Appeals Judge Allows Obama Administration to Continue Enforcing Indefinite Detention Law

NEW YORK (TheBlaze/AP) — Less than a week after a federal judge in New York ruled against it, an appeals judge has temporarily allowed enforcement of a law that permits the indefinite detention of people believed to have supported terrorists.

Despite U.S. District Judge Katherine Forrest’s claim that the “indefinite detention” provision found in the National Defense Authorization Act for 2012 could infringe on First Amendment rights, the Obama administration immediately asked an appeals judge to suspend the ruling.

The 2nd U.S. Circuit Court of Appeals in Manhattan order was issued late Monday by Circuit Judge Raymond J. Lohier after the government warned in court papers that the law was necessary in the nation’s battle against terrorism.

Lohier said the order would remain in effect until Sept. 28, when a three-judge panel was scheduled to hear arguments on the government’s effort to block a ruling that struck down the law.

The law says the U.S. government can indefinitely detain anyone who “substantially” or “directly” provides “support” to forces such as al-Qaida or the Taliban.

Last week, Forrest ruled that the government already has plenty of authority to detain terrorists and anyone suspected of aiding them without help from the vaguely written law. She urged Congress to make the law more specific so journalists, scholars, political activists and others would not worry that contacting enemies of the United States would put them in jeopardy of indefinite incarceration.

Lawyers for the government wrote that the judge’s actions were unprecedented and exceeded her authority. They also complained that it seemed to be worldwide in effect, “intruding upon military operations in the ongoing armed conflict against al-Qaida, the Taliban and associated forces.”

Plaintiffs’ attorney Carl Mayer said it was “astounding” that Lohier’s order was issued before evidence was presented.

“The government hasn’t put in any evidence. They just keep making these broad assertions,” Mayer said. “It’s all a `trust us’ proceeding.”

Jerika Richardson, a spokeswoman for federal prosecutors, said the government had no comment.

In May, Forrest temporarily struck down the law. She heard additional arguments last month before issuing her final ruling.

    It will be amusing to watch the left roll it out the morning after Romney wins. With Obama there has been no war protests, no code pink, no rants against tyrany of NDAA, or the Unequal Justice Department. The day after Romney wins the crazies come out (OWS) like we have not seen since the 60′s. The police state you built awaits.

      I’m hoping that moments after Romney was sworn in..75 % of all employees at all levles at the DOJ slink off into the darkness and quit..I sent Romney’s campaign Judge Andrew Napolitiano’s name for AG by the way, as he is a “real” constitutional scholar..and not the pretender in the White House

      @Mutiny – Yep, I checked the voting record and Paul Ryan also voted for NDAA. That just means that there are problems with our elected leaders not listening to We The People on both sides. I guess we can only hope that if/when Romney wins, they will cut that part of the NDAA when it comes up for the 2013 vote. Woodrow Wilson had his secret police and picked up over a thousand people (who disagreed with his policies) in the night and whisked them away without any due process. It is a travesty that OUR elected officials (who work for US) had the gall to put that into law.

      That is fine. We can then police all the leftist, sort of similar to what Pinochet did in Chile in the early 70′s. They can be rounded up (we know who they are) taken to the desert in the north and buried. Then America can get back to being a real country instead of one victimized by extreme leftwing nuts and Muslims. America does not need any marxists, Muslims or anyone who does not agree with the Constitution. It may take tucking it away for a few day to actually get back to it.       What will you do if this happens. What if Blacks begin shutting down their cities and going into the suburbs to take what is theirs? Will you rely on the police for protection?

      RESME, If I may offer my opinion, they are now one of 14 federal agencies with armed police power. At this rate all of the federal civilian agencies will eventually become 0bama’s new army. But, this one is particularly worrisome. One would think that they would be more or less security guards, but I really wonder. I have to believe 0bama is doing more of that magic wand waving and giving them full police power.
      At least Andrew Jackson did one thing right as president by getting rid of the fed. Woodrow Wilson really screwed us over again. They can’t even prove that the 16th Amendment was fully ratified or not.

      Hi Resme,

      I have a few different answers for you about your posted link;

      1- It doesn’t surprise me. Almost every grocery store has armed guards with the power to detain people.
      2- You and I also have the power of a “civilian arrest” to detain people. (See lawsuit resulting from improper detainment by a public person) because we can be sued for doing so.
      3- If you have read ProgressiveSlayers posts you would know that the USA is a no longer a Government but a corporation now. Being a corporation with control over the US Military is the same as the Fed having a Police Force. (I lost those links when I re-formatted my PC last Feb)
      4- Redistribution of wealth means redistribution or power. And Obama is very keen on both.
      5- Now here’s the real Monk thought on this subject and all Human issues…. people feel guilty for doing bad things to other people. The Human Ego says, “The guilty need to be punished”. So, the Ego, knowing that all Minds are joined and all Humans are Brothers, decides to punish itself by punishing its Brother. Then it feels guilty for what its done and starts all over again. It’s a never ending relationship of guilt and punishment. Very sad and very very true.

      We’ll discuss this more later.

The NDAA is the military funding bill that get passed every year, and yes you are correct, it has been around before Obama. However your lack of the ability to make sure you speak truth has left you in the dark. This year Obama put in new provisions that alllows him to determine the guilt of US citizens and lock them up for life without giving them a court date or trial or judge or jury….. He took away our 5th ammendment. The president didnt have these powers untill this year when HE PUT THEM into this years NDAA. BTW im not some republican advocating for Mitt Romney, he also said on tv he supports these new provisions. And it was Bush who first started this constitutional destroying in the first place. I dont like none of them

      You forgot to add Echo Delta. BTW I have this sneaking suspicion that the people doing the talking the talk aren’t the ones who will be the ones walking the walk. The math says that the “bitter clingers” win when the SHTF. 100+ million gun owners versus less than 2 million military and police. That would make it like the German tanker following WWII. He said that while the German tanks were so much better that they could kill 11 Shermans for every Panzer lost, but that there was always that 12th Sherman coming over the hill. They talk about all of the ammo that the DHS has, but I know how many rounds I’ve seen being sold at gun shows in Phoenix, and DHS has nothing on the people hitting those shows. Some of the folks in Phoenix have been stocking up for a LONG time.

    Wow, is that law so journalists can not dig deeper into the Ambassador’s assasination and the layers of people behind it, plus the information concerning the Ambassadors CIA ties and a bigger than Watergate cover up on American weapons again being given to terrorists who use them to kill Americans? Wooooo hmmm hmmm hmmmm, this is big. So the big threat hanging over everybody’s head who could possibly be in the know of these things can fear for their life from Progressive Liberals abuse of power? That is not right. It is perverted.     Fast forward to September 18, 2012…”an appeals judge has temporarily allowed enforcement of a law that permits the indefinite detention of people believed to have supported terrorists.”.. like those still housed in Guantanamo Bay.

    And Barry wonders why the perpetually outraged muslim world is laughing at him today…..

    I’d sure like to know who appointed the 3 judges that will be hearing the case on 9/28. Wanna bet they were Obama appointees? I wonder if any were part of Obama’s Midnight Appointments. You know how he criticized GWB for and then did it himself while congress and the media looked the other way? Yeah, those. (not sure if judges were in that pile of appointments though)

No matter what you say or do there are still stupid people that will write someone in rather than vote for someone better.
