FL Family Faces Fines for Holding Home Bible Studies

Over the past few years, a number of families have faced fines and other legal ramifications for hosting home Bible studies.
Recently, Michael Salman’s case captured widespread attention (he was hosting large meetings in a building on his property and was inevitably imprisoned after failing to comply with zoning regulations). Then, there was a family that was fined in San Juan Capistrano, California, for hosting a Bible study without a permit (a situation that was inevitably amended, with the city changing its code).
Now, there’s yet another case — this time involving a Florida family — that is capturing headlines. Like the aforementioned cases, Shane and Marlen Roessiger, of Venice, are being held accountable for hosting weekly, Friday night home Bible study meetings that include as many as 10 participants.

The cost of their zoning violation amounts to $250 per day. In addition to holding the home studies, the Roessiger family is also under fire for posting a small sign in their front yard. It reads, “Need Prayer (941) 484-4915.” The husband and wife, though, aren’t taking the city’s response to their home Bible studies and personal yard sign without fighting back.
“It is difficult to understand how it is illegal to have a prayer meeting on Friday night with a half dozen people but it is alright if I invited the same group on Monday evening to watch Monday night Football,” Shane said in an interview with Fox News Radio.
The family has sought assistance from The Pacific Justice Institute, a conservative legal firm. Brad Dacus, president of the group, is speaking out in defense of the Roessigers.

“It’s a weekly Bible study. It’s the same kind of Bible study that occurs in households across America,” Dacus said in an interview with Fox News. “They are having a specific problem with this family solely because they are having family and friends over to read the Bible and pray. That may be fine in some tyrannical parts of the world. That is not okay in the United States of America.”
Pam Johnson, a spokesperson for the City of Venice, defended the city in this case and confirmed the code violations. The specific issue at hand is whether the family has been using its home as a “house of worship.”
“The Code Enforcement Board has continued both cases, although Mr. Roessiger was found guilty a few months ago of zoning violation (as it relates to land use),” Johnson said in her statement. “It has not been determined at this time if the use violation has been abated. No determination of guilt has been made for the sign issue because the case is continued.”

If I hated Atheist, I would have posted the names of the people that are giving Roessiger Family a hard time. Especially the one, that I know started this, but he gets enough death threats from the crap the he pulls on other people. So I don’t do that, because that would be wrong.
And yes their a group of Rich Drunken Atheist ( former Lawyers), that have nothing better to do then go out of their way to bother other people, that have done nothing to them, because their on a power trip…….

Posted on September 17, 2012 at 7:25pmI used to go to a small church that didn’t have it’s own building. Then the church got the funding to build it’s own building. I never will know what or where but that church became corrupted, I was little so I never could have understood why the church would turn on the pastor and his family for something a little girl said and then six years later make sure that pastor never led as a camp director. Guilt haunts, forgiveness overcomes guilt, but seeing a home Bible study is reassuring in that area and not surprising. I never want to wish ill on anyone but it’s definitely going to get harder from here on out for those that chose to worship God in their own way. For wanting Christians to go into hiding and not “shove” it at people why chase them from their own homes? Or do athiests just want to eradicate it from people that never wanted any harm to anyone?

I remember the last country I was in where you couldn’t get together & pray (or read the Bible), it was Saudi Arabia. Yep, the same place where it is illegal to bring a Bible into the country (I snuck mine in very carefully) and where most of the 9-11 hijackers originated from. I was over there to help protect them from Iraq in the 90s. If some country wants my help to protect them, yet they won’t allow me the right to pray to my God, well, pith on them!

Posted on September 17, 2012 at 9:46pmSounds like the City is interfering with freedom of Religion protected by the Constitution. A private home is hardly a Church. This also looks to be an elderly couple. This might also be considered as abuse of the elderly. They should contact their State Representatives (unless the reps are Dems) for assistance if the lawyers don’t succeed. However, I believe the lawyers will win.

Posted on September 17, 2012 at 10:20pmUmm, let me think about this a moment… ten people are having an in-house study and the home owners are arreted for assembling without a license- in their own home. Really- what part of private property doesn’t the city understand? What people do in the privacy of their home is their own damn business, not the government’s or anyone else’s. I’m fairly certain I wouldn’t be wrong in saying that if these people were having a wife-swap aprty and twenty people showed up, there’d be no concern shown by anyone in the city government or complaints registered. Not even if they were worshipping the moon god during the event.
This community- and any state that allows such infringement of people’s rights and God’s Word- is going to fall hard. Let the stones be torn down and no one ever pass by again.
As it is written, let it be done.

Would your outrage be as strong for Jews, Muslims, or even those snake handling fundamentalist if this was next to your house? I think the hypocrites can drop their “Christian Pose” and outrage. Not all “non-theist” are threatened by faith they do not believe in. I am not. I am concerned about religious fervor as one post said its ” time to pick a camp” and take sides. Talk that is in the direction of religious based turmoil. Your faith is YOUR faith! How weak is it( your faith) that a SIGN or no sign in a yard means anything? No one can take your faith or keep you from saying prayers. There are many NON-theist who are and have been tolerant of Faith. Careful to lump the few into the many. I am conservative. The Dems got the weak minded Non Theist only for the power they seek. I think outside of just my belief or non belief. Don’t play into being divided and start “choosing sides” based on just your FAITH. There are many who are standing with Liberty and being shunned by your FAITH.

