Landmark Calif. Burger Joint Forced to Shut Down Over ADA Lawsuit

A decades-old Sacramento, Calif. burger joint is shutting its doors for being out of compliance with the Americans with Disabilities Act because the owner says he can’t afford to bring it up to code.
Ford’s Real Hamburgers has been slinging burgers, fries and shakes for years, but was hit hard in the recession. Now, KTXL-TV is reporting that a local attorney who makes his living filing ADA cases — many on his own behalf — is suing the restaurant — and Ford’s can’t keep up.
“We scrimped and saved and cut down the staff. I’m down to six employees,” owner Hank Vereschzagin told KTXL.
As the station noted, Ford’s is indeed out of ADA compliance: There isn’t enough room to roll into the bathroom in a wheelchair. But Vereschzagin said he just doesn’t have the money to fix the more than 60-year-old building.
“I don’t know. I don’t know what I’m going to do next,” he said. “I just know I can’t keep this open.”
Scott Johnson, the attorney filing the suit, didn’t comment to KTXL about the Ford’s complaint, but he did speak to the station earlier this year when he was suing a diner.
“Being a quadriplegic, there’s nothing I can do about that,” Johnson said in February. “But these businesses that have structural barriers to access, that’s frustrating.”
Jerry Silvia, a longtime Ford’s customer who is paralyzed from the chest down, said the lack of accessibility has never stopped him from enjoying his regular order: a 1/3-pounder with fries.
“I’ve been coming here 21 years,” Silvia said. Of Johnson, he added: “He’s strictly crusading on his own behalf.”

Posted on September 30, 2012 at 3:35pmThe problem is that even if enough volunteers would step forward, the costs for obtaining the necessary permits would be prohibitive. While I firmly support a requirement that businesses make “Reasonable” accommodations for disabled employees, to demand that a business make unreasonably expensive ones for customers is idiotic. There is supposed to be free enterprise in this country. That means if you don’t want to do business with a company, you don’t. If they don’t want to spend the money to attract your business, you go elsewhere. How many businesses have been put under by these stupid lawsuits? How many jobs have been lost over them? I know of one shopping center that was going to reconfigure one store to accommodate the expansion of the adjacent restaurant. The entire thing went away when it was pointed out that the new bathroom that they were planning as part of the remodel wasn’t going to be ADA compliant, they had to drop their plans because of the cost of redesigning the plans. The store owners had been fighting the plan for years but their attorneys had told them that the plan was going to go through. Then the store manager looked at the shopping center contractor and said “You had better check to see if the new bathroom is up to code per the ADA.” It wasn’t and the entire plan went away.

My wife and I were looking at an old house to turn into a beauty salon for her (she’s a manicurist). The home on the property is built on a hill (like all in the area). There is very little parking anyway, very old town. We were told we’d have to put an ELEVATOR in for handicapped people. She has older female clients, some in their 80′s & 90′s and none need an elevator. It would have cost over $200,000 to renevate in order to comply. And, it is zoned for business. THIS IS CALIFORNIA.
And for the folks that simply say, “move” F-U! We CAN’T move. There’s many like us that are trapped. That’s part of the “-ist” and NWO plan. We’re friggin trapped. I can’t believe the idiot that recommend this business owner “just move”. Obviously, if he can’t afford to keep employees or keep up with rapidly changing/expanding government codes, he CAN”T leave either.
I’m not looking for sympathy, but so many people don’t realize what it’s like when so many liberties are being taken away. Regulations = bondage.
And, in CA, if/when this man can make the changes…guaranteed next year the codes will change from a different agency. Small business is under SEVERE attack.

Stop seeking “privilages and immunities” by organizing under the government and tell them to buck off when they tell you otherwise. He consented to the rules when obtained a business licence and organized as Corporation or LLC.

