63-Year-Old Cancer Patient Armed With a Shotgun Holds Off Home Intruders

A 63-year-old man with stage 4 lymphoma used a shotgun to hold off two intruders who broke into his home.

Dixon Smith of Laketon Township, Mich. told MLive.com he confronted the two men just before noon on Thursday after he heard them talking downstairs shortly after his wife left to go shopping. He grabbed the gun and waited as they made it up to the second floor.

“They made it almost to the top stair. I came out and told them to lay down,” Smith told MLive.

He made them lie still while he dialed 911 and waited for police to arrive — “kind of a long five to 10 minutes, though,” he said. He said he spent the time talking to the two men and warning them not to try anything, which they didn’t. He said they were both wearing backpacks.

“I really tried to be as forceful as possible,” said Smith, whose cancer is currently in remission. “I didn’t want them to get me into a conversation. You can’t let them get too close to where they can grab the gun.”

According to WOOD-TV, Alex Andrew Dickerson, 26, and James Leon Polk, 27, were each charged with first-degree home invasion Friday.

Smith said he and his wife know Polk and have tried to help him over the years, even taking him on a trip to Florida when he was a teenager. Smith said he believes the man became a drug addict, and he and his wife suspect him of stealing other things from the home in the past, including cash and his cancer medication.

Smith said police believe the two picked the front door lock with a credit card and that they found a chair in the woods outside used for staking out the home.

“It’s not a fun experience,” Smith told WOOD. “You don’t really know what’s really going on and it’s not, it’s not what you might think. It’s not like the movies, you know it’s pretty serious when you’re holding a gun on somebody.”

He continued, “You don’t know if they’re gonna pull a gun out or try to take your gun away from you or get you in a corner when you’re forced to shoot them. And I was trying to keep that from happening.”

He told the station he’d prefer the two get rehab rather than harsh jail sentences.

“Something that would straighten him out,” he said. “But what are you going to do?”

      A gun is just like any other tool, when you need one you need one desperately. This man is lucky he lives in a state where he can own a shot gun. Many States state that they are free but you cannot own a gun. For all practical purposes those states are really foreign nations.

      Well, he did EXACTLY the right thing…this is what Concealed Carry Weapons training teaches us. You don’t shoot unless/until you feel physically threatened. the only place I differ with this gentleman is that I’d want both of them in jail where they can learn first-hand what “consequences for your actions” means. They look to be two “mighty tasty fish” to prison inmates.

      I have, in the past, very effectively pinned home intruders to the wall, inside the house, using a bow with broad head arrows, and once used a dowel rod sharpened in a pencil sharpener. I have also taken down some idiot shooting at me from 250 feet away, with a bow and arrows with target tips.

      But, I do carry either a compact 40 cal, or compact 9 mm when I’m put and about, and I’ve used them too. Once, when I was shot in a drive by, once when I was shot in a gun fight where I was assisting a wounded police officer take down some idiot, and once in a convenience store where I killed a robber who was holding a gun pointed at the store clerk. I killed the idiot shooting at the cop, and the idiots (3 of them) shooting at me during the drive by.

      This is the crap I have to put up with to live in a crappy neighborhood.

    Personally, I prefer the Remington 870 pump with the extended magazine filled with 00 buckshot. If he missed with that double barrel they would be on him before he could reload. They were smart and cooperated!

      I don’t thin those guys were willing to risk getting blasted with a double barrell to chance being able to overpower him and take it. I do agree a pump is so much better though as I have detered break ins at my house just by racking it. That sound of a 12 guage pump racking will turn the strongest mans bowels to water. That noise means a world of hurt is comming your way.

      As a female, I have fantasized that if I had to shoot someone that broke in, I would have to ask them to step into the shower first, so they won’t get blood on the carpet. Silly thought, when faced with the real thing, would shoot them anywhere if I had too. As an aside, it is interesting that the laws involving the banning of certain guns disproportionately disadvantages women, because it’s the easy firing guns and light weight guns they make illegal. Thought at one point I would be interested in a KelTec9 because it is light weight, it’s not available in gun shops in California, but not to own. The Judge, a cute little gun that shoots both bullets and shot is completely illegal here.

      Try the Walther P99 (AS) models. You can change out the backstrap to make the fit the smaller hand quite easily. Even better, bat your eyes at the guy behind the counter and have him change them out for you :-))

      Walther also makes a P22 that fires .22 calibre ammo — cheaper to feed than the P99 (9 mm). Most .22 rounds are hollow point while the cheaper 9 mm is rounded. The expensive 9 mm is the hollow point or frangible (shatters on impact so it does not ricochet).

      i prefer my walther ppq 40 cal. it is kind of an updated version of the p99. it weighs about the same as my xd-40 sub compact but is a bit larger. it also has the swappable back straps to fit different hand sizes. it also features a 5.5 lb trigger pull and a .1 inch audible trigger reset. once you hold one you will want one.

