Earlier this month, an Oklahoma mother was slapped with a ticket after her 3-year-old potty training son dropped his drawers and urinated in their front yard. Now the officer issuing that ticket has been fired.
According to NewsOK, officer Ken Qualls was fired Friday after a hearing earlier in the week and the case has been dropped. Mother Ashley Warden protested against the ticket but she wasn’t the only one complaining. NewsOK reported Piedmont City Manager Jim Crosby saying that city council members got emails about the controversial public urination ticket from people in Canada, England and Australia.
“Of course we did receive a lot of notoriety over that,” Crosby acknowledged.
The officer with 18 years of law enforcement experience plans to appeal his being fired.
According to Crosby, Qualls has also said that he didn’t see Dillan Warden pee in the front yard, but saw a teen ushering the boy to the front yard location to do his business.

Those on the website In the Line of Duty have begun discussing if Qualls should have been fired over the incident. Here are two opposing thoughts on the situation:
- Ofc52sierra: Would I fire him over this? Actually, YES. He showed a complete lack of common sense. Anyone who would write a ticket because a LITTLE boy peed outside shows absolutely no sense of right and wrong. I’d forever worry about what OTHER mistake he might make.
- Flxn1: If that’s the only thing they had on the officer, no he should not have been fired.

If it shows a pattern of this “Barney Fife” approach, then yes, he should be fired. If it indicates that this incident was an aberration, then he deserves no more than a mild reprimand.

$2,500 for urinating in public? Delinquency of a minor for answering the call of nature? The kid is being potty trained.
Maybe there’s more to the story on both sides. Did the mother first talk back to the cop when he approached to tell her to not let her kid pee in the yard? Was the cop rude and threatening? There’s much more here that nobody is reporting. If not, then the cop IS a risk and needs to at least be reassigned to desk duty. Firing and maybe losing his pension is overkill — just like the fine was!

Nov. 21, 2012 at 5:19pmthis cop was known to hang out at the end of the street that the family lived on for the last few hours of his shift. he simply wanted to be a tough guy. he got what he deserved, and why should the taxpayers pay for him to sit behind a desk for the next ten years or so? just so he can get his taxpayer provided pension? by the way this housing addition was layed out in 2.5-5 acre lots, so its not like he was on main street.

This officer is a bully and if an altercation occurred between the officer and the mother, it was because the officer provoked one by not ignoring the toddler and moving on. Just because he wears a uniform it doesn’t negate him from being in the wrong. IMHO – probable would not have been fired if he would have admitted his mistake and apologized.

Seems to me this cop shamed his handlers. Were there other skeletons in the closet? Not as far as we know. So, yeah, firing for just this one incident seems a bit much. I’m pretty sure this boy and his family aren’t scarred for life. Time to reign in the emotionalism. You’d think the cop peed on someone.

His lack of judgement in this trivial event, renders him not capable of judgement in more serious cases, such as murder, etc.
I don’t know about the $2500 fine. I don’t have concrete info. But, any fine is absurd.

So a city paid to train and equip this officer for 18years and now they let him fire him over a difference of interpretation. That is what our court system if for, that’s why we pay judges not twitter to either enforce the officers point of view of the law or not. So if this is going to be the norm of all laws then why do cities, counties, states and countries even enact laws. Let’s just let humanity live wild and watch how long your peaceful life lasts.

I was speaking about teaching a child lessons in civility and getting along in society. I don’t believe in letting kids grow up thinking that they can whiz any ol’ where they want. That leads directly to joining OWS. :)
If I noticed such a thing, I’d probably mention it to mom or dad, if it was more than one occurrence. If it was out in the middle of the woods, then who cares. But in a neighborhood, it happens, so you use the opportunity to teach the kid something (gently).

No, because it’s the right thing to do. If you see a 5 year old boy, say, running around the neighborhood slugging 3 year old girls, especially habitually, it’s probably a good idea to let his mother and father know. That used to be called neighbors watching out for one another, akin to watching for strange cars pulling up to a neighbor’s home while they’re away.

We lost the election because Romney (1) is a Mormon; (2) spouted that he would pass “Comprehensive Immigration Reform” in the first year in the second debate; (3) agreed with Obama’s foreign policy completely in the last debate.

That job REQUIRES split second thinking that could mean life or death.Maybe not most of the time or even perhaps very much in the past. But the future it looks more like a certainty. I was being quite serious, but as an aside. I have kids, and they were hardly “toddlers” at 3. In fact, my son couldn’t run through the house beating on furniture with his plastic hammer fast enough. Toddler suggests, to me at least, a kid that “toddles” and is just learning the basics of getting around.

I have two children, thank you very much. And I’ve always viewed toddler as a concept for 18 month to about 2.5 years old. I’m not saying I’m right, I’m saying that’s what I’ve always considered it, so clearly I learned it from somewhere. 3 to 4 years old seems quite old, to me, for considering a child a toddler. At that point, I’ve always referred to them as a “child”. But apparently, that’s just me.

Nov. 21, 2012 at 3:02pmThis officer made a huge mistake and really overstepped the bounds of good judgement but to be fired is far too harsh. Yes, he should have been made to issue an apology to the parents and he should have been suspended for a month without pay. To fire an 18 year veteran is as bad as the lack of judgement he used.
The mitigating factor, for the city, might be if he had been in trouble before. Has he ever been cited or disclipined for anything? Has he ever shown a lack of respect toward citizens he has come into contact with? Maybe we aren’t getting the whole story.

Nov. 21, 2012 at 3:58pmYou can’t retrain and 18 year officer – this man is a complete control freak – I’ll be you if we did a psychological exam of the officer he would FAIL immediately. I would expect to see notations of “Napoleon complex” and other issues with this officer.

Nov. 21, 2012 at 4:04pm18 year officers get training all the time (not necessarily re-training, but still training). Ohio has been re-training cops (at least in my neck) on CHL and open carry the last few years. I suspect that some of them have served at least, if not more, than 18 years.

The state of Ohio is a slum compared to where I live in California (on the beach). So you just lost that point.
Moreover, you sound like a government worker – so it begs the question. How do you know so much about policemen and are you a government worker.
Now, do you really want to tell me how I couldn’t afford to live in your subdivision?
How much taxpayer money did you get/steal?

Cleveland is a dump even to other Ohioans. And California is hardly bragging rights. So you pay a lot more taxes, get a lot more intrusive government, and you can’t even carry a firearm for self defense.

1: He has a history of making poor judgement and when this one went national the way it did the town thought “now is our chance to get rid of him”
2: His firing was a knee jurk reaction to this story going into the national news.
My money is on the former of the two.

If it is, why would you fire a flatfoot for enforcing the law???
It’s typical of people these days; blame the messenger, or more appropriately, blaming enforcers instead of legislators. Why blame cops when idiots make these laws??? It’s asinine, really.

Nov. 21, 2012 at 3:07pmAccording to the SCOTUS, they are not in fact required to Protect or Serve individuals at all. This is one of the prime arguments used to open up concealed carry in most states (or was rather, now that they’re all mostly open except Illinois and a few other states).
