75-Year-Old Driver Given Ticket for…Excessive Horn Use in Road Rage Incident

Elderly Man James Ernst Cited for Excessive Honking in Incident With Bikers

A 75-year-old Colorado man has learned that hard way that excessive honking will not be tolerated in the state. Especially when you use your horn to harass a pack of cyclists.

Dir Friel and some friends were riding along a rural road on Sunday in Boulder County when James Ernst pulled behind them in an SUV. Friel and his cadre went single-file and tried to wave the man around. But Ernst wasn’t having it. Angry, he tailed the group for five minutes, honking his horn incessantly.

“In our case, we weren’t holding up traffic. There was plenty of room to go around, and this weird guy behind us just kept honking his horn for 5 minutes,” Friel told the local NBC station. “We were single file, waiving him by. Finally, you’re like this is insane. I have to get this on film.”

Frield whipped out his phone and took video. He eventually posted it on YouTube, and it went viral:

The bikers eventually called the police and State Troopers used the video to track down Ernst. He was then cited for harassment, impeding the flow of traffic, and improper use of a horn or warning device.

“I don’t know what happened,” David Erns’s son, James, told KMGH-TV. “Maybe there was something that precipitated it. I don’t know, because he’s a gentle old man.”

Gentle — but with a lighter pocket book.

Some commenters have suggested that if the man would have passed the cyclists, he would have been breaking the law because it was a double yellow line. That’s not true when it comes to bikers. ABC explains:

The Bicycle Safety Act was passed in Colorado in 2009. It states that motor vehicles must give bicyclists three feet of space when passing and vehicles may cross the center yellow line to pass bikes. Bicyclists must ride as far right as they deem safe and they do not have to ride in the gutter. Under this law, bicyclists may ride side-by-side but are required to ride single file when a car approaches.

    Maybe the horn was just stuck as those gas pedals and floormats do !

    In rural areas for safety protection, you use your horn to let others you are coming around a curve that cannot be seen by the opposing drivers.

    Elderly drivers took their written test a long time ago when things made common sense; however, today laws are passed without anyone’s knowledge. Sounds like the government has a communication problem that only they can solve; however, they love to collect fines to pay for their salaries. Good Luck Senior Citizens, one way or another, the government thugs are out to take your freedom away!!!!

      Did you watch the video? This is not a government power grab. You are correct it is common courtesy to honk prior to passing to let the person know you are passing them – this was not a courtesy honk. Watch the video. This guy chose to honk his horn for the almost the entire video – that is harrassing. Not only that but the road was not curvy, it was relatively flat. If you notice there is another vehicle that passes all of them with no issue. This individual had some agenda against cyclists and took it out by driving behind them with his horn blaring. There is no reason for this. Cyclists have laws we have to follow in addition to automobiles.
      This is not about the government taking away Senior Citizens rights, its about the government protecting all of its citizens. Mr. Ernst had ample time to go around this group and just let them go about their ride, but chose to impose his will on others. What gives Mr. Ernst the right to intimidate others. Had he hit one of them that could have been considered attempted vehicular manslaughter.
      Why cant we just let people conduct thier legitimate business without feeling that we need to be involved.
      Share the road!

      I think there is something people miss about this crap. Is there some reason why a bicyclist can move off the road onto the damn gravel for 3 secs like we did when we were kids?

      It’s like joggers. I see joggers in my area running IN the road all the time and the problem is that there is a bicycle/jogging paved path just 4 feet to the side of them. Why and the hell do these people have to IMPEDE traffic by using the road? And don’t tell me there is enough room on the road to share the road. Bullcrap! Ever hear of mirrors? And then if we come up beside them when a car is coming in the opposite direction. We have to almost stop and wait so we can weave over the center to pass the morons.

      Share the road my ass. Get off the road, get back on the sidewalk/paved path or grass.

      I’ll tell you what the problem is. They feel like they are entitled to use the road for some reason. I don’t see why they cant use the sidewalk like kids and people did for years.

