Federal Judge: Hobby Lobby Must Offer Morning-After Pill

OKLAHOMA CITY (AP) — A federal judge Monday rejected Hobby Lobby Stores Inc.’s request to block part of the federal health care overhaul that requires the arts and craft supply company to provide insurance coverage for the morning-after and week-after birth control pills.
In a 28-page ruling, U.S. District Judge Joe Heaton denied a request by Hobby Lobby to prevent the government from enforcing portions of the health care law mandating insurance coverage for contraceptives the company’s Christian owners consider objectionable.
The Oklahoma City-based company and a sister company, Mardel Inc., sued the government in September, claiming the mandate violates the owners’ religious beliefs. The owners contend the morning-after and week-after birth control pills are tantamount to abortion because they can prevent a fertilized egg from implanting in a woman’s womb. They also object to providing coverage for certain kinds of intrauterine devices.
At a hearing earlier this month, a government lawyer said the drugs do not cause abortions and that the U.S. has a compelling interest in mandating insurance coverage for them.
In his ruling denying Hobby Lobby’s request for an injunction, Heaton said that while churches and other religious organizations have been granted constitutional protection from the birth-control provisions, “Hobby Lobby and Mardel are not religious organizations.”
“Plaintiffs have not cited, and the court has not found, any case concluding that secular, for-profit corporations such as Hobby Lobby and Mardel have a constitutional right to the free exercise of religion,” the ruling said.
Heaton wrote that “the court is not unsympathetic” to the problems cited by Hobby Lobby and their owners, the Green family. He said the health care law’s expansion of employer obligations “results in concerns and issues not previously confronted by companies or their owners.”
“The question of whether the Greens can establish a free exercise constitutional violation by reason of restrictions or requirements imposed on general business corporations they own or control involves largely uncharted waters,” Heaton wrote.
Hobby Lobby’s attorney said the companies’ owners will appeal.
“Every American, including family business owners like the Greens, should be free to live and do business according to their religious beliefs,” Kyle Duncan, general counsel for the Becket Fund for Religious Liberty, said in a statement.
The morning-after pill works by preventing ovulation or fertilization. In medical terms, pregnancy begins when a fertilized egg attaches itself to the wall of the uterus. If taken within 72 hours of unprotected sex, it can reduce a woman’s chances of pregnancy by as much as 89 percent.
Critics of contraception say it is the equivalent of an abortion pill because it can prevent a fertilized egg from attaching to the uterus. The lawsuit also alleges that certain kinds of intrauterine devices can destroy an embryo by preventing it from implanting in a woman’s uterus.
Hobby Lobby is the largest business to file a lawsuit against the mandate.
Hobby Lobby calls itself a “biblically founded business” and is closed on Sundays. Founded in 1972, the company now operates more than 500 stores in 41 states and employs more than 13,000 full-time employees who are eligible for health insurance coverage. The company, which is self-insured, has said it will face a daily $1.3 million fine beginning Jan. 1 if it ignores the law.
“It is by God’s grace and provision that Hobby Lobby has endured,” said David Green, founder and CEO. “Therefore we seek to honor God by operating the company in a manner consistent with biblical principles.”
The Green family has said it has no moral objection to the use of other contraceptives and will continue covering them for its employees.

Judges keep forcing locals to tear down nativity scenes as they put their “boot on the throat” of those who won’t comply with mandates that contradict their faith. At least half of people “of faith” supported the re-election of this tyranny, so where does that leave us, friends? If the other half of us don’t stand against, vast darkness will insue, reaching a point of bloodshed when it will be too late to stand. Kroger has already announced that since it can not afford to pay for the Obamacare required insurance, or the penalty for not providing it, they will be limiting ALL hourly employees to only 28 hours a week. This will cut the average full time employees paycheck by 30% and cost them the insurance that they were receiving as well. All at a time when inflation is bound to increase, AND they will be punished for not buying insurance on their now even lower paychecks.
The problem with insurance in this country was fixable without a 2700 page takeover of the healthcare sector of the economy. The costs of medical insurance can be decreased by buying the right kind of insurance POLICIES. A $5000 deductible major medical plan combined with a health savings account that rolls over from year to year, or with a supplemental policy to cover the $5000 deductible would save the average person thousands of dollars a year. Unfortunately, most people aren’t well enough educated on how to buy insurance to make an informed buying decision.

Religion is a protected class and discriminating against people who don’t hold your religious beliefs is a violation of the law.

If/When the government forces you to provide benefits that violate your religous beliefs you have to then choose between your dedication to your business or your dedication to God. If necessary, close up shop, lay off your employees.. Remember that you are not really free in this country and must do what the State demands, especially if you are in the practice of doing that most basic of life, working, producing, profiting.

I have decided that ‘enough-is-enough’ already. We need numbers but we don’t need everyone. Remember….even the American revolution did not involve everyone. About 15% to 20% of Americans fought the revolution. The other 80% were either loyalists or fence-sitters. We still won. It is sad to think we may have to do it again…..but it is fast coming to that conclusion.

However, they ignor the part of the constitution that states, the governmnet is not allowed to “interfere with the practice thereof”, which seems too me would apply to Hobby Lobby’s right to exercise it’s religious beliefs.

If the employees don’t like that certain things are not covered, they can look elsewhere, or make sure they have funds set aside to cover what is not in the policy. Now the government it taking away our power to make any decisions for themselves.
People are putting the chains on their own necks and wrists, without even recognizing what is happening. When they cry for relief, who do they expect to save them?

I take an aleve everyday, It is not covered by my insurance and my husbands doc says he should take a baby aspirin every day-again, not covered by insurance. Am I missing something??

Life is present BEFORE conception. Sperm and eggs are alive as well. Denying this is denying science. Someone once argued with me saying “if you have a tank full of sperm or eggs alone, they will never become a human!” I retorted “If you have a tank full of fertilized eggs, they will all be dead within a week without a human mother to sustain them.”
Your definition of life is completely subjective in this case; it leans closer to “potential to become a living human” than “life.” The conservative way is to let the individual decide. The biblical way is the same. I don’t think (as a Christian) that God will allow a mother who has destroyed her child into heaven… but if she repents? Why not? Who is to say that’s not God’s will? Not I; I am not prideful enough to doubt God.

Therefore, the government should not be able to force the employer to provide insurance for their employees. That would be the result of your arguement. If the buyer of the insurance (employer) has no choice in the matter, then they should not be required by penalty of law to provide the benefit. That would be a decision between the employer and employee! Keep the government mandate out of the decision. Problem solved; you are on your own to provide for your own healthcare. The company you work for has no business telling you what should or should not be covered. It is up to you to take care of yourself!!! Now that is independence!
