Could Next Week’s Election Be Delayed By Sandy?

NJ Gov Chris Christie’s Twitter post about issuing an executive order that would postpone Halloween in the Garden State got people thinking: If it’s not safe to trick-or-treat, will the northeast corridor be safe enough to vote?

Seven million people are without power in the wake of Hurricane Sandy. Estimates about how long it will take to restore the power vary from a couple of days to just over a week. According to FEMA’s chief Craig Fugate, the delay in restoring power might play a role in the upcoming election. From his comments to the press last night:

“We are anticipating that, based on the storm, there could be impacts that would linger into next week and have impacts on the federal election.”

The UK Telegraph reported that FEMA was considering using the agencies assets to help the election happen.

FEMA was examining how much it can pay to help rebuild any polling stations destroyed in the storm.

During yesterday’s conference call with the press, the FEMA chief has also hinted that his agency might become more involved with the voting process.

“It’s really too early to say what will be the impacts of the storm, and that’s why it’s again important that we’ll be supporting the governors’ teams and their supervisors of election or secretaries of state as they determine what … assistance they may need.”

Politico’s Roger Simon reported on his Twitter account that Jay Carney was “not sure” if President Obama has the power to delay the national election:

Our initial investigation shows that it is unlikely that any president would have the power to change or delay the day of the national election. Congress (which is not in session) would likely have to act to change the date — currently the Tuesday after the first Monday in November. “As Hurricane Sandy threatens to cause widespread power outages lasting into next week, some voters are asking whether Election Day could be changed from Nov. 6.,” the Wall Street Journal notes. “The answer is yes, but it would take an act of Congress.”

However, Congress hasn’t been interested in taking up the issue in the past. In 2004, Congress passed a resolution on changing presidential election dates stating:

“No single individual or agency should be given the authority to postpone the date of a Presidential election.”

That resolution was a response to talk delaying voting due to a terrorist threat to the election of ’04. The Star-Ledger of NJ reported that our current vice president had a strong opinion on changing election day:

“I think that is the worst idea in the world,” Biden said in a 2004 interview on ABC’s “This Week with George Stephanopoulos,” according to a transcript. “Essentially acknowledging to the whole world we think we’re going to be attacked before this happens, I think it is absolutely mindless with all due respect.”

 

But while moving the date is unlikely on a national level, it is generally accepted that elections are the responsibility of each individual state and the power to delay them typically sits with the governor or the secretary of state. We did see some of the early voting suspended in the run-up to the arrival of Hurricane Sandy, but that action still offered voters the option to send in an absentee ballot or cast a ballot on November 6th.

Politco reports that Daniel Lowenstein of UCLA’s Center for the Liberal Arts and Free Institutions has shared his opinion on postponing any election.

“There is always likely to be some bad weather somewhere and various other kinds of problems on election day. To warrant any kind of postponement of the election, it would have to be truly extraordinary and pretty widespread.”

The state laws regarding elections are fairly clear on what states can do if people are unable to vote. In some states governors and election boards are specifically permitted to change the election day. Courtesy of the Moritz College of Law at The Ohio State University.

Florida – The governor may suspend or delay any election after declaring a state of emergency. The rescheduled election must be held within 10 days of the original election, or as soon as possible thereafter. The Division of Elections must adopt an “elections emergency contingency plan”. FLA. STAT. ANN. § 101.733 (West 2004) and FLA. ADMIN. CODE ANN. r. 1S-9.001 et seq. (2004).

Georgia – If the governor declares a state of emergency, the secretary of state may postpone the date of any election by not more than 45 daysGa. Code Ann. § 21-2-50.1 (2003).

Iowa – The secretary of state, in the role of state commissioner of election, may exercise emergency powers over any election affected by a disaster of natural or other origin. The secretary of state must adopt rules setting out the extent of the emergency powers and when they will be exercised. The current rules stipulate that no federal election may be postponed or suspended. IOWA CODE ANN. § 47.1 (West 2004) and IOWA ADMIN. CODE r. 721-21.1(47) (2004).

Maryland – The governor may declare a state of emergency, providing for the postponement of the election in all or part of the state in the emergency proclamationMD. CODE ANN., ELEC. § 8-103 (2004).

New York – The State Board of Elections may order an additional day for voting, not more than twenty days after the original election, when a disaster causes fewer than 25% of eligible voters to actually be able to vote. N.Y. ELEC. LAW § 3-108 (McKinney 2001).

North Carolina – The Executive Director of the State Board of Elections may exercise emergency powers to conduct an election where the normal schedule for the election has been disrupted by a natural disaster, extremely inclement weather, or armed conflict. N.C. GEN. STAT. § 163-27.1 (2004).

