MIAMI (AP) — A Marine veteran jailed for months in Mexico after trying to carry a family heirloom shotgun across the border has been freed, U.S. officials and his lawyer said late Friday.

The attorney for 27-year-old Jon Hammar tweeted Friday night that his client had been released from a detention center in Matamoros, Mexico.

“Jon is out, going home!” Eddie Varon Levy tweeted.

Patrick Ventrell, the acting deputy spokesman for the State Department, confirmed Hammer’s release and return to the U.S. in a statement Friday night.

“Officials from the U.S. Consulate General in Matamoros met him at the prison and escorted him to the U.S. border, where he was reunited with members of his family,” the statement said. “We sincerely appreciate the efforts on the part of Mexican authorities to ensure that an appropriate resolution was made in accordance with Mexican law, and that Mr. Hammar will be free to spend the holidays with his loved ones.”

An aide to a legal representative of the Mexican attorney general’s office had told U.S. Sen. Bill Nelson’s staff about the pending release after the Florida Democrat’s office got word from Hammar’s mother, according to a press release from Nelson’s office.

“No American should be in a Mexican jail for five months without being able to have his case in front of a judge,” Nelson said in that statement. “We’re grateful; this is a good Christmas present.”

Earlier Friday, Varon Levy said he was flying from Mexico City to Matamoros to pick up his client. After that, the attorney said, they intended to cross the border at Brownsville, Texas. “I’m very happy. I feel that the Mexican legal system came out the way it should have,” he said.

U.S. immigration and State Department officials had been at the Mexican detention center waiting for Hammar’s release.

A defense lawyer said Mexican authorities determined there was no intent to commit a crime, Nelson’s office said. The senator was among a handful of elected officials who urged the State Department to help get Hammar out of Mexico. His family had said he was being held in isolation after threats to his safety were received.

“These past few months have been an absolute nightmare for Jon and his family, and I am so relieved that this whole ordeal will soon be over,” said U.S. Rep. Ileana Ros-Lehtinen, R-Fla., in a statement. ” I am overcome with joy knowing that Jon will be spending Christmas with his parents, family and friends.”

The attorney, Varon Levy, said the path for Hammar’s return was cleared when Mexican officials decided not to appeal the judge’s ruling.

Civilian gun ownership is illegal under Mexican law unless the owner purchases the weapon from a special shop run by the country’s Department of Defense.

“The Department of State warns all U.S. citizens against taking any type of firearm or ammunition into Mexico,” the U.S. Embassy in Mexico writes on its website. “Entering Mexico with a firearm, certain types of knives, or even a single round of ammunition is illegal, even if the weapon or ammunition is taken into Mexico unintentionally.”

Mexican law also bans shotguns with barrels of less than 25 inches. The family said Hammar’s shotgun has a barrel of 24 inches.

Tourists are allowed to bring guns for hunting on rare occasions, but Mexican officials said all visitors must receive a special permit before entering the country. Mexican customs agents do not issue gun permits. As a result, anyone crossing the border with a firearm or ammunition without a previously issued government permit is in instant violation of Mexican law, which stipulates long jail terms for breaking weapons laws.

Hammar and his friend were on their way to Costa Rica in August and planned to drive across the Mexican border near Matamoros in a Winnebago filled with surfboards and camping gear. Hammar asked U.S. border agents what to do with the unloaded shotgun. His family said agents told them to fill out a form for the gun, which belonged to Hammar’s great-grandfather.

But when the pair crossed the border and handed the paperwork to Mexican officials, they impounded the RV and jailed the men, saying it was illegal to carry that type of gun. Hammar’s friend was later released because the gun did not belong to him.

Before Hammar’s release, Varon Levy said he was not sure of his client’s immediate plans upon being freed. “Probably some down time,” he said.

      Just bc it happened this time doesnt mean it happens all the time. The media exaggerated everything. I was in Yucatan, Mexico last year. I purchased a rather large Mayan ceremonial knife as a souvenir and was allowed back into the US without any problems. The racist right wing FOX news media hypes this up.

      Thanks to everyone that helped get this young man out of that prison and back on American soil. This was a parent led, Fox news led, movement that got him released.

      I do not watch Bill O’Reilly but I understand from what I have read that he was also instrumental in Mr. Hammar’s release. Good job Bill.

      Right wing, if Fox had not kept up the pressure, I think this young man would STILL be in jail. A few congress people were fighting for him, but Hillary and the president seemed disinterested. Now if they had denied him birth control, he could have gotten a phone call from the president. I guess Obama thinks preventing life is more important than possibly saving months or years of a young man’s life, or at least he is giving that impression.

      I am very happy for this young man and his family. On Mexico’s web site it states no guns. Now let us discuss gun control. According to Mexico you can not own a gun there unless it meets specified requirements and is licensed by the STATE. What a laugh, they have major drug cartels armed to the teeth mass killing their people and they can not stop it. They are governed in the North by thugs with guns and they have gun controls. Do we want that kind of gun control in the USA? If they rock the 2nd amendment you can ready here for criminals are the only ones with weapons and they will rule our country. So think hard just what you want. No guns, criminals only with guns? I dont think so.

      I’m former Air Force but once a Marine ALWAYS a Marine!
      My pseudonym honors my father. I learned a lot from being around an USMC family. I broke 107yrs of USMC to go USAF ’72-’78. Dad was 2nd Battalion 5th Marines Inchon’s 2nd wave and 1st to take KIMPO Airfield…
      As taught to me, the family wanted me to go USMC… Dad too, but he said that nobody but myself had to make that decision. Good or bad as the results would be, I should make it myself.

      On a humorous note, Dad did, in his way, expressed to me that I was NEVER to say that I was in the military. Marines and Army are in the Military… Me… I was in the service.

      Almost 38yrs have passed since I enlisted, NOT ONCE have I ever said that I was in the Military.

    I think people would be wise to stay out of Mexico period. Anyone can plan a gun in your car or luggage or just throw you in jail on a trumped up charge. Why risk it? Our govermnent seem helpless in getting Americans (war heroes) out of jail and talkshow hosts may be too busy to get you out,

    With so many Mexicans coming up here illegally to get away from the horrible conditions down there I have to wonder why so many wish to make California and other southern states back into Mexico. What is the point. Actually, they don’t have to wait to long, Obama is doing everything in his power, and he is gaining more every day, to make this into another 3 world country so they won’t have to do much.

    The next time you want to go to Costa Rica… fly a commercial airliner out of the USA and don’t drive into Mexico. Everyone should just stay out of Mexico IMHO. Let their tourist industry dry up completely. Maybe then they’ll clean things up.

    ‘im very happy that this young man has returned to America and back to his family for Christmas. I also would like to thank him for going to war and protecting America from her enemies. I’m also very sorry that he suffers PTSD as a result of war. I do however have a concern. I think with all that has occurred concerning guns in our country. I know this young man would agree with me when I say, anyone who has PTSD should out of good conscience turn their weapons in to the proper authorities. The time has come for all of us to reconsider our gun policies and make adjustments as seem fit. God bless America and God bless this young man !!!

I have a brother who came back from the first Gulf War with it, and he is now a happily married father of three, with a job he loves, and a church that fills his heart with joy. PTSD is not a dangerous mental illness in spite of what you see on stupid crime shows.

      The Veterans Disarmament Act — which has already passed the House — would place any veteran who has ever been diagnosed with Post-Traumatic Stress Disorder (PTSD) on the federal gun ban list.Sounds to me like the republicans are finally using some common sense !

    Gun control REALLY works. No violence, crime or murders in Mexico.