      GET OFF THE ROAD AND BACK ON YOUR PAVED BICYCLE PATH OR SIDEWALK.
      Maybe you’ll live longer too.

      Bicycle riders need to realize car drivers are apprehensive passing them on roads and highways. When bicycles are ridden two abreast it is cause for double anxiety for drivers, as we feel a dread of the bikes suddenly swerving to miss some obstacle in the road and being killed by a motorist.
      No one want s that to happen!
      Now, there is also the arrogant, superior, I’m more eco-friendly attitude of some riders, not respecting the right of way of motor vehicles. This can cause road rage.

      Just one more “entitled” group! Do bicyclist have to license their vehicle for the road? Do bicyclist have to carry vehicle insurance? Do bicyclist pay road use taxes vis-a-vis gasoline taxation? Have governments local and state used taxpayer’s monies to provide for bike trails that are paid for by the majority and if used are only used by a slim minority? If your answer to just these few questions is YES, then you are a logical and rational person who understands the 75 y/o gentleman and understand the safety hazard that bicyclist present. I have heard the counter argument; “But I own a car and pay for all those things on it, so I’m entitled”. To which I reply, “Try telling that to the officer who tickets you for driving one of your unlicensed cars while your licensed car is in the shop!

      Im usually quiet on here, But all of the people defending the old man are more then likely,
      Over weight, obese, couldn’t ride a bike down their street let alone up a hill. You people just seem jealous as heck that people want to make a healthy choice and keep their bodes in shape and not have a gut that hangs over your waist line..

      They have every right as you and I on the road.

      And for the ones saying “Oh they have many trails and unused roads” They are on freaking Road bikes and not Mountain bikes. And for them to get off to the “Gravel”, those bikes dont have hardly any traction.

      This old guy was just pizzed over nothing probably. He had plenty of room to passs WITHOUT going over the center line.

      But these cyclists were much more considerate than MOST of the ones I’ve encountered. They ride in twos well into the right hand lane without offering to fall back into single file, and they usually don’t even move over at all as if they’re daring you to hit them.

      I sometimes come around a curve on country roads and can’t see them until I’m almost on them and have to hit my brakes.

      And in every instance they don’t bother to even move over to the right, expecting the driver to make a wide swing around them.

      I haven’t checked the accident stats for cyclists, but I’m betting…percentage wise…they have a lot of injuries and some deaths due to their irresponsible behavior which could be avoided if they rode more responsibly.

      You really are a nitwit aren’t you? A road bike cannot simply ride off in the gravel at 25mph every time another person wants to use the road. Maybe we should put you on a bike with a 1/2″ wide tire and see how you do hitting gravel, sand, or just a grassy patch at speed! Are you seriously that rude and ignorant that you aren’t willing to SHARE THE TAXPAYER FUNDED ROAD with other TAXPAYERS!?! I sincerely hope that your driving privileges are revoked for your rude behavior and that you are forced to ride a bicycle to work for a decade.       Hey FFTYRANNY get a clue you can not ride in the dirt with a high performance road bike. @25MPH + You will be on the ground as soon as you leave the paved road. As to the side walk that is equally ignorant of the reality. The sidewalk is for walking I do not want you blowing by me @ 25+ MPH when I am walking down a side walk. Getting hit by a bike doing 25+ is not I assure you a pleasant experience.
      also at the speed you ride a bike, and since they make very little noise it is very easy to end up stepping in front of a bike as he approaches you on the side walk.

      My calm and level headed friends. I own a car as well as three bicycles. Most cyclists also drive and we understand both sides of the argument. I suggest that before people who haven’t ridden a bicycle since they were 15 comment on how irresponsible the cyclists are on the roads, they venture out into the real world and go bike a short distance. Cyclists commonly bike 20-120 miles at a time and that CAN NOT be done only on nice calm smooth country roads. There are always times when we can not only stay on a nice bike path or wide and recently paved roads with 20mph speed limits.