Virginia – The governor may postpone an election not more than 14 days in areas affected by a declared state of emergency. VA. CODE ANN. § 24.2-603.1 (Michie 2004). UPDATE: It does appear that the Virginia Code mentions all local elections and primary elections for National office, but it does not say anything about a Presidential election.

What about the battleground state of Ohio? Ohio does not have a statement on delaying elections, but it does have an official process for temporary succession of power.

Ohio – ”The General Assembly shall have the power and the immediate duty to pass laws to provide for prompt and temporary succession to the powers and duties of public offices, of whatever nature and whether filled by election or appointment, the incumbents of which may become unavailable for carrying on the powers and duties of such offices and to pass such other laws as may be necessary and proper for insuring the continuity of governmental operations in periods of emergency resulting from disasters caused by enemy attack.” OHIO CONST. art. II, § 42.

What happens if a state cannot get its act together and hold elections before the Electoral College is slated to meet and electors vote? Cornell Law’s website explains:

Whenever any State has held an election for the purpose of choosing electors, and has failed to make a choice on the day prescribed by law, the electors may be appointed on a subsequent day in such a manner as the legislature of such State may direct.

As the storm begins to move out and damage is assessed, states most seriously affected will be better able to decide on any adjustments made to their voting schedules (both early voting and Nov 6th balloting).

If any state makes a significant change, it is likely that legal challenges will be raised. TheBlaze will continue to monitor and update this story.

      Hey FEMA .. instead of trying to postpone the election (which I hear they are “preparing” for) all they need to do is help set up voting polls for the people — election polls are LOCAL .. you don’t have to travel across the city to vote! Just get them some power and let the people vote! It is IN THE CONSTITUTION election day IS November 6th .. NO LATER!

      Even if it WAS Constitutional, any postponement would set a precedent for postponement for any future natural catastrophe, so where would it end, snowstorms in the Midwest, tropical storms in Florida, RAIN in SEATTLE?
      And as someone mentioned in a post yesterday,I wonder how many early voting Romney ballots have been “lost or damaged” during the storm? And in COLORADO, no less……..

      What Y’all forget is the Obama Administration changed the 1954 Truman Executive Order on Marshall Law from “National ‘Emergency’” to a “National ‘Crisis’” and it gave him all those powers that he has not been able to get by going through EPA and Carbon Tax Legislation. All his “Green Jobs” laws are in that Order and also other items that don’t really relate to an “Crisis” since those things are long term most “Crisis’” are short term.

      By next week, it will have been a week and most everything should be near normal, except for those wanting an excuse to try to cheat.
      BTW, that picture; I am SO tired of black people, these days, almost 50 years after civil rights were passed, STILL showing black people in chains. This newer generation did NOT know any hardships or struggles of segregation. They were all born into an era of affirmative action and more than equal rights than anyone else, even other minorities. The Asians didn’t need any special help, neither did the immigrant Indians. Don’t even TRY that “down with the man, i been strugglin’” BS on me. I know better. Affirmative action needs to be phased out now, black people have as many, if not more, rights than whites, and it is against the law to discriminate, be it white on black, or black on white. We all bleed red and are Americans and it’s time they acted like it. If you hate whitey and America, go to Liberia or any other country that will take you. Renounce your citizenship and live in peace and let us live ours in peace.

      Riots are ≤ Civil War. Power generators can provde power for the electronic booths in locations effected. Polling places are set up to be accessable, most of the time within walking distance. If need be organize the Meals on Wheels people to provide rides.
      Tea Party people, organize to get the word out in those areas that are worst effected, go door to door and knock on them to let people know the polls will be open, and people should come out to vote.
      Let’s all stop playing the victim card BHO and the Democrats have been pushing at us for the last 4+ years. Are we a nation of victims, or a nation of solutions? Has the BHO mindset and propganda really taken hold and is now rooted so deeply we can’t see ourselves as anything but helpless victims? BO was hired to bring us Hope & Change, but all he’s done is try to brainwash all of us into feeling and acting like victims. ENOUGH IS ENOUGH, WE ARE OVERCOMERS, NOT VICTIMS…FIND A SOLUTION AND MAKE IT HAPPEN!!!!!!

      You mean like the fires last year in Texas and Oklahoma? Or how about the midwestern floods or the rash of tornados that ripped up Joplin among other towns? Did the world end for those living in New York or were they still able to hop the subway and busses to work, take their kids to school and drive around unimpeded?

      I know some people think the world revolves around the east coast, but this is a regional not national disaster so help is availible from other areas (barring interference from the unions or FEMA) and is forthcoming.

      In a week everyone still alive will be rescued, most streets passable and much of the electricity restored. Appropriate intact buildings found and equipted with generators.