Posted on September 30, 2012 at 7:23pmNot sure about the overreaching “codes” he may have there but my first thought is to rent a handicap porta-potty. He could put it right near the handicap parking space! It would only cost about a $100 a month which would include maintenance. Depending on where you are, these accessibility laws only kick in when you remodel or significantly change an existing out of code older building, with some exceptions.
If nothing else it could help him keep his doors open long enough to bring this to a public debate, outreach and shine yet another light on the overreaching unfriendly government.

The rest of the country is catching up with all these unreasonable demands of a business. Seems like if you can’t use the facilities, you’d go someplace else and let those who are happy with the place keep using it. This is just common courtesy. What do I do when I’m around jerks with too much perfume on? I leave, period. I don’t have a lawsuit or get pizzed like some of these people do who can’t be accommodated to their liking.

He traveles around California looking businesses to sue…he usually settles with easy businees for several thousand $$$. This how he makes his living…sueing…businesses. I’m agreed with you about getting who you voted for, however if that was directed at me; my wife and I have never had the people/propositions we vote for come into being.
Most often, when we engage in conversations regarding “real stuff” people have literally said, “I just want to put blinders on and go about my life.”
It’s aweful that CA was once “the place” to go to start over, start a buisness, get a job, a shot at success, farming, etc. Now, it’s every race except whites, different languages everywhere, a severely corrupt (like Chicago) government, huge gang/drug trafficking problems, people breeding in order to get paid $500 a kid, buisness go under constantly.
btw: Asian businesses have a HUGE start-up/go-under rate. Where/why do they keep getting loans? Even their banks change names every 6 months. Money laundering…period.

Posted on October 1, 2012 at 1:49amLet’s hope there is some smart, aggressive Rental Agent/Mall Manager in Sacramento who has a vacant store, ready to go, totally compliant who will give this man about a year’s worth of free rent to get him in there and bring his followers with him to the Mall…with photos and other memorabilia …same colors etc. Can’t you see a bigger than life size photo of the sign, the History of the store on the walls? But now able to accommodate wheel chairs, and yes, I think it’s okay to make concessions to do that !! Once I had to be in Wheelchair (sprained ankle) and I got a healthy respect for what it was like. SO make lemonade. Let him move his business to a modern facility, complete with HVAC/parking and compliant bathrooms etc. and fire up that grill !

Fact is if handicap people want larger doors to the restrooms they should gather a fund and ask the manager if he would agree to get the work down at their cost.

Has your wife considered a traveling salon for her older clients?You wouldn’t need all the permits and probaly would be less expensive.I don’t know how it works in CA.Here in Va she could do that quite easily.We have some who do so and make good money at it.The insurance I think is a little higher but is offset by not haveing the headaches of clients at your home.Not only the legal headaches but the personal ones as well.I also think the business license may be a ltlle higher[may be wrong about that though]
It may be worth looking into.

Posted on October 1, 2012 at 11:15amIt is terrible when you are recognizably ‘different’ from others. You have challenges that others don’t face every day. It doesn’t matter if that’s a physical difference, emotional, mental or sexual one.
What we’ve lost here is the ability to be reasonable and rational. People with physical challenges want to be ‘normal’ so they get laws passed to make accommodations to environments that let them be more ‘normal’. There’s nothing wrong with that until they cripple a normal person (or persons) with the laws. It’s one thing for a large Hotel or someone building a new building to incorporated these features into the structure. It’s an entirely different matter to shut someone down because they can’t afford it. Now the group that says they are bullied is the group doing the bullying and it’s just wrong, we all know it.
It’s the same thing with the homosexual therapy issue. Nobody is holding a gun to the head of someone going into such therapy but the groups pushing for more power, more ‘normalcy’ see it as a crime, quackery, or whatever and THEY bully those looking for that kind of help by shutting down their options.
We have lost the ability to reason. We have lost the ability to see rational solutions, simple solutions, in favor of the guilt solution. We have lost the ability to say no to those outside of the ‘normal’ median of society. Welcome to tyranny of the minority.

