Lesbians Launch Discrimination Complaint Against NY Farm Owners for Refusing to Host Their Gay Wedding

ALBANY, N.Y. (TheBlaze/AP) — Two New York women who say they were turned away from a potential wedding site because they are lesbians have filed a discrimination complaint.

Advocates say the complaint filed with the state Division of Human Rights is among the first of its kind since New York legalized same-sex weddings last year.

Melisa Erwin and Jennie McCarthy, of Albany, say they filed the complaint Oct. 11 after Liberty Ridge Farm told them they could not use the site for their wedding next summer.

“When we asked why [the owners told us], ‘That’s what my husband and I decided. We’ve been married a long time and it’s great you’re getting married and all, but you can’t do it here,’” McCarthy told WNYT-TV.

The farm has had a growing presence of weddings on its premises. This year, alone, 15 nuptials were booked. But with gay marriage being so new in New York State — and with this being one of the first cases of alleged discrimination – there’s no telling how the legalities will play out.

Despite critique, owner Robert Gifford is adamant about not hosting gay marriages at Liberty Ridge.

“I think it’s our right to choose who we market to, like any business,” he said in an interview with WNYT last week. ”We are a family business and we just feel we ought to stay down the family path.”

A spokesman for the owners of Liberty Ridge Farm says the couple acted in line with their values. Jason McGuire, of New Yorkers for Constitutional Freedoms, says the owners feel that their rights are being violated and that they will contest the complaint. While the law has an exemption for religious halls and membership organizations, the farm doesn’t fall under these categories.

      Now if this farm would have refused to have a polygamist wedding, that would have been totally fine, but mess with those mentally ill gays and watch holy he*l break loose. Gays are to be worshiped in modern society.

      It is private land and its the owner’s choice. It’s simple. Why are these lesbians so intolerant of Christians and their values? Why would the government side with an anti-Christian movement? Oh, wait, Dear Leader…yes, now it make sense.

      I don’t oppose gay marriage, but if these people tell you that you can’t book their private property for an event, move on and find a place where you’re welcome.

      Imagine this was a Klan rally trying to book their event on a Mosque’s private retreat. Who would people side with? Double standards are tough to justify without double talk.

      Agree. It’s just another movement of the Overton Window.

      First, it was “We’re here, we’re queer. Get used to it.” And we did, thinking what they did in the privacy of their own bedroom was their business.

      Then it was brought out of the bed room at Disney Gay Days, and that was fine too, because how Disney wants to run their park is up to them. Meanwhile, the homosexual agenda gains steam.

      Then it was Civil Unions, and we all said “that’s fair that they have some civil analog of hat the rest of us have in marriage. And even more steam was gained.

      Emboldened, they got religions to recognize a right that God never established in gay marriage, and got it pushed through their states, and we thought “we’re not in those states or churches. Let’s make sure there’s a law passed that says the citizens of one state don’t have to be subjected to a definition of marriage that they didn’t vote for & don’t support, and it’ll be fine. We’ll call it the Defense of Marriage Act.”

      The Obama comes along and refuses to recognize DOMA and states may be forced to recognize these illegitimate (in terms of their own state laws) marriages. Even more momentum.

      Now we have discrimination suits ain’t people who don’t support gay marriage taking place on their property. How long before churches are being sued?

      Despite individual rights and liberties, I support a private company from deciding what events they want to host at their farm. As my father used to say, “Your civil rights end at the tip of my nose, as that’s where my begin”. Of course he often offered the same sentiment towards individuals who attempted to infuse their religious beliefs into public policy or government laws, regulations, etc. And despite all the convenient and selective interpretation of the founding fathers that GB puts forth, they all held INDIVIDUAL LIBERTY and SELF DETERMINATION above their own religious beliefs. There should be no surprise that individuals from England, Spain and France would be primarily Christian. And it is irrelevant in the discussion regarding their priorities which was very clear. The government nor the church, and clearly not the combination should supersede the right of the individual to chose their own destiny through the exercise of their right to life, liberty and pursuit of happiness.

      If the farm owners feel that supporting gay marriage is against their values or religion I would support their choice. They are giving up the revenue for their values. This couple can go elsewhere. people have the right to the free practice of their religion. The government shouldn’t be able to force this issue.

