A northeast Ohio man accused of making fun of a young girl with cerebral palsy has been sentenced to nearly a month in jail.

Canton Municipal Judge John A. Poulos gave William M. Bailey, 43, the maximum sentence Tuesday after Bailey pleaded no contest to reduced misdemeanor charges of disorderly conduct and aggravated menacing, the Canton Repository reported. He will report to jail in January to begin a 29-day jail sentence and will pay more than $400 in court costs and fines.

Bailey and his 9-year-old son were caught on video apparently mimicking their 10-year-old neighbor Hope Holcomb’s limp. The footage went viral last month, though Bailey insisted he was not mocking Holcomb and was reacting only to name-calling directed at his son, the newspaper reported.

A statement distributed by Bailey’s attorney after the court hearing said: “To Hope and her family, please accept my apology for my inappropriate behavior. I know that my actions were immature and lacked the respect you deserve. I didn’t realize the impact this incident would have upon both of our families and I truly regret it.”

Bailey also wrote a direct apology to Holcomb. Her mother, Tricia Knight, told the Repository: “I know he doesn’t mean it. I know it’s crap.”

Knight said her daughter has been deeply upset by the incident.

“She wants the blinds closed. She doesn’t want to be outside,” Knight said.

    I think the family should not have had him arrested but they should have sued for it, hitting the father right where it hurts, the BANK ACCOUNT!!

    It’s not a criminal case and how long will he actually stay in jail, story says 29 days but he’ll get out early for being nice. Now if they sue then that money is gone never to get it back and that would hurt way more!

      Really?!? You think that filing a lawsuit on no grounds whatsoever instead of the parents, or more specifically, the father of this little girl standing up for her and dealing with the problem on the spot, is the right thing to do? Since when are we a nation that has to use laws to coddle everyone? No adult should mock a child with a disability, but should that be a criminal offense or even the subject of a civil suit? I say no. Not unless he was committing the act on the family’s property and then it would be a trespassing issue.

      I don’t know about you, but I took an oath to the Constitution. Now, if I have to stand by and say that the Hilsboro Baptist Church is practicing their freedom of speech when they go to funerals for fallen Marines and the like, then you can be damn sure that I will say that while this man’s actions were distasteful, lewd, and immoral; he broke no law.

      As an aside, the father of this little girl looks like he is lacking in the man department. I’m pretty sure that his wife wears the pants. Maybe that is what is really wrong with this situation.

      The community won’t do much as these guys are probably already on the outs. Most of those types only respond to physical force – and ironically are the first to press charges.

      Family is simply left with is the law. Sucks that men are no longer a part of society.

      The man yes was clearly out of line and immature as he admits and apologizes for. Thats where this should have ended. The mother says his apology is crap! Once someone apologizes and it appears to me that his words are regretful and he is taking responsibility for what he did then the ball is in the corner of the folks whom he offended.

      Jail time? Hardly!! If this is the new precedent, then anyone can be jailed for just about any perceived slight. We will need to build more jails if this keeps up.

      How about work place violence where someone who survived and went through the violence in the work place, then at a later time feels threatened by a coworkers glare or quick response to being surprised from behind? Are we then going to have people removed? I’ve already seen this done and it happened 6 years after the tragic event. If people are given an excuse to FEEL entitled to some kind of special treatment by society, they will then lean on that and keep the fires of victimhood burning brightly within them and sometimes more than not, for all to see.

      Thought police on the move. Even if what you have done is really only immature, vile, cruel and ugly, gov’t officials, in this case a prosecutor and judge, will find a way to make it a “CRIME” so you will go to jail–and for how long? How long will this man’s family be disrupted because he behaved childishly and with a total lack of feeling and forethought for a few moments? Doesn’t he have a right to be a dufus? I feel very badly for the hurt of this little gal and her folks, but I feel a lot worse about what this sort of case presages for America’s future.

      If he went to jail just for mocking her, that would be a violation of free speech.
      However, if he was harassing her and committing aggravated menacing, that’s where it stops being free speech and starts being a crime.

      I don’t know about you, but I’d like to know why someone was sentenced to JAIL for being an *******? An apology should have been enough! If his community decided to ostricize him, fine! That’s his communities decision. But JAIL? Seriously?

      We’re officially no better than the UK who routinely jails their people for saying stupid things but only give out warning cards to YOBS (thug youths) who vandalize and assault people!

    What a douche. He should have an unfortunate “accident” falling down some stairs and into a dumpster, but in no way should the government be sending him to jail for being a douche. I’m sorry but everybody look out for the Feeling Police!!! What he did was terrible and despicable but people do that everyday and they don’t go to jail for it nor should they! Freedom of speech means he can say what he wants to that little girl…but I would fully support her father in his efforts to beat some sense and respect into that piece of trash!

