Florida Woman Faces 60 Days in Jail After Trying to ‘Ride’ Wild Manatee

Have you ever tried to pet a wild animal? It’s probably not the safest thing to do, but it could also land you in jail with a hefty fine, it seems.
A 53-year-old Florida woman was arrested at the Sears where she works on Saturday after being photographed in late September playing with– and seemingly trying to “ride”– a wild manatee.
The Tampa Bay Times has the wild background to the story:
A bystander got photographs of a woman perched atop a manatee on Sept. 30, and the case gained attention after law-enforcement officials launched a public campaign several days later to identify her.
Shortly after Sheriff Bob Gualtieri’s Oct. 2 press conference to decry the alleged abuse of the animal, Gutierrez phoned the agency and admitted touching the manatee. She later told sheriff’s deputies she didn’t know that doing so was illegal.
The case was referred to the Pasco-Pinellas State Attorney’s Office, which issued the misdemeanor arrest warrant.
Under the Florida Manatee Sanctuary Act, sea cow molestation is a second-degree misdemeanor, an offense punishable by a $500 fine or up to 60 days in jail. [Emphasis added]

Yes, there is a “Manatee Sanctuary Act” that, according to NBC News, makes it “unlawful for any person at any time, by any means, or in any manner intentionally or negligently to annoy, molest, harass, or disturb or attempt to molest, harass, or disturb any manatee.”
Less clear is how authorities determine if– by your negligence– you have annoyed a manatee.
Authorities added that the manatee was not physically hurt, but that the “psychological impact” of the encounter would be harder to evaluate, the Tampa Bay Times relates.
During a press conference Sheriff Gualtieri told Gutierrez to “go ride a jet ski.” She has been released from jail on a $1,500 bail.

Did this woman lasso it? or otherwise detain it? I think the Manatee would have exited stage left if it were offended. It was free, right? I’ve had a Bobcat sit next to me in the Forrest. I was there, he approached and sat next to me. Did I violate his rights?

This type of statement and this type of article causes psychogical damage to the reading, thinking and voting members of a free country. STOP assuming animals are people and wanna be your friends. That’s about all this gal is guilty of… but the king…er, gubment… has laid claim to all the deer… and the manatees.
Maybe we should get a manatee whisperer on the case. This will require at least tens of millions of taxpayer funds to make sure the manatee’s chi is centered and its chakras are realigned.

So, she’s a local and SHOULD know better. I did two tours in South Florida (NAS Key West) and was quite well aware that you are not permitted to play w/the local fauna. FMP will arrest you and prosecute you if you do. In this case, it was the local rather than state police that arrested her.
Florida is NOT some gigantic theme park in which you are nestled in a petting zoo. Manatees are protected because they are endangered and mild mannered, even if they are not habituated to humans.
Neither can you go out and play w/the ubiquitous dolphins that are in the wild. You can swim w/them in certain controlled parks. Dolphins are not mild natured; the males will use you for a beach ball and good luck w/the females pushing you back up to the surface for air.
Again — Florida is not some state-sized theme park. It is a state that has a right to protect its wild animals and wild areas, be they in the waters or ashore.

This is a case of common sense being thrown out the wind. This women is most likely born and raised in the US and like most unfamiliar with the PETA like laws emposed on US citizens. Common sense says that if she has no criminal history and the animal wasn’t hurt let her off with a warning. This is getting too stupid to real.

Manatees are behemoths and the near-match size of the woman notwithstanding, manatees can injure a person pretty baad. If you think riding manatees should be not restricted and people should be allowed to act stupid and face the consequence of their behavior (I’d be inclined to let the natural course proceed, I am a fan of Darwin Awards), then change the law.

I know that they are protected, you are supposed to look out for them while driving a boat and so on. Common sense stuff… But I never knew of the rest of the law. What a citizens supposed to do? Read the law books everyday, should we all become lawyers? Why doesn’t the state hands out each person visiting Florida a oak with all the existing laws. I never got my Florida law book from the state when I moved here. I never got any updates. At lease the state hound issue everyone a free Obama phone so we can check the laws on the Internet before we do anything including flushing the toilet the proper way. Give me a freaking break…. She was stupid for doing what she did but arrest her…. Hey cops, go arrest areal criminal…. Probably not because you are too busy eating doughnuts and chasing honest people.

It’s not illegal to touch a manatee, only to “harass” one, whatever the hell that means. From the picture it is not even evident that she is riding it. You would need video to prove that. I’ve seen these things up close while diving and I don’t think you could ride one. Their giant tail would swat you right off, assuming you could even get a hold on the big slippery thing in the first place. This happened in the county I live in. Apparently there must be no REAL crime here and the police are getting bored.

