Why Does This Texas City Want to Shut Down This Restaurant?

Citing numerous fire and safety code violations that the owner has dismissed as “baseless,” attorneys for the City of McKinney, Texas, seem determined to shut down Hank’s Texas Grill.

The 70+ violations leveled against the restaurant include state flags hung as decoration and “faded parking lot striping.”

Faded parking lines?

“Owner Ron Reynolds believes the city is making up reasons to shut down his honkytonk and is using overly aggressive police patrols to do it,” CBS DFW reports.

Considering how long the battle between the restaurant and city authorities has been going on, Reynolds may actually have a point.

“It’s very upsetting to hear they want to close our restaurant,” he said.

Reynolds sought a permanent injunction earlier this week that would keep firefighters and police off his property. But attorneys for the city claim it’s illegal for a business to sue municipalities because of code violations and asked the judge to shut down Hank’s.

“We’re just moving forward with our case and hope to get it done as soon as we can,” said City Attorney Mark Houser.

Luckily for Reynolds, the judge denied the city’s request and instead moved the restaurant’s hearing to next week.

“I would prefer to have it resolved as soon as possible but that’s between the lawyers that legal moves that they are making,” Reynolds said.

The restaurant’s owner’s desire to put this fight to rest is understandable.

“Earlier this month the court granted Reynolds a restraining order against the McKinney Police Department and others. Today the judge ruled that the temporary restraining order would stay in place for another week,” CBS DFW reports.

“But the judge also granted the police department’s request to once again allow officers to patrol the restaurant parking lot,” the report adds.

The ruling involving police patrolling his parking lot is the one that has Reynolds concerned.

“He referred to recently shot videotape that shows police officers congregating outside the restaurant, in an effort he says is meant to scare away customers,” the report continues.

“While the city denies the owner’s allegations of harassment, officers did enter the restaurant two weeks ago to investigate a bomb threat this despite the restraining order,” CBS DFW adds.

    This sounds like a property grab that can land these city officials and the Sheriff in prison. They better be careful and pray everyone is as stupid as they are.

      I actually live near that restaurant and it is a very popular place throughout the week. This isn’t the first time that restaurant has been in the news for supposed violations that were never substantiated. I see an underlining theme to this as an abuse of power. Curious about the outcome!

      Eminent domain = The city, county, state can and will take your property and tear it down to make room for some other business that will pay more taxes because your business is now in a fast growing area and your taxes aren’t as much as the business they will put there once they run you out = government run amok.

      Over zoning and crap violations signal that the owner *issed off someone at city hall or clear cut case of abuse of authority in order to take the property legally through eminent domain. The police congregating there is a clear cut sign to drive business away. Lackeys with a badge. Think of how many homes, businesses, or vehicles were being broken into or stolen while they stood around like gestapo harassing a Texas business owner and trying to drive business away.

      It may be a grab of some sort but usually these things don’t work out well for municipalities once the press gets a hold of them. Hank’s just needs to make sure it meets all the codes by any reasonable standard and guard against active efforts to shut it down.

      The owner should ask for County assistance as a mediator and get the city police out of it.

      Rothbardian_in_the_Cleve: So you get up in the morning and put on the uniform and go to work. At your morning briefing you’re told of the need for your unit to patrol the restaurant because of potential violations and patrols will be done this way: fill in the blank.

      According to your thinking the police are allowed to think individually and choose not to enforce the patrol because they think it’s wrong? I’m not saying there aren’t union thugs in the police department, but there’s union thugs in every place that has unions. The teachers union is a prime example and in particular public unions are rife with thugs. In my state it’s the teachers and communication workers that run the state. TThuggery and intimidation is how they get their power and why, among other reasons, public unions should be illegal.

      Whether they are union or not is immaterial. The princple is:

      “I just work here.” “I was just following orders.” “The other guys will be pissed if I don’t play along.” “I’ve got a wife and kid to think about.” “I’ll lose my job.”

      IS NOT AN EXCUSE FOR DOING EVIL!

