he did, just yet. I had high hopes for Roberts. Justice Roberts has proved to be a big question mark in my mind by his actions. Perhaps I want to believe in some goodness during these trying times, and I am possibly making excuses for someone who may not have made a decision that is good for America. I want there to be other factors that I and others are not aware of that guided that decision of his. I have to put that aside for now, for the Truth of this may sap my strength a bit more at this point in time. It not healthy to have too much disappointment and discouragement in the forefront of what we all need to do. America does not need more betrayal.

Bet the “free-market” could tell us in “one-sentence”. There is probably 200 pgs in the law to explain those 2 likeable items..Why? probably embedded somewhere in the “old-child” clause, the parent has to provide toilet paper & toothpaste to the “old-kid” until the age of 27yrs.. Marxists manifesto at the DNC convention. My read is that a Catholic has difficulty distinguishing between the Parable of the Good Samaritan and the manifesto. A Catholic-vote website poll shows about half of Catholics voting Obama – in spite of the Obamacare mandate that Catholic institutions fund abortions. So somewhere in the deep recess of his mind, Justice Roberts goes Obamacare = doing good for the poor so it is ok (that tax bit was simply a religion-state separation ploy). Let the non-Obama voting Catholics and non-Catholics stand up and vote in November to repeal Obamacare

Many Orders like the Jesuits (for example) had numerous rogue Priest’s doing the teaching back then. They do not follow the Church’s doctrine and exclude much of the way the faith is intended to be lived. In other words they made it casual, comfortable and free wheeling and as a result corrupted many. It is not reflective of the true faith and these folks you referred to probably practice the faith when the feel like it if ever. By the way you left out Biden the other hypocrite.

Roberts did not want to bring the Court into disrepute with a decision that flew in the face of duly enacted legislation. Bernanke does not want it to be said that the Fed is inactive in the face of persistent economic malaise: if it can’t at least create more money, then what is it good for?
