Republicans Defeat Ratification of the U.N.’s ‘Rights of Persons With Disabilities’ Treaty in Senate
The Senate failed to ratify a United Nations treaty that many felt could usurp parents’ rights after a big push Monday from conservatives to call senators and voice opposition.
Many Republican senators rejected the U.N.’s Convention on the Rights of Persons With Disabilities treaty, which was modeled after the Americans with Disabilities Act. Prior to Tuesday, a majority of Republicans had already said they would not take up the treaty during a lame-duck session.
With 38 Republicans casting “no” votes, the 61-38 vote fell five short of the two-thirds majority needed. See how each senator voted here.

The treaty urges nations to strive to ensure that the disabled enjoy the same rights as their fellow citizens. Those opposed to it, like former Senator Rick Santorum, said it would have the potential to trump the sovereignty of U.S. law. Santorum, who has a special needs child himself, had voiced opposition several months ago from a parents’ rights standpoint:
This means that the Federal government, acting under U.N. directions, can determine for all children with disabilities what is best for them. The second, the education provision of CRPD does not support the parental rights rules of past U.N. human rights treaties. Omission of these rules would potentially eradicate parental rights for the education of children with disabilities.
Santorum called into the Glenn Beck Radio Program Monday to continue spreading his perspective before today’s session.
Many pro-life groups, according to Life News, opposed the treaty as well for measures they felt could support abortion and sterilization:
Bradley Mattes, president of the International Right to Life Federation, stated, “This is a misleading measure in that it does nothing to protect life. It is disguised as a way to ‘help’ the disabled. Instead it intentionally sacrifices the most vulnerable – the disabled and the unborn – all in the name of population control.”
He continued, “Many don’t realize that this international treaty could potentially supersede future attempts to overturn Roe v. Wade.”
The language in Article 25 of the treaty that pro-life groups oppose reads that it would provide “free or affordable health care including in the area of sexual and reproductive health and population-based health programs.’” Life News reported Tony Perkins, the head of the Family Research Council, translating this to mean “the global community could force America to sanction sterilization or abortion for the disabled–at taxpayer expense.”
Supporters said the treaty would ensure that the United States remains the world leader in promoting rights for the disabled. Among them was former Majority Leader Bob Dole, who was disabled during World War II, and Sen. John McCain, who suffered disabling injuries in Vietnam.
The 89-year-old Republican sat in a wheelchair in the well of the Senate on the GOP side of the chamber, his wife Elizabeth nearby. Dole recently had been hospitalized but came to the Senate to push for the treaty.
“It really isn’t controversial,” Sen. John Kerry, D-Mass., said in defense of the treaty. “What this treaty says is very simple. It just says that you can’t discriminate against the disabled. It says that other countries have to do what we did 22 years ago when we set the example for the world and passed the Americans with Disabilities Act.”
“I am frankly upset,” said Sen. Chris Coons, D-Del., “that [Republicans] have succeeded in scaring the parents who home school their children all over this country.” He said he said his office had received dozens of calls from homeschooling parents urging him to vote against the convention.
The treaty has been signed by 155 nations and ratified by 126 countries, including Britain, France, Germany, China and Russia. Supporters like Kerry said that the treaty requires no changes in U.S. law, that a committee created by the treaty to make recommendations has no power to change laws and that the treaty cannot serve as a basis for a lawsuit in U.S. courts. Opposition had voiced concern that the states would need to report to this committee to show they were in compliance with the treaty.
“I do not support the cumbersome regulations and potentially overzealous international organizations with anti-American biases that infringe upon American society,” said Sen. Jim Inhofe, R-Okla.

Why then, do we need to make ourselves subject to an extra international law oveseen by the UN. The Republicans didn’t vote against the substance of the law, but rather the unnecessary oversight that comes with it.

This is a little off topic, but if you want to defraud the gov’t and go file a false disability claim so you can get a lifetime paycheck from uncle Sam, then you better get out and hurt that toe or hit yourself in the head. What is so sad is that there are people that are really disabled, but these Obozo supporters have eaten up all the disability money.
A month before your birthday the Social Security Dept will mail you a letter that shows how much your approx. SS benefit will be when you hit 62 or 65. The statement also shows you how much your lifetime disability payment would be if you had a hurt toe today. Say your forty years old, and you can’t find work. Would you rather make up a false disability claim and get a lifetime amount that will be the same as your social security, or would you rather make equal to or less money working?
Duh….is something in the air that causes an inordinate number of people with hurt toes, bi-polar, and hurt shoulders? Made up claims that keep the real disabled from getting valid claims paid. Obozo’s all approve fellow Obozos claims first and deny the Fat White people claims first. Bar none. Who’s Racist?

