Can the Police Take Your Gun(s) During a State of Emergency?
As superstorm Sandy was preparing to pound the Eastern United States, Cam Edwards, of NRA News, joined Glenn Beck on his television program Monday to discuss Americans’ gun rights during a state of emergency.
“You need to know your rights,” Beck said. “This is what happens when people’s rights are trampled in an emergency…Somebody takes advantage of that situation,” he later added.
Beck went on to air part of a news report about a woman who was disarmed and forced from her home during Hurricane Katrina in New Orleans.
Patty Konie explained to officers back in 2005 that her home was dry, she had plenty of food and she wanted to stay in her home with her dogs. However, police did not respect her request and forced her to leave. Further, when she revealed to officers that she had an unloaded handgun, officers tackled her to the floor and confiscated the gun — even though it was a legal firearm.
“I said, ‘it’s not even loaded,’ while I dropped it on the floor and they punched me in the face,” Konie says in the video report. “They dragged me out of here. I really thought they were going to kill me. I really did.”

Edwards said it is important that gun owners know their rights, especially ahead of potential disasters like Hurricane Sandy. In 2006, then-President George W. Bush signed an executive order called the Disaster Recovery Personal Protection Act that strengthened individual gun rights during a national emergency.
“What that bill did…it basically says to law enforcement across the country, that you cannot violate the rights of American gun owners, even in a state of emergency, you can’t violate federal law, you can’t violate state law,” Edwards said. “If that happens, then the punishment for those law enforcement agencies is a loss in federal funding.”
“What we saw locally was the mayor and police chief in New Orleans saying, you’re not going to be armed,” Edwards added.
The state of Louisiana also passed their own law that specifically forbids law enforcement agencies of disarming law abiding citizens.
So, if you find yourself in the same situation as Patty Konie in the aftermath of Hurricane Sandy, Edwards said there are a few things you should be mindful of:
“You cooperate, you get the names [of the officers], you get all the information that you can, you hire an attorney and you have that attorney contact the NRA Civil Rights Defense Fund,” he said.
Shockingly, some gun owners still have not been reunited with their firearms that were confiscated during Katrina roughly seven years ago, Edwards said.
“The last time I talked to the attorneys that were working with the NRA on the case, there were barrels of firearms that were rusting away in the New Orleans Police Department,” he added. “We had a city in Katrina that decided that law abiding gun owners should be defenseless.”
When deciding whether to travel with your gun during a state of emergency, consider where you will be going. If you are traveling to somewhere like a public shelter, you may not be able to have a firearm, said Edwards. As always, be smart and utilize caution when handling and traveling with your firearm.

They can control gunpowder. All they have to do is pick another industry that uses the same chemicals that go into making gunpowder, and regulate the chemicals in that other industry, and by default gunpowder also gets regulated. Why not? They do it with lead, and other minerals.

The cops can do whatever they want. You can say no and pay the price.
And believe me, they would enjoy using what they call, “pain compliance”.
It’s all over by the time a court decides you were right.
During Katrina, cops illegally took guns.
The same can happen anytime.
The best protection is electing politicians who don’t want to trample your rights.
……..or the constitution.

They will go home, and love on a dog who would never bring them a morsel to eat, and would gobble down a steak without you in mind. Meanwhile, you will gossip and despise that neighbor who doesn’t quite see things they way you do, or they might look a little unkempt with bad hygiene. That neighbor who would give you a morsel to eat if you were laying in a ditch starving, but your damned dog wouldn’t do that.

You might be that big a coward, Reme, but you probably shouldn’t be projecting that cowardice onto people who don’t need ‘electricity, gas, internet, water’ provided by dotgov or private enterprise. Not that the fed woulod go so far as to do that en masse in the country- it’d sure as heck might be one good way to get everyone who owns a gun irate enough to do something about it.

But the beauty of it all is that guns don’t need all those new-fangled things like electricity and internet. Haven’t met too many I’d be willing to lay my life down for- which is probably why I’m not Jesus, thank God!
As for the homeless you acclaim passing by on the streets- again, you don’t know people, so don’t be telling them what they’re doing, either at home, in church, or on the street.