      It’s the owners choice. they don’t like it, too bad! you can’t force someone to do something they don’t want to do. if they want to get gay married they can find somewhere else. and besides this kind of thing doesn’t just happen to gays. I have a straight cousin (got married to her husband) last year have a reservation cancelled on her. she had to find another place to hold the wedding. these 2 lesbos are just crybabies

      So these two homosexuals could have uite easily moved on to a place that would accomodate them, but they chose to go to court instead. The political statement is more important to them than the flaccid invocation you offerred of “life, liberty and the pursuit of happiness”.

      Just another mentally ill couple trying to hurt someone because they did not get their way. This is a private farm, and if the owners don’t want them there then so be it, find another place and move on. But this was never about the wedding, its about pushing the gay agenda yet again. I would never allow one on my property either, as my values don’t agree with their lifestyle so their lifestyle will not be on my land.

      @encinom. Businesses that refuse certain patrons are punished by the loss of income from the persons they bar, as well as those who find the rejection wrong. Capitalism is based on VOLUNTARY exchange of goods, services, and money. The couple are not being denied any life threatening services. There are numerous venues they could book instead.
      You may disagree with this couple, but it is private property. They are entitled to decide who will be their customers. once you start compelling service, where do you stop? Can Hell’s Angels demand to have weddings there? People who cannot afford the wedding but WANT it there? Property rights have already been dangerously erode, despite the Constitution. Weaken it much more, and you may as well leave your door unlocked at home; you will no longer be entitled to keep anyone who wants to go in out of it.

      It’s totally within thier rights to deny service to anyone, and enicmon yes woolworth ahd every right to deny service as well. And those whop are denied service have every right to take their business else where. Just as those who find those business practices unamerican and bigotted have every right to protest and boycott thyose businesses. The only place that should be able to practice discrimination is the government as they have no competetion to compete against.
      It’s not really discrimination for a privately owned business to deny service what it is is bad business to turn down paying costumer.

      But it would be OK to exclude someone that wanted to have a cigar wedding, because smoking is icky. Suppose I wanted a nude wedding would they be forced to hold that? If one section of society can set a limit to what they condone then all society can set it own limits.

      It is a PRIVATE business, not the government’s business. Remember that the Constitution prohibits Congress from making any law that prohibits the free exercise of any individual’s religion. The farm owners have the Constitutional right to lease their facilities according to their religious beliefs.

      Right to marry is considered a basic civil right, there is nothing is the law that defines what a human right is.

      Of course under the New York Anti-Discrimination law, the farmers are in the wrong.

      Anyone who provides goods and services to the general public is considered a public accommodation. It is against the law for a public accommodation to withhold or refuse to provide those goods or services; charge a different amount for the same goods or services; set different terms for obtaining those goods or services; discourage certain people from using them; or advertise or make statements that would make you feel unwelcome because of your race, color, creed, age, national origin, alienage or citizenship status, gender (including gender identity), sexual orientation, disability, marital status, and partnership status. Please note that there are limited exemptions from the provisions of this law based upon gender and age.

      So either the Farmers can get out of the business of hosting weddings or they could apply with the law.

These farmers are in the business of renting out their property for weddings, their activities are cover by New York’s Public Accommodations law. In a court of law, it is the laws of the State of New York that will trump God’s law, every day of the week,

      There is no biblical injunction about race, especially based on skin colour. Anyone who used the Bible to justify race hatred and discrimination was flat out wrong.       “Forcing” religion? Where in this article did it state anything about religioin being forced on either party? In what “religion” is homosexuality accepted? This is another obvious example of the 2-4% of gays in this country wanting the other 96-98% to bend to their ways. It’s disgusting. We are so sick and tired of being told everyone has to be accepted and thus be forced to dissassociate ourselves from our morales and ethos. Plus you can’t say if those “lesbians” were a hundred pounds lighter (each) that they wouldn’t have men asking them out. they are gay because they honestly eat too much.       Actually, there is a Public Accommodations law in New York that prevent private businesse from denying services and goods on account of race, religion, gender, sexual preference, etc. Please check your facts.

      that’spart of the problem ENCOCIM, making it illegal to discriminate against something like a gay wedding. it is NOT the same thing as giving equal rights to minorities. Gays are not a minority, there are an abomination on society as a whole, especially a Christian society, need i remind you, one that our country was FOUNDED upon. if gays don’t like it, they are more than welcome to move to a country that will more than accept them for who they are. like Egypt, or Libya, or Afghanistan, or say any muslim country in the world. since these are the types of nations that this administration supports, imagine where these folks will be when such laws as sharia are implemented throughout the free world. can you say headless gays?

