Surveillance Camera Captures Violent School Beating: ‘Every Parent’s Worst Nightmare’

A surveillance camera captured a disturbing and violent school beating at a middle school in Indiana. Now, the teenager and his parents are suing the school district because they say it isn’t doing enough to prevent instances of bullying.

In the video, 13-year-old Austin McDaniel is put into a choke hold and slammed to the ground by a 15-year-old student. The bully then proceeded to punch McDaniel incessantly, delivering dozens of blows until his victim is beaten unconscious.

Students can be seen all around watching the incident, however, no one steps in to help McDaniel — they just watch.

“It makes you sick to your stomach really,” McDaniel told WUFX.

The teen’s mother said they were very close to offices and classrooms but no teachers or staff members at Benjamin Rush Middle School came to help. She is also furious about how the school responded once they were made aware of the beating.

“My son sat at the school with a head concussion and other injuries for an hour and twelve minutes before they called,” she said.

The mother also said the school swept the incident under the rug and failed to inform parents about the attack or address it with students.

To make matters worse, McDaniel’s friend Logan got beat up just 11 days later, leaving both students afraid of when the next attack will come.

“This is a complete lack of supervision. This is a complete lack of watching what is going on in front of you. It’s just every parent’s worst nightmare,” another unidentified parent says.

A lawsuit is being filed by both teens and their parents against the Rush County school district in hopes it will do more to address bullying in the future.

      They don’t want kids hitting back in the government schools. You’re a sitting duck. I saw the difference at a Waldorf school where my child was encouraged to defend himself. They empowered the children. Don’t know if that’s still their policy but it was commonsensical and refreshing.
      How sad to see all those students just watching. “Whatever you do to the least of my brothers you do unto Me”.

      My son is slight in build. He’s 11, and now an advanced blue belt in TaeKwon Do. I told him that if someone picks on you, walk away. If someone won’t stop, kick them in the head if you fear that you will be hurt. I agree the school is at fault but, as this kids mother said, “..it was an hour and a half before they were contacted, and my son had a concussion….”. If this bully would have had his ass handed to him then the kid would have been able to continue his day. The real problem? The parents of the bully. It’s a shame that you have to tell your child to defend himsel at school, anywhere. Thanks progressives!

      D-Fence A head kick is a last attack to put them out! Teach your kid to go for core deep damage hits fast and multiple. Bruce Lee was fancy but if in reality you want to be the Dude and abide, after the encounter, do damage fast! Then you can walk away.

      kid was the same size as his assailant, he should have fought back and kicked the crap out of the bully! BUT NOOOO we can’t allow people to defend themselves!
      Max of 15 minutes of instruction and the victim would be the victor within seconds of the fight starting with a nice trip to the hospital er for the bully!!
      STOP BEING VICTIMS!!

      The “law of the jungle” does not apply in school…a message to posters who feel that the victim should be responsible for defending himself. Yes, one should be taught self defense skills but no one need endure such an attack, adult or child.

      @Eduardo: Yes, nobody needs to endure such attacks, but they still happen to people-adults and children-anyway. It never hurts to prepare, and to have your kids prepared should you or your kid find yourself in that situation. Skills in self defense are just like guns and knives… Better to have it and not need it than to need it and not have it.

      It’s time to teach the bully that he will not get away with it, The victims need to wait for the right opportunity with something that will even things out (like a baseball bat in gym class ) and go to town! That is what I would have done.

      The sad part is that the taxpayer is going to get stuck with the bill for the negligence of the school and the teachers. This crap would not happen if the teachers and adminstration wre personally liable and we empowered them the authority of corporal punishment.

      You may have touched at the core of the problem. By the early to mid 70′s schools were essentially stripped of what is known as locus parentis. They no longer were allowed to act on the parents behalf in matters of discipline. (How anyone would think that schools could maintain discipline, much less order, without the ability to punish is beyond me.) This was partly a direct result of lawsuits by some liberal parents that could not stand to see their precious little monsters be familiarized with the concept of consequences. The other part was liberal educators who decide that, despite evidence to the contrary, negative reinforcement was both ineffective and harmful. And here we are some 30 plus years later with the results, a generation of now adults who are narcissistic dunces that still have no concept of consequences, and a government and society that now has done the same thing to parents that it did to those educators.

      My son came home from school and was told that if bullied they were not supposed to hit back. I told him to follow the rules 3 times, going to a teacher and specifically saying I am being bullied. On the 4th time, beat the snot out of whoever starts it, boy or girl. Last day of school last year (7th grade) he had a black girl steal a hand full of coin money from the table in front of him. When he asked for it back, she threw it at his face. I told the school if I had ANY problems with this girl that was not dealt with I would press assault charges on her and sue the school.

