SAN FRANCISCO (AP) — The Department of Homeland Security is planning to issue a policy memo stating that illegal immigrants with American same-sex partners are eligible to have their deportations put on hold under a federal program designed to focus resources away from low-priority cases.

The move had been sought by gay rights activists and their allies in Congress before Homeland Security Secretary Janet Napolitano announced plans for the policy Thursday in a letter to 84 Democratic lawmakers.

“It will mark the very first time that lesbian and gay couples have been recognized within immigration policy for relief,” said Steve Ralls, the spokesman for Immigration Equality, an advocacy group for gay, lesbian, bisexual and transgender immigrants.

The Democratic lawmakers addressed in Napolitano’s letter pressed the agency to inform Immigration and Customs Enforcement field offices that bi-national gay couples in long-term relationships have family ties that should be considered as grounds for deferring a foreign citizen’s removal from the U.S.

“I have directed ICE to disseminate written guidance to the field that the interpretation of the phrase ‘family relationships’ includes long-term, same-sex partners,” Napolitano wrote, adding that the decision to grant reprieves still would be considered on a case-by-case basis.

The instructions do not mean that foreigners who are married to Americans of the same sex will be eligible for green cards or citizenship, as are immigrants with opposite sex spouses. The Obama administration is continuing to enforce a 1996 law that prohibits the government from recognizing same-sex marriages, even as it opposes it in court and takes gay relationships into account when evaluating deportation cases.

The Williams Institute, a think tank, estimates that as of 2010 there were about 29,000 same-sex couples nationwide comprised of a U.S citizen and a citizen of another country.

The policy guidance expected to go out next week will reference a memo ICE Director John Morton issued last year advising the agency’s officers and lawyers to review pending deportation cases to determine which ones should be top priority and which ones might be shelved, Napolitano said.

Government attorneys weigh factors such as a person’s criminal record, family ties and community relations in making their decisions.

ICE officials said at the time that long-term same-sex relationships could be included under the family ties criteria, but advocates and House Democrats led by Minority Leader Nancy Pelosi wanted that determination put into writing.

know what good our federal govt.actually is. I truely think we would be better
off without Washington DC. We have the absolute dregs of society running
our country. Maybe it’s high time to clean it out and get rid of all the alphabet
soup agencies that are trying to enslave America.

  We would be better off if 80% of the DC pigs got fired because most of the government is unconstitutional and shouldn’t exist. The hogs in DC will continue spending us into a depression of this I have no doubt. Most of them don’t even know what their role is supposed to be and it damn sure isn’t regulating businesses out of business like they always do. The government is bloated and needs to be cut down to size they’re supposed to be our servants not the other way around and it’s time they learn their place.

  Ahh, all the conspiracies and doomsaying. It’s not real. Denmark was the first nation to give gay couples recognition. In 1989. God has had 23 years to smite them from the map. They’ve had 23 years for the degradation of morality to increase violent crime. (Their crime rates per capita is way lower than ours.) The Vandals who sacked Rome (supposedly for allowing homosexuality) have been surprisingly non-threatening toward Copenhagen.
  
  Gays in America aren’t a real problem. A very real problem is government overspending. This will allow the government to spend less time and money on deporting low-priority aliens. Conservative leaders are fooling you into ignoring progress the government is making toward reducing the deficit.

She will engage in an “in depth, oral interview” with each lesbian candidate. She will get to know them personally and know all kinds of “intimidate details” about each female. She will discover their hopes and dreams and what turns them on and off.

  How much more can we expect from the administration? They have given us numerous clues as to how they will operate if they are re-elected. The actions of Obama have proven to be a death knoll for the USA with the loss of jobs,illegal imigration,lowering of our credit ratimng for the first time ever, Fast and furious guns given to criminals causing deaths,including one of our own. The Libya Embassy mishandling began when they knowingly sent AmbassadorStevens to a country without a security net, then tried to cover it with lies and more lies. The attacks on Christians by Obama by imposing birth control compliance on Catholics, knowing it is against their religion is a slap in the face to all religions, for they will be next. The snubbing of our allies in England and Israel is the last straw and leaves Israel out in the cold. Obama is a scourge on our country and it’s time for him to be out in the November election. He is not representative of the American spirit that has been upheld by many who fought to keep it alive. What gives DHS the right or power to make laws oh yeah the same person who gave them the power to enforce laws and made them his personal army his own panzer division with their new APC’s better than what the military is using in afghanistan.And there are pictures of them being ready for use.But what do they need upgraded humvees and apc’s for give me a logical explanation someone I can’t think of one that makes me feel safe even if they do say rescue on them.

  Lol, straights have been doing that for years. And that’s why they make sure you’re in a real relationship, otherwise it’s fraud or something and the American will be punished under the law and the alien deported. They’re going to have the same process with same-sex partnerships.
  
  To use a less than stellar conservative argument: They won’t be granted special rights, because straights would then be allowed to pretend that they are in a same-sex relationship with a friend.
  Would it be meaningless, yes. But the conservatives who use that argument seem to think being able to enter a meaningless marriage/relationship is equal to marriage with someone they genuinely love.

Has any body made the point, that you are paying taxes to a government that is suppose to defend our borders, but instead chooses to use you as guinea pigs to determine if the illegals are hard core criminals or not?
Then this same government uses your taxes to support the illegals. For them, the non citizens ,it is a win-win. For you, a citizen, if you are hard pressed to pay the taxes, they will use your tax money to hold you to the fullest extent of the law, to pay your taxes.
