This Woman Lost Her Job Over a Facebook Post — And You Won’t Believe What She Said About Obama
An outrageous Facebook post, calling President Barack Obama “the n***er” and referencing his assassination, has cost a California women her job and reputation after the disgusting message went viral.
Denise Helms, of Turlock, Calif., reportedly set the post to “private” on her Facebook page, but someone snapped an image and put it on Twitter.
The message got the attention of the Secret Service and her employer, Cold Stone Creamery. She was promptly fired and the company spent much of Thursday responding to angry tweets about the woman’s post,” FOX40 reports.
βThis employee is no longer w/the (sic) company & her disgraceful and completely unacceptable comments do not reflect our views,β the company tweeted via its official Twitter account.
Helms had deleted her post and deactivated her Facebook account, but the damage was done.
What may be even more disturbing than her post, is the fact that she initially didn’t appear to be remorseful at all.
“I don’t understand what I did wrong,” she told FOX40.
However, she later admitted that what she said was “wrong.” Helms also argued that she is not a racist and said she doesn’t really want Obama to be assassinated because, after all,Β he “does have two kids.”
βI think I was just really upset, and (the post) just kind of came out,β Helms said.

I agree; for a “journalist” to use that kind of title is ridiculous. We might agree that she deserved to be fired, but if you’re reporting “news” you don’t put your opinion into the article.
Now, as a commenter, I completely agree with the company in letting her go. The woman’s words reflect on her employer, and an employer has every right to fire an employee who might get them negative feedback. No breach of freedom of speech here; the business was well within their rights to fire her.

While I think the post was in bad taste, she has a right to say it on her own time. Do you think the people who are making threats on HER life should be fired from THEIR jobs, too? If they weren’t such cowards as to hide behind a blocked caller ID, maybe they would, too. You can bet the same thing would have been repeated over and over if Romney had won, and would have been ignored by the MSM.
Maybe she has a case for free speech, maybe she doesn’t, it depends upon which activist judge she winds up in front of. It’s California, so the bets are off that she will get anywhere.

As far as he hoping that somebody, anybody be assasinated I can relate HOWEVER the definition of HOPE and the deffinition of THREAT are nowhere near the same therefore the SS has authority over her speech.

Hispanic Americans are not open borders. Easy test is to see if they would like 50 million Chinese to come over here. With China close to getting rid of the 1 child policy & the wage differential having 50 million Chinese here is not out of the question with open borders.
Mexican labor is multiples more expensive than Chinese labor. Chinese would come here & work for less than Mexicans. There would also be a fair share of Chinese that would go on the dole& thereby breaking the Democrat conceived system. I do not think the Hispanics want open borders.

I worked for over 30 years working in the Healthcare Field and I have had to sign Conduct Policy’s when I first started a job. Your conduct outside of your job is just as important as it is at work and a persons conduct can reflect badly on the Employer.

Freedom of Speech only applies when the liberals are doing it. Bill Ayres can bomb a police station and the Pentagon and walk away scot free, but don’t threaten a liberal or you could go to jail. I and others have had discussions where we have said similar comments to each other, but without intent. I did not see intent in her message, and no matter what you or I think about people that are racist, I do not believe there is an actual law that says you can’t be racist, but you cannot take your racism to harming someone because of your racist views. What ever happened to the part of law that says there has to be intent for an actual crime to have taken place? This is what starts to happen when you let the Constitution go on the back burner of your minds. In 2016, we should demand that a candidate is chosen that will fight to restore our Constitution back to what it was before the Civil War!

I didn’t say that. I said I can completely understand why a private company would fire an employee whose behavior would negatively impact sales. It wasn’t my choice to let her go… but I’m not going to fault a business for making a decision.

She said “maybe he’ll get assassinated this term,,,” Although that can be interpreted as wishful thinking, it falls far short of being a threat. It could simply address a possibility, and I doubt if anybody here would deny that possibility.
Compare what she said, and the response to it, with the “crickets chirping” response to the hundreds of direct and explicit tweets by people stating that they would assassinate Romney if he was elected.

We do not have an administration that follows the constitution so how can we actually have OUR freedom? We have entered a new scary time. It does not matter what I think of her post. Regardless of whether we agree or disagree, as true Americans, we should remain vigilant to strongly defend oneβs right voice their view.
To penalize one for expressing themselves or exercising their freedom and liberty is an infringement and a denial of that freedom and liberty which we all enjoy. Today we censor someone else with whom we disagree, tomorrow it may be you and me who is censored.