      To finish……The school admitted the incident was not handled correctly. This school is infamous for covering up actions by the bad “element” (gang members, etc) which detract from the good students like my grandaughter (top 10% of her class).
      BTW, the class president got accepted by W Va., and was thrown out before his freshman year was completed. The rumor is that he was involved in drugs, but I don’t really know the facts. Maybe he hit a girl, or pulled a “Hulk Hogan” pose in the hallway like he did with my grandaughter.
      Finally, after the local incident was over, I wrote a well-received piece about the way in which the school handled my grandaughter’s incident. In it, I called the school on its total lack of communication from Sept ’2010 to May of ’2011, despite my grandaughter sought help on several occasions.
      The public schools are a reflection of the politically-correct atmosphere in our country today. Don’t say anything about someone, especially if they are a “minority”, or you will be branded a racist.
      For more of this nonsense, just vote for the Democratic candidates, and you will soon be home-schooling your kids as you pay taxes for the public school you no longer can safely send your kid to attend.

      This situation happened much the same to one of my sons. He was being bullied by a kid ( stupid little jerk) he jumped my son from behind around the neck as you see on the video (many witnesses) my son pulled him off and threw him against the lockers. My son was suppended the other kid got lunch detention. We finally had him arrested for harrasment by communications. Now mommy and daddy had to see. The school never did anything worth anything!

      I guess the Blaze couldn’t post the first part of my gr-daughter’s story due to the use of the word tw&ts (in reference to two girls who bullyed her). God forbid we should see that word. Of course, you can watch all the video you want on kids being beaten in school or a bus driver being sucker-punched by a disadvantaged minority.

      The lawsuit filed should be so punishing in punitive damages, as to force the school district to:
      A. Close that middle school building. Or,
      B. Terminate the work contract of all staff in that building, beginning with the Principal, and continuing down the line with everyone who was aware of the incident and did absolutely nothing. Hey if we can do that to Joe Paterno “…for not doing enough to convince his superiors to stop the abuse on children.” this school shouldn’t be exempted either. Right…?! And while we are at it, why not take away all the athletic awards that school had earned over the years…, Because that’s what we call Justice those days around here. Right? :)

      I just want to be clear on the context of the stories here regarding violence. When it is an Afro American involved the context is clearly that they are violent and anti-social by nature. When the violence involves a white student the context is the school system was irresponsible somehow. It isn’t possible for “journalism” to get more pathetic than this.

      I will instruct my son to always fight back and that I will be on his side. I will teach my kid to punch in the nose and throat to hospitalize any thug bully. The schools, and especially the govt run indoctrination joints teach passivity so that when the govt tells you to do something you never question their authority. If any punk bully hurts my kid there will be physical repurcusions to endure. And they will not be pleasant.

      Exactly, mtcountrygrl. But I bet if you asked every one of those parents, they’ll tell you they can’t afford it. Yet somehow, they can afford their new cars, big screen TV’s, $150-$200 for cable, iPads, video game systems, etc. If parents cared about their children’s education, they’d sacrifice whatever they needed to so their kids could go to a private school. At the same time, fight these stupid lawmakers to get rid of the Department of Education once and for all. They have failed.

      Looks alot like my school. Stand up to the bully, get in a few licks. It suprises the heck out of them. I once had construction workers pull me off a football star who jumped me from behind. It was a hoot. Never saw him in my neighborhood again. Oh the shame of being beaten by a 118 lb, 4-eyed wimp.

      When I was a child in the early 50′s, I was being bullied. I told my father and he gave me following advice. Hit the bully in the nose so hard it bleeds. Get blood on your fist and lick it off while smiling and then hit him the nose again. It worked the 3 times I needed to do it.

      This is exactly the reason why my two 6 year old daughters will start martial arts after this school year. They dont necessarily need to become human weapons but I want my girls to be confident that if walking away doesnt work that they know what to do and dont need to be afriad. Sometimes just having that confidence about you makes others back off.

      was bullied in 7th grade by two brothers ,one bigger ,one same size .the also lived few blocks away ,one day in my yard, they tried to intimidate me then hit me ,same old thing .i waited until the big one looked away and decked him ,the look on his brothers face was priceless ,caught brother at top of drive way ,needless to say they would walk away from me always from then on. this was 1974 so this would not work now (to bad)
      point is bullies are insecure and usually damaged and best defense is to take it to them

      That’s not always true. We have two boys that we’re friends (and I use that term loosely) with their PARENTS, meaning both. The kids are hot-tempered brats with huge chips on their shoulders. They know Tai Kwon Do, and one day their mouths are gonna write a check their bodies can’t cash. The oldest (same age as my son, different school) is constantly getting into fights that he kicks **** because of his skills. Can’t wait until he gets into high school.