      There is no excuse for being reckless or selfish on a bike, but neither is there an excuse for a cyclist, simply trying to enjoy their exercise or training to be continually harassed by others on the road. With that said, if I feel it is unsafe for a car to pass me around a tight turn, I will take the entire lane (not darting in front of any vehicles mind you) to prevent them from driving me into the ditch or trees, then move back to the side when the road straightens.

      Most cyclists use common sense, so please try to look at it from a cyclists prospective before frustrations are allowed to boil over.

      And the awesome looking outfits stop us from bleeding around our scrotal region, in case you were wondering… not for Paris fashion week.

      Quite possibly the most ignorant dribble I have ever read! You do realize that bike riders have every right to ride on the road in most states just as do car drivers? You don’t OWN the road! You do realize not every municipality HAS bike paths?!?!

      This is the problem with Libertarians/Neo-Anarchists that think they are fighting tyranny. They think every action by a law officer is an afront against them. Heck, breathing air should be illegal for a cop because YOU could have breathed it and therefore he stole it from you.

    I know exactly why he did it. Cyclists are universally hated in Colorado and for good reason. We have people that ride like this early in the morning, right in the middle of rush hour traffic. And you find yourself trying to dodge on coming traffic and not hitting this selfish freak on the bike.

    Then you’ll find them riding on the same roads, and I mean major roads, in rush hour coming home.

    And every now and then one of them gets run over. And…. here’s the kicker…. the cyclist always gets the ticket. It happened a couple weeks ago, not two blocks from my home. I’m driving out of my neighborhood to see an ambulance and cops at an intersection. Everyone standing around a mangled bike in the middle of the road.

Two-lane country road, no way. I used to cycle like these guys and I would have slowed down enough to get even with this SUV and told his old ass off.       @Stourme, I lived in Golden Colorado for seven years and I now hate these bikers with a passion. They have many trails and unused roads to ride on but they pick busy roads during rush hour on purpose so that they can be seen in their jester suits. Its a weird ego thing for these people. They think that they are cool or something. It doesnt even make sense. They often ride two abreast and do not yield no matter how long the line of cars behind them. I never saw anyone honk at them like the mentally deranged doofus in the video. I was not happy with them but I was under the impression that they had just as much right to the road as cars do. When you ride your bike with the intention to impede traffic your just a rude moron.

      But back to my past runin with bikers. Two of them were intentionally blocking the lane preventing me from passing, and laughing and shooting me the bird. When I did finally pass both of them got thoroughly soaked on their backs with my Big Gulp Dr Pepper. I LMAO for miles thinking about them riding for miles with sticky cracks. lol

      Travel is a unalienable right. Traveling as I wish on a road I help pay for is a right, not a privilage. In the Lawful world there are no privilages. Privilage is something you obtain from your master. Who is your master? I don’t have one.

      I ride a bike to work because I have low vision and can no longer dbtain a drivers’ license. I can still see well enough to ride a bike. I always stay as far to the right as possible, ride on low volume roads, obey all traffic laws and follow normal rules of curtesy to others using the public roadways. Drivers frequently buzz me, sometimes force me off the road, and sometimes show their disgust that a bicyle dares to venture unto the roadway. I get it, I am much smaller and slower than a car. However, I try to stay out of their way and not impede others who wish to pass me. Unfortunately, there are some selfish people on the road who are impatient, rude, too busy texting or talking on a cell phone, and others, apparently like you, who carry a massive chip on their shoulder. You may be in a car and in a big hurry, but you are not the only one entitled to traverse the public roadways. My advice to you, dude, is to slow down, find a different avenue to vent your aggression, be patient, and show a little respcet and consideration to others…it is good for your blood pressure and may save someone’s life, as well as keep you out of a vehicular homicide charge.

