Fury After Paper Publishes Names, Addresses of Legal Pistol Owners in New York

New York Journal News Publishes Names, Addresses of Gun Permit Holders in Westchester, Rockland Counties

New York’s “Journal News” ignited a fierce debate Sunday after publishing the names and addresses of pistol permit holders in two New York counties.  They are actively working on acquiring data for a third county.

The article, titled “Map: Where are the gun permits in your neighborhood?,” reads:

The map indicates the addresses of all pistol permit holders in Westchester and Rockland counties. Each dot represents an individual permit holder licensed to own a handgun — a pistol or revolver. The data does not include owners of long guns — rifles or shotguns — which can be purchased without a permit. Being included in this map does not mean the individual at a specific location owns a weapon, just that they are licensed to do so.

Data for all permit categories, unrestricted carry, premises, business, employment, target and hunting, is included, but permit information is not available on an individual basis.

To create the map, The Journal News submitted Freedom of Information requests for the names and addresses of all pistol permit holders in Westchester, Rockland and Putnam. By state law, the information is public record.

Putnam is still putting together its records and could not immediately provide any data. The map will be updated when that data is released.  [Emphasis added]

Unlike with the above map, however, on the Journal News website, you can click on any one of the dots and get the full name and exact address of the permit holder.

AMI Global Security, which published an article condemning the “massive privacy breach” that is “meant to intimidate the lawful” and “abrogate the Bill of Rights,” collected a few of the first comments:

“If the homeowner is killed or injured, will LOHUD be charged as an accomplice to the crime?”

“It is as if they put out an ad to jewel thieves listing the names and addresses of where to find diamonds and cash.”

“This is CRAZY!! why in the world would you post every licensed gun owner information?? What do you hope to accomplish by doing this? This is the type of thing you do for sex offenders not law abiding gun owners. What next? should I hang a flag outside my house that says I own a gun?”

“Now everyone knows where the LEGAL GUNS are kept, a valuable piece of information for criminals. Why don’t you do something helpful, like trying to find out where the ILLEGAL GUNS are kept? That would be helpful to the non-criminal population”

AMI Global Security also added recent “threats from local government” with regard to guns.

New York Governor Andrew Cuomo said last week, as the nation still shook from the tragedy at Sandy Hook, that he was considering new gun control measures when it came to “assault” weapons in the state:

“Confiscation could be an option.  Mandatory sale to the state could be an option.  Permitting could be an option — keep your gun but permit it.”

This is not the first time the journal news has published the private information of gun holders.  They pulled a similar stunt back in 2006, but that time, they only published names and municipalities– not exact street addresses.

    Love the kids you are right they all ought to sue them because they not only know who the good people who own guns are but know they know who don’t have them or did not register them. Sue there asses off for attempted Murder. The ones at those community’s need to get together and sue the paper and there internet pages. I would say they should get a good chunk of change.       this is why you don’t get “permits” to exercise your 2nd amendment rights.
      It isn’t a right if you have to ask permission. I would sue the paper and then suer the agency that released the info.

      This was, no doubt, published with approval and encouragement by Cuomo and Holder.

      Not only are legal registrants specified, but, by inference, those who are not are thus also indicated. Those endangered are both those who are and are not on ‘the List’. Will Cuomo, Holder and Obama publish lists of other categories, too, via this newspaper? Salaries? Work schedules? Names of relatives? Party affiliation? (Or is party affiliation assumed to be in opposition to ‘the Obama,’ by virtue of being on this ‘List’)?

      Yeah, it SOUNDS so good, the liberal arguments — “Oh, we juuuuust want to REGISTER the guns… we don’t want to publish that information, and we CERTAINLY don’t want to confiscate.” And then look what happens.

      I think at the very least if they do not sue, they should look into how this paper got this information and whether that was part of the agreements that were made when people bought the guns. Of course, even if they were, it’s not justified, but it would be good to know if what this organization and/or the government did was against explicitly written laws and contracts. If a gun owner wants to opt to inform the world that they own (same with permits), then that’s their choice, and theirs alone, by rights.

      I have a simple way to deal with this news paper…fight fire with fire. Get a list of all the employees who work at the Journal along with their address and phone numbers. Also include their family members. Verify whether or not they are on the gun permit list that the Journal published (mark each name accordingly). Then send a copy of this list to every permitted gun owner who was listed by the Journal. Finally send a copy of the Journal’s employee list of addresses to each prison inmate in the state of New York identifying those who have a weapons permit and those who don’t. Problem will correct itself.

      They are doing this so their paid protesters can go to these houses and make these people miserable so that they just shut up and sit down.