I am part of a congregation that spends considerable time and effort in helping others move beyond simple survival. We do bring essentials to them, but we also are actively working in ESL and adult literacy in our own neighborhood. We dig water wells in Latin America and teach hygiene that goes with keeping the well clean. We do other medical and dental missions in Latin America as well.
I suggest you apprentice yourself to such a congregation where you live. You will quickly find out how good it feels to love your neighbor as yourself. You will quickly find out that there is more going on to help others than you seem to think. Just because most of us don’t “blow our own horns” does not mean the Church is not out on the front line working for Christ Jesus.

Cops would never follow orders that conflict with people’s rights. Just because they are unionized government muscle doesn’t mean that they don’t have a “line”. When the time comes that the order is given to disarm people cops will never obey it. /sarc
Tell you what, takes a few folks who resist and a few cops in body bags and maybe we can find detante’. As long as cops see us as sheep there is nothing to stop them from enforcing tyranny. Raise the cost in human toll and maybe…just maybe…cops will think twice before kicking in doors.

Smaller communities will band together to 1) cleanse themselves of the Takers who will loot themselves into a frenzy, then 2) organize to defend themselves against the hungry hordes who leave urban wastelands to feed on outlying communities who are trying to survive past the 3-day margin of food that most people have in their homes. If you don’t know your neighbors well enough to band with them for mutual defense then it will be everyone for themselves because eventually you will need to sleep.

As an american Indian, I can give you some history from not that long ago. Our peace loving people gave up their weapons and ways, then their land, and then were forced into detention. This was done with the full support of the (this) government, with military enforcement. This is what happens to sheeple. This government did it while the ink was still wet on the constitution. That is the wrong way to think. Study communsit take overs. They have no problem making you dead. If the feds come for your guns, give them what they came for, and live another day. The ones you have burried in the woods are the ones you use later.
Study counterinsurgency. The fed will want you to fight in the open. They will drive into your hood with armored vehicles. If you fight, they will put a rocket through your front door from a drone or helicopter. The person that is smart will smile and give up their guns. Look at Afghanistan. American troops love when the insurgents will stand and fight. They are easy to kill. It is that insurgent that looks like the average civilian who then blows up the police station that is hard to deal with.

I agree with your sentiment. However, I’m not sure people grasp the hardship of guerrilla conflict. For example, we would have an advantage that could be exploited. Each of those cops and soldiers and bureacrats has a family that live among us. To your point, don’t attack head on the APC. Rather, you can burn down the homes of soldiers and cops. You take the war to them on terms that they can understand. Nobody wants to do that, but the point that forming up to look down the barrel of a tank is suicide can’t go without saying. So how do you win? Sure you can go Wolverines. You may or may not win. You can appeal for foreign intervention. Who knows what strings come with that. You can become what you despise by doing what I mentioned above. You can fight in the open and lose. Or you can be a subject/serf. None of those are good choices. But, if the goal is to win, then you have to make the conflict as horrible for the enemy as you can imagine.

Not sure where you are from, but if the “feds” turned off power, water, gas & internet in an attempt to force Americans to relinquish their firearms, they would have a blood bath on their hands. Is the mass chaos that would derive from this failed attempt at disarming the American people, many would be seaching out these items that many of us will still have. The “feds” phsyically CANNOT “turn off” my access to power, water or gas and I can live perfectly fine without the internet. I can promise you one thing… it would be a grave mistake on the part of the federal govt. to make any attempt at disarming the great State of Texas, especially during a scenario such as that.

As for me being a coward that is afraid to fight, I have three combat deployments to include Panama Iraq, and Afghanistan- How about you? Fighting is not the issues.
This conversation is about what to do in the event of some sort of communist, Marxist take over of the gov, where they want to get rid of the constitution, and do away with our bill of rights.
In such an event, the dumb people will stand at their front door with that colt .45, and try to fight. They will die in place, and die in vain. The smart person may just give up that gun in the night stand, but will retain that one buried in a state park, on the back 40, or elsewhere. He will fight, but his mind will be primary weapon.
The corrupt government will not have a shoot out with you at your front door. The will roll in the dark, using thermals, night vision, and air power. If you fight, you will get a rocket through your house, killing you, and your family.
The smart person will know how to blend in with the population, and take the fight to the government. They will have studied the Viet Kong, counterinsurgents in the Middle East, and they will fight on their own terms, and in a way that they can win.