They ARE NOT important rights, serious rights, big rights or small rights, special persons rights or what your freaking opinion is of your rights. They are rights which God gave to man at the Creation, once and for all.
      Travel rights??? it is a priviledge to use the roads, just get 2,3 or 4 DUIs (depends on the level of liberal judges) and see if you have an unalienable right to drive on the road!!

      My Dad is 90 years old and still drives in Texas. He does have to get his license renewed every year pending his passing an eye test. Personally; I’d rather he not drive at 90 years old but I have know a guy 92 years old and still drives. They probably just think you youngsters need to make room for experienced drivers. :-) lol

      75 that’s young, my grand father is 96 and passed with flying colors. My brother took him to DMV, and he’s an over the road truck driver. If he thinks my grandad can drive ok, that’s better than the DMV.

    In our town(demokrat-controlled), the cyclists have the same right of way as a automobile, and can ride right down the middle of the lane. So autos either have to stay behind the cyclist or violate the law by passing over the solid line. This is by order of the bicyclist czar.

      The guys on the bikes are in the wrong. They are not riding single file . See the double yellow lines ? The driver is following the rules , you cant cross a double yellow line. He should not be fined , the bikes should be. I know are diffrent in every state but the double yellow line law is the same in every state. The roads are built for cars , here in Texas we have bike lanes in some places. The lanes keep bikes from impeeding traffic.

      People do not buy cars to drive them at 5 or 20 mph, because cyclists are clogging up the road.

      These cyclists do not seem that bad, but other cyclists maybe have been. If you make an analogy between cyclist-motorist interactions & allergies, previous cyclists might have ridden abreast & been rude. After such an incident(s), the motorists now becomes sensitized to cyclists to where he is upset even if they are courteous.

      One more thing, if you are passing anther vehicle, pedestrian or cyclists, what do you want to see? Air! You want to see air & a lot of it. You want to see a gap of 1 to 3 feet or more between the side of their car & them. If you come with in a dime’s width or less than a foot people become very upset with you.

      Considering that a cyclists takes up 2 or 3 feet of the lane & you want to put 2 or 3 feet between him & you vehicle A cyclist can take up 33% to 50% of the lane even if they are on the fog line.

      Do you as a motorist want to cross the double yellow line & risk a ticket?

      Cycling & cars do not mix well.

      But I can’t drive my ATV (has: lights[brake/headlights], seat/shoulder belts, horn, turn signals, 4-way flasher AND INSURANCE) on a road.
      Adding: forget the fine for crossing yellow line, ain’t it dangerous?

      “Ain’t” if dangerous? No, not really? There are still stories of some jurisdictions as being speed traps.

      There are a lot of good cops out there, but you telling me there are not cops who would pull this guy over for passing on a double yellow line?

      I used the word if. Will you go out on a limb & say no cops would give him a ticket, if he crossed the double yellow line?

    This could be sign of Alzheimer’s. My dad had it and he started doing repetitive things this would be something he would have done. I would have my dad checked out for Alzheimer’s.!

    I drive all over 400-450 miles a day as a delivery driver and have never had a problem with bicyclists.Its dangerous for them,but theses no reason we can’t share the roads using some common sense.Ideally,these 2 lane highways should have paved bike lanes along side them but who’s gonna pay for that?I doubt if there’s enough bicycle riders to pay a fee for it.
    The old guy probably just don’t want to change with the times or just doesn’t like seeing men in spandex and wearing goofy looking helmets.Who knows?

      The cycleist shoud pay for it not the drivers of autos . too many times I have watched cycleist block traffic , mthinking they own the road and you the driver of a 3ooo pond care are the problem .

      Bikers have the right to ride on roads, but should have more courtesy to stay on the side instead out blocking autos going the speed limit. It is annoying when they block going around them and you have to slow down to their speed, until you have clearance to cut over the line to pass.

      I live in a biking area, and some of these people thing they OWN the road and are totally rude. Others notice cars approaching and move over as far as they can. It’s just like our general population, some are very nice and thoughtful and some are combative about everything. The worst part of bikers is: the combative ones in real life are even worse in the biker life. Nasty in tights.

