DALLAS (AP) — A Dallas woman who beat her 2-year-old daughter and glued the toddler’s hands to a wall was sentenced Friday to 99 years in prison by a judge who described his decision as a necessary punishment for a brutal, shocking attack.

Elizabeth Escalona did not immediately react as State District Judge Larry Mitchell pronounced the sentence at the end of a five-day hearing. Prosecutor Eren Price, who originally offered Escalona a plea deal for 45 years, had argued that she now thought the 23-year-old mother deserved life.

Mitchell said his decision came down to one thing.

“On Sept. 7, 2011, you savagely beat your child to the edge of death,” Mitchell said. “For this you must be punished.”

The beating left Jocelyn Cedillo in a coma for a couple of days.

Escalona’s other children told authorities their mother attacked Jocelyn due to potty training problems. Police say she kicked her daughter in the stomach, beat her with a milk jug, then stuck her hands to an apartment wall with an adhesive commonly known as Super Glue.

Jocelyn suffered bleeding in her brain, a fractured rib, multiple bruises and bite marks, a doctor testified. Some skin had been torn off her hands, where doctors also found glue residue and white paint chips from the apartment wall.

Escalona pleaded guilty in July to one count of felony injury to a child.

Price said Escalona would be eligible to apply for parole in 30 years.

The prosecutor repeatedly sought to portray Escalona as a liar, a monster and an unfit mother. She forced Escalona Thursday to look at enlarged photos of the bruises her attack left on Jocelyn.

Price argued Friday that if a stranger had beaten Jocelyn the same way, no one would hesitate to give that person life in prison. Escalona had mishandled a “beautiful gift” of a daughter and failed to recognize what she had done, Price argued.

“The 45-year recommendation was for somebody who was going to take ownership of what she did, appreciate what she caused,” Price said.

Sending her to prison for decades would protect her children’s future, Price argued.

“You can give Jocelyn and her brothers and sister peace,” she said. “You can give them peace, so that when they’re sitting around the dinner table at Thanksgiving with their big family, they’re not worried that their mother is going to come walking through the door.”

Defense attorney Angie N’Duka asked for probation or a prison sentence shorter than 10 years. N’Duka argued that her client was a “train wreck” waiting to happen before the attack, the product of a broken home, abuse and a childhood that included illegal drugs and hanging out with gang members.

N’Duka repeated that she did not want to minimize the injuries from the attack.

“They are despicable, but then the question is, `What is justice for Jocelyn?’” she said, adding later: “Giving Elizabeth the opportunity to be a better mother, giving her the opportunity to get counseling services, will be justice for Jocelyn.”

Escalona’s five children, including Jocelyn and a baby born after the attack, are in the care of their grandmother, Ofeila Escalona.

Mitchell listened to both lawyers and took a short break before delivering his sentence.

The judge said he believed many of the allegations that Escalona was abused as a child. “And again, outside of the context of this trial, I think even the state would find you to be a sympathetic figure, because they prosecute people for what was done to you,” Mitchell said. “But I can’t consider that evidence outside of the context of this trial.”

He then announced the sentence. A family member of Escalona began sobbing and screaming, “No!”

N’Duka told reporters that Escalona had asked afterward, “What about my children?”

N’Duka said the sentence was “way too harsh” and suggested the widespread attention her client’s case had received contributed to the sentence.

“It’s a lot of pressure, a lot of pressure on the parties,” N’Duka said.

Price said afterward prosecutors decided to ask for a longer sentence after receiving more evidence they wouldn’t have had if Escalona had taken a deal for 45 years.

“We feel like the judge listened very carefully to a very difficult week of testimony, and we feel like he did exactly what the evidence called for,” Price said.

Ofelia Escalona had asked for leniency for her daughter. After the sentencing, she left the courtroom with a solemn expression, ignoring reporters’ shouted questions.

      I’ve been following this case all along as it is not avoidable in our news – it’s taking place here in my area. She deserves the 99 years. Justice was served. What she did to that little 2-year-old is just unmentionable. What we do know is that child abusers generally live a hellish life in prison so unless they keep her apart from the general population (and this judge did not sound like he would cut her ANY slack!) – She will get what is coming to her.

      She will appeal this sentence and she’ll get off. Most women can kill their children and are sentenced very lightly (infanticide). This case has a lot of media attention right now, so the judge wants to look good. Two years from now after the media winds have blown over, an appeals court will change her sentence to 3 years and give her 2 yrs served and will get probation for the remaining year and will be out walking around in 2 years. Guaranteed.

      This judge has no respect for life. 99 years is a death sentence. The mother needs help and the children need a mother who gets helped. 20 year sentence max. allows the child to grow up safe. This judge should not be sitting on a bench.

      I see in the article that she lived a life hanging out with the wrong crowd.I realize that she may have had a rough childhood,but it is still the choices you make in life that gets you 5 children by the time you are 23.I am not saying that being the parent of that many children is wrong,at least in the sense of someone who is married and the father,one father not several,is around.She knew right from wrong when she was younger,and knew there were other places she could go for support other than people who were only going to bring her down.There are churches everywhere in this country and I bet she passed many and never thought to check one out.I bet she would have found loving support in those churches instead of hateful,deceitful pain and anguish from gangs and unloving family members.I thank God that that child survived and only hope that now God can do something in that child’s life as well as her mom’s.

    That father should get 10 years for not being there to protect his children, or getting them out of that situation. She deserves to be put away for life, as they cannot institute the death penalty. She for all intents and purposes, has killed that child for the child will never get over what has been done to her. The other children are probably the ones who are now “train wrecks.” That beeaytch needs to have the crap beat out of her every day for at least a month, then maybe she will have some feeling about what she has done before the rest of her sentence is being served.