      It will be months perhaps a year before all of the homes are rebuilt, infrastructure repaired and business will be back to normal.

      How long do we wait? A week, a month, a year? Look at how long it took for repairs from Katrina in some towns (more than two years) http://www.cnn.com/2007/US/08/29/katrina.day/

      No. I think one week and basic functions restored is reasonable for people to get to the polls.

      I just got back inside from cleaning up a fairly large limb from off my roof. I still need to repair the 6 or so feet of gutter and the hole in my roof, but I’m taking a break. I’ll need a few shingles and should be okay again. The storm here started Saturday night, and it’s still raining with some wind right now.
      I guess it’s been a good thing I haven’t been able to find a regular job for a couple of years now. I haven’t ever recieved any public assistance, nor have I tried to obtain anything. I happen to live in a RED STATE about 3 miles inland from the Atlantic Ocean. I know where my polling place is, and I can walk a mile or so to get there, and back as gas here is around $4.00/gal.
      People can do what they feel is important to do, and very few really need the Feds to help them out. Liberalism is a state of mind, as is conservativism.

      Electronic voting means you can tally votes easily.

      You want to sit there and count 50 million+ individual ballots? … more importantly you want to PAY someone to sit there and do it? Whatever happened to trimming the government fat.

      I’ve been a stringer for the AP on six elections and three national polls including Bush in 2000. They do not use electronic counts to make elections official. We have always physically counted every one of the 100-million (or so) ballots. It’s done mostly by volunteers and can be completed in about three hours. No reason why that should change this time around.

      Scantron, and a #2 pencil, still tally with a computer, but that is pretty old school for most people. I remember groups tying to say the act of filling in a rectangle area with a pencil was racially bias, and favored White students on SAT, ACT, GRE, MCAT, LSAT, SOLS, and other tests.
      I guess we are just poor, poor victims and everything is out of our control, so why vote anyway, it won’t count, and the contest is already decided if you want to believe that way.
      Victims have given up control and are at the mercy of someone or something else. That someone or something else is the only way that the right can be fixed. Do you want to continue being a victim, or decide to take your own self determination back and help find and work out a solution?
      Sorry, but the answer is still in your hands and you will have to self determine anyway.

      We color in a oval on a paper ballot .. and feed it into the counter … ourselves .. it tells us when each page is accepted and processed .. we had at least 30 booths where you fill out the ballot .. but only needed two machines for the tally. People could take their time .. no rush on filling out the ballot and the line moved quickly .. I did not have to wait in line to feed my ballot into the tally machine.

      Are you really that dense? Nobody sits and counts 50 million ballots genius. They count their own precincts (typically less than 10,000). Also, most are volunteers. Lastly, we’ve done it without computers for over 200 years. I think we can figure it out.

      I don’t trust the electronic method, it can be fixed, glitched, hacked or whatever. Paper ballots can have boxes of dead and illegal and fictitious voters, BUT this can be caught easier. If the dems do not cheat they will not win!

      So you’re fine with 10,000 votes to count? Whatever, the point is a computer can do it magnitudes times faster, doesn’t complain, doesn’t need supervision. These are the tasks they were originally built for – mindless computation.

      And in terms of how it’s been for 200 years – that’s some great insight. Let me counter with some of my own:
      1) There are a lot of things they did 200 years ago that we don’t do now – how about driving cars. Without committing too great a strawman, my point is that innovation should influence all sections of life evenly, if not you get an imbalance. What’s your stance on political commercials? Those didn’t exist 200 years ago.

      2) The population 200 years ago was significantly smaller than today. 1800 census said population of America was just under 6 million. It’s 50 times that today (50). More people live in New York today than the entire US 200 years ago.

      3) We’ve used them in past elections so your 200 year argument is invalid on this point alone.

      Your distrust of technology is laughable. You want hardcopy, how about a printed receipt? You buy stuff online? You trust them to charge you correctly don’t you.

      All you have to do to ensure the software is fair is release it OPEN SOURCE. Not only does it become more secure by the white hats making sure it is, it becomes completely bipartisan because it’s algorithms are exposed.

    With the early voting people have had plenty of time to vote. Just because the weather inconveniences you and you didn’t take advantage of the calm weather earlier, doesn’t mean that the rest of the country has to sit and wait around for you. Like a previous poster stated, those in Iraq risked being shot by going to vote and the liberals are whining because it might be inconvenient? Here’s a thought about the lack of power for computer voting machines – do like we do in my county – use pencils with bubbles to fill in.

      Remember Michelle telling them to all vote early in case their toilets over flowed on election day. They have had time to vote. They have known since last week the storm was coming. They could have voted last week! That is what I would have done. I want to know where are the cameras? Are the people being filmed on their roofs?? What are they going to do? They don’t have Bush to blame!