    Maybe the old guy is from India where the honking is incessant, necessary, and part of road-side manners. Painted on the back of every truck is “Horn please.” Wherever you can fit your car or motorcycle is fair game. Marked lanes are merely suggestions. Honk on old man… but only if you are in India.

    How about the idiots on the bike, just stop step off the road and let the man drive by!
    Look at the 1 minute 56 second mark, there is no shoulder on that road! These bikers could not keep up with the posted speed limit, so they should have pulled off the road to allow the car to go by.
    The car would have been ticketed if he crossed the double yellow line to pass these idiots…… And everyone saying gramps must be off his meds, well, guess you don’t know traffic laws.

      There is no law requiring one to A) stay in the lane, and B) travel at a prdetermined speed. These cyclist had just as much right to be there at 10 mph as the car operater has at 35 mph.

      Uh Lordjosh there IS in fact a LAW that states that it is illegal to pass ANY type of a vehicle when there is a SOLID DOUBLE LINE IN THE CENTER OF THE ROAD. Oh and YES there is a LAW that states that in such situations all vehicles must travel within ten miles of the posted speed limit, so if the speed limit is 30MPH the cyclists MUST do at least 20MPH.

      I sure hope you dont have a drivers license

      You are wrong on all counts. There is not even a law that requires one to have a drivers license. I’m sure you read you state’s motor vehicle code to make sure you are required to have one before you got one, right?

      The cyclist looked like they did everything right, even showing some great skill riding a straight line while recording video with their cell phones while some crazy guy is honking the horn at them. They don’t have to ride the posted speed limit. It is a limit, not a minimum. You are correct about not passing on the double yellow line. He could have received a ticket for that as well. He would have had to wait behind the cyclist until it was legal to pass, just like he would have had to wait behind some old lady driving 15 MPH on that road.

      OK josh you believe what you like but when you go to jail fro driving without a license because the cops pulled you over for passing on a solid line dont come crying to those of us that believe in some sense of reasonable order in this world for the safety of all.

      Applying for a license and registering your vehicle is signing a contract called a statute staple. When you VOLUNTARILY apply for such you are contracting into an agreement to abide by the corrosponding CODE(statute). Otherwise no “reasonable” sovereign would believe another soveriegn or a collective of soveriegns has any Lawful right to dictate behavior,..for safety or otherwise.

    Legally speaking the driver of the vehicle COULD NOT pass them. It wasnt safe. The driver cannot legally allow his wheels to cross a solid double line and he couldnt fit his vehicle between the yellow lines and the white lines safely. Legally speaking the cyclists should have been charged with impeading traffic. By the way I am a cyclist, have been for 31 years. The cyclists should have pulled over.

      lawful means allowed by law while legal means of or relating to or concerned with law, to sides of the same coin for more clarification…

      Black’s Law Dictionary defines unlawful as not authorized by law, illegal. Illegal is defined as forbidden by law, unlawful. Semantically, there is a slight difference. It seems that something illegal is expressly proscribed by statute, and something unlawful is just not expressly authorized.

      The only TRUE difference is that there is none

    I can’t stand seeing these pinheads riding on the roads. They are a menace and completely out of control. The more of them that get run over the better. Keep your stupid bikes off the roads. Go to a park or a track where you can’t inconvenience motorists.

    This guy was a jerk, for sure. But he charges are much more offensive to me.

    The last two are just plain dumb. As far as the harrasment, who is the plaintiff? Did these cyclist open court and bring charges(under penalty of purjury)? Is the old man going to get a trial by jury? Or is the state charging him?
    Let me ask you this. If the prosecuter is allegedly representing the state and the judge works for the state, where is the fair trial?

      In criminal cases, the state is always the plaintiff. Citizens cannot “bring charges” against anyone. Also, the sixth amendment guarantees a trial by jury in all criminal cases. I think you need to brush up on how the courts work.