      Many people fail to realize the responding police and crime scene investigators do not clean up for you. They take away the bodies, that is all. It is up to you to clean up all the bits of flesh, skull, brain and muscle as well as soak up the pools of blood. Youll probably need new carpet and wallpaper, plus fix the holes in your wall. You may even need a new home because the current one would be a tramatic reminder to your wife and kids. Is it really worth it?

      Besides the guy said he new one of the robbers, its alot more difficult to shoot someone you know, as he clearly had some compassiom for the kid.

      Actually, that’s not a bad point. I’ve been a “cancer patient” and am now a “cancer survivor.” I think, though, in this case, it emphasizes the point that he’s been through some tough times and is strong; is a survivor. I don’t think I’d mind it being a part of the story (if it was about me), but your point is well made and not without merit.

    Due to a mental illness, I have permanently lost my 2nd Amendment rights. I often wonder how will I defend myself against multiple attackers. I always sleep with a 2 foot long steel jack handle by my side…and with one eye open. And one thing’s for sure, I will never, ever start a family. How would I be able to defend and protect them? With a 2 foot long steel bar?? Give me a break!! And here’s some good advice: don’t run off to your favorite psychiatrist at the slightest sign of depression. Try to deal with it yourself. Get active in your community and your church. Read your Bible everyday and PRAY!! And if don’t work, then by all means, seek professional help!

      Kimber Pepper Blaster, legal everywhere, powered by a primer, effective to 13 ft. Pepper moves @ 90mph badboys can’t duck. Non- lethal, washes off with a hose pipe. Costs less than $40. Better first choice than a gun.

      The government has made it WAY TOO EASY to file for and receive, benefits for PTSD. Thousands of veterans are filing for it, for a wide variety of reasons. MARK MY WORDS YOU VETERANS WHO ARE CONTEMPLATING FILING FOR THIS DISABILITY, this will be construed as a mental issue that the government will use as a reason to prevent you from owning a firearm.

I adopted a germ shepherd several yrs ago and now it doesn’t matter if I remember to lock the door or not. Keep the faith.

      @KATZKINER: Pepper spray is a better first line of defense? I can see in his specific situation, but… really? Discharge that inside your home and there’s a good chance you’ll be blinded/choked by the spray yourself.

      Freaking brilliant. 90mph is not faster than a bullet — there’s still enough time to pull a trigger. If a person pulled pepper spray on me and I had a gun, I know what I’m doing…

      If you’re trespassing in my home, you have just one chance to get down on the ground, face-down — or you’ll soon have a surplus of lead and brass in your body…

      US NAVY VET. Honey, some people need help, but I’d go to a minister before I’d ever submit to the highly paid psych… most I’ve ever known had more problems than most of us.
      You’re right, get on your knees and pray. I’d tell you a story, but it takes too long, but the essence is: God answers prayer if you’re sincere. There’s never been a doubt in my mind about WHO GOD IS. He is the answer to everything.
      And, if anyone ever came into my house uninvited, they’d be carried out and my family know this and always knock or call first, so I don’t worry about them walking in on me.

      @Navy — I, too, am a retired Navy vet. I sleep w/several fighting knives as last resort, machete, and other weapons by the bed. I don’t hear well any more — too much time at the range, near USMC DIs, and ship noise. My cats are my alert system. They may not be much in a fight, but they hear really well!

      @ Navy — the CS canister is likely not legal, esp if it’s “ex-military.”

      If you are able, go back to the VA and get them to make your mental illness “cured” or reduce the percentage based on same. That should restore your gun ownership rights.

      I’m not accusing you just letting you know. Pot isn’t the same as it was 30 years ago. It causes signs of mental illness such as panic attacks, depression, and even schizophrenia. When one withdrawals from it, the symptoms can be really bad for several days.

      My Navy friend committed suicide but insisted the pot helped him with his mental illness. I bet it was the CAUSE of it. But, I didn’t know that then. So, I was thinking the knowledge could help you now. He went to every doc known to mankind.

      It is true about marijuana. Google it.

      Guys — on the federal paperwork for purchasing a firearm, there are questions that you must answer truthfully. One of those is abt mental health. Some mental health issues like bipolar, depression, schizophrenia, PTSD, etc., make you ineligible for firearm ownership. It’s not a state thing; it’s a federal thing. Once your name is in their system, you name will pop up as ineligible.

      The “Batman” killer fudged his paperwork to get his firearms w/which he shot up the movie theatre. His name was not in the federal database of ineligible persons.