      The bully needs to be suspended, maybe sent to a juvie school. The reaction of the other students shows what 70+ years of progressive education indoctrination has done to our nation. The kids won’t stand up for justice. They have been trained to look away, to not get involved, to apologize to the bully and the haters. America will fall from within, and we can see its decline after “leaders” like Johnson, Carter, Clinton (the liar), and Obama. Their agenda is not to keep America strong, it is to make money for your buddies and suck every perk you can get out of the American people. The election is weeks away. You can stop our slide into mediocrity and start us back on the right path by voting all the bums out and electing those who really care about America.       Did you see the same video? That kid was wrestled down and beaten. What is your issue? What does it matter where the Dad is? Yes, he should be there with his boy, but you know as well as I do that kids, boys and girls, all too frequently grow up without one or the other parent.

      Whether the kid’s Dad is in their home, not in their home, or on the moon is irrelevant. NO kid should have to be scared of being beaten like this boy was, just because he is in school, and not the king of popularity.

      The boy that did the beating? He should be locked up; that’s animal behavior, not civilized-person behavior. The kids that stood and watched? They ought to be suspended for not trying to at least get help. The parents of the kid who did the beating? They should be at minimum forced to apologize to the boy and his mother, and cover the kid’s medical expenses. Administrators who tried to keep it quiet? Fired. But the unions will protect them.

      So-called victim? Wow.

      I agree with you JUSTICE_MAN99, the feminization of America is absolutely destroying our children, our homes and the fabric of our society. I am 100% a believer in that fact. Women have done more damage to families and American culture than anyone else to date, although there is another group giving them a run for their money these days. That is why I, and I’m trying to teach my daughters to respect our God-given role and responsibilities, starting with the number one rule in our home: No Stereotyping men as idiots and women as superior, more responsible, more intelligent than their male counterparts.

      When I said that the father being in the home or not was irrelevant, it was in response to the idea that the boy was only a victim of this attack because you assume his father is not present. Whether Dad is in the home or not, the event took place.

      I would not be suing the school, I would be suing the parents of the 15-yr old that did the beating. As a minor, the parents are responsible for the actions of their child. Let them pay a few hundred thousand Dollars for the actions of their child and see how that works.

      This is a great justification for giving students school vouchers & not forcing them to go to a school assigned by the government. This is also a good reason to dump the teacher’s unions. No teachers will lose their jobs over this because they are almost impossible to fire.

      If that were my son, I’d be enrolling him in a martial arts program so the next time someone tries to beat on him, he can kick their arse.

      I agree with smokey888x2 though, by removing God from our schools, we take away the morals that teach students that this behavior is unacceptable.

    I agree with many of the posts, here. When we were growing up, we were not afraid to fight back or step in to help someone in need. We would break up the fights ourselves. But in the society created by our friends on the left, it is all up to government now. And don’t you dare interfere, because you’ll get in trouble, too. Now, that said, I don’t give a flying crap. I would have stepped in anyway and stopped the beating (even if they threatened me with suspension). The kid that got attacked should also learn to defend himself a little better. We don’t need any more comities on bullying or more laws to outlaw behavior.. .we need personal responsibility, parent involvement, and less government intrusion. In the latter environment, the kid that needlessly attacked the other boy would be a little more careful because of retaliation at the local level. He has nothing to fear. He’ll get a slap on the wrist, and he knows it.

      You people need to stop blaming everything on THE LEFT. I am a Republican but I have eyes and brain enough to see that this is a problem from both sides of the aisle. Both the Democrats and Republicans write and pass laws on safety for the people, which Benjamin Franklin warned against, and “We The People” just sit here and take it or we are too blind and encourage it. The world is not a safe place for anyone, and no safety law is going to change it, it will just take freedom away. I am in my mid fifties and bullying was around back when I was in school, but luckily I had a Dad that showed me how to stand up top the bullies. I agree, get the government out of our school systems, get them out of most things, but at the same time, get rid of laws that keep us from protecting ourselves, and tell the states to shove those type of laws. We are to the point that almost ALL our freedoms are gone, but people will just not wake up to this fact and continue to do what Einstein said was the definition of insanity.