This sucks! Really sucks! I also thought that there was a clause that only required ADA compliance if it was reasonably fees-able for a business to do so?

Or, maybe he could shut down, sell off the assets, declare disability and live off the government dole for awhile, or forever. This is what the government wants, right? This should also be a lessen in why you should incorporate your business, otherwise the lawyers can come after your house, car, and your grandma’s jewelry. To MetalPatriot, you can get out. There are no thugs with guns at the border saying “No!” (at least not yet, give them time). It might be rough, it might cause a financial loss in the short term, but the long term benefits of moving somewhere free should far out strip the temporary economic set back of finding a way to liquidate and switch employment.

Posted on October 1, 2012 at 2:22pmAgain, the focus is on the symptoms and not on the root cause. There should be no laws about accommodations for the disabled or anything else. Nothing beyond natural law/unalienable rights is needed. A disabled person has no “right to a burger.”
Some of you may agree with that. But search your hearts. Somewhere, in some way there is a law, just as unreasonable as others you may decry, with which you agree.
The thing about freedom is that it must be universal. It must be simple. Live and let live. Force for defense, only. The nonaggression principle. Stop trying to control others. If someone’s doing or failing to do something you think he should and he’s violating no one’s rights, stay out of it. It’s none of your business. You don’t get to decide what’s good or reasonable for anyone but yourself.
But, then, if you believed these things that I believe, we wouldn’t be losing our country.
The fact that an argument can be made that someone should do something, like make accommodations for the disabled, doesn’t mean we can force him to do so. The disabled, and you who would care if an establishment were allowed to exist that doesn’t cater to them are free to boycott it.
You morons who think laws like those intended to help the disabled are reasonable are the ones responsible for the slow, painful, tortuous murder of liberty. I look forward to watching you burn in your self-created hell.

So, let’s see if I get this… A BUSINESS is COMPLELLED to comply with every aspect of the ADA – so that ANY handicapped person can fully “enjoy” the business, but that SAME handicapped person is under NO OBLIGATION to ever GO to that business!
The Business OWNER(s) is/are SCREWED, with NO GUARANTEE that they will EVER recoup the cost of compliance from those for whom the compliance is mandated!
It’s ONE THING for GOVERNMENT BUILDINGS/facilities to be ADA compliant (so that ALL citizens have equal access to our Government and its services), but it’s something else altogether to FORCE PRIVATE BUSINESS to comply with these regulations!
No Shoes, No Shirt, No Service!

NOW it’s No Wheelchair Ramp, No Handicap Restroom stalls, No BUSINESS!
I’ll be DAMNED if I’ll put one of those CO2 detectors (mandated by MY STATE) in MY HOME! AND I think I’ll add a few steps (up, then down again) on the way to my front door – JUST to keep wheelchair bound people AWAY!

When people get the idea that they can get millions from just filing a complaint and not have to work for it we get these people. People who never contribute , they only use the system to take other peoples money. As for the disabled view I understand how frustrated people can get but forcing a man out of business because the lawyer wants more money is ridiculous. Say you host a party at your house for a friend, a guy in a wheelchair is invited. He sees your bathroom and calls his ADA specialist lawyer, and you get sued for twice as much as your family home is worth. Because your bathroom is ADA non-compliant you have to pay the $$$$$$$$$ AND the lawyers fees. This pretty much is what happened, I have no problem with ADA but I do have a problem with leeches and flatworms that use theses things to take hard earned money from people who earned it.

Posted on October 1, 2012 at 10:41pmThere is a whole sleazy group of lawyers who work this ADA scam and other scams like it, they know that insurance companies will pay off these claims just to get rid of them so the companies can focus their time and efforts on real cases. The lawyer knows the bathroom door isn’t wide enough for a wheelchair, why not find a burger place in a newer building that has bigger doors? The world is not perfect, in some cases it can’t be changed easily or reasonably, if it was, the owner would have done it. Get a life and do something good instead of being so mean and vindictive.

