Florida Division of Elections Official Recommends Retabulation of 20K Votes in Allen West Race

An official with the Florida Division of Elections is recommending that the St. Lucie County Canvassing Board retabulate another five days of early voting, Jeffrey Scott Shapiro, a volunteer attorney with the Allen West campaign, told TheBlaze.

The “personal” recommendation was made by state Division of Elections official David Drury after officials realized there were 304 early voting ballots that were never counted.

The board has not made a final decision on the matter but one is expected sometime Friday night. However, should the county’s canvassing board adopt the recommendation, an additional 20,000 early voting ballots would be retabulated in the race between Rep. Allen West (R-Fla.) and Democrat Patrick Murphy.

Shapiro said the West campaign would need to gain just 249 votes in those 20,000 ballots to trigger a statutory recount under state law. West gained 535 votes in the initial recount of three days of early voting ballots, or 16,275 ballots. Following the recount, the vote tally for both candidates was decreased by more than 800 votes, 80 percent of the decrease hitting Murphy.

“In a U.S. congressional race where more than 330,000 votes are at stake — and a current gap to victory is less than 2,000 — an 800-vote change in a sample of 16,275 is extremely significant,” Shapiro recently wrote in an op-ed for the Sun Sentinel.

Election officials found some discrepancies, including a missing “communications log” and at least 304 uncounted votes, according to Shapiro.

Officials reportedly brought in boxes of ballots from St. Lucie Elections Supervisor Gertrude Walker’s office on Friday, looking for the 304 ballots that may be missing. The Palm Beach Post previously reported that an attorney for Walker said the missing ballots could be in her office.

The elections supervisor had apparently been undergoing tests at a hospital and hadn’t been in her office all day. Gertrude did reportedly speak with the state elections office and was told if she could isolate the “affected” ballots, her office may only need to recount those.

Earlier on Friday, a circuit court judge denied West‘s request that he order a recount of 37,379 ballots from early voting in St. Lucie County.

Gerald Richman, an attorney for Murphy, said in court on Friday that there is not enough evidence to support a full recount of early votes. Even if the canvassing board orders a full recount, the Murphy campaign plans to go to court to block it.

“If the canvassing board were to decide that they want to do that without any evidentiary basis to do so, we’ll be back before your honor with a motion for injunctive relief against them doing it because under the law the statute that we cited for your honor they have absolutely no right to do it,” Richman reportedly said.

      You bring up a good point. St. Lucie has already found over 300 ballots that did not get counted, and this was only for a recount of a couple of days of the 8 days of early voting. They also found that some precincts had been counted twice and some had never been counted.

      I pray Congressman West is able to close the gap by 249 more votes, which will force a recount of every ballot for the entire election. And folks, this is only one county out of thousands in the USA. Do you have any confidence that your vote counted? Do you have any confidence that no illegal aliens cancelled your vote? St. Lucie County is only a pimple. The rest of the country is a pit of sneaky, lying, underhanded manipulation of votes and voters. And to think that our heros overseas were not allowed their vote. If this does not get resolved, then no one can trust our elections anymore, I know I don’t. My vote was not counted.

    If those people cheated Colonel West, they should receive no less than 5 years in prison and a fine that is as hight as can be paid. America shoul call out the theives and make sure examples are set for this act of treason against our system.

      Mr. West may, ideed, have lost and he’s said several times (on Sean Hannity, Glenn Beck, at perhaps other shows) that he’ll accept that verdict once all of the ballots have been fairly and accurately counted.

      But don’t you think it’s a little too early to be declaring a winner when:

      1. At least 800 ballots are MISSING and, apparently haven’t been counted?

      2. A partial recount of some of the early ballots showed that Mr. West has 130+ more votes than was originally counted and Mr. Murphy had 650+ fewer votes than was originally counted?

      3. There are accusations that election officals locked the doors of some polling places, and counted the ballots in those places in secret?

      4. There are other accusations that in some polling places the total votes counted don’t match the number of voters who signed-in to vote?

      It seems to me that a basic tenet of a democracy is that all votes that are cast in an election are counted accurately and in a manner that is open to scrutiny and above reproach. It’s OBVIOUSLY that did NOT happen in this case! Therefore, the ONLY way to determine who actually DID win is for there to be a recount of ALL questionable ballots, including finding and counting any ballots that are missing.

      You’d think that Mr. Murphy would WELCOME a recount to resolve any questions of the legitimacy of his “victory” but he seems intent on preventing an honest, open assessment of the results. SHAME ON HIM!

      Just heard today some young woman was charged with stealing $6,000 from girl scout cookie sales.

      Amen. Our guys go to foreign lands to do whatever is requested of them, being away from friends and family and our gov’t has the balz to not count their vote, or have them sent out on a special airplane to make sure their vote COUNTS.
      I’ve always been a big supporter of the military, but this voting thing has me so angry, I’m ready to box a few heads for how they are treating our guys. Our men deserve much better than they get.

    The only evidentiary basis needed is that the People of Florida deserve and must demand this recount to ensure Free and Fair processes are followed. Having a few hundred votes somewhere on your desk and miscounting 500 for three days of early voting is unacceptable! Everyone blocking this should be investigated. There is nothing wrong with making sure you get it right. Right Mr President, isn’t that what you say about Benghazi, what’s the rush?

    Woulld someone tell me why Ms. Walker was doing with a box of ballots in her office? Has anyone checked her car? How about her house? Her pocketbook? Talk about suspicious? Isn’t this alone reason for a recount? And how does one explain 149% voters in a precinct? This woman needs to be fired! In fact all supervisor’s of elections in the state of Fl. need to be fired. West has faced death and survived, he’s now facing a fate worse than death-the Fl. dept of elections.

    Missing ballots “might” be in the Supervisor of Elections’ office?!?! Is that proper and approved procedures?!?! And even if it is (which I doubt is the case!), wouldn’t see know for sure or, at the very least, wouldn’t someone else go check?!?!

    This whole thing is getting stranger by the minute! Something is VERY wrong here and the ONLY way to settle the issue is for there to be a TOTAL recount of ALL early ballots!

    Mr. West seems determined to see that the election process is honest and accurate, and has said he’ll accept the results no matter what they are if that is the case. Mr. Murphy seems intent in holding onto his slim “victory” even though there’s plenty of evidence that something is fishy.

    Who do YOU think has the best interests of the voters at heart?!?!

    Recount the votes and let the chips fall where they may!