Posted on October 30, 2012 at 4:19pmThere are a few things you should be mindful of, since police have been told they can’t confiscate weapons and the Bill of Rights and specifically the Second Amendment is the highest law in the land, all those engaged in confiscation are breaking the law and as we all know police do not break the law. Those pretending to be police will be shot until they are considered not to be a threat. If it is found after such self protective action that they were in fact police officers, the department must fill out a form and investigate why a police officer would be breaking such an important law.

If only 3% of the gun owners in this country were to decide to fight back, the odds would NOT be in the favor of the government forces. With over 100 MILLION gun owners in this country, even a small percentage is all it takes for the resistance to be far too large for any government to put down. There is a reason why I would like to avoid any idiotic actions by the government that might blow up in their faces. The loss of life could end up in the hundreds of thousands or millions depending on the level of the government’s response. Considering their level of competency at Waco, does anyone doubt that the whole thing could escalate out of proportion, especially with the racial tensions that have come from the growing radicalization of the New Black Panthers and Nation of Islam, and the increasing number of black mobs randomly attacking whites?
I saw a near riot develop after a police officer in Dallas shot a repeat offender felon drug dealer who was beating the crap out of him trying to get away. His Momma was out there stirring up trouble screaming to the reporters that her son wasn’t that bad and didn’t deserve to die. Sorry but the cop wasn’t bad at all and didn’t deserve to have the crap beaten out of him either. Then the “black community” complains that the police won’t patrol their neighborhoods.

If you depend on someone else for your food there is always a possibility that they can deprive you of it. It doesnt matter if it is the government, local thugs or natural disaster that is limiting your food supply. So instead of working against our liberties they work with the people use their liberties to help fix the emergency situation while maintaining the trust of the people.
They could triple their size of the police force. Kind of like what Special Forces does as a Force Multiplier. One 12 man ODA trains up a 500 man guerrilla unit. It is run and lead by the LE authorities. You have the local people helping maintain the law and order in the local area. Who would not want that.
A smart government, in a state of an emergency, would use a concept of Continuation of the Constitution instead of the Continuation of Power or Continuation of Government. The federal government is ready to enact COP and COG through FEMA.
One is built on trust and the others are built on consolidation of power and distrust. One fixes the problem the others make it worse.
Our liberties are our greatest assets, not liabilities, even in a time of a great emergency.

They will be local law enforcement, people like our neighbors. Could you really shoot somebody not that far removed from yourself? Maybe. What if you have a wife and kids to look after? Would you still go down in a blaze of glory with your guns blazing and put them at risk? As a 2nd Amendment loving gun owner these are very real questions and scenarios you need to consider and weigh. Will they REALLY have to pry it from your cold dead hand? Or will you lay it down to calm the terrified children screaming in the next room? Troubling times… troubling times… I pray none of us are ever faced with those 2 options.

If only 1 out of 10 gun owners rebel against them, it’s devastating odds. There are about 1.4 million active duty military (Not taking into consideration those that would refuse orders to fire, oppress, or shoot their own citizens). Still the government forces are horribly outnumbered by well trained marksmen. It would boil down to opposing an 8 million man army of snipers, saboteurs, sappers, and partisans. It isn’t so much as the first few who might turn over their firearms, it is all the rest who hear about it, and lay in wait at the next house. This is EXACTLY what happened at Concord and Lexington. The British went to seize a stash of colonial weapons hoping to prevent and outbreak of violence in politically volatile times. While searching a house for weapons a soldier knocked over a candle and accidently set a fire. Then began an extremely bloody running gun battle that saw the British cut to pieces by snipers. I would also like to reiterate that civil conflicts are never civil, and should such a thing occur there would be no such thing as civilians or non-combatants on either side. It isn’t something you want to see, experience, or even have to read about.