      You don’t think it’ll come down to these OWS types hiding outside these peoples homes, stalking them following them around shouting obscenities constantly, follow these people to work and disrupt everything there to get these people fired.

      Frankly, I do not understand all of the uproar here. If anybody should be pissed its those who are unarmed in the area. And, considering that NY is a “May Issue” state as opposed to a “Will Issue” state only those with the financial and political clout, or security job descriptions will be armed. This map tells the bad guys which homes to avoid. I just wonder how many professional criminals will be taken into custody with a copy of this map on them? It is the unarmed citizen (also know as a subject) who this media outlet did a disservice.

      Keaton, you liberals are always arguing just on the border of what illogical claims of yours haven’t been completely exploded, but never admitting “I was wrong the other day”. This is highly dishonest. Just the other day it was “nobody’s talking about confiscating.” (It’ll be interesting to see if SendTheMeteors will publicly admit he was wrong on that one.)

      But as usual, even the arguments you libs do still feel safe to use have already been debunked by others. Just read the comments around yours! Specifically: the “mystery” of who does and doesn’t have a guns is an even better deterrant than telling the criminals who to avoid and who (by process of elimination) it’s likely safer to hit. And if you’d just stop and think honestly for a moment before posting blathering defensiveness of liberalism however you can, you’d realize that easily.

      You can’t ‘sue’ the government agency for this. A Freedom of Information Act (FOIA) request was used to obtain the information.

      Perhaps every named, law-abiding gun owner, should show up at the newspaper and the homes of the editors, reporters and owners of the newpaper, make use of the public property in front of them and demonstrate their dislike of abusing public resources for private agendas.

      Not so fast — that was my gut reaction too, but a lawyer should scrutinize every word of the contracts and laws leading up to that. It is not safe to just assume this information was legally given into a database that Freedom of Information applies to. A gun purchase is a contract of sales between a private business and a private individual. It should be more akin to personal identifying information like social security numbers which may NOT be given out via FOIA.

      Even if the laws were set up so that it could go into that database, that should be changed.

      @Bones: As the article points out, this doesn’t prove ownership of a weapon. In NY, they’ve made it a requirement that you get a permit to purchase a weapon. This map is of permit holders. While it’s highly unlikely that anyone would get a permit without buying a weapon afterward, this map does not show those that have purchased weapons. Whatever “contract” was made by these individuals, it was with the state (or maybe city) of NY, not with gun dealers.

      This is a perfect example of why gun registration or permits are bad. This is essentially a government database of every gun owner in the area. I’m sure the federal government would love to have something like this. They could easily use it to confiscate every firearm in the country.

      This is a state issue, but all states need to look closely at this and pass laws preventing the distribution of license data, especially when it comes to concealed-carry permits. You can stop FOIA issues if you have the state law in place to do so. Some may require voter approval and language to their constitution, not an impossible feat either.

      I’m pretty sure your average gang banger does not have his Saturday night special registered. Just guessing, but I surmise that this list is not only useless but highly inaccurate. Inaccurate because it does not (and cannot) account for criminal gun ownership, and useless because the vast overwhelming majority of gun violence is committed CRIMINALS who don’t obey pesky laws like registering a firearm.
      Actually it does these law abiding Citizens a favor by publicly giving notice that they are armed and therefore are more dangerous to victimize. I wouldn’t be a bit surprised to find a criminal origination using this map to either target these homes for burglary (to get the guns) or to target the gun less and undefended homes.

      Your name and address are not “private” to government agencies. They are available on tax records, post office transactions, etc. Only “Personally Identifyable Information ” or PII is considered non FOIA accessible. This includes Social Security Numbers, Credit Card information, Health History (HIPAA compliance issues), and any sealed court activity. Other than that, fair game.

      That is why the Democrats were able to publish Republican Political donor and candidate addresses, it’s also been used by Republicans so neither party can claim the high road here.

      Is it alarming that such information is readily available- yes, completely alarming, but not illegal.

      Check out many of the information sharing websites, they have so much info on you it will make your head spin. Before you freak out about that, and Google search something, remember Google keeps a list of what you search, where you surf off of Google and what you shop for.

      Nothing you do is private folks. If you want privacy, unplug and go live in a cave in Montana someplace and hope someone doesn’t report you as a Sasquatch sighting!

      Jediknight — social security numbers are registered with the government as well and FOIA does not grant anyone access to them. The permit is taken out by a private individual for the express purpose of becoming able to legally purchase a gun from a private business. The involvement of government does not automatically guarantee FOIA access.