    Since elections are run by the states, postponements for certain states run a very real risk of disenfranchising entire states full of voters. For example, New York moves its election out a week, but every other state has voted and Romney has the electoral votes he needs to win the presidency. If I’m a New Yorker, I’m not going to show up.

    This is the same argument that Hawaiians may as well not vote since the time change puts them last and perhaps the votes are already counted and there is a winner. Or California, 3 time zones away from the East Coast, for another example.

      WOW – what unConstitutional and unAmerican statements! Voting is the RIGHT of every adult citizen, except felons, and that right can not be impeded. BTW, didn’t you learn anything from the aftermath of the release of Romney’s 47% statement. DO YOU EVEN know who those who don’t pay taxes are, who are on public assistance? They are senior citizens, veterans, the working poor, students, long-term unemployed still looking for work, disabled individuals, etc. ONLY about 6% of the 47% are the so-called “takers”.

      And, btw – many of those who don’t pay taxes and are on public assistance VOTE REPUBLICAN~

    I hate to say this, but I think (regardless of weather people have power or not) Obama will use a call for a Delay in the Election as his ultimate “October Surprise”. It defies the constitution. It “comes off” as sympathetic. And if Romney Opposes it, the people who are ignorant will only see it as “Romney wants me to have to walk to the poll, when I could wait a week and take the train”. If Obama does it, It is totally self-centered and political. Hopefully the Romney Momentum will scare him from doing it though.

      Please explain what is stupid about imagining Obama wouldn’t take advantage of this crisis to help tilt the election in his favor. He was willing to perpetrate a fairy tale/lie about video causing the death of our Ambassador (the first ambassador killed on the ground since the Carter administration) for weeks. He has lied with impunity and ruled by fiat whenever it has served his purpose. I will tell what is stupid. Stupid is believing that this petty tyrant has even a remote emotional connection to this country, its people or its history.     I wouldn’t think the Marxist would want to postpone the election, because with each passing week, his regime’s house of cards becomes weaker and weaker. They’re living on borrowed time the way it is.

    However, the “Never let a crises go to waste.” is always there in the back of my mind. Leave it to leftists to possibly devise yet something even more unethical or immoral to perpetrate on an unwitting citizenry.

    I don’t think the election should be changed at all. I think most people had the opportunity to vote early (I did) and also to send in an absentee ballot. I for one am ready to get this election over with and get on to restoring this Great Country. GO ROMNEY!!!!

    It’s a tough one to call, however I don’t think I like hearing that FEMA can make a call as to whether or not the election can take place. There’s a lot that can be done withing one week. Ok, so the election takes place and Romney wins. Don’t you think that Obama would be screeching at the top of his lungs? If Obama does win, I’m guessing hearings will start about his role in Benghazi and he’ll be impeached. What happens then? Biden becomes president if Obama is impeached? What if the congressional and senate races give the majority back to the Dems? Is Nancy Smellosi next in line after Biden? Food for thought….

      Sigh…Quite honestly Otto, I am disgusted with the bunch of whiners many people have become. My mother knew what starvation felt like as a kid, my father knew what it was like to be handed a .22 each morning before school and told to go get dinner. My parents made sure I appreciated every little thing in my life like flush toilets, electricity and hot water. People complain when the store is out of “organic” Portobello mushrooms or our hairdresser can’t fit us in this week. Suck it up people! It is what it is, go do your duty and vote, even if it means you have to walk 5 miles to do it and have to stand in line with a bunch of strangers who smell bad because they haven’t had a shower in a week. Think of it as part of Michelle Obama’s recomendation to get some exercise and save our national resources (water, gasoline and electricity) –or not.

      I’m pretty sure that impassioned Republics and Independents who are voting for Romney would be willing to swim, wade, snorkle their way to the polls this year. Early voting started in TX on 10/22. I was determined to be the first one in line. Nothing was going to keep me from voting this election. States can surely come up with something!

      Great point! I have been trying to guess what this petty tyrant would come up with once his numbers started heading south. This storm could be his mandate from God to suspend the elections until he can get his ground game (voter fraud) in order. I have no doubt he will not go down without pulling everything out of the hat.

      I too have for over a year suspected that if Obama was behind in the polls close to election day he would declare a National Emergency and HE would decide when the elections would next be held. Things are not looking good for him. He has on several occasions by-passed Congress and used Presidential orders to do things that they either opposed or did not authorize. I suspect that there is very little that he would not do to stay in office. I also strongly suspect that this weekend we will hear that the terrorists responsible for the Benghazi massacre have been killed. Anything for votes. Remember their golden rule “Never let a good crises go to waste”.