Using the same argument, Stifroc- do you think those ‘people like your neighbors’ would shoot you because you refused to turn over your weapons?

Most of us grew shooting and still maintain .22s, shotguns and hunting rifles and know how to use them. This is an area big on deer, turkey, wild boar and waterfowl hunting. Probably 50 police/deputies in the county and most of them are hunters and gun owners themselves.

Absolutely! They will be on the side of the enemy using “law enforcement” as a cover for oppression. I urge police to go to Oath Keepers and pledge to never enforce tyranny. If the police choose to enforce tyranny they are just as much my enemy and therefore a target as any of the powers issuing the orders. The Jews cooperated with the government in Nazi Germany. Most of them paid for that mistake with their lives. Israelis said they would never surrender like that again. Many feel it is better to die a man than live as a slave. If you look at the NDAA that Obama signed (the update), the government can suspend all your rights, take your weapons, take your food, your property, everything that you have “for the good of the people”. So if the authorities come knocking on your door and you surrender your firearm, when they come back for your food, water, wife, kids, etc…, what will you defend yourself with? These are the questions each American individual needs to ask yourself so you are mentally prepared. Will you allow them into your home to take whatever some beaurocrat decides you should not have in a crisis or will you stand to the rights that God and the Constitution gave you? Think long and hard on your decision as it could cost you up to your life.
I have a photo on my wall at work showing Jews after being offloaded from the freight cars in Auschwitz, waiting to be processed into the camp. It reminds me that while we all hope that humanity has learned from the past, the truth is that there are many people that would think nothing of exterminating us all.

Everybody I personally know firmly believes the 2nd Ammendment covers civilians. Here lies our dilemma…
In our history, the Supreme Court has both ruled that our right to keep and bear arms as legal, law abiding citizens of the U.S.A. is a natural/fundamental right to protect ourselves from harm AND has ruled that this same right is specifically relegated to ONLY militia during the post-revolutionary era where states had to depend on themselves “in case” it needed defense against the new Federal system – which was untrusted by many…Jefferson included.
I am ignorant of current law, other than the Heller case, and believe some light could be shed here to help those that are interested.

Most of the gun owners in the United States are well trained, well practiced with their tools. Many are former military, quite a few are hunters and are far better shots than the police. I’m on the same page with you with this scenario and a very good analogy with the Concord and Lexington case. My only problem with it is that the patriots at that time had a clearly defined enemy and they all had a common cause. The chips were ALL IN on that deal and they all risked their Lives, Fortunes and their sacred honor on defeating the British. We don’t have that. The Government is not our enemy first of all, and neither is our local law enforcement; (yet). Also, We don’t know each other. We are all still bound by our everyday life and Trapping’s of a modern society. If your house is stormed by the authorities in the middle of the night; We Like Minded neighbors would be like “Sorry about his Luckâ€. We have no common bond and moral fortitude to “Fight Backâ€. We are too selfish with our independent thinking on this and it would be our undoing. It’s romantic to think of our selves as Patriots of freedom in a blog. We are Virtual Patriots. Not real ones.

When Katrina first hit and I was watching the videos coming out where people described being surrounded by armed authorities, guns pointing, to take the rifle from the back of their truck, it was like 6 vs 1. Six fully automatic weapons versus one semi-auto .357 hunting rifle. They disarmed the man and left the area. They left him to the criminals. That is unacceptable. I figured that if I was in his shoes, I could snap off the safety and rapid fire at least 6 rounds in 1.5 to 2.0 seconds. I won’t survive, but I might get half of them, or more if I’m lucky. Then when forensics comes out and processes the scene, they’ll see exactly what happened. If the price must be paid to teach those monsters that taking away my protection will also cost them lives, then so be it. Freedom comes with a price tag. The bill is long overdue to our tree of liberty.

As much as I don’t want to have to relive that time, I would do so to preserve the liberty of my children, even if it cost me my life. As old guys we are pretty much through anyway but I believe we still owe a duty to future generations to pass on liberty just as it was passed to us by the men who landed at Normandy or Guadalcanal or the men who died at Lexington and Concord.
I don’t want to have to look at my children from my death bed in fifteen or twenty years and explain why they must live out their lives as slaves to a totalitarian government because I stood by and did nothing to stop it.