There, that’s fixed for him and he doesn’t have to shut down. I already called the place, got an answering machine left a message to call me back, hope he calls me back. Have a friend who went through the same thing, and in California. He never had to spend anything after that and he didn’t have to close his business!!!!

I would think that the Obama depression has more to do with it. In good times people would find the money to continue the good time but now there it is to much of a risk as savings are gone and the bank might give you the money but uncertainty can change and no one could even afford the real hamburger. As they just bought it no doubt they are already in underwater in the building.

Most take Shakespeare’s comment about lawyers to mean that getting rid of them would make settling disputes much easier.
This libiot shyster however, believes that Shakespeare meant getting rid of the lawyers is necessary because they are the supreme defenders of law and order.
Maybe that’s what William Shakespeare originally. I don’t know as I haven’t read the play from which the line came, but that’s not how people take it now, as evidenced in the Eagle’s song, “Get Over It.”
For those unfamiliar with the tune, it’s about all the whining and moaning people do, about how we’re all victims now.
The line I’m referring to is:

In my office building it was over 100 grand per bathroom to renovate to ADA compliance which consisted of 2 stalls and 1 urinal. In the 15 years I have worked there I have seen no one ever in a wheelchair use the restroom.

Instead he was more interested in what he could get out of the business rather than what he could put into it. The ADA has been around for over 20 years(the one good thing Bush Sr. did) it’s not like it’s something new. And based on the video all that was needed was a wider door and some handrails. Like many business owners he’s just a cheap pr@#k and now he’s paying for it.

What right does the government have to tell anyone whom it must serve? GHW Bush was a terrible president: ADA, Agenda 21, New World Order. If a business chooses to ignore or cannot afford ada compliance, the solution is to put that business out of business. Government mandates regulations, but does not provide funding for compliance (I wouldn’t advocate that approach – just pointing out that they are very free with other people’s money).

I understand ADA rules, but thought older buildings were exempt also until renovation took place, then they must comply.

Scott Johnson has been filing these suits since 2004. I know it goes against all of your most cherished and deeply held beliefs to accept that there might be problems that can’t be blamed on President Obama, but there really are.

There are a lot of businesses (restaurants and stores) in my area, that do not comply with the ADA.
Not a single handicapped person has ever whined about them. They just go to the many businesses that do comply with the ADA or roll up to the takeout window, like the guy in this story does.
We are a nation of rules and regulations, designed for the minority of the citizens, instead of the majority. Americans are no longer free. Capitalism is being slaughtered.
We are prisoners of the Government. The very people we employ with our tax dollars.
They are supposed to be working for us, not against us.

A piece of legislation is going to be enforced but owners of stores aren’t made to allow people their rights as stated in the Constitution.
All that I’m saying is that your business should first and foremost be made to follow the laws of the land as signed and agreed upon by the individual states.
How can you say that store owners need not observe these rights but they need to observe this legislation?

And, I can see many of the things in the ADA affecting the construction of new buildings, and when major upgrades or additions to larger public access buildings occur. But, the law is poorly written when it does not grandfather older buildings, and allows this type of particular activity. If you read a good portion of the ADA and design and build a new structure within these guidelines to the point that you pass inspections. A slick lawyer like this guy can still screw the hell out of you with the right judge. And, I bet he knows which judges and courts are friendly to his activity. Don’t expect the federal government to ever stand up for you even if you have followed their laws, rules, and guidelines to the Nth degree.

I’ve been in places where the ladies room handicapped stall was in use by non-handicapped people and I’ve been where the stall is too small for my chair. I manage. There are ways to do this without making such a huge fuss and getting into court battles. ADA was there to protect us from those who just don’t care, not to be a tool to live on suing others. This lawyer is a parasite and should find another line of work!
Like my husband often says, instead of socializing medical services, we should have socialized legal services first. That makes MUCH more sense.
