Police Shoot, Kill Marine During Altercation in CA

PALM SPRINGS, Calif. (AP) — Police say they had no choice but to shoot and kill a Camp Pendleton Marine after he refused to pull over, drove into one officer, and tried to drive off with another officer hanging halfway out of his car window.

The Marine repeatedly ignored orders to stop after being approached by officers on bike patrol around 2 a.m. Saturday, the Palm Springs Police Department said in a statement Monday.

One of the officers partially climbed into the passenger window to stop the car, but the Marine accelerated, striking the other officer, the department said. The Marine kept driving with the officer hanging out of the window until the car crashed near the garage exit, it said.

Both officers were treated for injuries at a hospital and released. They have been placed on administrative leave while the department investigates.

The Marine died at the scene and the lone passenger, another Marine, was not injured, authorities said.

“In the course of these events, fearing for their safety and the safety of others both officers discharged their weapons,” the statement said.

The Desert Sun identified the Marine who was shot as Cpl. Allan DeVillena II and said his family contacted the newspaper.

Police said authorities later found a smartphone in the car that was reported stolen by someone whose identification card was found in the Marine’s pants pocket.

The lone passenger was arrested for investigation of public intoxication and for an unrelated misdemeanor warrant then released. Police did not release his name.

DeVillena’s father, Alan DeVillena, told the newspaper his son and the passenger had gone out to celebrate the 237th birthday of the Marine Corps, which was Saturday.

The father said the family was headed to Palm Springs to find out what had happened after being notified of his son’s death by the Marine Corps.

The newspaper reported both Marines were with the 1st Marine Logistics Group based in Camp Pendleton, but the men were stationed at Twentynine Palms.

Marine Corps officials could not be immediately reached for comment Monday when many offices were closed for Veterans Day.

DeVillena said his son served in Afghanistan and was due to finish his four-year enlistment in about two months. He said he planned to attend college.

“He was looking to get into audio engineering,” DeVillena told the newspaper. “He wanted to get into recording. He wrote a lot. He had a passion for music.”

      Wow are you an idiot! What part of he tried to run over a person, cop or other wise, don’t you get? Intentionally run over ANY person and if that or another near by person has a concealed weapon they are justified to shoot to stop the action.

      Maybe the marines were in fear for their lives. As for me, I am extremely “anti-authority”. What facts do you have to prove your claim that these cops were justified. What is a cop but an anti-social punk wearing his halloween costume all year long? I can prove it. Take any police staion in the country, strip it of all weapons and cages, what do you have? A bunch of idiots. There is no law, there is no justice. Just coercion.

      Strangely enough, I am an anti-authority person as well, but also a cop. However, many on the Progressive and socialist & anarchist sides of libertarianism are absolute bigots towards anybody of authority. Towards parents, cop, teacher, pastor, you name it. It’s called neo-anarchism and it is as bad or worse than progressivism or neo-cons.

      They are bigots because the preach “tolerance” (repeatitive theme) yet only their opinion matters. Only their interpretation of the Bible, Declaration, Constitution, Bill Of Rights, state/local laws, science, etc… counts. I have been around too many cops that see it the same way, only their version is correct, but it’s a two way street. All parties are as guilty of it as the other.

      That’s the key though: we have to realize we are fallen and that cops being a member of society will make up the same percentages of thugs and trash as the rest of society. Same with military, usually more so as of late.

      Another part of the problem with the Neo-Anarchist’s is just like most “kids” these days: I want what I want and I want it right now, damn what it does to me or anyone else. The ME generation. America was not set up that way, not to be anarchist but to be a nation of laws. Somebody has to be in authority to write, enact and enforce those laws.

      I dislike authority but also recognize it’s importance. That’s the difference.

    appears to be a good service ribbon. I smell a brush with the UCMJ at one point in his
    military service…..

      The medal is the National Defense Service Medal. Everyone gets one after Basic. This has to be a photo from an earlier time. Slick sleeves + NDS usually equals boot camp.