      Please don’t get me wrong, I know lots of gay and lesbian people and have many friends who are as well. but i do not advocate the same title and privileges that are defined as marriage.

      The public accommodations law of NY it would appear that it would not cover this insistence: http://law.justia.com/codes/new-york/2010/cvr/article-4/40/. The law is very specific where discrimination cannot occur and in my reading, a farm is not one. The best I could find was the 2010 law. It may have changed to include a farm, though I doubt it.

      I believe these two knew there would be “trouble” with the farm and pressed forward regardless to make a statement or start their lives in hopes of a sizable lawsuit winning. I think it will be struck down.

      When making our wedding plans, as I recall, we had one ‘no’ in a sea of ‘yes’. I did not dig into why the one place said no. I accepted the answer from the private business owner and moved on to the many others with our funds. It would appear to me that this couple was waiting for a ‘no’ to begin pursuit of why.

Your concept of liberty appears to be that man should be free to force others to use their time, energy, talents and property to support collective moral imperatives. This was the same rationalization argued by slavers throughout history.

      It is a damnable idea that government can legitimately force those who walk in virtue’s paths to share the fruits of virtue with those who refuse to live in accordance with the same virtuous principles that gave rise to their prosperity.

      Decline of civilization is guaranteed when this pernicious and fatal cancer takes root and society starts believing that all should have equal access to the fruits of virtue without having to walk in virtue’s paths.

      Get your damnable secular humanist, egalitarian moral philosophy and imperatives OUT of government. Stop believing that compelling some to share the fruits of their labors with others is moral, when in fact it is Slavery by any other name and is inherently immoral.

      encinom it is a private farm where the owners can allow whomever they wish to use their farm. Only in a dictatorship would they be forced to preform a wedding of someone they do not wish to support. These *****’s have no case. It will be thrown out. However, we are dealing with NY and it wouldn’t surprise me when they violate the Constitution.

The government has no legitimate (Constitutionally provisioned) authority for dictating who these associations of individuals with a common goal must do commerce with, or associate with; not does it have legitimate authority to interfere with the right of these individuals to disposition and manage their property in accordance with their own moral framework and principles. ALL of your social justice imperatives and objectives are part of a moral belief system that is being instantiated as a state religion. Your argument prove that you feel justified imposing your moral framework by power of law. The only logically consistent view is, as the Founding Fathers intended, the government should never impose moral imperatives in law. If you don’t like the restrictions that one man imposes on how he manages his property – then you are protected by the same Constitution to exercise your property in accordance with your conscience – catering to whatever clientele that your principles dictate. But what the Constitution expressly prohibits you from doing is imposing your morals and compelling others to manage their time, energy, talents and property the way you, or several of you, see fit. It is criminal to compel another to disposition or use his property contrary to his own will. Go buy a farm and do lesbian marriages.

      All business can refuse service to whom ever they want! No shoes, no shirt, same sex, no service. Now if they were to charge double the price for same sex now that would be an actionable situation.

      Forcing any business to have to participate in a “Same Sex Marriage” is like forcing any Doctor to perform an “Abortion”. Your Rights do not override My Rights to say no. There are a multitude of options out there in New York State for them to find a business that would be happy and proud to perform their Civil Union Service. There is no need to force anyone.

      Besides, would you want to pay good money on your special day to a business that really doesn’t want your business and clearly doesn’t share your type of values?

      Find someone from the GLBM community that owns a cool place to celebrate your special day.

      Had they requested to be married at a town hall or community center or something like that, then yes they would have a legitamate complaint. However; they were denied having the marriage performed on PRIVATE PROPERTY. Which means too bad so sad but there’s nothing you can do about it and there is nothing our precious government can do either. I think it’s so ridiculous that gays and lesbians feel like they’re owed acceptance. Get over it and get married somewhere else. Don’t push it.

