As superstorm Sandy was preparing to pound the Eastern United States, Cam Edwards, of NRA News, joined Glenn Beck on his television program Monday to discuss Americans’ gun rights during a state of emergency.
“You need to know your rights,” Beck said. “This is what happens when people’s rights are trampled in an emergency…Somebody takes advantage of that situation,” he later added.
Beck went on to air part of a news report about a woman who was disarmed and forced from her home during Hurricane Katrina in New Orleans.
Patty Konie explained to officers back in 2005 that her home was dry, she had plenty of food and she wanted to stay in her home with her dogs. However, police did not respect her request and forced her to leave. Further, when she revealed to officers that she had an unloaded handgun, officers tackled her to the floor and confiscated the gun — even though it was a legal firearm.
“I said, ‘it’s not even loaded,’ while I dropped it on the floor and they punched me in the face,” Konie says in the video report. “They dragged me out of here. I really thought they were going to kill me. I really did.”

Edwards said it is important that gun owners know their rights, especially ahead of potential disasters like Hurricane Sandy. In 2006, then-President George W. Bush signed an executive order called the Disaster Recovery Personal Protection Act that strengthened individual gun rights during a national emergency.
“What that bill did…it basically says to law enforcement across the country, that you cannot violate the rights of American gun owners, even in a state of emergency, you can’t violate federal law, you can’t violate state law,” Edwards said. “If that happens, then the punishment for those law enforcement agencies is a loss in federal funding.”
“What we saw locally was the mayor and police chief in New Orleans saying, you’re not going to be armed,” Edwards added.
The state of Louisiana also passed their own law that specifically forbids law enforcement agencies of disarming law abiding citizens.
So, if you find yourself in the same situation as Patty Konie in the aftermath of Hurricane Sandy, Edwards said there are a few things you should be mindful of:
“You cooperate, you get the names [of the officers], you get all the information that you can, you hire an attorney and you have that attorney contact the NRA Civil Rights Defense Fund,” he said.
Shockingly, some gun owners still have not been reunited with their firearms that were confiscated during Katrina roughly seven years ago, Edwards said.
“The last time I talked to the attorneys that were working with the NRA on the case, there were barrels of firearms that were rusting away in the New Orleans Police Department,” he added. “We had a city in Katrina that decided that law abiding gun owners should be defenseless.”
When deciding whether to travel with your gun during a state of emergency, consider where you will be going. If you are traveling to somewhere like a public shelter, you may not be able to have a firearm, said Edwards. As always, be smart and utilize caution when handling and traveling with your firearm.

Jan. 25, 2013 at 11:20amThe whole question is moot. Even entertaining the idea that the govt can in any emergency confiscate your firearms is absurd. The Dick act of 1902 further clarifies what was already known and that was the militia was divided into three groups including the unorganized militia, who can during an emergency rise up to defend their communities! The whole intent of the second Amendment (if you read the writings of the founders not only as they published letters in newspapers at the time but, their speechs and correspondance between them , WAS the people be armed for the greatest of emergencies, Govt. Tyranny! They NEVER would have allowed Govt. to simply say this is an exceptional emergency hand in your guns to the govt….the second amendment would then be moot!
This is also why a “National registry is wrong” it allows for confication BY THE GOVT. Background checks at the time of purchase are fine and responsible…but the info gleaned beond the check is prohibited from being kept by the govt for tracking and confiscation purposes. Incidently, as far as katrina…many of the police Fled when things got really bad and took care of their own families leaving people unarmed prey to criminals. This was a case in point of abuse of power and incompetance!

Our Armed Forces and Police officers are people too, with thoughts & concerns of their own about the trampling of Constitution. I don’t think that all of them will just take marching orders participate in stripping American Citizens of their 2nd Amendment rights. Proof of this can be found in the Oath Keepers here at http://oathkeepers.org/oath/ . Call your local law enforcement centers and ask them if they know about the Oath Keepers. If not ask them if they to consider supporting the Oath Keepers. At minimum, talk to individual Officers and members of the Armed Forces, get the word out through them.

I have never been screwed over by a dog. A dog has never lied to me. They always let you know how they feel as long as you can read their body language – unlike humans who smile while they sink the blade in deeper.
I loose 50% of my income every 2 weeks to GOVT (humans) and my ex wife (some-what human).

Second, We pay the police to protect our rights, if I have to hire a lawyer, you can darn well bet there will be a lawsuit.
So much is backwards these days. Most law enforement’s motto is, “to protect and serve”.
Protect and serve whom, or what?,,,,think about it!
I will just continue to serve and protect my family thankyou, as they know I will always be there when needed.

Question is how many people are they willing to sacrifice to do it. Colonel Trautman had a great quote for this. I don’t have any kids or a wife so chances are after my ammo stores are spent (this is after I take out 3-5 of the initial lambs) you will be forced to send your boys in and let me introduce them to a cut gas line and a road flare.

Oct. 31, 2012 at 9:05amIf there is an emergency like Katrina or whatever NEVER open you door to cops unless you called them or want their help. Otherwise talk to them through the door. Be respectful and tell them you are fine and dont need any help. If they insist and threaten to come in anyway tell them you know your Rights they are now trespassing and you want them off your property unless they have a warrant. If they keep insisting and start trying to get in. Tell them you are armed and you WILL use force to stop them and you are willing to die and they better be too. And that you hope they told their family they loved them today. Then get in a good defensible position and as soon as one of them come in open fire.

Oct. 31, 2012 at 1:28amA few years back I almost had to arrest a Deputy Sheriff for trespass. That’s right. He had no warrant nor reasonable suspicion of anything yet he was nosing around my property. He said he was looking for stray cattle. I asked did he see any he answered no. Then I asked him if he had a warrant, again no. He saw I was wearing a sidearm and he asked me why do you have that. I said it’s to guard against trespassers, in which he was doing at that moment. It’d be a shame to have to arrest him I said. He got back in the cruiser and left. He asked the D.A. if I could have arrested him, the D.A. said “yes, you didn’t have a warrant or valid reason to be there, so you were trespassing.” That deputy sheriff is now a detective with the local Police department. He puts the rookies through orientation and makes sure they know what they can and can not do. Unless a person is breaking the law they can not confiscate firearms from that person.

Well said. I’m in that age group too with bad wheels these days, new hip and new knee so I won’t be involved in many evasive maneuvers.