    From the local syndicate: “The department said its officers saw a fight break out in the parking structure at 275 S. Indian Canyon Drive. As they talked with the driver of a black Chrysler 300, some sort of scuffle broke out between its driver and the officers, according to Palm Spring police Sgt. Mike Kovaleff.

    It was not clear of the Marine was in the car or outside it, but Kivaleff said both officers fired their weapons. Both police officers have been with the department for more than 4 years. They were put on administrative leave pending the outcome of the shooting investigation, Kovaleff said.” So the cops were there while bars closed, were investigating screaming inside the structure. The marine was identified by witnesses as someone involved in a fight. Cops contacted him, he fought with them, most likely outside his car. Got into his car while drunk and tried to flee putting the public at risk. He had one cop hanging out his window and struck another. Hmmm…. But the cops acted unreasonably…

    Some of the most mundane contacts can quickly escalate into life threatening incidents. What you need to remember is cops are reactors. The last few years have been the most deadly for LE officers due to a horrendous economy and the deterioration of the judeao-Christian values this country was built on. Cops cannot control a person’s decisions, only counter them. Another consideration is that a cop has to make the decision to pull the trigger in a matter of moments. Failure to act can result in death or the death of your partners. We don’t know all the facts of this case, could be that the marine might have just mugged somebody and thought the cops were after him for that.

      I am a local cop McPappy, you igit. I have taken people’s rights away in accordance with the laws established by the people and those that they put into office. I don’t go hunt for innocent people to kill or violate. I have never taken one’s rights away but on a warrant or probable cause. I don’t demand that the public bow before me. I am a conservative and no matter how much you want to believe local cops and deputies are unionized thugs, it is not true. I know my posts won’t change your opinion McPappy, but maybe somebody reading this with two brain cells knocking together will realize law biding citizens and local LE are on the same side.

      After I retired from active duty, I used to train cops on weapons and tactics. Sometimes for pay and sometimes for free. After two years of being around law enforcement and seeing their real attitudes toward the constitution and their jobs, I no longer provide any assistance to any of them. They claim to support the Constitution, but tell one that you don’t give consent to search you vehicle and you will see how much they care about the Constitution. I taught one to shoot so he could pass his test and he was fired less than a year later when he was caught on camera with another deputy beating a guy after he was in the jail. Never again will I provide any support to them. They aways force escalation until they get to use as much force as possible. Maybe the Marine was wrong, maybe not. There is only one side to hear now.     This is sad,I love the Marines, but I support the police as well. If you have an officer hanging halfway out of the car and a perp is driving away to escape, then that officer should and would be in fear for his life. As much as I appreciate this and all Marines sacrafice for us the American people… civilian authority must be recognized and respected just as this young mans comanding officer would be.

      I support our law enforcement as well but I have a real problem with this. if you’re on a bike and you are going to be pulling over cars and a individual decides he is not going to stop for the officers, for them to make the claim that they were in fear of their life’s while trying to climb onto a moving vehicle…really? At worst this young man was intoxicated while operating a motor vehicle and in possession of stolen property which may or may not be a felony in that state. Unbelievable…

      @tunnelboy your correct, I live near the MCAGCC and it is not uncommon for Marines to let loose. I do not need all the facts to say that the police made a stupid decision also not uncommon, if they would follow their oath a little better maybe these molehills wouldn’t lead to a mountain. Whatever happened to law enforcements motto “to protect and serve”? It is not like the police couldn’t have called in a helicopter to pursue, they never get away. Sad…..

    Some of the comments on this site disgust me. What you idiots don’t understand is most local police officers and deputy sheriffs are not only veterans but are typically conservative minded. I am a deputy sheriff and I am speaking from personal knowledge. In fact this last election bode very well for Mitt Romney at my station. For all you idiots saying the poor guy was unarmed, did you miss the part about using his car as a weapon, dragging a cop and possessing stolen property. It used to be that conservatives were the logical thinkers that did not react solely on emotions.