Unless there is much more to this story, I am absolutely ashamed of a number of people in this case.
Was she aware of the Manatee rules? Is riding a Manatee actually molesting it? Did the Manatee like it, or dislike it? Did anyone ask her to stop? Was she stabbing or otherwise injuring the Manatee?
Or was she simply swimming and saw the Manatee and approached it and when it let her ride it, she did? Was she simply interacting with an animal, as humans have for the last 50,000 years?

It is sheer STUPIDITY to harass ANY wild animal. There are also warning signs marking sea turtle nests as well on our beaches. The wildlife here is an asset the people in this state takes to heart.

My concern is that our society has gone very out of whack when it comes to criminalizing EVERYTHING! As I recently heard, you cannot be awake for more than 15 minutes without breaking some kind of law.
This is the opposite of Liberty.
Did you read Glenn Beck’s “The Overton Window?” It talks about the theory by that same name. The theory that if you push what is acceptable to people to extreme limits, then “the norm” because a bigger and bigger window. Such as the concept of arresting someone for riding a manatee would have been absolutely ridiculous at one time, but now it is defended.
Just as arresting a parent who is arrested for leaving her 13 old child at home babysitting her three younger siblings. One of the children sneaked outside and crossed the street. A neighbor, instead of grabbing the kid and bringing him/her home, called the police! That is insane! But it happens. Some people defend it. Some people realize that we’ve gone too far. The window has been pushed to extreme limits, and all of it has to do with us losing our Liberty.

Posted on November 25, 2012 at 1:35amThe call to issue an arrest warrant was made by the state attorney, not the sheriff. Most LEOS will tell you the safest place to arrest somebody is often at their job, they are less likely to have people interfere and are less likely to be armed. Last year in St Petersburg two officers were killed serving an arrest warrant. There was a lot of publicity when this happened, so her employer was already aware of the incident.

Being arrested seems that it would be a life altering event. One that a typically law-abiding citizen should never be subjected to. One that would stop a person from feeling “secure in their persons, houses, papers, and effects, against unreasonable searches and seizures.”
And according to other reports of the story, she had actually called the police to say that she was the one who touched the Manatee. Then one month later she was arrested at Sears where she works. Her pictures have been blasted all over the internet, and now there is a mug shot of her as well. This is a 53 year old woman. She is probably a Mother and maybe even a Grandmother.
Agenda 21 is ruling our world, and this seems to me to be another prime example.
Unless there are facts to the story that I am unaware of. And if so, then maybe I would stand corrected.

The police in Florida should be more concerned with the boaters driving drunk and/or recklessly (as they acutally do harm to the manatees).

I lived in South Florida for 16 years and I’ve seen some really stupid people do some really stupid things with wild animals some even died or seriously hurt the animal for no reason other than to amuse themselves or others. These laws are there to protect the animal and the human. Would if the manatee grabbed her with its mouth and hurt this idiot female or killed her? Idiots like this female need to find some respect for the creatures that live on this Earth with us. Would it be okay if someone wanted to play with bald eagle chicks? Or put a saddle and bridel on a polar bear? Does the death of the woman trainer at seaworld being killed by a killer whale make it any clearer? Manattes are normally very docile creatures and will swim with you, but that doesn’t mean you can jump on its back. It’s about respecting the natural world around you.

For those of you NOT from Florida you may not know how abused these peaceful creatures are and why we here in Florida have VERY strict laws involving this. She was not a brain dead tourist but a brain dead native that SHOULD know better!! Max out her sentence to the fullest and publich her photo and crime in EVERY paper here!!

Problem….. Slowed the boat a bit and lowered fuel consumption. That was enough to kill it and to keep the / / / / / / Manatee scars.

I just saw it for the first time last night. It is a reality show where you pitch a product to millionaires/billionaires, and then are either “not interested” or “in”. If they are “in” then they haggle with you to get the best bargain. But basically you bring a dollar amount of how much you need to have invested, and then how much of your company you are willing to give away for that. (a percentage.)
This kind of product is right up their alley. The only problem is that part of their fun, is cutting you down. But they do throw around a lot of great business concepts in the process. It’s educational, at least for me.
But from a marketing standpoint, introducing a Manatee to the Shark Tank, could be brilliant!
The only risk is total humiliation at the hands of the Sharks. If you’ve never seen it, I’d watch one episode if I were you.
