Two women from Irving, Texas are suing state troopers and the head of their department in federal court after they say they were forced to endure an illegal and humiliating “roadside body cavity search” during a routine traffic stop, The Dallas Morning News reports.

The case is currently under investigation by the public integrity division of the Dallas County District Attorney’s Office and will go before a grand jury in January.

The dash-mounted camera on a trooper’s vehicle reportedly captured the entire incident on video. Angel Dobbs, 38, and her niece Ashley Dobbs, 24, say the unlawful search happened on the night of July 13 along a state highway.

In their lawsuit, the women allege that a female trooper, identified as Kelley Helleson, used her fingers to search both their anuses and vaginas with the same latex glove. To add to their horrific experience, the women say they were on the side of the road in full view of passing vehicles.

The video from the car’s dash cam clearly shows a female officer feeling around both women’s breasts and then sticking her hand down the front and back of their pants, wearing latex gloves.

According to the lawsuit, David Farrell, a Texas state trooper, pulled the car over after seeing the women throw cigarette butts out of the window. He reportedly questioned them about marijuana and then called Helleson to the scene to assist him.

Farrell requested the search because he said the women were “acting weird,” the suit said.

Farrell searched their vehicle for marijuana but didn’t find any, they said. He then tried to “morph this situation into a DWI investigation,” the lawsuit said. Angel Dobbs passed a roadside sobriety test and the women were given warnings for littering, the suit said.

During the search of Angel Dobbs’ anus, Helleson irritated one of the cysts she suffers from, the lawsuit said, causing her “severe and continuing pain and discomfort.”

“Angel Dobbs was overwhelmed with emotion and a feeling of helplessness and reacted stating that Helleson had just violated her in a most horrific manner,” the lawsuit said.

The women also are suing Steven McCraw, director of the Texas Department of Public Safety, saying he was aware of previous problems and complaints about “unlawful strip searches, cavity searches and the like” yet failed to do anything about it.

While the Texas Department of Public Safety refuses to discuss pending court cases, DPS spokeswoman Katherine Cesinger issued the following statement:

“Following the traffic stop that occurred in July of this year and based on a citizen’s complaint, the Texas Rangers conducted an inquiry surrounding the events, and has since turned the results over to the Dallas County District Attorney’s Office for review.”

Scott H. Palmer, an attorney representing the women, told the Dallas Morning News that the entire ordeal was caught on video from one of the trooper’s dash cams.

“You can see what’s happening clearly,” he added.

Palmer blasted the troopers’ conduct, saying the searches were basically “sexual assault” on the side of the road. “No one’s ever seen the likes of this…We can’t let them get away with it.”

      I, too, hope the plaintiffs win this case. The cops totally had/have the “god complex” and think they can get away with anything. They had no right to search in the manner they did. They didn’t even have the right to search the car. Who cares if the deputy’s sense of smell if faulty. Totally unconstitutional.

      I’ll bet they have an agreement. Anytime he pulls over a female, he calls this d y k e in to do her little “search”….I can not see how throwing a cigarette out the window is susupicious behavior. And it’s not a dry season, get real. I hope they both get fired. Fox 4 News said (I didn’t read this whole article) that the woman was suspended WITH pay …that’s outrageous.

      Please People. Learn the Law.

      First and Foremost.

      When Approached by an officer start your video camera and put him on notice that this event is going to be recorded for HIS and your safety.

      In 13 States, it is “illegal” to audio record a person without their consent.

      If he brings this up and you are in your vehicle tell him this is Private Property and you have a right to operate your camera on or in your Private Property. Tell him he approached your car, and if he wishes not to be audio taped, to leave the premises. Also inform him that anything he says will be used in a court of law, if neccessary. Request his business card with his name and if he Violates your rights he will be sued in a civil court of law, under common law jurisdiction.

      Then you can let him take the floor.

      If his hands are NOT writing the ticket while he is questioning you about anything other than pertinent information regarding to your alleged infraction, he is violating your rights.
      HE is NOT allowed to prolong a Stop.

      If he asks you if you have drugs or weapons in the car You can tell him to kick sand.
      If he has no reasonable suspiscion or Probable cause to believe you have drugs or weapons, he is powerless.

      If he asks you were you are going or coming from tell him it is none of his business.

      If these girls had no marijuana in the car, They have a solid case and will surely win an accord and satisfaction judgement.