      The moment that any of these officers realize that what they are doing is harrassing a citizen at the behest of some ticked off city councilman, or angry town big wig, then it is their duty to DISOBEY the UNLAWFUL! order.

      If a public servant knowingly enters into this sort of thing, he becomes a Thug, and loses all credibility. This type of corruption is a deal breaker, and misapplied justice is what starts riots and revolutions.

      The police officer “just following orders” is just as guilty as the power hungry twit issuing the orders.

      Seems to me like there is more to this story than what is stated in the article.

      The best I can make out is for some reason police officers are constantly patrolling the parking lot of a diner; because he hangs up flags and has faded parking lines.? With our new totalitarian style of governing here in America I can understand how the county itself is trying to shut down a business owner for a bunch of minor infractions, but why are regular police officers constantly badgering this man and his patrons? Is the county sending these jack booted thugs to this diner to cause him even more trouble? LoL; I guess that wouldn’t surprise me either…not any more.

      A friend of mine had a bar and restaurant that was in a rather mediocre location, but only about 100 feet inside one city, with another smaller city butting up against that city limit. About ten years ago or so there was a nearby major proposed business change, and suddenly his location looked to be a prime location for others. Both cities began to harass his business and often had both city, and country patrol vehicles waiting to pounce on anybody pulling out of his parking lot. One night they snagged four cars in a row and all four were his employees making runs to pick up suddenly needed supplies. Two of them were off duty cops from yet another town, working security there. They were severely harassed. After a lengthy harassment campaign causing the loss of a lot of business he finally gave up and sold the property yet getting a decent amount from some other potential investors. The larger business proposal faded into the mist never even getting off the ground, much less coming anywhere near to fruition. No, the city, county, and state no longer collect taxes from his once thriving business. The city’s drunk of a mayor is gone now too.

      Well, let’s all put our money where our mouth is and CALL THE GOOD FOLKS AT THE CITY HALL AND TELL THEM WHAT YOU THINK. Better yet, email them telling them that YOU WILL NEVER VISIT THEIR TOWN IF THEY DO NOT LEAVE THAT PLACE ALONE (provided he keeps his restaurant up to code).

      If they get enough emails, THEY WILL GET THE MESSAGE.

      I dont really see what the problem is. If i was living near that restaraunt, I would be happy the police were doing this. I DONT WANT TO LOOK AT FADED PARKING LOT LINES!!! If I paid a lot of money to live in this area, why should I have to look at trashy faded parking lot lines and stated flags. IF I DONT WANT TO LOOK AT IT, IT SHOULD BE ILLEGAL!!! Don’t people get that??

      Sure there are some good cops but they are in the background doing their jobs. Unfortunately, for us, as someone said here, a lot of cops are baton wielding union thugs. I will add to that innocent dog shooting, legal gun owner hating, home invading, “legal” gangsters – especially the SWAT types. Someone aptly stated “What do you call a place where only the cops have guns? Answer: A police state. The militarized robocop types are multiplying and they are being “armed to the teeth” – by us, the taxpayers. Here we have a political police chief sending his goons out to harass a a business owner who has fallen out of favor with somebody, or, as someone said, maybe somebody covets his property or maybe a well connected competitor want his competition eliminated. The governmental corruption in this country is growing like weeds in the springtime.

      Live near club also, no problems any more than any other place. This city has a government that always does as it please. Keep financing a airport that loses money just so an ex city council members can sell fuel. stop Spouts Grocery from coming to mckinney because some homebuilder wanted the spot of land. Nice it seems on the outside but government leans to the dark side.

      Every freedom loving patriot in that area should go to Hanks at least once a week. Hanks should also file law suits for violation of his civils rights,state and local corruption,exortion and violations of the public trust in that the local government is using tax payer dollars and tax payer employee in what is clear a vendetta against a private citizen. The people in this community and the surrounding communities should ban together like Franklin said if we fail the come together we will surely parish alone.