I had a similar problem with Yahoo. I commented that some idiot will take a shot at the president now and that will be a pretext to take our weapons away and that it would get ugly. They cut off my ability to post. Seriously censored speech. I know it their site and they set the rules but I saw far worse postings when Bush was president.

If you ever spend any time on left-leaning forums, it’s laughable how often many of the enlightened wish ill upon individuals or large swaths of the population. No different rules for different people.

We have a constitutionally protected freedom of speech however there have always been some limitations to that speech, particularly if it infringes on the rights of others. Some things the Supreme Court has determined are not protected forms of speech include:
- Incitement or advocacy of the use of force, such as threatening statements about the president
- False statements of fact, such as lying under oath in court, libel or slander.
- Obscenity, generally viewed as something with a “tendency to exert a corrupting and debasing impact leading to antisocial behavior”
- Child pornography
- Fighting words and offensive speech. This covers speech that “tend[s] to incite an immediate breach of the peace” by provoking a fight, so long as it is a “personally abusive [word] which, when addressed to the ordinary citizen, is, as a matter of common knowledge, inherently likely to provoke a violent reaction”.
- Threats of violence that are directed at a person or group of persons that has the intent of placing the target at risk of bodily harm or death
- Speech owned by others, such as intellectual property
- Commercial speech, such as false or misleading advertising.
There are few rights that are exist without some restrictions in some cases. I hope you all learned something today but I am not counting on it.

Now anyone can go snooping through what their employees have said on social media and they have have to fire anyone who has said something that disparages a political candidate or who uses a racial slur or they will be seen as biased. It might even open them up to a lawsuit. Cold Stone may have been better off just staying out of it.

I guarantee that people who made threats against Reagan or Bush were investigated by the secret service and in many cases charged. If not for the threatening statement or blatant racism, then at least for being an idiot who “doesn’t understand what she did wrong.”

I presume that means you did not bother to even check if there was any truth to that claim? Not surprising since the right seems to be allergic to facts. Well let me help you out on this. Michigan, Florida, Vermont, Virginia, Ohio, Washington, Colorado, Connecticut, Delaware, and Hawaii all have voter ID laws and all went to Obama. I can understand why you might not have taken on the monumental task of actually verifying the information you spew. After all, I had to use a very complicated and new website for researching data. It’s a little thing that you may never have heard of. It’s called google. It took me a whole 2 to verify the info.
On a related note, there are 32 states that receive more federal funds than they contribute in taxes (the “takers,” right?). Of those 32 states, 27 of them voted for Romney. Red states have receive welfare much more than blue states. That means the red states are the takers. Not surprisingly, the ten highest educated states went for Obama and the ten lowest educated went to Romney. Those the facts.

In other words, the government isn’t suppose to whack you upside the head for protesting against it. However, your employer and everyone else is free to fire you or stomp a mudhole in you if they don’t like what you say. It only applies to the government, they can’t prosecute you for your opinions, but they can prosecute you for threats. She probably as well signed a media usage agreement at work saying that you can be fired for anything that you post on the internet, lots of employers have them. She is not being prosecuted by the government an employers can fire you for any reason so there is no first amendment issue here at all.

Wrong, wrong, and wrong again. First of all- it was a black man who bought the first slave in this nation. Second of all- I have researched my family history pretty thoroughly and I am 100% positive that since our arrival here in the states in the mid 1700′s not one of my ancestor’s owned anyone, and it is entirely possible that one or two of my ancestors came here as a servant. Third, I am a woman. And just as soon as blacks stop referencing my gender as biotches and ho’s I will defend their sensitivity to the “N” word!!! Finally, racism does exist- I am not trying to say that it doesn’t. That said, it is not as prevalent as it once was decades ago. We have made great, no, tremendous strides closing the gap between the races. This is truly evident in everyday life. To downplay this accomplishment is not only sad, but quite dangerous in my opinion. It implies that there is still a great divide, but the truth is, that divide was a small pinprick when Obama took office and is now a gaping hole. To avoid a wound from becoming infected, you treat it, cover it and protect it. You don’t rip off the bandage; drag it through the muck and mire and then act surprised when it becomes red, warm, and swollen with pus. Anyone, here, believe that at the end of 2008, race relations were as bad as they are now? No! This is one problem that Obama cannot say that he inherited from the Bush administration. PERIOD. He owns this one.

