Calif. Student Sues School After Allegedly Being Suspended for His Politics (And He Has Some Noteworthy Video Evidence)

A California conservative at Fresno State University is suing his school after allegedly being put on disciplinary probation because of his politics.
The school’s leadership– particularly University President John Welty– is reportedly outspoken in its support for liberal policies like the DREAM Act. The school’s newspaper took things so far last May that they published a poem that begins: “America, the land robbed by the white savage.”
Neil O’Brien is active in student government, and has made no secret about his opposition to the DREAM Act. He decided to ask the professors in the Chicano and Latin American Studies Department– at least one of whom seems to be a faculty advisor for the paper– what they thought of the poem.
Fox News has more on what happened next:
When O’Brien approached the professors separately in their offices, the same thing happened in each case: they said they didn’t want to talk with him. Openly recording the encounters on a video camera, O’Brien told them he just wanted to ask questions. They again told him to leave, and closed their doors.
What happened next is what got O’Brien in trouble: The professors called the police. According to police reports, the professors said that O’Brien had been “threatening” and “harassing” them. Police took O’Brien in for questioning, but decided not to file charges after watching video he took of the incident (which O’Brien has posted online here.)

Though the police chose not to pursue the matter, the school seemingly felt that punishment was still warranted.
Fox News continues:
O’Brien’s troubles continued when he was called into the Dean’s office and told he would face a disciplinary hearing in which he would not be allowed to have a lawyer present.
In the disciplinary hearing, O’Brien says he repeatedly asked his questioners to watch the video of the incident – but they refused, even though he brought a DVD with the footage to the hearing.
University Vice President Paul Oliaro ultimately gave O’Brien disciplinary probation for a semester – which forbade him from serving as the president of a student group he formed (a chapter of Young Americans For Liberty) and banned him from going “within 100 feet of the Chicano Latin American studies faculty or staff or their offices or classrooms in which they are teaching.”
“You can see that even though the video completely exonerates me, I still went through all this hell,” he told FoxNews.com.
In O’Brien’s opinion, the only conclusion is that he is being reprimanded for his politics.
“I can’t think of a reason besides that they just don’t like conservatives, and just don’t like to answer questions on anything,” he remarked.
O’Brien’s lawyer, Brian Leighton, added: “What these professors can’t stand is that Neil shows up to all these university meetings… and he says what he thinks.” O’Brien emailed us a full copy of his complaint– read it here.
School representatives say they cannot provide details on the case, since it has to do with disciplinary action against a student, but insist that personal politics were unrelated to O’Brien’s punishment.
“Fresno State strongly values and supports the First Amendment rights of all students, faculty, staff and administrators. We encourage individuals to exercise their freedom of speech, provided they do so in an appropriate manner,” the school’s spokeswoman Kathleen Rhodes Schock commented.
Though this is related to politics, it should be noted that a quick Google search reveals O’Neil seemingly had a website called “therealpedro.com” about the “lies, crimes, and possible cover-up” of the school’s president Pedro Ramirez, who was found to be an illegal immigrant in late 2010. The website has not been updated since May.
But O’Brien remains firm: “This school is totally Orwellian…I just want to share my opinion when I disagree, and I shouldn’t be treated like a criminal for it.”

I imagine if a student in at any university in the country walks into a professors office and refuses to leave when asked (the first guy was helping another student) then they are violating school policy.
This has nothing to do with politics. This was just amateur ambush videotaping, hoping to get a reaction. Nobody should have to put up with that.
Here’s an test. Walk into anybody’s office, at a University, business or a police station or wherever and refuse to leave and see what happens.

Consent is required before law enforcement records you. Any other person who is a party to a conversation can legally record it.
As for the rest of your weak argument – these are not passers-by he is asking. They are faculty. In particular, the first gentleman is the faculty advisor to the student newspaper that this student is questioning. He is EXACTLY the person that should be questioned.
Instead, asking this faculty member about the article that he sactioned as faculty advisor is considered ‘harrassment’ and the student is disciplined.
I hope the lawsuit is successful and very, very public.

And you’re also confused. This guy could have made an appointment with the professor or waited until the professor was finished with the other student or whatever. And, if the student actually wanted to discuss the issue and his complaints, he wouldn’t need the video tape or he wouldn’t have refused to leave and whatever else.
This was a transparent effort to harass and embarrass the professor, nothing more. Please. I know you’re not stupid. This is hardly the way mature people discuss issues. This is a James O’Keefe wannabe, who is on probation by the way for trying to secretly record conversations an elected official. He was convicted, in case you’ve forgotten.

When the school Newspaper published such things as that poem, it is necessary to confront the font of such incitement to violence directly. Poor wittle prof could not stand the light of day. Every professor should be able to withstand the scrutiny of any & all class lectures taped & put on the internet or cable access channel.
By definition there are so many people in a classroom that it is public.
The poem reminds of the book “A Land so Strange”. You read the book find out who the Mexicans are, white fathers & Indian mothers (A lot of Iberian Y chromosomes & Indian mitochondria). So they Mexicans are better than us non Mexican, because their paternal ancestors raped their maternal ancestors. LULZ! Those same Spaniard/Indian mix came north & conquered the Pueblo. Of course those people were happy to be conquered because they rose up in the Pueblo Revolt of 1680, or Popé’s Rebellion.
But it is all copasetic because they did it before the Anglos got here so that makes it legit!

Higher education are not places of new ideas or academic and political freedom. Under a one-party consent law, you can record a phone call or conversation so long as you are a party to the conversation. Furthermore, if you are not a party to the conversation, a “one-party consent” law will allow you to record the conversation or phone call so long as your source consents and has full knowledge that the communication will be recorded.”