      @I think glenn is more in the right realm we need an entirely new school system. Home schooling is definitely the way to go for all who can, but when parents both have to work the kids need parental control back in the schools, perhaps homeschooling co-ops, where the parents who can sub for parents who can’t in return for some sort of bartered returns. There are many good home schooling platforms out their and computer schools. There needs to be a mass exodus from the union controlled public education system.

    There are going to be bullies until there are consiquences for kids to act this way from toddlers up. If a child did this at 4 a parent would punish them in a way that stopped them from ever thinking of doing it again. Anyone that thinks society is better off now that parents can’t spank is probably a parent that thinks their bully of a child is just boisterous. If teachers could paddle kids starting in Kindergarten they would never need to use the paddle because kids would know it could happen. Now, they just do what ever they wish knowing all adults hands are tied. This is truly an example of the “chickens have come home to roost”, and they are pooping all over the coop!

      I got a swat every day. I didn’t do my home work. I had parents that had 7 children and had a hard time keeping track of them. I saw teachers abuse the board of education. I also saw where it did a lot of good.It’s a shame that a little abuse took it away.

    The other kids CAN NOT do anything. If they do, they get expelled for fighting.
    Then the students get blamed for doing nothing at all.

    Thank the liberals for this situation. If you let kids deal with bullies in a language they understand, there would be less bullying.

    But instead, you have to go tell a teacher. Hard to tell a teacher when you get your a$$ knocked out.

      Liberals make absolutely no distinction between defensive fighting & offensive fighting.

      If you blocked a punchby knocking it out of the way with your forearm as taught in martial arts, an ass stupid liberal would consdider the block violent & provocative. I know I have have discussed it before witt ********.

      I told my son recently “If someone does that to you again, you start swinging, kicking, whatever you have to do”. He said to me “But I’ll get in trouble”. I responded “Don’t you worry about what happens to you. You just start hitting. If you get in trouble, I’ll take care of it”. He’s almost 6.

      I won’t say what happened to him. Nothing horrendous yet. But I got a little freaked out. I’ve been trying to encourage the “tell the teacher” thing, but one story he told was just to much. I was bullied throughout my school years, so I know exactly how bullies work the system. There’s even one kid in his class that knows exactly what he can do each day to keep from getting into to much trouble.

      I’m going to start having my son practice hitting me very soon. I’m really tired of hearing the stories, both from him and the media, and feeling helpless. So I’m going to teach him what I didn’t learn until I was past it: that you must fight back. I told him that night, don’t worry about getting hurt. You swing and hurt the other kid. Make him bleed. If you make him bleed, he won’t ever bother you again.

      Let the school expel him. Then we’ll either go to another school or I’ll sue them for negligence. I’ve been through this bs when I was a kid and I’m not going to watch my son go through it too.

      My brother was suspended for fighting in high school, even though the teacher reported exactly what had happened……..my brother backed up, and backed up, and backed up……until his back was against the wall……..and when the other kid punched him, he punched back and ended the fight…….We threw haybales all summer on the farm. It’s downright stupid to pick on 2 kinds of kids in school…….the brick and block mason’s children, and the alfalfa farmers. Dumb, dumb, dumb. Someone’s gonna get hurt. This was 30 years ago. Teachers and school administrators are twits. There is no justice for children, just take it…………What a load of bull………..

      When the bullies started going after my son, he stayed silent about it for along time until one day it boiled over. He was pulled out of class for his protection and I was called. I asked why all this time he had told me everything was fine at school, he said he didn’t want me to know about it because he wanted to handle it on his own, but the truth be told he did not know how to handle it. He said he would get in trouble if he fought back and I said not with me you won’t. This is what he needed to hear but because he kept it a secret and also lied about it, I had to get him squared away fast to always tell the truth no matter what. Then the next time someone picked on him he was to throw a punch. A boy and a girl both were throwing rocks at him after school and in the cross walk leaving school as he was pushing his bike along, he stops and wallops the boy hard, that was the end of his bully experience at the school. The VP called me about it and said because they get such a kick and reaction out of him (emotional) that is the reason why they pick on him. She agreed he should fight back but would not back it up. He did not get into any trouble, but if this happens you better have a plan. Once I told him he could stand up for himself, he jumped a bully from behind after the kid taunted him….nope thats not going to do…its got to be face to face. Be specific!

      The teachers can’t do anything because the bully’s parents will sue. The other kids can’t do anything because the bully’s parents and the school will suspend and sue them. When the kid finally does fight back they usually get expelled along with the bully. This is because the entire country is now being run by a bunch of people infected with politicalcorrectitis that spreads like the common cold and is harder to cure than cancer.

      Both of my children go to a California school, from a desktop computer in our house.