They have one of the most dangerous jobs with a meager salary at best, but they do make mistakes, after all they are human, but I think a lot of them have a power complex and think that they can do as they please. This lady had an unloaded gun in her own house and was treated like a thug criminal. The officer/officers should lose their jobs.

Go over to youtube and watch the shooting of Sergeant of Marines Guerena, Jose. He was shot over 50 times in his own home in the a.m. after pulling a night shift at the mine (yes, he worked in a mine). He was awoken by his wife’s screams that armed men were jumping over the fence and rushing the house. If a swat team can break into the home of a Marine and murder him in cold blood, some shooting indiscriminately into his home from around corners where his wife and child were ducking for cover to save their lives; then why do you think I would believe your story that says LEO’s don’t want to take away our rights? They are a gang and they no longer serve the public interest except in a farcical kind of facade to keep the average person content and unquestioning.

Actually, most cops I know (and I know hundreds), support the 2nd Amendment and have absolutely zero desire to disarm law abiding people and would absolutely not participate in such an unconstitutional aberration. What those cops did in New Orleans was appalling. People should realize that the viral videos of police misbehavior are not representative of most cops. Sure there are plenty of bad cops, just like there are bad doctors, bad plumbers, bad priests, and any other occupation.
Most cops are decent people and really do want to help good people and remove those who harm others from society.

Further, have you known an OathKeeper LEO to arrest a Citizen for a non-violent offense such as marijuana possession or “illegal” possession of a firearm? If you have, then they are not keep their oath and do not know the meaning of the Constitution. In this day and age, I find it to be extremely difficult to be an LEO, to do your job as they require for you to maintain employment, and still be an OathKeeper. I just don’t see it happening much.

Water- The problem is that today nearly all police everywhere are members of a union and those public sector unions are all pro-leftist. The deck is stacked where individual police officers are subject to criminal politicians and criminal unions. Each LEO will have to decide for him or her self if they will obey the order to enforce tyranny when the order comes down, and it WILL come. I’m sure your sons are honorable men but they will face this decision and the issue will be clouded by rhetoric like “public safety”, disarming a population has NEVER worked in favor of that population. They need to think this over carefully now before a Katrina like situation hits, when the SHTF it will be too late. I hope they decide to do the right thing, stand with the population and refuse to enforce tyranny. If not, and they come to my door, I will be forced to kill them in self defense, that is the essence of the evil we are facing. If the police side with the corrupt government and tyranny, the casualties will be massive.

I am a life-long NRA member, but the NRA Headquarters is in Arlington, just across the river from D.C., and the NRA’s full-time staff and lobbyists are just another bunch of Gucci-loafer-wearing, bespoke-suit drones infected by the atmosphere they move and work in, just like most of our legislators. There can be no compromise on the 2nd Amendment rights of Americans, period dot. Anyone who shows up at my door to confiscate my weapons better be prepared for a firefight, and I don’t care what kind of local or national emergency they think gives them the right to try and take my firearms. An armed American is a citizen, a disarmed American is a slave, and I’m no slave nor will I be.

I agree. What I find amazing is that the question was even posed. 95% of weapons purchases I consider to be a measured attempt at meeting a contingency that I’m not expecting (i.e. and “emergency).
The question to me is like saying “can the car insurance industry confiscate your vehicle if they think you intend to drive”.
I read the headline and I thought “what, WHAT?” Really?
What the feds don’t realize is that the fact that we own firearms gives us the right to keep them. My gun says so, 2nd Amendment or not. ;)

Do you think that the hundreds of thousands of AR-15 rifles purchased in the last four years were bought for deer hunting? That caliber isn’t even legal for deer in most states. The AR-15 is a combat weapon, a battle rifle designed specifically for that purpose. Without getting into the specific differences between the AR-15 and M16, they both accomplish the same mission, killing people.
The vast majority of people who purchased that weapon in the last four years did so for self/home defense. ANY TIME you are defending your life, it is an emergency.