      Calling yourself “conservative” isn’t going to get you much empathy anymore. All the “conservatives” I hear on this site and TV support the Patriot Act and any other police state nonsense. Maybe that is way so many LEO call themselves “conservative”. It is becoming just another word for someone who hates the Constitution and wants to remove all the protections it carries for individuals in America. Tell us that you don’t immediately assume someone is guilty of a crime if he does not consent to your desire to search his private property. Tell us you don’t call a canine immediatly when a citizen dares to deny your request to violate his rights. The founding fathers would find that behavior disgusting and tyranical. Think about that the next time you are offended when a citizen asserts his right to be left alone by government employees.
      Maybe the Marine was wrong, but don’t try to tell us that cops don’t abuse their power and cover for each other and the political class on a daily basis. We all live in the real world and have eyes and ears of our own. De Oppreso Libre

      As a military war vet, I can assure you that there are plenty of people in the service who could very easily put themselves in a situation where a police officer must use deadly force against them. There are a lot of useless, lawless people in the military and even more who are incredibly stupid who would be the type to get blackout-level drunk and go on a rampage that ends with a tragedy like this.

      You think that this is necessarily an effort to besmirch the military? Well I think that a lot of you people at this site are incredibly naive about the people in the military. You tend to elevate them on some sort of “do no wrong” pedestal but that’s simply not the way it is.

    I’m on the side of argument: this was murder, acted out by two Palm Springs PD because: this is a pattern.

    As someone else mentioned, all they needed to do was call backup and helicopter.

    The Marine wasn’t even shooting at them! Just driving away. And that gives the cops the “right” to shoot?

    More and more stories of Marines being killed by cops are frequenting newspapers across the country. Why? Why Marines? Why not Coasties, soldiers, or airmen?

    Why panicky cops?

    Too much of a pattern.

      You are right the police are not properly trained, they panic to often, If you show a jack knife to clean your finger nails,they will kill you,if you show any thing they can call a wepon i don’t care what it is,they will kill you, thats how the younger generation is now trained. It;s there policie,if you notice most of these many murders are done by newer police I call it murder because they sweep It under the carpet and call it a day. Also let me remind you that the police or law inforcement be they local, state, feds, FBI, and all the other 3&4 letter dept. are no more then hired GUNS to put you down when ever they want. Now who does that leave, THE SHERIFFS DEPT. they are the real peace keepers the protectors, of the people, for the people, and by the people so help me GOD, they are elected not hired guns, they work for us people not the govt.     So they new he had no weapon except his fist and wouldn’t stop for them…and that was reason to shot him instead of the tires on the car? How many people have seen ever get away from a police chase especially when the news choppers swoope in……really? I hope these two officers see this brave young man’s face in there nightmares night after night.

    When someone is approached and addressed by a law enforcement officer ~ that person; being addressed by the officer, is legally supposed to give that officer his or her full attention and do as they are told by the officer. People that end up like this Marine or getting beat up by an officer are usually those folks that think they have rights to give the officer a foul mouth and an attitude ~ take Rodney King for instance. That dummy was high on PCP or something. The cops chased his arse for 50 miles or so and when they caught him ~ he got what a person gets when they try to run from the law. It isn’t anything new; one should know that when you can piss off a cop _ he’s probably going to beat your arse, clobber you or shoot you if you have anything resembling the brandishing of a weapon. :-)

    Perhaps the Marine knew how the local police abuse military personel with contempt and a maximum fine for minor or imagined offensives. Remember the police are unionized liberals with the right to use their authority to harass and fine conservative minded patriotic American loving military.
    As a veteran I can remember the local police using their power for money for local politicians. I was arrested three blocks from a fight I never saw or was involved in I spent the night in jail and hd to pay a fine.
    California being broke proberly needs to arrest and fine many many military people to help meet pay checks for the police department

      I recall vividly, how local police used to harass GI’s. They kept two sets of books and pocketed most “fines” collected. The complaints were so many against them that the FBI eventually took them down. A new Commanding General ordered the approaches to the base converted to “Tank Driver Training Lanes”, as predatory police used to sit and wait and prey on soldiers heading back to base after PT. He cautioned the police that “new Tankers were ordered to keep going, regardless of what lay in their path.” That same General also held a parade through the town, and we took the track pads off of our vehicles and made a righteous mess of their streets. We used to take our hats off and place them over our hearts when anyone said his name!

