Conservative’s Anti-Jihad Subway Ad Leads to New Policies: NYC Authority Can Now Ban Ads That Could ‘Incite or Provoke Violence’

The epic battle between American Freedom Defense Initiative executive director and blogger Pamela Geller and The Metropolitan Transportation Authority (MTA) culminated with a court decision that forced the transit authority to permit the display of controversial ads about radical Islam. But the story didn’t end there. As TheBlaze reported this morning, Geller’s case caused the MTA to rethink the manner in which it handles First Amendment issues, leading to the adoption of some potentially-controversial measures.

On Friday, TheBlaze spoke with a spokesperson who confirmed some of the details surrounding the case, while clarifying the new changes that passed on Thursday. As noted, one of the emergent provisions that was added into the public company’s advertising standards in the wake of the Geller debate allows the MTA to deny ads it believes could incite violence (this was not mentioned in the press release the agency put out about the changes).

As previously noted, a document, reflecting yesterday’s changes, was provided by the MTA to TheBlaze this morning. It highlights the transit authority’s advertising standards and reads, in part, “The licensee (‘advertising contractor’) shall not display or maintain any advertisement that falls within one or more of the following categories.” One of the category sections reads:

The advertisement, or any information contained in it, is directly adverse to the commercial or administrative interests of the MTA or is harmful to the morale of MTA employees or contains material the display of which the MTA reasonably foresees would incite or provoke violence or other immediate breach of the peace, and so harm, disrupt, or interfere with safe, efficient, and orderly transit operations.

It is the portion presented in bold that is new to the regulations. It’s inclusion is interesting for a number of reasons. On the surface, it appears oddly placed in the list of grievances that could lead to the banning of an advertisement. Furthermore, there is some ambiguity regarding what led to the inclusion of the “violence” reference in the first place.

In an e-mail reply, MTA spokesperson Aaron Donovan told TheBlaze that the change was among the “outstanding issues” that the agency was looking to tackle in the new regulatory document.

“Since we hadn’t updated our advertising standards in 15 years, we used this opportunity to address several outstanding issues or potential hypothetical situations,” he wrote. “This is one of them.”

TheBlaze responded with additional questions about the motivations for the change, asking how, in particular, the MTA’s court battle with Geller impacted the new restriction on violent ads. Donovan responded, admitting that the dilemma did play an integral role in the decision to make the change.

“The ad, and more specifically the litigation surrounding it, caused us to think about a variety of potential scenarios and review our standards more carefully within a prism of First Amendment law,” he commented.

Considering that the MTA has made its opposition to the ad’s message known in the past — and taking into account continued calls for bans on blasphemy and offensive messages — the natural question is: Will this new regulation serve as a backdoor method for banning controversial ads that take aim at specific faiths, like Islam?

To gain a better perspective, TheBlaze asked who would be involved in the process of defining which messages incite violence and what the metrics for doing so would be.

“It would go through the same process we currently use to determine whether ads meet the overall guidelines,” Donovan explained. “Ads are submitted to our advertising contractor, CBS Outdoor, for posting and approval.”

Once the ads are submitted, Donovan said that CBS then decides which ones need to be scrutinized more closely to ensure they meet guidelines. Considering the other MTA regulation that was adopted on Thursday — the requirement that political, religious and morality-based ads include a disclaimer separating their ideals from the agency’s — the spokesperson said that CBS would also be involved in flagging ads for that purpose.

“The MTA’s final determination is made by the MTA’s Director of Real Estate, in consultation with CBS Outdoor (our ad contractor), the MTA’s General Counsel, the Chairman, and others he may choose to consult with,” he continued, highlighting how potentially-violent ads will be assessed.

Still, considering these elements, the issue needs further exploration. The language seems fluid enough to present further First Amendment battles in the future — especially considering the guidelines’ subjective nature.

    That’s the entire nature of the anti-jihad campaign. To bring attention to their deadly tactics and to say NO!. What’s offensive about that, and to who?       Obviously, under this new regulation, if the MTA has any Muslim employees, they can claim an ad hurts their “morale” and the ad will be quashed. Will the same hold true for anti-Catholic ads, or anti-”creationist” ads or anti-abortion ads? How about ads that dare to use words such as “Christmas” or “Easter” or “God”? How about an ad that hurts the “morale” of and Obama supporter? Will they be refused by CBS and the MTA? Why not just eliminate all advertising in MTA facilities and vehicles? Then they won’t have to make any decisions at all. Of course, they also won’t get the advertising revenue I’m sure they crave.

