WWII Vet Getting Booted From Home of 50 Years After Complaining About Sewage Problem

WWII Veteran Sam Hendrix Fights to Save His Texas Home of 50 Years After Raw Sewage Spill

(Photo: CBS11)

Sam Hendrix has lived in the Southward Mobile Home Park in McKinney, Texas for nearly 50 years.

“I’ve lived here since 1963,” he said, suppressing tears as he explained it’s where he and his wife lived until she passed away sixteen years ago.

But now, the 88-year-old World War II veteran may be forced out by the building’s owners, and says he’s not sure where he’ll go.

CBS11 relates [emphasis added]:

The problem began when raw sewage overflowed right behind his trailer.‬ “It stinks!” he said. ‬

So he says he had to sleep on his sofa in the living room.‬  His bedroom was off limits.‬ “All the mess was right outside these windows. I tried to sleep right here, but it was impossible.”

He says he repeatedly called the property manager to fix it, but never heard back.‬  So Hendrix reported it to the city of McKinney.‬

He thought the problem was solved when the property manager fixed the leak.‬  Three weeks later, Hendrix received this notice terminating his lease– and must move out be out by December 1.‬

CBS has more on the story, including an interview with Hendrix:

I sent a Paypal donation to Sam Hendrix fund. They are not answering the phone at the mobile home park, so I fired them off a letter I will send snail mail tomorrow. When I saw this story I wondered which retarded Blue State it was from, but even worse it is from MY state! That is not how we do it in Texas!

Private property rights. The manager has the right to refuse the lease. That is the way of capitalism. You cannot favor free enterprise and then complain when you disagree with the outcome.

Just because they have the right to does not make what they are doing right. He pays to live there and their responsibility is to keep the place sanitary and safe. They were not keeping their contractual obligation.
I can tell you all about other stories from Texas. In Texas a doctor can stick a DNR in your chart without you or your family’s consent. The hospitals can also decide that you are not worth saving and that they will no longer treat you. I thought Texas was better than most other states. I guess there are problems where ever you go.

We have not had any luck in finding a place for him to move his home. It is a 1966 model and only 12 wide. Modern day parks do not allow anything this old in their parks. He faces having to move out and leave it. This has upset him very much as he was not expecting anything like this after 50 years. He was planning to live out his life where he had lived with his wife before she died. The video tells it all, I was standing a few few feet behind the camera and had to turn my face when he was crying about his wife. His lower lip tells it all. This is a very sad story indeed. As long as I am breathing I will tell this story to anyone who will listen.

More than likely when Mr. Sam Hendrix reported it to the city of McKinney. The city sent a worker to evaluate the complaint & then probably fined the owner of the Southward Mobile Home Park for a code violation.

I agree this man should just stay put and make the property owner force him out. The property owner will have to file a lawsuit in court and get a judge to order the man evicted and that order would have to go to the local sheriff to be effected. These events will take a year or more to process. In the meantime he is living there rent free because the property owner will refuse his rent payments. Once the case goes before a judge this man will have the opportunity to present his case and the judge could rule against the property owner. Regardless the process will take a year or longer and during that time as the story gets out to more and more people this man will garner more and more support.

I had a sililar problem like this in an apartment once. The carpet in my roomates bedroom smalled like cat piss. Even after being cleaned the smell was still there, and the management company refused to do anything about it. So, my roomate rolled up the carpet and took to the managers affice and dropped on his desk. Of course they threatened to call the police, but after they all calmed dow, they still did not replace the carpet. But at least his room did not smell like cat pee anymore, and they would have to replace it when we moved out. Not a perfect solution, but better than it was.
