Pastor’s Shocking Church Sign Calling Obama a ‘Communist’ & ‘Muslim’ & Endorsing Romney Sparks IRS Complaint
Pastor Ray Miller of Church in the Valley in Leakey, Texas, likely didn’t realize the national attention his church would get when he posted a controversial message about President Barack Obama. This month, Miller, known for placing wacky signs outside of the house of worship, posted the following proclamation: “VOTE FOR THE MORMON, NOT THE MUSLIM! THE CAPITALIST, NOT THE COMMUNIST!”
After the story about the marquee was reported in local — then national — media, a church-state separatist group issued a letter to the Internal Revenue Service, demanding that Miller and his church be investigated for violating tax code. But before we get into the Americans United for Separation of Church and State (AU) complaint, let’s further explore the political sign.
According to KHOU-TV, the message outside Church in the Valley is the talk of the town. While the small-town preacher has been declining interviews about the signage, he did say that the message was his idea, exclusively. Admitting that the anti-Obama sentiment was intentional, Miller also said that he has strong feelings about the 2012 election.
While the preacher maintains that the sign speaks for itself — it may also end up causing him some unwanted legal grief. After all, churches are 501(c)(3) organizations. As tax-exempt entities registered by the IRS, they are not legally permitted to endorse candidates. By asking those observing the sign to “vote for the Mormon” and to avoid supporting “the communist,” some are charging that the church illegally endorsed Republican candidate Mitt Romney.

Photo Credit: KHOU-TV
The issue isn’t going away either, as AU petitioned the IRS today to investigate the church, with the organization claiming in a press release received by TheBlaze that Miller “violated federal tax law and should suffer the consequences.” The organization’s executive director, the Rev. Barry W. Lynn, said that he hopes to see the IRS crack down on the house of worship’s “over-the-top law-breaking.”
“Millions of Americans are aware that this church has openly violated the law, and many of them are asking what the IRS intends to do about it,” Lynn wrote in a letter delivered to the IRS today. “Failure to act will only spur more houses of worship to ignore the law. I urge you to investigate this matter and apply the laws of the land.”
Despite this call for the government to intervene, there may be a snag in Lynn’s plan. As TheBlaze reported on Monday, the government has suspended church audits until new regulations are adopted. While it’s possible that the AU request will be backlogged, it’s unlikely that an investigation will happen in the short-term.

This is nothing more than the Lefts typical attempt to squash the free speech of others because they do not like the message.

Posted on October 23, 2012 at 8:48pmInteresting views going around here. Here’s an idea: wouldn’t taking this to court be a GOOD thing? If it is indeed unconstitutional (and I personally think it is), then churches can no longer be sued or kept quiet on their political views. If it isn’t constitutional… well, we’re exactly where we are now. For that reason I think that this lawsuit should continue.
@The-Monk
“The IRS would have to first prove that Obama is a communist to say the sign was referring to him.”
Actually, the IRS would have to prove there’s a Mormon running for president. Last I checked, no one (left, right, or center) is arguing that.
@Rickc34
“Again the atheist’s attack believers .”
Reread the article. The leader of the group filing a suit is a reverend. He might be a poor Christian and an even poorer constitutionalist, but it’s highly unlikely he’s an atheist if he’s labeling himself as a reverend.
@Snow
“one more example of the government and anti-christian groups using the IRS for their political intimidation.”
See my comment to Rick. A reverend leads this organization… not what one would normally call “anti-Christian.”

But since Socialism is never achievable, Communism is where the road ends when Big Government decides they know better than the individual and decide to take care of everyone. Those in power in the government take the place of the rich so there is never any true equality. You can never have equality when some people work at the yoke and others sit around an reap the reward of that work.

The tax implication of churches relates not to churches and whether the IRS can come after a church for what is said at the pulpit has never been tested (for good reason if you are a government bureaucrat and want to maintain power even if it is by tacit agreement and not law)…
why do you think the Westboro Baptist hateful group has not been stripped of tax exempt status? because it is at best a questionable legal approach, likely to get the whole house of cards torn down by the Supremes.

Not a leftist at all, but I’m curious if you have a link to NPR endorsing Obama or telling people to vote for him over Romney. 503c3s can support their own agendas (for example, churches can speak freely about voting pro-life is the only Christian voting), but they cannot specify candidates. In the same way, NPR can spout “facts” that are blatantly favorable to Obama, but it’s not considered endorsement either.

Posted on October 23, 2012 at 3:19pmWhy does gov. dictate pulpit speech or church signs? Because most churches sold thier headship to satan. Biblical God is no longer the churches headship. The simple solution is to give back 501C3 tax exempt status. Many churches have done this and still maintain their tax exempt status without being a 501C3 organization yet now can speak out. NO CHURCH NEEDS TO BE 501C3 TO BE TAX EXEMPT. Historically all churches are tax exempt. 501C3 churches have been duped by the gov.. One national attorney who specializes in church clients exiting 501C3′s has never had one church end up with a problem in all his years. I agree that they probably have no case, the matter here is the pressure they can bring to bear – not just the slander of being accused of wrongdoing, and the damage thus done to reputations. I have seen too many fine pastors ruined for good due to a insinuation of ‘breaking a rule’ and my own church I led was hounded in 2000 by the IRS over a false charge by a former member.
We were vindicated in the end, but the damage had been done. The subsequent witch hunt by the church superiors in my denomination made me so sick of their opportunism it was one of many reasons I left for good.

There is no way that law can stand. It inhabits free speech because of a person’s religious status. The ministers during the American Revolution spoke plainly and openly against the British and helped to bring about our freedom from the king of England. There is nothing in the constitution that says that a person who is a pastor or any part of a religious organization cannot speak out about their political feelings.