      The only way around the paperwork is to buy at a gun show or buy fm a private seller. If you buy fm a licensed firearms dealer, they run a background check for your name.

      I’m in the same boat as you. May I suggest wasp spray (over a 20 ft. range, and it won’t form a cloud and get you too) and ordinary road flares (only if they don’t have guns, of course. If they only have knives, plus they’ll get a smell of their afterlife). Kitchen knives, canned goods, knick-knacks, anything that includes a good arm and a good eye. Practice up too. Wrist-rockets with pinballs. etc. The possibilities are only limited by your own creativity. ‘Home Alone’? No problem. In particularily difficult neighborhoods, don’t be afraid to set up booby traps. Remember, the element of surprise is crucial. Feel prepared and then you might not panic. The intruders will.

      Ah, yes, canned goods. The inmates I used to work with would tell of being “Jack Mac’d” in the night. A fellow inmate would put a can of Jack Mac (canned mackerel) into a sock and just beat the living daylights out of the intended target.

      You can get a good bit of velocity going swinging a sock full of mackerel over your head. However, only a firearm goes up against another firearm w/any hope of parity.

      Navy….due to your illness, I believe you cannot have ” concealed carry”. You can do rifles, shotguns, probably an AR or two. Check with the authorities. I will ask my gun coach when next I go to the range. God Bless You.

      I can relate to what you said because the same thing happened to an older brother. I mentioned once to a person I know that I have a concealed weapons permit. He said, Oh, is that so you can carry a gun? I said no, It’s so I can carry a gun legally. Come right down to it, a piece of paper is not going to stop me from having a firearm to defend myself or others.

      My State has outlawed everything. Pepper spray is considered a firearm as well as a pee shooter and sling shot. Also CO2 cartridges cannot be purchased anymore so they must be treated as gun power now.

      I would suggest either the Evanix Conquest 9mm, or the Benjamin Rogue ePCP. If you can find one used the Career 9mm ultra is pretty good as well with a couple of modifications. All are multi-shot airguns with roughly the power of a .38 special. The bullets cast by a Lee 356-102-1R mold work admirably and fly accurately (1/2″ group at 75 yds with my Career on a still day.) I have a 9mm and a .45 as my “apocalypse” guns since it’s hard to beat 30 rounds a minute with weapons that let you make your own ammo with nothing but some used metal and a campfire. They are not nearly as regulated as firearms in most jurisdictions, so unless you’ve been locally banned from having any weapons at all you should be able to purchase one legally. (check to be sure, of course.)

      Evanix also makes a .22 PCP target pistol that’s about as good as a .22 short if that’s more your thing.

    Since the two were innocently taking from those who have and distributing tho those who have not, I feel that they should be pardoned.

    These two fine upstanding citizens should run for public office to try and get their message out to those less fortunate who understand being poor, like themselves. They are only misunderstood in their ways of doing business as usual. How can they be blamed for such injustice in life and from this mans wealth that he did not create himself.

      I agree. The actions of these two were clearly taken out of context. Anyone with common sense knows that calling their actions bad have some political agenda. We should also note that calling people who do illegal things “criminals” is de-humanizing and shows a complete lack of concern for our neighbors.

      As for the money? These two should not have to pay anything because a penalty is actually a tax, and it is Obama’s responsibility to make sure that the 99 percent never pay taxes. The homeowner should have to pay a tax penalty because he utilized government services by calling the police. He should also have to pay for counseling if the experience of being held at gunpoint has long-term emotional ramifications on these individuals.

    Just one more story of why we need the fight for and keep our “right to bear arms.” The overwhelming majority of us (gun owners) have absolutely no intention of commiting crimes or hurting somebody. We just want to be able to defend ourselves when somebody is trying to hurt or steal from us.

    I don’t understand why our government doesn’t want this.

    Don’t worry, citizen. The powers that be will GLADLY take your money and my money to both incarcerate and “save” these two wayward youths. The road to hell is paved with good intentions (I guess). It would be cheaper and safer to let these idiots destroy themselves with their poisons of choice and pass into obscurity. And let’s be honest: If the two thieves were looking for drugs, they were looking for prescription drugs, not smack crack or pot.
    The addiction treatment scheme is a horrible, expensive joke based on emotion… not results.
    I would’ve shot with the assumption these two were armed and asked agents of the state to help clean up the mess. Happy ending.
    Maybe the two junky thieves should each be given a puppy and a pat on the head. They can sell the dogs and know that, no matter what, we’re still pullin’ for ‘em. Here’s some more money, private prison industry and substance abuse treatment charlatans!!!

It is outside Muskegon but in a more rural area to the north (near N. Muskegon) on Muskegon Lake near Bear Lake for anyone who was wondering also.