    That community needs to stand with Hank! Do a petition or something. I am sure he is loosing money big time with cops hanging out in the parking lot. Not to mention the lawyer and court fees. Tax payers should be outraged. This kind of crap from the gov. needs to be stopped and not allowed to even happen. The media should be all over it.       My husband works for a small business owner (under 50 employees) and the city hit him for his parking lot (which is for employees only, the business isn’t one that has customers, they make a product and send it out) for not having the right kind of asphalt, lines, etc. And of course, you can’t do it yourself, you have to hire the city to do it. And yet, we have lanes on the public roads that don’t have the little arrows that tell you whether it’s a straight, turn only etc. So why does the city get to have laxer rules than businesses? And this is Texas, the most business friendly state in the union.

      Looks like a clean place to me. The accusations about the painted lines look to be absurd, and the place appears to be clean on the inside. The owner does in no way seem to be a dirt-bag.
      We need more info on this, but it could be a case of the city wanting the property fora crony.

    Confused? Is this a case of the city government taking private property? If so, the mayor is misusing his authority by using firefighters and police in this manner. This should be decided in the Court system without abusing citizens rights.

    Firefighters are paid to fight fires; Police are to keep the peace; so, why are they on this parking lot? Is there an emergency? Where are the citizens in this town? This Mayor needs to be recalled for using these emergency responders in this way. Cities are going bankrupt; this story sounds as if the Mayor is misusing funds and its emergency responders budgets to fight this issue instead of using the Court system to solve this issue.

    This is an incomplete story. ? Let’s start with some more complete history to why the city wants this property.

      I agree. Need some background. I am a little tired of hearing people run down police. I don’t happen to believe that the police, in general, are knuckle dragging, tobacco chewing, dentally challenged in breeders any more than Tea Party’ers are. I do believe they are a targeted group of people. I know they are armed and trained. Makes liberal sense that we should take each other out ( we all know liberals hate guns). So…Pit us against them (us). It’s like a twisted game. I’m not playing.

      bet this owner said something about taxes & spending..too much of the first and a tsunami’s worth of the second. THIS ruffled the feathers of both the police and the firefighters…..I work in a pubic place, alone mostly, and have told the police my thoughts on taxes & spending- I hurt their feelings, and this is conservative SW Ohio.

    It must be hard to be a cop. Sitting in a patrol car all day surrounded by electronic gadgets that they will never understand. So they use their cars as battering rams. Having to get out of their car and puke their guts out because they haven’t shot an innocent person in almost 12 hours and the withdrawals are severe. They encourage crime, otherwise they would be out of a job. There they sit, surveying the population, knowing damn well that everyone is guilty, giving cops no alternative but to use their sidearm. Then having to file that tedious paperwork where they cover each other’s backs in keeping with the unspoken cop code that a fellow cop is always right. If they can’t beat up another citizen, then they will instigate domestic violence at home. They just hope that when their wives wake up from their coma in the hospital that they will not remember how they got there. Remember, the cop brain knows no equal, holds a limited vocabulary, and their dark hearts harbor contempt for those without bruises, broken collar bones, and with no chains.

      A little out of order aren’t we, V-15?…. There are some bad in every walk of life, but you are way out there with your comments about police. I’ve been stopped on my motorcycle for going into a non-passing lane when a conversion van pulled out in front of me from a shopping center. When the cop walked up and asked if I knew why I was being stopped, I said “I suppose because of passing the van that pulled out in front of me.” I said that it was marginal and that I had momentum to carry me right around the van with no safety problems. I was polite, and he, knowing I was right, just looked at my reg/dr lic/ins card and said ” have a good day.”
      So, they are not all smart asses. If, however, as we descend into anarchy, if you are concerned with a police state, and that some cops may enforce laws concocted by the ever-more-oppressive federal gov., then I share your concern.
      For instance, if we elect this communist to another term, and he gets a chance to enforce the UN Arms-Trade-Treaty and eventually confiscate legal gun-owners firearms, then police will need to consider whether or not to knock on your door to recover what is legally yours according to the second amendment, and you will need to decide whether or not to give that gun up.
      That concern I share with many freedom-loving Americans.