      I have a handicapped son. If I tried to prosecute everyone that makes fun of him, I’d have a never ending job. I’ve had mothers steer their children away from him in a public park, had a “friend” at CHURCH make fun of him (dealt with that one through the parents, only to find out they have a family member that’s disabled….hate to be them). It’s part of life. I got teased for being smart, how I wore my ****, having braces, and on and on. It’s sort of a right of passage and makes you stronger. Yes, the parents should have spoken to the man, confronted him, and shamed him, but prosecution? Like a previous poster said, the government is setting us up to accept people being jailed for criticizing Obama….it will be called treason to even think bad thoughts about the messiah O.

If he was born that stupid, he would have been picked on enough to know what it feels like. He’s lucky that little girls dad didn’t get at him before the system did. I hope she comes to realize she’s more valuable with her physical issues than he is with his video cam. With his criminal record, and everyone knowing why he got in trouble, he’ll have a hard time providing for the boy he was teaching to be a jackass like him. Hopefully he’ll be too ashamed to come back to the neighbourhood, even to pack up.

    I would imagine the shame and humiliation this guy felt after all the bad publicity would be enough punishment.We don’t need to go around jailing people for rude or disgusting behavior.
    Disorderly conduct?Aggravated menacing? Really????These charges should be reserved for real criminal activity.
    His apology was sufficient and all was needed was a stiff warning from the Judge to not let it happen again,period.

      A stern warning from the judge. Are you serious? Look how well that has worked over the past 30 years with teenage delinquents. This man and his son need to learn that actions have consequences. They have emotionally damaged that young girl and need to pay the price. I have been the recepient of a ‘court-ordered apology’ myself and can recognize the weasel-wording used to satisfy lawyers.

      This man should have known better. I hope his son learned a lesson from this example.

      This fool is guilty of child abuse which is defined as sexual, physical, mental, and or emotional trauma. Because of her disability she is more susceptible/sensitive to this harassment than most people.

      Thirty days in the local lock-up is light in my opinion. I stand by my original statements. Laws are made to protect the innocent in cases like this. Do we chose which laws to enforce or ignore? That leads to anarchy.

What happens next time someone tells a dirty or racist joke? You goto jail for offending anyone of any race or either gender. This is a slope that once on we will not be able to get off.       I wouldn’t need the courts. Let catch some ass neighbor of mine mock my child on video who has a debilitating disease (thankfully I don’t have a child who’s handicapped) that she’s trying to cope with daily. I’ll be the one in jail after he takes a trip to the hospital as I unload 30+ years of martial arts training on his ass. This neighbor is a jerk and I have no problem with him going to jail. I think freedom of speech should end when an adult purposefully makes fun of and mocks a 10 year old girl. Like I said, I’d be in jail. I get angry just watching the video.

      No Jeet, it shouldn’t end at your crappy completely arbitrary line in the sand for free speech. This is a blatant affront to the constitution. Is this guy a total dick whom i would laugh at if he punched in the jaw? Yep. But the government punishing him is unacceptable,unconstitutional, and shouldn’t be left alone. Who’s next? People who make fun of Islam? Christianity? Scientology?

      That man was a bully. Not only he bullied a handicapped little girl, he teached his son to do it also. There’s two victims. Freedom of speech?…come on…that’s an abused right…used to protect certain misguided conducts…censured and criticize for others. The law is not clear about this…it seems to be something that’s interpreted according to the eye of the beholder.

      FREEPROO8~ Your joking right? Freedom of speech is abused? You need to reexamine if your not kidding, what right is next to be abused? Let’s just get rid of those rights then since people abuse them. Then you won’t be able to have a critical public opinion about certain things, then what? The law is DEAD CLEAR, he has every legal and constitutional right to be a massive douche like this if he so wants to that isn’t up to interpretation. This judge should be removed asap for this.

      JOHNNY@- People interpret freedom of speech as they conveniently think. Is not clear when is correct or when overstep some boundaries. As you may notice in many of this posts, there’s some disagreement of when the use of the freedom of speech became just hurtful or plainly wrong. I think abused is not the correct term to describe the constitutional right but you have to agree that’s isn’t entirely clear. Freedom to speak whatever I might want to speak? Individually that’s something any person can do, even in the most of the oppressive governments exist today or ever existed. The consequence, that’s another matter. In this case the judge just apply some existing law. He didn’t made the law. The accused person didn’t contest the charges. You think the judge did wrong? He just apparently interpreted that in that particular case freedom of speech didn’t apply to justify the action.
      Use words to purposely and intentionally and just for fun hurt someone is not right. Bullying isn’t right in any place. Many childrens live in hell everyday in schools around America because some inmatures exercises the freedom to speak stupidity just for fun. Look what happened in Columbine Colorado. Kids get abused verbally, just for the fun of others. They growth and someday they decided to exercise the freedom to express what they think about the freedom of speech of others. Did they have the constitutional right to defend themselves? Is was right?