      If she was abused as a child, did they just give her children to an abuser (the grandmother)? Or is this the paternal grandmother? Does anyone know?

      Terrible story. How does anyone abuse a child like this, especially a person who is supposed to love that child unconditionally.

      This child will never be the same and will affect her for her entire existence. I think the sentence is fitting.

      face it, until this moment, the father was under court order to not be around his children and there was a restraining order out against him. Oh, and on top of that, he had to pay her 3/4 of his bi-weekly check for child support. The system is rigged against the male and now we have rampant single mothers who think they can all raise a child on their own. THEY CAN’T!!! It is hard enough to raise a child with two parents with a single y chromosome between them (if you get the metaphor) and to try to do it with just one parent is beyond most people.

    What mixed messages our society sends. Beat up a 2 year old child and glue her hands to the wall and you’re an inhuman monster who gets 99 years in prison. Chop up the child in the womb and toss her in the trash and you’re simply exercising your sacred womanly rights.

    I’m the father of two small girls and I find her crime shocking to the core.

    That said, I think that 99 tears is far too severe. While one can understand the emotional reactions of parents, the court is not expected to react emotionally. Rapists and killers often do not receive such a severe punishment.

    While not wishing to defend her, I have heard of other parents (single ones, usually) with several children who have found it increasingly difficult to cope and have had some sort of emotional meltdown. Parents who truly love their children have momentarily lost the plot.

    I am a single parent of only two girls and I can tell you that it is difficult sometimes as one juggles parenting with work. Emotional pressure and pure exhaustion can take its toll.

    I realise that my view will be unpopular, but I think that this sentence is unjust.

      It’s probably a good thing the judge isn’t 100% sure the system will run out of money to keep her behind bars, or the judge may have ordered her hands cut-off, and serve ten years behind bars to glorify the judge’s majestic judgeship.

      I meant to add that the young man who shot his mother and sister in cold blood was repeatedly told by the dispatcher not to worry because people would be found to help him. I realise that it is the dispatcher’s job to keep the person calm and that she did not represent the court, but I just mention that…

      She beat her two year old child within an inch of her life.
      She beat her in the head, causing bleeding on the brain.
      She kicked her in the stomach, causing internal injuries.
      She bit the child. She glued her hands to the wall.
      Part of the child’s hand skin was peeled off.
      Just because the two year old child soiled her pants.

      That physical attack on an innocent child, is what you should call severe, unjust, and excessive, not the mother’s 99 year sentence.
      She deserves the sentence. I have zero sympathy for anyone who harms a child.

      @kiwi……i am a parent of 3 girls and i dont believe the sentence was harsh enough. this wasnt just a beating, this mother glued the childs hands to the wall and beat her into a coma. it was only by the grace of God that the little girl didnt die.
      i can say with all truthfulness that NOTHING my kids do or did would ever cause me to loose control like that..and it wouldnt matter how tired or stressed out i was.
      if these women would learn to keep their knees together and stop spitting out kids that they dont want and cant take care of our world would be a much better place.

      Look, I have 5 kids 7 and under, and husband who is in the military and is often gone. I sometimes have CRAZY deadlines (I work at home) things like this don’t pop into normal peoples heads. You could argue she had some kind of break down and hurt her child. I won’t but you could. BUT she glued her kids hands to the wall and continued to “punish” her. Sounds like a monster not some poor stressed out soul we should feel bad for. She made her decisions in life and they shouldn’t earn her pitty.

    Good job judge. 99 years. This way she will be 53 and hopefully going through menopause before she’s eligible for parole. That way she won’t get pregnant with another child to abuse.

    The judge should have ordered her sterilized. She could get pregnant during a conjugal visit, win her appeal, then get out of prison early.
    I have zero sympathy for anyone who harms a child.

      Maybe China has a valid point limiting couples to one child but for a reason other than then population. If you only have one.. odds are you’re going to love and adore that child with everything in you. If you want more you have to go through tests or obtain a license or something.

      I don’t want to shock anyone who thinks everyone is married these days, nor get too graphic, but the article clearly says she was in a gang – any children she has would be the result of being “passed around”. Those gang girls don’t marry anyone. There is no way to know who the father is of any of her children without extensive DNA testing.

      Liberal laws don’t allow you to assign the death penalty to whoever you deem fit to kill? raucous and rancorous comments about killing people on this site have the moral code of an episode of twenty four.

      Why do conservatives see fit to be renegades who enforce a death penalty for all crimes, no matter how minor or how severe. Society cannot work like that.

      You are confusing political conservatives, with right wing religious zealots. Not all conservatives believe in the death penalty. It has always struck me funny that conservatives tend to disavow government intervention in our lives, but then give the government the right to take your life. Once you give the government the right to kill you for whatever reason, they simply have to change the deffinition of what they can kill you for. We have seen it happen already.

    It’s disturbing to me that her mother has custody of her five children. Wasn’t Elizabeth Escalona mother said to have abused Elizabeth at the trial? Is the State going to keep close watch on these 5 children? Furthermore, where is/are the father(s) of these kids? Has the government been paying for the upkeep of each child as it was born?

      Now the thing is that 25 years ago the punishment for her probably wouldn’t have been so steep. Just like teachers get mad about students day-dreaming because the student isn’t glorifying the teachers education; as it begins appearing to judges that the system may run out of money to keep people locked in prison to glorify their judgeship, the judges will begin handing out death sentences to people for the same infractions.

      it says shes eligible for parole in 30 yrs. She will attend a drug treatment program and be out in 10. Atleast she would if it were here in Illinois. Texas im sure is different. They actually punish their criminals accordingly.
