$500 Daily Fine? Family Outraged After City Enforces Obscure Ordinance on Disabled Boy and His Pet Pig ‘Twinkie’

A small legal battle is brewing in Coral Springs, Florida over a young boy with Down’s syndrome and his pet pig.
Heather Ray, the mother of 8-year-old Kason, recently purchased the animal for her son as a therapy pet, forgoing more traditional animals because of her husband and older son’s allergies.
6-week-old “Twinkie” became family almost immediately, they say, and has barely left Kason’s side since they bought him three weeks ago.
βYou know, he does get mad. He throws fits. He doesnβt like things, and Twinkie has a very calming effect on him,” Ray explained, according to ABC News.Β “It mellows him out, it calms him down…Itβs so good for him. He loves her so much.β
So what’s the problem?Β Apparently Coral Springs has an old law against raising livestock, and Twinkie’s breaking the rule.

The city only found out about Twinkie because Ray did her homework before purchasing the $1,300 animal, and actually asked for a waiver from the city in mid-October, ABC writes:
[Heather Ray] found out that Broward County and several cities surrounding her own allowed pet pigs to be kept, and when she learned of Coral Springβs rules, she contacted city officials to request a waiver or special exemption because of her sonβs disability. On Oct. 15 officials said they couldnβt grant her request.
In a written statement to ABC News on Monday, the cityβs communication and marketing director, Bob Goehrig, wrote: βA city ordinance does not allow pigs as pets. Pigs are considered livestock. If the Rays can show us there is a medical necessity and can bring documentation, weβll be glad to look into it.β
But Ray said sheβs already sent the city all the documentation theyβve requested, including a letter from her sonβs doctor supporting the recommendation for a therapy pet for Kason.
In the letter, a copy of which Ray provided to ABC News, Dr. Juan Carlos Millon wrote on Oct. 23, 2012, that Kason had βcertain limitations coping with stress and anxietyβ¦I am prescribing an emotional support animal that will assist Kason in coping with his disability.β

Ray doesn’t have her hopes up about the waiver.Β Noting that her previous request was denied, the mother said she was previously told that she could either pay a $1,600 fine or try to change the law.Β If she fails to do either, she said, they “made it clear” she could be hit with a $500 daily fine.
Explaining why she’s fighting the bureaucracy, Ray explained:
βFor children with special needs, anyone with special needs, acceptance is a big deal…Unfortunately in our society, you know, people with special needs just are not always acceptedβ¦an animal loves you no matter what. They donβt care what you look like, they donβt care how you talk, how you walk, you know, they donβt care, as long as you love them they love you unconditionally, so thatβs very important to him, for us to have that for him.β
And just to cover all the bases, various news sites interviewed Ray’s neighbors to see if there were previously-unreported complaints to factor in.
“This is the first I heard about it,” Cicely McCracken, who lives across the street said. “I’ve got a noisy dog β a pig wouldn’t bother me.”Β Another neighbor said he doesn’t mind having a small pig in the neighborhood, but is concerned about letting people bend the law.

The definition of livestock is an animal that is kept for meat or fur. The city doesn’t get to make up their own definition of “livestock”.
The protective covenants in my neighborhood prohibit the keeping of poultry or livestock. So I have pet chickens and pet rabbits. The darn pet chickens keep laying eggs though. I told them to stop it but they ignore me. And those crazy rabbits….. they boink like rabbits and keep hopping into my stew pot……………..

While i feel for the child the mother is in voilation of the law that she was well aware of and got the pet anyway. The doctor didnt state she need a pig but an animal, she couldve gotten a dog.

Surrounding counties don’t have the law and the mother followed procedures and filed for a medical waiver not thinking that it would be a big deal, because it shouldn’t a big deal. Just brain dead bureaucrats throwing their weight around. If you had a special needs child i would hope you would do absolutley everything to give the child the highest quality of life. The mother had an instinct that the pig would work for her son and she went with it. Let the boy keep TWINKIE, for goodness sake. Pigs are highly intelligent and are being bred smaller and smaller for pets NOT eating. A pygmy pig or mini pig is no bigger than a dog at less than 150 1bs. and less than 24″ at the shoulder.

She is not keeping the pig as livestock for meat, fur, byproducts, or breeding. She bought him as a pet. Therefore, no laws were broken until the government classified the pig from a pet to livestock based on species rather than based on use.
Fight! There is NO reason she shouldn’t get a waiver!

I have lived in Indiana MOST of my life, and spent much time with Pigs, Cows, and Horses… Pigs can make great pets, and are very loving animals (and typically pretty smart, I had one friend with a pet pig that would put the smartest dogs to shame…) and only an un-informed idiot would deny this child the possession of 1 pet pig…
They are not raising a heard… So you can’t argue that it is a “livestock” animal, since there in NO intention of future consumption…
Simply put, this is the cities attempt of wringing money out of this poor family… Plain and simple.. You don’t ask the city for a waiver… You ask your neighbors if they are okay with it, and if so, you ask that they never say anything… City doesn’t even have to know…

Now, if the animal is taken away, the child will be worse off than if the animal was never given to him. The only person hurt here, if the city doesn’t allow her to keep the animal, is the child. Knowing the restrictions, Mom should have requested the childs needs before purchase. I hope the kid gets to keep his pet pig.

And if I don’t want to live next to people with roosters, then I choose neighborhoods where people do not indulge. I’m not a fan of “owning” property while having no rights to that property without asking permission from the government, thanks.

My point is that this child will be destroyed if the city takes his pet pig from him. The Mother should have thought this through. I’ve always wondered, as an aside, why “law abiding” only applies to normal people and not those in power? But that’s another issue altogether.
Had this woman not done the right thing, and practiced what I do which is “don’t ask permission, ask forgiveness” chances are that pig would have died in the house of old age without a bit of worry.

This woman knew she might be going against the law. It’s not the fault of the mayor. He/She is just upholding the law as it is written. The Mother is at fault here. She should not have purchased the animal until she got a waiver from the city. As I said in an earlier post, the child will be the only one hurt here if the city doesn’t allow the animal.

Seems to me the word “livestock” can be easily taken to court by noting that one does not normally raise pot bellied pigs in order to obtain bacon.

Defining livestock is going to be a problem. Where as going back to the intent of the original law might be a choice educated people would choose.
So often common sense gives way to the urge of some to have power over another.