      It works both ways: Crime creates police and police create crime. Maybe there are some good ones out there that I have never met. All the ones I know of beat their spouses, carve their ex-wives’ name into the side of the .40 round, beat up co-workers, shoot and kill unarmed citizens, etc. So, yes, police create crime while they attempt to prevent it. It comes down to this: The police want to be the only ones able to commit crimes; they are the largest gang in the United States.

      Way off topic but…..

      Does anyone know the best pop-up for a Mac? I use ghostery (which works great!) to defend tracking. But I tried adblock plus and had to disable it. The problem is I start protecting so much that I can’t get what I’m trying to see/read/play to pull up.

    I wonder if all the OTHER CRIMES in that area are being pursued by the police with as many man hours as these parking lot patrols focused on Hank’s “fork and spoon” operation…

    Hard to believe that a police department’s “show of force” targeting a restaurant can be anything but unwise and a waste of the people’s crime fighting resources. If the police are being used to harass and intimidate property owners so the city can take their property, that would be evil.

    Let’s hear the “rest of the story”.
    From the video, the place looks reasonably clean, parking lot looks pretty good. I’d probably say its even better than some or most. It had good outside lighting, and the kitchen, even though the tape was short, it was orderly.
    So, what is the story about? Obviously the Cops are gooning this place really hard. There’s more to the story than going to court. Somebody has peed in somebody’s western boot.

    Now, what’s the rest of the story?

      When city Government behaves like that it could only be one of two things, either the business owner has a personal problem with the mayor or a city councilman. Or the city wants the property so they can generate more tax dollars by some other use of the property. In this case it could be both, so far there is no mention of a buy out or offer for the property through eminent domain normally they say so. More info would be helpful but because nothing more is being said at this point I think it’s a tiff with the mayor.

    McKinney does this a lot. They shut down my favorite shooting range located way out along the middle of the highway, no where near residential housing. They were not violating anything, the city just wanted to zone them out of business.

    I like Hank’s a lot and hate to see the city win.

      Hanks looks like a very clean & fun place.

      The police are willingly letting themselves be used.

      They need to fire the city attorney. The need to throw the mayor & councilmen out of office. The police chief needs to be fired.

      The expanding airport downrange might have had something to do with the range closure. Ticked me off as well.
      Regarding Hanks, yeah, they didn’t grease the right palm somewhere. I cannot imaging that little corner being any more valuable than the vacant lot on the NW, the gas station and strip mall on the NE, and the car dealership on the SW. Something doesn’t add up.
      I like the place and surprisingly, don’t mind the extra police. My truck was broken into while watching Dale Watson one night. No problems there for me anyway for a couple years now.

    That is a VERY valuable piece of property… The place is a little run down looking, but its adjacent to new retail. Not uncommon in DFW to run people off for “The common good”

    I would have liked a little bit more of an in-depth look at the entire picture (i.e. see each listed violation (even if it is just a link to it) and has anybody had an independent unbiased inspection done?) We need some idea of the validity of the 70+ violations before an informed conclusion can be drawn here. Incidentally, you have to maintain your parking space paint in my city also.

      yeah i think its important as cookie thornton from kirkwood MO was harrased by local government enough that he took action with a gun and killed many people in the court….he likely wouldnt have been pushed so far if it hadnt been for government harassment. i saw similarities. my bad. we should all be outraged at small government who takes things to the extreme. such as this case and cookies case. besides, this aint facebook. this is supposed to be real news, no bias. why take down a story you thought worthy enough to post in the first place

      My point is that YOUR link as I saw it ….was a Blaze link. Was it originally? Or was it a link to another site?

      The Blaze, in the past, has posted stories of gov’t over-reaching. If they posted @ 9pm then pulled the story- then re-posted at 12:35am; then for clarity – perhaps The Blaze should say so.