So to be clear…you’d argue that this is somehow insufficient and that we need MORE laws and to suggest that we have enough (or too many) is heinous and disgusting. Makes total sense. /sarc

As far as any modern day UN treaties or iniatives; the one that the progressives tried to get through was for the disabled. But, it meant that the nation with the best program for aiding the disabled would turn over their rights to countries that believe the mentally deficient should either be put to death or locked up in institutions. Do you really want the Iranians making rules for the handling of the disabled? You liberals need to wake-up, some of these countries think YOU are mentally challenged. You liberals are so afraid of Christians you have forgotten that Muslims would put you all to death if they had the chance. Iran has NO homosexuals. The penalty for this in Iran is death.
Remember folks! Treaties become the Law of the Land in the US after ratification by the Senate. They will try for the UN Small Arms Treaty, The UN Law of the Seas Treaty (good ol’ Jesse Helms stopped that one in the 90′s) . Nothing . . . .nothing out of the UN is good for America. Only until we have one more Supreme Court Judge who believes that International Law should trump the US’s Constitution. Part of our supremes are on record of saying they can and should take international law into consideration when making interpretation of our laws.

Ok we already have the ADA. If the UN wants to set up a model of our ADA for other countries to pass then go for it. The treaty can be amended at will by a simple majority of the co-signers into anything they want. We exceed the current standards of the treaty already. Why set us up for real surprises later on.

Doesn’t differ from current US law one bit. Perkins and Santorum see the word ‘reproductive health care’ and have an evangelical hissy fit. Same language in the ADA and Santorum supported that in the Senate. It was an opportunity for the US to share some moral leadership in the world. 38 Senators said ‘no, let China and Russia and France stand up for the disabled, after all ratifying the treaty would have required us to do nothing, and apparently that’s too much sacrifice for some.’

The ENTIRE point of signing anything from the UN is to validate the UN as having a say over us as Americans, which is absolutely something we neither want nor need. Furthermore, their idiotic treaty with America over our special needs people, as most things generated from the Socialist Democrats, will morph into something we TRULY regret. Imagine, if you will, once the treaty is signed, if it had passed, the UN deciding that they now have a say in my son’s healthcare- and THEY decide he has to be sterilized, and if he refuses, they can find him at some sort of fault and say he no longer has the capacity to make his own healthcare decisions, since he OBVIOUSLY made a wrong one, and they toss him into a public facility to be monitored.” They will FIND the ability to do it. To, essentially, take him away from his home, and his mother’s happily-given lifetime care, which will absolutely terrify and torture him. Do NOT give the stinking UN ONE bit more control over Americans.. We don’t need them, and don’tt want them meddling! substitute the word “intelligent” for the word “Republicans” in the article and in the comments, and you will then have the truth. If you’ve read the entire treaty, then you know that Article 18.2 requires that “Children with disabilities shall be registered immediately after birth…..”. What possible explanation could there be that would make this okay with ANY parent? Why do they need to know who and where all the disabled are in the world? Too creepy… can’t help but conjure up those Agenda21 population control plans. We should be concerned about our children’s privacy, disabled or not.. and we don’t need some council of non-elected foreign bureaucrats to advise us on the future of disability law in America.
As with most intiatives from the UN, this is about power and money. If they want to study and emulate US disability standards/law, they can easily do so. The information is readily available.

I took action yesterday and this morning informing family friends, emailing and calling Senators. Watched the vote live and tweeted and hit social networks sites and informing family that it did not pass.

It left me with a broken back that will never heal, and now I’ve lost all the cartilege in my knees. Neither the government, NOR the UN, has any business deciding my future healthcare. I am a mature intelligent adult who can make that decision for myself. I live in fear of Agenda 21, ever since ODumbocare was passed. Who are THEY to decide I’m no longer a useful member of society? I have four nieces who would disagree pretty violently with that!

Anytime the United Nations wants to put any requirements on individual US citizens it should be fought. On the rare occasion the UN has a good idea- our Legislative Branch can massage it into a bill that fits the concept, without binding us to some BS UN treaty.

Parents right to raise child would be become the right of Government. Most of the UN Treaty would force women to abort defective babies or face law suits. Its a law that could never pass Congress but was an attempt by Obama the Killer to bypass the Constitution.
Treaties cannot be repealed.

Therefore if your child gets sick oh well too bad. Sucks to be you.
Or your wife discovers she is pregnant and the child is discovered to have the down syndrome gene or some other gene that would cause a disability, so the U.N. tells your wife she must abort that child. He/she would not be good for the collective.