Parents probably are not paying most of the bill for these students= you and I are with our grants, taxes, loans that will not get paid back, welfare, etc. That is why schools can get away with this stuff. The newspaper sponsor should get fired, and not hired elsewhere for that vile poem. Makes you wonder why the immigrants want to come to the US so badly if they think so poorly of the country. Does not make sense.

Speaking of reading, did you even read the entire 61 page complaint that was filed by the student (plaintiff) to the court? This is about much more than recording a conversation, which was fine. Obviously if it was illegal the campus police would have done something about it yes? This student should win this case.
However, I would like to hear your opinion about the behavior of the faculty in all matters pertaining to this case and not only the faculty, but the fact Pedro Ramirez, an illegal alien, was attending the university, registered to vote, and also driving illegally. Also, what is your opinion of the poem published by the school’s newspaper?

My stand on immigration is that they learn English. English is for governance. We speak different languages at home or social occasions or whenever. In my family you can find people who can speak non English languages fluently. So I have nothing against foreign languages. You cannot govern well with multiple languages.

After watching the video I am annoyed at the idiot trying to make something sensational out of the paper with a ridiculous attempt at cornering these professors. He was in the wrong and deserves his punishment. His attitude was aggressive and confrontational. If he had genuinely wanted an opinion, he would have gone about getting the video in a different way. He was trying to be belligerent and that is what he got in turn. I am sorry I can’t be more indignant about the racism at the school, but when our side approaches the issue this way, I have to call it like I see it. He was wrong.

It will get far worse. While gun sales are at record levels with no hint of slowing down, more preparation is a necessity. People MUST form neighborhood defense groups within their suburbs, because they will be the first to be attacked by these white-hating crazies of all colors and stripes.
We, in the countryside, have formed our militias and we’re adding more every day. We own the rural areas surrounding the urban cesspools, and we’re prepared, but I’m afraid our suburban neighbors are not.
Just having guns won’t protect you. You must be uinified and form together in groups to be really effective.

They are not going to allow their schizophrenia to be filmed. When they do allow filming, the truth will not be found. Does this mean that the only way to expose these people is to carry a hidden camera like James O’keefe? Does anyone think the outcome would be different if these encounters had been secretly filmed? Would a secret filming hold up in court or would he be in more trouble? How do we get to the truth…just wondering? I’ll bet the prof’s actions will still be excused… rf

After all since it was clearly in his hand based on what we saw on the video both professors did not ask him not to record. I believe the law only prohibits recordings without an individuals knowledge – hidden microphones, camera’s or even recording a phone conversation. Not sure though.

The student broke state law, in addition to school code by recording without the teachers/faculty’s consent. Look up the laws. The student is in the wrong here.

Posted on December 13, 2012 at 11:42amNo, a news crew has permission to film in PUBLIC PLACES. That is why you see camera men and news reporters ambushing people off of the lots of private property, and not just bursting into private offices of CEOs and the like. The school itself, specifically the offices of teachers, are considered private property, and in those types of situations both parties must consent to being recorded.
It takes about 30 seconds of Googling to figure this out, in case you’re interested.

You may be correct about filming on private property in CA….or, maybe not. The question still unanswered is, “with the camera in full sight, and no objections coming from those being filmed, is there implied consensual agreement and therefore allowable?” Progressives like you always overlook and divert attention away from the bigger underlying question. If someone is using the law to hide and cover up immoral, illegal or just plain wrongful behavior, do additional considerations need to be given to the case? Again I would refer back to James O’Keefe. Does exposing federal employees breaking the law, justify a hidden camera to do so? Why not?…federal employees use cameras to catch citizens in wrong doing all the time. Turnabout is fair play in my opinion. The ultimate battle here is – do we allow Progressives to use selected portions of the law or the Constitution to destroy the rule of law and the Constitution? By definition, a “public place” is (from uslegal dot com) “… generally an indoor or outdoor area, whether privately or publicly owned, to which the public have access by right or by invitation, expressed or implied, whether by payment of money or not, but not a place when used exclusively by one or more individuals for a private gathering or other personal purpose…” So, as a paying student or myself as a visitor, the “whether by payment of money or not” would definitely apply. I can stand in public a public area and video a private area (stand in the hallway and video through the open door of an office – close the door if you do not want to be on video, which was done). A campus is a public place and, by the given argument that news crews can video while at a public place… I rest my case.

These professors need to be put in their place and reminded of where they work and what their job is supposed to be. Being a Hispanic and conservative in college was interesting for me. Many didn’t know what to say when I shared some of my views and knowing where I came from (poverty) they assumed I was with them and all about taking what I didn’t work hard to earn.

The atheists are trampling our right to freedom of religion.No one cares or is doing anything about it. They are taking down the nativity scenes, crosses, use of the very word CHRISTMAS is even forbidden. Libs get their news from the comedy channel!!!! What a joke. And they listen to the massive lies and believe them. My 2 sons are libs (sigh). I tried to have a reasonable, logical conversation last week. I asked my son if he thought someone should be given a credit card without a limit on it even though they didn’t have the money to pay the debt. His answer: “yeah, I dont think I’m going to have this conversation with you”. Now, that’s willful blindness and hypocrisy, the hallmark of every lib………..He knew the right answer to the question should be HELL NO!!!!

The real war on Christmas is by the people who make it about Santa, and Rudolph and all that cheap tinsel and lights. Christmas is a holy day, best celebrated with family and friends.