In Rancho Cucamonga CA., the man threatened in a similar manner for holding Bible studies in his home brilliantly turned the tables on the officials when he pinned them into a corner with the statement/question, “According to your allegation, even daily thanks to our Lord before we eat is a violation and could result in fines and incarceration, is this true?” The official responded, “Yes, it’s true.” The official could hardly say otherwise after inaccurately, recklessly and desperately defining the scope of their non-existent offense. Ultimately, Rancho Cucamonga supervisors were shamed and forced to issue an apology, reprimand the humiliated official and vow to make changes to the current zoning laws. Venice, Florida joins Rancho Cucamonga CA, San Diego CA, San Juan Capistrano CA, and Phoenix Arizona in the attempted trend to ban Bible studies.

Posted on September 18, 2012 at 8:24pmThe issue appears to be with regulations of maintaining a neighborhood, like parking and traffic – which can be a real consideration in some areas. Most likely, visitors or citizens are being oblivious of their neighbors, though, it’s no surprise to live next to people that are just unhappy and difficult. Most police would simply explain the situation, so it could be rectified immediately. It is hard for me to imagine such an unresolvable conflict. The community would be better served by people, who tried to get along with the law, who have a very hard job, with simple communication and understanding, instead of being so prone to lawsuit. WWJD?

Why are we not involved with our ciy and county government enough to stop this crap? We have been asleep at the switch and it’s time for us to take back our cities and counties, that is where government starts, and we have let this freedom irroding group do this. All you out there that are outraged get off your butts and run for something in your town, or county. We are the government, which neighbor do you want running your life? You see, even if your mortgage is paid in full – no other leins on the property, Property Taxes Continue, even after you are dead; then your relatives and/or heirs must pay them PLUS any Death Taxes due ! In this case, the City of Venice probably sent in a SPY to check out all of that praying and bible study going on there. This MUST be fought – Every Case – Nationwide ! It is past time to take America Back !

Posted on September 17, 2012 at 3:15pmI’m not saying I agree with the code/law in any way. I don’t. BUT, it seems to me that the sign is the issue. They draw the MNF analogy and I’d wager that if the sign read “Got MNF?” that they’d have the same issue. There are plenty of places that won’t let you put up signage for such things. If you bought the property under that regulation then you should know better than to do this. It’s no different than the flags on veterans homes in HOA’s. Is it crappy? Yep. Did you sign the HOA agreement when you bought your house? Well then who’s fault is it?
Again, I think they should be able to do it, but what this attorney and this article are suggesting seems a little apart from reality.

Posted on September 18, 2012 at 2:46amRothbard, I think you have something with the sign issue. A lot of communities have sign ordinances which are usually very restrictive. When my son did his Eagle project, part of it was replacing a sign. That required detailed plans, an ariel veiw of the church property showing where the sign was with measurements to propert lines and public easements, measurements of the sign, etc. The stone altar he built in front of the church which is used for Pascal Fires at Easter didn’t need squat from the building department. As with the other cases, this probably has nothing to do with a few people gathering for Bible Study. In Mr’ Salman’s case, he did build a Church on his property. It was not zoned for houses of worship and the permit was for a garage, not a Church or assembly hall. And he refused to comply with various safety issues that apply to assembly halls and houses of worship that don’t apply to a garage.

No we didn’t it’s only since government has gotten out of it’s proper role beginning roughly a century ago to regulate us into submission.Look at the second amendment,every ‘gun law’ passed since the second amendment is unconstitutional,do you see anywhere in the second amendment that says we need a permit to purchase a firearm?
It’s the same thing with freedom of religion,with the first amendment it states congress shall make no law,end of story case closed.

Posted on September 17, 2012 at 3:20pmDude, that dog ain’t gonna hunt. There are only a handfew left who care. So they pass a law saying if you are dishonorably discharged you can’t have a gun. Or if you are crazy you can’t have a gun. We all say “Yeah, I don’t want crazies with guns so sure go ahead.”
Therein lies the problem. You want that law? Fine. AMEND THE CONSTITUTION! We had to amend the constitution to ban booze. Why? Now they ban freaking soda. I have to have an ID to get cold medicine. Did you see an amendment anywhere? I sure didn’t. If we had to amend the constitution to ban booze why do we not have to do it to ban weed or bath salts or crack?
People are more than happy to crap on the constitution when it suits them and then complain when someone else does. Collectively we all deserve what is about to befall us.

Nothing on religion. Local governments are looking for $ and power anywhere they can find it these days to fund their retirement pensions. They don’t care about the people they are serving. They have turned it around to us serving them. Thanks to the unions. I say break ‘em up. They are eating us alive in every way possible.

If this is the same story I heard on Fox about a week ago, the issue was that the home that was hosting the Bible Study had cars parked up and down the street at that time, and it involved a lot more than 10 people. Think about it. If you lived in that neighborhood you would tolerate this occasionally for parties, but on a weekly basis – well, then it’s time for them to rent a room somewhere. Maybe a church?

If it was Muslims having Friday prayers in the front yard, no one would of been able to get away with stopping it. They wouldn’t even of tried. Its time to go to the streets and be heard this typing back and fourth isn’t getting the job done. Love/pray