No need to sit and stare at computer screens anymore, or search millions of Facebook accounts to find this stuff.
It is called a spider. It is a computer search program that spreads out and finds what you are looking for. All you have to do is tell the program where to look and it will find it.
From there, the program goes into the settings on the Facebook server and changes them so someone can get a screen shot. Simple as that.
Also, why would someone be looking at a no-body’s Facebook page, bother to get a screen shot then twitter the FB post to everyone. Then who gets mad over a no-body doing basically nothing.
It doesn’t add up for me. Why the big scene for such a small thing?
It is possible she is a publicity seeker and wants her own reality series too… hey its the world we live in.

Posted on November 9, 2012 at 5:40pmI have some bad news for you. Freedom of speech is a right. You are absolutely correct. But, others have the right to ignore it, or to act upon it. All rights also have responsibilities AND CONSEQUENCES. You make the case that if people disagree, that they should ignore it. I agree. But, with that, you also have to accept the responsibility for those that might agree with you, and act upon it. So, are you so likely to protect those that would promote assassination, now? What will you say in court? What you say, can be a double-edged sword.

Because you don’t like what she said? It’s all stick and stones man. If we can start busting people for saying things we don’t agree with does that mean I can have Bill Maher buried under a prison? BTW – it’s impossible to ‘act’ upon a noun and she never threatened anyone – she made a wish. That said, anyone who choses to ‘act’ upon her for using a certain descriptive term WOULD be breaking an actual law and violating an actual right.
I also have some more bad news for you Basketfullofpuppies – ‘shall not be infringed’ means shall not be infringed. If she wants to plot an assassination down to the last detail she’s free to do so – when she puts the rifle in her car to go do it THEN you can arrest her. Up until that point she could be writing a book, doing it for catharsis or planning a legitimate rebellion for which the founding fathers gave us the constitution. We make good and bad decisions all day every day – if you’re going to start putting people in jail for pondering options, we’re all in a lot of trouble. Again, I don’t expect you to agree with it – but last I checked they hadn’t burned the Constitution and Bill of Rights just yet. You’re free to be an idiot, I’m free to use racial slurs and Obama is free to say he hates white people and America. That’s why this place is awesome.

It’s always nice when racists expose themselves. No one sneaked into her house and stole her words. SHE chose to post them for people SHE chose to share it with. If a “vulture” showed it to others, it’s because she enjoys talking to “vultures”. Now, I come from a state with plenty of wildlife and my daddy was a hunter. From what I’ve seen, vultures tend to keep company with other vultures. Maybe Helms should change her way of thinking so that she’ll be able to attract a different sort of friends. Right now, it looks like she’s just enjoying the privilege of exercising her right to freedom of speech. With rights comes responsibilities and consequences.

On top of that, the right to free speech is not absolute and there are several forms that are not protected. I listed them in a comment above. If you disagree and think that all speech is protected, I encourage you to lie in court under oath some day, to use one example.

In its statement, UtahAmerican Energy blames the Obama administration for instituting policies that will close down “204 American coal-fired power plants by 2014″ and for drastically reducing the market for coal.”

Those folks aren’t going to blame President Obama; they’re going to blame the person doing the firing. Republicans just can’t seem to understand that their tactics are only making them more unpopular with working folks. They’ll soon be relegated to the dustbin of history, just like the Whigs, the Federalists, et cetera.

High profile liberal organizers have even called for the violent rape of female conservative bloggers and they are still lauded and employed. Compared to some of the things said about Secretary Rice this is the tamest of explosive emotional expletives. HOWEVER. In the New America, under the new fascist regime you must be exceedingly careful about what you say and who you say it to. Your friends, your family, and especially your acquaintances are more than willing to report you to the authorities for your thoughts and words.

With rights, come responsibilities. The Constitution does not protect “fighting words”, and if this woman had said this about a member of my family, and in my presence, I would’ve shown her the door in no uncertain terms. The fact that her employer is fielding calls about this person makes it evident that she managed to bring them into the fray. She brought disgrace upon them, by association. You will be known by the company you keep. They preferred not to associate with her, anymore. I don’t blame them. I blame her.
