‘Public Nuisance’: You’ll Never Believe why This L.A. Entrepreneur Was Forced to Close His Shop

After his father retired in the late 1980s, Nick Benetatos has owned and operated Tam’s Burgers in South Central Los Angeles. And although his shop has withstood everything from recession to the infamous 1992 L.A. riots –

– it was no match for zoning board officials.

“When the markets were burned down, liquor stores were burned down, everything was burned down, people had nowhere to go, they came to us. We were handing out loaves of bread for free,” Benetatos told ReasonTV.

“We have much love for the community. And the community obviously has much love for us,” he adds.

Sadly, though, Tam’s Burgers will close permanently next year because city officials have succeeded in regulating it out of existence:

The trouble between Benetatos and the city began after authorities decided his restaurant was a contributing factor to the area’s crime rate.

No, really.

“It has a nexus and a connection to a disproportionate amount of criminal activity,” Detective Eric Moore, head of LAPD’s Nuisance Abatement unit, told Reason.

But it’s not as if Benetatos didn’t ​try ​to work with the city.

The police asked him to remove payphones, so he removed the payphones. Then they asked him to remove tables for outdoor seating, and he removed the tables for outdoor seating (it resulted in a 15 percent drop in revenues). Then the city’s zoning board ordered him to comply with 22 separate conditions, including hiring a full-time security guard, putting up fences, and installing a security camera system.

Needless to say, Benetatos couldn’t afford to keep up with the city’s demands.

“The LAPD wants to control my business and run it in their view of how it should be run, and I’m trying to run it in the view that I’ve been here for 30 years and know how it should be run, and I’m successful,” he said.

Benetatos appealed the zoning board’s conditions at a recent city council meeting. They turned him down.

And that is how L.A. officials regulated a long-standing neighborhood burger joint out of existence.

    ahhh yes!! california’s way is to regulate ANY tax income out of existance!!! Or, was his business in a rent restricted zone and they were clearing his business out to put up a strip mall? I cry foul however this has panned out!!! Regulations on regulations on regulations are WORSE then any emminent domain claims!!!

      Typical for California. If they really were serious about cleaning out a “nexus of criminal activity”, they would clear out Beverly Hills. There is FAR more criminal activity occurring behind the walls of the rich and famous. This guy should sue the city for several things: failure to provide adequate neighborhood protection and holding him criminally and civilly liable for unspecified actions of others; actions that were never alleged to have been committed by him. Typical. In my city, taggers go after homes, businesses, anything they can get spray paint to stick to. The reaction of the city council? Business owners who sold spray paint are now held criminally liable if spray paint is sold to minors and for the victims? They have 24 hours to fix the damage or they will be given a $124 ticket per day for failing to paint it. The city provided additional funding to hire a guy who does nothing but run around giving victims tickets. If the city is not satisfied with the paint job, it could include more fines and jail time. Not a single new asset was directed to control the source of the crime, and the victims are now the criminals. I guess it’s way easier when the victims don’t run away. LA is as insane as the rest of California. The only way to change it is to vote out the criminals that run it. It worked here. It can work there.

      You know I was going to post that “I needed more information” as I was reading but, sense this businessman was doing everything in compliance the city ask of him and STILL was overegulated by some suit wearing bean pushers…..I took a stand in his suppport saying “enough is enough”!!! It is LONG past time that we STOP cuddling the criminals in our country by giving them excuses like “too many out door seatings”!! What’s next no more park benches??

      So let me get this straight. This business was a place criminals gathered regularly and the LAPD couldn’t control them, so the answer is to put them out of business? Nice work, LAPD.       I don’t feel sorry for the folks out there since they kepp electing the same far left liberals like Poloosie & Boxer.California is on my no fly list – refuse to ge there & spend money and if I buy on Amazon or E-bay I avoid theese nut states and spend it else where. Only problem is we here in Oklahoma & Texas are getting filled up. Here in S. Oklahoma in my county unemployment has stayed under 4% for the last 4 years and our state in under 7% for all that time. We are a right to work state.

      California is not the only place. I leased a supposedly on going business resturant in Norman, OK. In applying for the business permit, the resturant had to be inspected and it became apparant to me that the city wanted its pound of flesh against the local landlord who was an attorney. The city kept coming up with more and more requirements and after I would comply with the requirements there would be something else they wanted done. Finally, in frustration, the landlord said “no more”. She would not comply with their demands and I lost all of the time and money I had put into the resturant to get it open and the community lost a business that they were looking forward to patronizing.

      In the city of Minneapolis there is an island in the middle of the Mississippi River. Nicolette island is like a piece if the 1880s frozen in time with old Victorian homes, narrow streets, a quaint inn. Turns out most of the homes are owned by members of the city council or their close friends/relatives, purchased quietly by a sweetheart deal for hardly any money. There’s a Catholic HS on the island, has been there for 100+ years and when they attempted to build a football field the neighboring residents objected, saying it would lower property values. The city council (aka the homeowners) banned its construction but eventually lost in the courts. Political inbred SOBs.

The days of sitting back and taking the attitude of “let’s just wait and see”. Is over. People need to take a stand and speak up and fight back…..otherwise you get what you deserve and then no one wins. Where does anyone have the right to stand in the way of progress especially when it’s yours? Start at the town level and work your self up to the state level. Stop the complacency now!     Sounds like Mr. Benetatos has done all that he can and much more to accommodate the needs of the community as well as the wishes of the police-nanny state that surrounds him. It’s a crying shame that dedicated, hard working people get caught up in a p*ss-poor government bureaucracy that is totally ineffective and/or simply does not care.

    …after all Mr. Benetatos, you didn’t build that!

    I think the problem is that wherever young people hang out if the culture is one of violence, you will have violence.

    We have a mall that for a decade was a nice place. In the last decade gang member have been having out there. So we get shootings. So the second mall that was built was not an indoor mall. there is more than one reason for it. but one of them was security. Gangs do not hang out in inclement weather.

    Basically the t/rds that run LA can shut down any fast food place or any other place where young people might spend money & tarry for a moment.

    BTW LA just put a minority out of business. Not to worry they already filled out his welfare application for him. See they caaaaaaare!

      I have been studying Criminal Justice, and I see the full size of this, but what makes it worse is understand exactly what the leadership will justify this to the officers with. Community policing is one of the big trends in law enforcement, and while it has some intelligent points, some of the community restoration aspects of it are, disturbing.

    I would have said. Fine. close me down, now all those criminals elements will visit your area to get their burgers. Can we just ban Liberals, they have the brains of gnats.

    I would file suit against the city if I were him. Surely, there is a good lawyer in LA that will take his case pro-bono.

      That’s what I’m thinking. … something is afoot here. Someone either wants that property or needs the competition that his business creates to be eliminated.

      I have seen governement acted stupidly beofre. So Ido nnot doubt it will jhappen again.

      For instance a local government widened a street, which took away parking spaces form an eatery. The city government told the eatery that they did not have enough parking stalls for their business & so they would have to close or relocate. True Story.

      But I think JHrusky is on to something. Not everything is a nail & we need more than hammers in pour toolkit.

    Fences and security cameras?!?! Are they nuts?!?!? I don’t think I’d be inclined to stop for lunch at a burger joint that has fencing, security cameras and armed security guards!

    That area of LA has been a “high crime area” for YEARS, and putting up fencing and security cameras at a burger joint aren’t going to change that! Get real!

    Btw, it will be interesting to see if the crime rate in that area drops after this place is out of business. I, for one, am NOT holding my breath!