      Never answer a police officer. “Am I obligated to answer?” And of course, your not. Never perform for a police officer. Never get out of the vehicle, never perform a sobriety test or submit to a breathalizer. Never remain silent, however never say anything except “no thank you”, “am I obligated?”, and most importantly, “I do not consent”. Always have video capability and record the entire encounter. Police officers are not your friends and they are not interested in justice. The false sense of authority turns them into sadistic psychopaths. Many studies proving that and the vid above is more proof positive. Riddle me this, how can a person be both a “public servant” and an “authority” at the same time? They have no authority, period. It’s time to remind them.

      All those things you said sound great and might actually work, as long as we live in a country that still recognizes that we have any rights. What I see happening is the rapid erosion of those rights. What’s to stop a Gestapo cop from taking your camera/recorder and smashing it on the ground. What’s to stop them from destroying or altering their own recording, or not making one at all? What I see coming is a world where we are not only laughed at for daring to think we can protect ourselves, but suffering severely at the hands of those sworn to protect us if we even try.

      I’m a cop and I’m sure many of you would hate me for that fact alone. However in the 7 years I’ve been on the job I’ve never heard or seen anything like this. I’m stunned and disgusted. It took me about 3 years before I opened my eyes with marijuana prohibition. The stuff should be legal, plain and simple. This officer should lose her job at a minimum.

      Regarding a previous commenter that stated you should never get out of a car if an officer tells you to, bad advise, you better get out. The courts have ruled time and again that an officer can legally order to to exit your car. Regarding submitting to chemical test if you’re arrested for DUI. Most states will suspend your license for a year if you don’t submit to the test, so be prepared to not drive for a year if thats what you decide to do.

      We’re not all thugs with badges, most of us are still good guys!

      If a Officer orders you out of the car you must get out. I would make the officer disclose on the video why this action is neccessary, and then remind him that if he violates my rights I will sue Him/Her (agent) and their Agency. According to law, the Agency is ultimately responsible for it’s agent actions.

      ALWAYS LOCK THE CAR when you get out, and remind the officer that he/she does NOT have your consent to search the vehicle.

      I would also notify him that My SHIRT on my BODY which contains my CAMERA, are ALL private Property, and seizing my camera without a warrant is a violation of my rights.
      If a officer took my camera, I would demand to be in view and earshot of his dashcam.
      Having the lame excuse that the “dog ate the video”, is not going to fly well in the eyes of 12 people in a TRIAL BY JURY.
      You have the right to demand this.
      Don’t allow a bench trail by a partial hearing officer (judge).

      Peesh posh! Street whores keep drugs, syringes and lots of other things in both their front and back openings at their crotch . Most of them stink to high heaven, too. Doing a cavity search isn’t all that uncommon but usually the cop makes the woman being searched pull out the drugs, knives or whatever else they have up there. Using one pair of gloves is no big deal as I’m pretty certain the cop didn’t insert her (even gloved) fingers into any cavity. The job is hard and gross enough without being subjected to that. Eeewwww! It’s not something cops look forward to any more than they look forward to some creep pooping in the back seat, spitting, hitting and/or other (many other) things done to cops and their gear daily. Stupid women shouldn’t have agrivated an already dicy situation. Betcha they screamed curses and threats before the search…

      Holy crap! I worked for 20 years in Maricopa County Jails and we absolutely were not allowed to do any kind of a search like that even on new arrestees. A cavity search had to be performed by medical staff. I might add, these women did not seem to be acting weird at all.

And if you were to charge me for not obeying your commands, I would probably not be able to cross examine the cross dressers(i know some are woman)so their opinions are useless. What facts do you have that support your assertion that I must get out of my vehical if you tell me too? Are you claiming to have authority over me? If so, where, when and how did you aquire it? Please, facts only.

      You are actually correct. If a officer does not have a legitimate reason to call you out of the car.
      You can win a judgement in court.
      Most people never challenge this due to being unaware of their rights and the law.
      Statutory public law is applicable to public servants only.
      This is another situation where people give up their rights, and pay the fines and/or perform according to the judgement.
      An Officer is a Public servant and is acting as a Trustee according to Trust Law.
      This by default, makes you the Executor/Admistrator and Beneficiary.
      YOU ARE ACTUALLY IN CHARGE, if the stop does not have cause of action ( I.E. A violation of ones person or property and/or a breach of contract).
      If They have a cause of action, you must allow arrest.
      When you face a Judge, immediately Strip their title and their authority by putting them on notice that They are public servants and therefore Trustees. This promulgates that you the Administrator, and never be subserviant to the hearing Officer (Judge). Ask why you were called to the court.
      If the have no Cause of Action ( Plaintiffs with a ligitimate claim and evidence ) They have no case.
      Learn about the tricks the Judges use to strip you of your Administrator Title and have you arrested before you try this in court.