      While not for everyone, online schooling is great when you get lucky enough to have a “geek” for a kid. Online schooling is quite effective, the assignments are all listed for the parent to see, and when the child completes the assignment, the assignment changes color. We simply look for “red” assignments, and THERE IS NO WHERE FOR THE KID TO HIDE FROM THE ASSIGNMENT!

      My 14 year old son DOES have to be pushed a little bit, because he has a tendency to go off on youtube and google tangents, but he comes to me and explains ad infinitem about his newest business adventure that he wants to embark on. One of these days, he’ll hit on a good one, and I’ll help him start it up.

    This should make some some of you ask yourself; Isn’t it time to start homeschooling?

    Public schools should only represent 20% of schools at most. The way to do this is to make parents pay for their own children’s education, through vouchers, or tax credits. Most private schools are less than the public ones!

    Is it worth having your child in the public school environment so you can drive a new car and go on a cruise vacations????

      I know some parents who downsized into a cheaper home, and drove older crappy vehicles, just so they could afford for the mother to stay at home and home school their kids.
      The kids are now grown, out on their own, and very successful.

    Bullying has got to stop. This makes me want to puke!
    Kids are so desensitized toward violence, that most of the kids in the video do nothing but watch the beating. We’ve become such a heartless society.

    Why didn’t some of the students call 9-11? Why weren’t the students demanding for the bully to get off the kid? Where were the adults, who should have been monitoring the halls?

      Defending yourself is against liberal thinking and they do anything they want. Some schools take the phones away from the kids, won’t allow them to record what happens in school and punish anyone that helps another student. Time to eliminate teacher unions. Let the parent pick the best school for their child. Yeah!!!! Right!!! Good luck with that one.

      They’re are not desensitized to violence, they are desensitized to the consequences of violence. ( real pain, blood, etc.) That said the axiom that violence doesn’t solve anything is a lie, it isn’t always the best answer and sometimes even the worst, but it is an viable answer.

    The boy doing the beating is a future union thug enforcer,he is heartless and he his protected by union school officials.I think if the school is found at fault it should cost them millions and then just maybe the taxpayer will solve the problem.

      You have a point there. You don;t have to be able to win a fight often times to deter a bully. you just have to be able to fight long enough or inflict enough pain or damage on a bully & he will move on.

      Too bad the cameras don’t have audio with decibel readings. A lawyer could go to town with that & show that terachers should have been able to hear the fight or screams & did nothing. There names could be added to the lawsuit.

      Many teachers, deans, & principles are worthless.

      I remember some bullies. One subsequently got kicked out the the school district among other things. He aslo robbed a convenience store & became a drug abuser, nice white kid.

      Ya, teachers just facilliate bullies for the most part be their choice of taking no action.

      The bully may have been smaller, but he was very fast. Many people are not fast enough to respond to an attack at that speed. Especially in many parts of today’s society where most kids grow up in a relatively nonviolent environment and don’t learn the martial instincts needed to be prepared for such a rapid attack. I’m not even sure martial arts training would help because even if you have the training necessary to handle yourself in a fight, most people won’t be aware enough to be prepared for such a instantaneous escalation of violence. That’s usually something only learned if you have to constantly deal with the serious threat of violence every day.

      I could never support the idea of parents beating the crap of their own kids who just got the crap beat out of them by a bully. That just sounds insane. It’ll condition the kid to be prepared for violence, but is also likely to create such stress that the kid will eventually lash out without justification, and become a bully.

    They need to catch the bully after school and teach him some manners. I got bullied in 8th grade because I was short and did not like athletics. I finally fought back and beat the snot out of him… the bullying stopped that day.

    What do you expect the other kids to do,our society has created a bunch of candyass cowards incapable of helping someone.Hell just one kid could have stopped it and my advice to the kid who got beat down learn how to fight because I learned a long time ago when it comes to a beat down it’s better to give than to receive. If a school has a bullying problem the answer isn’t lawsuits it’s the bully getting his ass kicked and often.

    When I was in Kindergarten, I had 2 friends. One was a Native American. The sixth grade kids bullied him and one day beat the living snot out of him. My other friend and I met the sixth graders later that day adn beat the tar out of them with “equalizers”, a baseball bat and a length of chain. It was good for a suspension from school but also got us the freedom not to be afraid. In this day of politiacl correctness and not keeping score in games so no ones feelings are hurt, it is time for the bullied to stand up and take back their schools. The bullies need to be expelled. Perhaps even charged with criminal violence. Until then, kids will continue to be picked on.; They don’t usually pick on kids who fight back… and don’t fight “fair”
