Fed Judge Dismisses Catholic-Owned Company’s Lawsuit Against Obama’s Contraceptive Mandate

The debate over the Obama administration’s controversial contraception mandate forges on, as individual cases are being waged in courtrooms across America. As TheBlaze reported in July, Catholic-owned employer Hercules Industries won a temporary halt of enforcement against the controversial mandate. While this is the case, a separate company has now lost a similar — and arguably — a more pronounced battle against the Obama administration.
On Friday, a decision was granted in a Missouri federal court that will do anything but excite religious conservatives. Judge Carol E. Jackson, who was appointed by President George H. W. Bush, found that the requirement that all employers provide contraception free-of-charge doesn’t infringe upon O’Brien Industrial Holdings, the business at the center of the court battle, and its rights to religious exercise.
The lawsuit unsuccessfully argued that the company was being forced to either violate conscience or refrain from participating and face crippling fines. The Associated Press has more about the case, which is one of nearly three dozen being waged against the federal government (read the ruling in its entirety here):
The lawsuit filed on behalf of Frank O’Brien and his company, O’Brien Industrial Holdings LLC of St. Louis, challenges the constitutionality of regulations in the health care law. Among other things, O’Brien, a devout Catholic, claimed the requirement that workplace health plans cover birth control infringes on his religious beliefs.
U.S. District Judge Carole Jackson, in a ruling late Friday, disagreed.
“This Court rejects the proposition that requiring indirect financial support of a practice, from which plaintiff himself abstains according to his religious principles, constitutes a substantial burden on plaintiff’s religious exercise,” Jackson wrote.

On Monday, an appeal was filed by Frank Manion of the American Center for Law and Justice (ACLJ). While a new court heating may be granted, the implications of this decision could be grand, especially considering that this case differs greatly from the Hercules Industries undertaking.
In the aforementioned case, the injunction was temporary and the federal government has appealed — the future of which is still unknown. In the new case waged by O’Brien Industrial Holdings LLC, the judge upheld the mandate indefinitely (this, of course, could change upon appeal).
Interestingly, Hobby Lobby, the popular craft-store chain, made similar arguments in a lawsuit the company filed against the contraceptive mandate last month. Rather than taking issue with birth control, Hobby Lobby’s main concern is with the morning after pill and related drugs. The store chain filed its lawsuit in the U.S. District Court for the Western District of Oklahoma.

IF one ‘runs a business’ within the confines stemming from a Corporate Constitution, one ‘implicitly agrees’ to the terms and conditions of that CONTRACT, albeit via deceit. Here is where Affordable Care Act comes into play; the business agreed to those terms and conditions when it filed it’s ‘Limited Liability’ charter with the CORPORATE Secretary of State it registered in, so it MUST ‘comply’ with the mandates that come out of the Mother Corporation, Corp USA. My Medicare deductible for 2013 changed from $5,000 to $10,000. Also, they increased the drug deductibles and reduced the amount Out of Pocket limitations in the tiers so that you will reach the Doughnut hole faster where you pay 67%or more for one drug., and you are on multiple drugs Why have Medicare? when you spend your entire SSA Check paying all the doctors, blood tests, xrays out of your pocket? They kill you off because you can’t afford drugs, tests, or food to keep you alive until you meet this $5,000 increase. Healthy living went out the door with those liars Bo and Mo can into our everyday lives.
How many seniors can afford to pay that first $10,000 before you can get any plan services paid when you receive less than $17,000 a year if you are lucky. You can’t even get help with Medicaid unless your check is less than $10,000 a year. Seniors who have Medicare are stuck with these policies that limit our care and drugs while taking our entire check paying medical bills. And, this is a plan?????? A pox on AARP for selling the seniors out with these policies that only help them put more money in DNC to buy votes for those who want to destroy the USA.

The First Amendment is not dead, tell me the last time you saw a corporation or business in a confessional both? A Company’s only purpose is to turn a profit, it has no soul. Christians do not have special rights, their First Amendment rights do not override the rights of others. No body is infring anyone right to worship. This is a labor issue, an employer is looking for a religious exemption to avoid treating his female employees equally.

The simply solution for everyone would be to offer a rider that is obtained and paid for by the employee.This way the employer isn’t required to pay for something that they don’t believe in and the women still have equal rights under labor law.Maybe they don’t offer riders for that though.Why they wouldn’t is beyond me though.We have them for cancer and other such conditions.Why not have them for contraception exc.This way everyone has the choice.No one is stuck paying for something they don’t believe in or have use of.
I’ll tell you why.No one seems to want a solution.All they want to do is bitch and moan.

Preachers are no where to be found. Pastors have disgraced God with their failure to stand and voice the teachings of God against such wicked leaders. The silence in the pulpits is shameful. Pastors are CEO’s of 501C3 corporations not allowed to speak out or they risk tax exempt status.