      The police are not here to serve and protect you. They are here to enforce the regulations set forth by private entities that parade as our governing bodies. They work for courts and not for you. Nothing you say in front of a police officer can EVER paint you in a good light. They CANNOT testify on YOUR BEHALF!!! It can and will be dismissed as hearsay. You should NEVER speak to an officer or allow any type of search of you or your property.

      The ONLY member of the police force whose sole job IS to serve you is the Sheriff. And if you elect the wrong one, then you screw yourself out of having any sort of respectable police force at all.

      The reason I said to do this , was to avoid an unpleasant situation of getting glass smashed in your face, and a possible beat down on the street and then being hauled off to jail to fight an obstruction charge.
      Like I said, he must have a Ligitimate reason to remove you from you personal property.

      That had nothing whatsoever to do with drugs. The cop was just on a power trip and trying to find any possible reason to nail somebody. Drugs are just a really easy excuse to try to escalate a traffic stop into something bigger because all they have to say is some unprovable subjective BS like “they were acting weird” or “her eyes were glazed over” or “I smelled alcohol/weed”.

      I’ve gone through similar incidents on more than one occassion. I never got cavity searched, but they did search me and make me strip down to nothing but my boxers once. And both times they illegaly searched my car without obtaining a warrant and providing a probable cause even though I refused when they asked me if they could.

      We are all aware of the ol’ tactic that they use, when they think they might have “smelled” something weird. They call in the K-9 unit and the dog walks around your car and “sniffs” out drugs and the like.
      Here is the rub: A police dog is considered an “officer”. When a police dog walks around your car and “sniffs” he is, in fact, “searching” the contents of your car without a warrant. That is an illegal search!!! If they say they they will get a warrant, let them. That should take anywhere from 1 to 8 hours. Also you can inform them that while we sit here waiting for the warrant, they could be chasing down cars with their trunks dragging down the highway that are full of weed or illegals.

      Also, I think the girl’s lawyers should find out the sexual orientation of the offending officer. If that female COP is, in fact, attracted to her same gender, they have an even more compelling case.

      The difference is, in a blue state, the victims would still be fined and jailed for awhile, while the officer’s unions would have an arbitrator in there fighting for their job and probably being successful, and the cops would have their job back, lawsuit may, or may not be filed, but only the police have the evidence (video) and whoops, some union-worker accidentally erases it. No lawsuit can be filed. Victims live in fear of police the rest of their lives and are afraid to come out of their homes.
      In a red state, the victims would be out of police custody, the offending police would be fired and a lawsuit would be filed against them. The law of the land would prevail, the 4th Amendment upheld, and the perverted police go to jail. Victims receive an apology and a huge settlement.

      I didn’t see Kelly Hellesen pull those gloves out of a sanitary box or bag either. They’ve probably been on the floorboard of her patrol car. She had her own hands all over those gloves before she donned them to stick into their privates.

      I have seen veternarian checks done with more sanitation!

However, I don’t understand why so many here on The Blaze will group cops into the same category and hate them ALL.       Conducting such an invasive search is uncalled for just because you smelled the odor of burnt marijuana during a traffic stop. If they did throw their joints out the window, so what, it’s still a ticket at best. What these two cops did was ridiculous and a waste of time. Worth millions in a lawsuit?       As a small business owner (convenience store) I deal with cops all the time for various reasons. I find most of them to be decent people who are just doing their job and trying to provide for their families. I’ve never known one who went to work looking to screw somebody over. Although I’m sure there are a few who do that. Either you’re immature or you’re just a natural born cop hater.

      Let me say, I don’t believe this was right at all.
      However, if a person inserts a gloved finger in someone’s anus, there is normally some reaction from the sphincter muscles, Neither of these women moved as the cop’s hand moved around the back of their pants.
      I think they will have a hard time proving penetration.