      Horns are required to draw attention to unusual or dangerous situations. They are for safety, not harassment. Some posts stated that it’s dangerous around curves. Well, your not supposed to pass until it’s safe and on a curve is not safe. Most posts indicate the drivers expect everyone must get out of your way because your special. BS. Common sense has gone out the window.

      Or maybe that bicyclist riding on or just inside of the fog line take up 2 or 3 feet of 12 foot lane (sometimes a narrow as 11 feet) going him 8 or 10 feet of lane if he wants to pass the cyclists without crossing the double yellow (NO PASSING) lines.

      Bicyclists are total pinheads on the roads. They are rude, dangerous, and never follow any traffic laws. They demand they they be allowed to “share” the road and then promptly assume they own it and can make their own rules.

      They should not be permitted on roads or highways. They are a menace and a danger to drivers.

      Not to be a Grammar Nazi, but the word you should have used is “saw” and not “seen”. Now here is where I really offend a bunch of people… if you have half a brain, do NOT ride a bike on the public roads. There are plenty of beautiful trails and bike paths for you to ride. When you ride on the roads, you are at risk from even the most careful driver. Bike vs Car = Bike having bad day. Bike vs Truck = red smudge on truck. You all can see how dangerous it is just to be on the roads in a car, why would you risk your life on a bike?? Besides, most cyclists I have personally encountered are not polite and they do not share the road like they demand. I am not saying there are not polite riders, but why would you want to ride on the road with car exhaust and scary drivers when you have all those tax-payer funded bike trails full of natural beauty to enjoy???

      Strictly legally speaking the driver of that vehicle could not both legally and safely pass them. WHY? There is a solid yellow double line in the middle of the road that means cars cannot pass one another on that section of road. If the driver of the vehicle allows his wheels to touch that yellow line while passing the cyclists he can be fined for a traffic violation and have points assessed against his license. The only other thing the driver can do is to pass the cyclists but keep his car completely within the white and yellow lines leaving the cyclists no room and possibly injuring them. The proper thing for the cyclists to do was PULL OVER and let the old man go by. The driver of the vehicle knows the law, the cyclists seem as if they expected him to break the law and if the driver of the vehicle had allowed his wheels to cross the yellow line how many officers do you know that WOULDNT have given you a ticket?

      I hate passing cyclists on the road, & I’m finding more and more that either won’t ride single file or they don’t ride over to the extreme right of the lane when cars are trying to pass, even on small, two-lane roads. Unless there is a bike lane, if you can’t ride at the speed limit, why are you on that road? If a car went that slow and blocked traffic, they could get a ticket for “impeding the flow of traffic”.

      I thought the definition of “share the road” went both ways?

      @clownshoes – well where I live in Colorado I have to ride quite a way on the roads to get to the trails. As a taxpayer who has registered 6 vehicles in my state, it is my right to operate a vehicle on the roads as long as I am in compliance with all local and state laws. I agree with you that there are plenty of people who ride bikes that do not follow the laws. Those are not cyclists. All of the cyclists I have ridden with follow the laws.
      Why do we ride on the roads with all of the exhaust and big heavy machinery? Because when we are riding and our feet are clipped to our pedals it is extremely difficult to dodge all of the pedestrians and dogs (and dog crap) on the sidewalks. Not only that but a pedestrian vs bike = bad day for pedestrian.
      Also the trails around us are not very compatible with road bike tires. Now we could create more jobs and pave all of the trails but then the runners and walkers would probably complain.
      My advice is that cyclists will continue to ride on roads (as it is legal) so operators of vehciles need to be aware of them. Just because you are bigger than them doesnt mean you should ignore them.
      Share the road!

    Pretty soon they will start issueing tickets for excessive dirt on your car, or dirty windows. Anything to get a buck. But, I have to admit, trailing them for 5 minutes honking, the guy had to be a prog.

      You do realize nearly every state has a law about proper usage of head lights and horns? Most include that you can not use your horn to create a nuisance.