    What a shame, but this Marine was over the top in his actions. If he and his buddy where out celebrating, undoubtedly intoxicants were involved. But, getting loaded is no reason to get yourself killed. Still, a report that I heard over the weekend says that gang activity has increased some 30% in the last two years. I’ll have to wait for a final investigation and hope that the info will be released.

The standards to join the military have been deliberately eroded and has allowed a cancer of debauchery to fester and grow in the government agencies that were once stellar in reputation!       How is a cop climbing into your car ‘acting appropriately’? So far as I’m concerned, any time any part of an ‘officer’ enters my vehicle without my permission I am considering it an attack and will act ‘appropriately’.
      By the description, the officers were less than intelligent in their behavior: why not get the license number, call the base MPs and get the car stopped at the gate?
      There is more back story to this than is being released, for sure. Still, a Marine died stupidly at the hands of Kalifornia gestapo.

But if I’ve been out drinking, have been speeding, am being chased by police, and at some point a cop responsible for public safety tries to reach in and shut off my engine before I kill someone, and I speed away with him hanging out my window… What am I doing, I know I can’t reason with a leftist, Never mind Wolf.

      My point is in the article it clearly says the car had wrecked and BOTH officers had fired. The one hanging though the window couldn’t reach his weapon before the crash, the other one would have jumped aside delaying him/her from firing. The logical time I can see for BOTH officers to fire is after the car had crashed when the one could get out of the window and draw and the other one could catch up. So here is the scene as I understand it. Car is crashed, both marines in the car or drunk and disoriented they aren’t going anywhere and could put up much of a fight if forced from the car(windows obviously open so the officers could open the door from outside the car), instead of doing what we see all the time on cops and videos released form dash cams BOTH officers open fire on the driver most likely not stopping at two rounds to the chest but most likely fare close to five each. Where do you see a problem with that scene as described by the article?

    And now for the weekly story of “The Police Acted Stupidly” with no follow up report to show the the officers action where by the book and totally appropriate. As found out by an independent agency the DA and this time Military justice but by that time there will be still no report on any web page

    You say caught with stolen property…….ever assume the cops planted the phone and the I.D. after yet again killing a citizen let alone serviceman. Government will do anything to make their case. We all know this.

      Here we go again….With nothing to go on, you charge the cops. Everyone is innocent until the cops get there right? America is at fault for all the wars going on right? You sound like my neighbor the ron paulite….The right answer is to get rid of bad cops, and train the rest. Who do you think the cops are? Many are just like this guy, returning home and finding a job they can do….Come on…enough already.

      One of them jumped INTO A WINDOW of a moving and occupied car. Does that sound like allowable procedure? Yes both were drunk but the cops did the wrong thing too. Also if you reread it the car had already crashed and was stopped removing the threat of the vehicle. Instead of forcing them both out of the car and onto the ground to be arrested THEY KILL a disoriented and probably wounded person sitting in a crashed car after they failed to do what they were told to do. Such as proceed with caution Do you think jumping into the open window of an occupied vehicle driven by a noticeably drunk driver? Do you honestly believe we will see much action on behalf of the family of the victim? Well we won’t they are already blaming the dead guy, you know the one the police would have to answer to. After a few weeks the officers will have their suspension removed and will receive back pay and we will hear nothing else on this topic.

    I’ve seen many vids of officers hanging in car windows as the car takes off…but never have I seen them kill the person for it. I wasn’t there, so don’t know if excessive force was used or not. Just saying…

      So says the cop. That’s the beauty of killing the “perp” they can’t counter your story. Of course, no court in America ever really allows any testimony contrary to what a union thug…er…police officer says anyway.