      I don’t know why the universities do nothing, or, almost nothing to stop these actions by the muslim
      societies since much of the university operating dollars come from FEDERALLY BACKED (government), STUDENT LOANS, and are under the federal laws (government), against using hate speech.

      If the universities do almost nothing to stop this hate speech why then should MTA, also a government run business try to suppress this on their subway cars and stations.

    Clearly the MTA has created a backdoor to censorship, but given the climate of intimidation emanating straight from Obama and the White House, first by demanding google remove the video( which google refused to remove) Obama’s apologist speech at the U.N. ( no one should slander the prophet), the lies about the events surrounding the Libyan terrorist attack, and now the scapegoating arrest of the egyptian born filmmaker on flimsy probation violations, violations that would not normally garner such attention from the courts, you really can’t blame the MTA for not wanting to take the heat alone, especially when their own government is trampling First Amendment Rights and siding with censorship and repression. The MTA has a tough job already, the New York City subway is a jungle, an urban war zone, everyday is a battle down there. I can understand their not wanting to inflame the crazies, but in America we have freedom of speech, and to capitulate to censorship is wrong even in the New York City Subway.

      Interesting that Obama tried to get the video taken down when apparently someone connected to Stanley Inc. (BIG government information technology contractor), put the video up on Youtube on Sept. 11 and had for weeks apparently been dickering with changing the name of the video. Check out Proof Positive on YouTube, sounds very far fetched until you start stacking up what has happened since the release of the video in early July. Questions for the media, find out exactly who put up the video out of Alexandria, VA on a hyperlink on Sept. 11, 2012, and WHY? Many it’s nothing…and maybe not.

      The NYC subway isn’t a war zone & there are no regular battles there. I lived in NYC until 2 years ago. My closest friends live there now & ride the subway every day. Since Giulliani cleaned it up when he was mayor, the subway has been a fast, safe, though increasingly expensive, mode of travel. Even the wealthy use it because of the speed (traffic is horrible in Manhattan). Mona Eltahawy committed vandalism. Graffiti artists aren’t appreciated in NYC: they’re arrested & sent to jail regardless their affiliation or politics. She also assaulted another woman; I hope “Pamela” presses charges, I would. Ms. Eltahawy broke the law. she wasn’t forced. She deserves to go to jail. The MTA may try to wimp out & avoid the 1st amendment thinking NYC is fair ground but it’s not Dearborn, MI. I don’t think they’ll get away w/ a policy change.

    If they are going to ban ads that could incite or provoke violence, then the ads for the movie “Django Unchained” should be banned.
    It’s coming out in December. That movie may very well cause Black on White violence.

    this is not hindering freedom of speech in any way. you can walk around with that sign, put on your t shirt, your front lawn and no one can say anything. if a corporation, establishment, company, does not want to accept your money to put up that sign, they do not have to. that is their right.

      However, they can be exposed by having similar protests at other ads thereby holding up traffic the same way they suggest this ad does/would/may. If they refuse accept that the same result was from a contrary ad and they don’t ban remove/it , having experienced the same result then they are exposed as discriminating. It’s easy to expose/defeat.

      CDN1979, that may be true for a private entity, but the MTA is government and as such, if they were to deny an ad due to a political viewpoint, that would be in violation of free speech.

      Not in this case. Public agencies and public accommodations CANNOT engage in prior restraint of free speech. If the MTA decides to defend the policy, the MTA will go to court, and the MTA will lose again; that is why they lost in the first place. This is exactly what liberals always do: demand that we conservatives and libertarians respect the law, but when I decision goes against them, ignore the case law, fight it in court, lose, make cosmetic changes and repeat the cycle.

      This is nothing more than lawlessness. The MTA has already been told what their legal obligations are under the Bill of Rights. They need to stop denying the First Amendment rights of advertisers with whom they disagree.

    Anyone believe if the ad had read something like “In any war between Believers and Non-believers, support the peace and acceptance spoken of by the Prophet. Support Islam and Sharia. Defeat intolerance and hatred.”, that the MTA would ban it? I’d guess not.

    What crystal ball will they use to predict what words will invoke violence?
    If they look back in time and see that a certain community is prone to violence are they then not giving veto power over this subject to that community, to the detriment of the less volatile Communities?