      If homosexual marriage was about equal rights, these people would be satisfied with civil unions, since they offer the same legal protection and benefits of marriage. It’s not about equal rights, though. They rent out their farm to the general public, they are subject to New York State’s Public Accommodation’s law which prevents discrimination base on sexual orientation.

      Private property and religious belief are always attacked in socialist countries. Do you really want to marry at a place that doesn’t want you there. Lawsuits are one of the reasons some people will never vote for gay marriage. You can force tolerance, but that doesn’t make it acceptance. I would “move on”. The lawsuits hurt their cause and can affect other states that are currently considering it.

    And so this is how it will go….if you don’t agree with homosexuality and all it’s games you will be sued into submission. A private business does not wish to provide its’ facilities to a homosexual marriage so instead of moving to a business that will accomodate them..the homosexuals instead choose to litigate against this business.

    When a conservative doesnt’ like something..he or she chooses not to buy it or endorse it, they move along.

    When a liberal doesn’t like something, he or she makes sure that no one can buy it or endorse it either by law suit, government mandate or intimidation they don’t move along.

    This is the slippery slope of homosexual marriage being recognized at the federal level….you exercise your conscience and choose not to participate in the delusion of “normalcy” the homosexual lobby wishes to impose on society..you will be litigated into submission. Your freedoms take a backseat to the protected classes like homosexuals. And if you think your church will be exempted because of protections it has under the constitution just look at how Obama treated the Catholic church with Obamacare. How Sandra Fluke treated a Catholic university. Let’s not stand on any misgivings here…we’ve seen how the left will treat any resistance to it’s agenda once a federal mandate is passed.

    These people, the owners of the farm, have every right to refuse service to the homosexuals. It is their property, their personal beliefs, their right to choose.

    The homosexual couple is being militant, bullies, demanding their way, filing claims and potentially a lawsuit. This is how it starts.

    If it is against your religious principles you have a choice. Frankly, I wouldn’t want a wedding where someone didn’t think it was right, but getting a free wedding elsewhere paid by for the folks who wouldn’t allow us on their property is a nice piece of revenge, and that is all it is. Hope the owners prevail in court..

      There are ways around this stuff. Market a wedding club to family oriented families as defined by the club. You join the private club after being “offered” membership, you pay your club “dues” and then you are allowed as a benefit of membership to hold a wedding under the minimal guidelines of the organization. It won’t be long though before homosexuals attempt to use the force of the State to force their way into private clubs and religious organizations. You are not free. Make sure you thank a vet for your lol freedoms.

    Hummmm! I guess some folks are not familiar with the old business of “We reserve the right to refuse service to anyone!”, which has been a staple of private business for as long a I can remember. Sounds reasonable to me that in business, if I own something, I have the right to sell it to whomever and whenever I choose, or not.

    this is the second suit reported in a week. It’s gonna go all the way to the supreme court, and we know we can’t trust them with private property rights.
    Interestingly, astudy reported last week on WND states 3.8% of adults consider themselves LGBT, yet they are forcing — FORCING –their agenda down the throats of the reast of us. No pun intended

      AFISH…remember of this 3.8% most of them are people who have tried homosexual sex but aren’t homosexuals.
      Strict homosexuals are consistently less than 2% of the population. And notice the lie they perpepuate? They want the world to believe that they’re genetically predisposed to be homosexuals…that they’re “born this way”. Yet the LGBT umbrella is not strict homosexuals but a conglomeration of people with sexual identity issues. A transgender individual doesn’t necessarily couple with the same sex. Bisexuals can drop the practice once they choose a mate. These are all variations on the human sexual psyche. They’re psychological states, not genetic ones. Yet if the homosexual lobby is to be believed, being homosexual is as inocuous as being left handed. Tell me..when homosexuals comprise 61% of new HIV cases in this country each year..that’s from less than 2% of the population…how inocuous is that..just like being left handed or something right?

      So if the LAW sez it is ok to nullify one persons Constitutional rights in favor of a States legislation, where does it stop?

      Italy 1922, Russia 1924, Germany 1932, China 1945. Just a few of the governments that had the LAW on their side. The people had nothing. What to tell the dead about the LAW.

      This is the only place on the face other earth for these…..people…..to get “married”!