      This is different from records about an elected representative or government appointee. That is the sort of thing where a person goes into a job knowing they are by name accountable to the people they work for. That’s what FOIA is for. But these are private individuals. Unless a lawyer can definitively pin down a regulation that allows this, I’m not convinced. :) (And even if they could, that still wouldn’t make it right of course.)

      I agree with you otherwise, just don’t want us giving ground that we should not justly be giving. :) The liberals probably would love nothing more than for us to just assume it qualifies under FOIA and roll over, even if we whine about it. In any case, it should be scrutinized by an independent expert; that’s all I’m saying basically. :)

      This is no big deal – Bloomie amd Maurio only let bodyguards have free gun permits. All others must pay about $1,200 so that means no poor folks have one and are on the list. I do agree that all those that aren’t on the list had better put their valulables in the safety deposit box and the thugs will avoid these addresses that are on it.

      If I was living in any of these disclosed counties, and was in anyway affected by a death directly related to the disclosure: I would want the paper charged with “Negligent Homicide” and all parties sued to emotional distress and damages.

      I am wondering how long it will be before yahoo deletes post. I know I sure wouldn’t want to be one of those people now….could be quite a Christmas morn.

      What is MORE dangerous than guns/Owners/Addresses information is the OWNERS/ADDRESSES part.. like the criminal who can now come to the door and say “Mrs. Adams?” or I have a delivery here for the ADAMS family… and dupe unsuspecting housekeeper etc. into opening the door.

      Aren’t there PRIVACY laws that protect us? First of all, I would sue them from here to hell; Secondly I would make sure that every advertiser for them that I also did business with was aware that I would be finding other vendors – boycotting the advertisers and even the commercial businesses that would allow this dumb A. paper to have dispensing stands. Boycott seems to be the only way we, the people, have of letting these jerks know we will not have our lives, information used for their purposes. I hope this paper is out of business in three months or less.

      That’s a very good point, Patty Henry. What about things like unlisted phone numbers? Surely they don’t have the right to give out the names. Pretend for a moment that the rest is okay, but the names?

      And addresses is another thing.

      Why not just the number of total permit holders? Why not just do that? That shouldn’t be a problem. Nobody would have objected. Why the names and addresses — what good does that do… none.

    Actually, this is very helpful for the criminals – they now know which homes have guns – AND WILL AVOID THOSE HOMES. Too bad for the rest of the homes on the list – they are now more likely to be burglarized.

    I still think all the gun haters should put signs outside their home – “THIS IS A GUN FREE HOME,” that way we won’t be confused – and it will be safer for the criminals to know which homes won’t get them shot!

      There is no way to know how many crimes were avoided by an armed citizen. How many rapes, burglaries, etc. are avoided with out firing your weapon? If a criminal avoids homes with large dogs, will they then avoid homes that they know are armed? I feel it was a huge breech of privacy to print this, and if I was a subscriber, advertiser I would then end my business with this paper and the people it is owned by.

There was a sort-of footnote that the list doesn’t include people with long guns (or unregistered guns bought from a private owner). Imagine the criminal’s supprise – “Hey, you wern’t on the list, you can’t shoot me” (bang) “Oh, ouch even”. We can only hope.

      Simply because a newspaper can do something doesn’t mean the MUST or SHOULD do it. This is just more evidence that the news organizations lack any form of ethical or moral leadership. I’m sure they did not debate the risks of publishing this data. Should even one woman or child be put at risk, the newspaper should be prosecuted for reckless endangerment. Imagine a woman who has spent time, effort and lots of money to move away from a violent ex-spouse. She’s even managed to obtain a gun permit to ensure her safety. Now the ex-spouse finds out exactly where she lives and that forces her to move again, pull her child from school, hide her tracks if she can. What’s the cost to women like her? What’s the cost to all of us when that violent spouse catches up to her?

I prefer that everyone know I am armed and trained to protect myself and my loved ones rather than being a random target. If someone breaks in and I shoot them in self-defense my attorney can cite this list as reasons the perp should have known not to break in but did anyway at his own peril. At a big box store in a major southwestern city I found it oddly comforting that there were others like me who were exercising their right to constitutionally carry pistols, concealed and open carry. It is time to man-up and quit boohooing about what liberals think and do. If you don’t like what your state allows, move to one of 50 others that might fit your preferences. I did.

      Anybody that lives in that area, if you feel the paper put you or your family in danger, and you had to buy a guard dog, or security system, etc. well that would seem to be damages to me…. I live in NY if they do this to me, I will sue for every stick of gum I chewed thinking about what I need to do to protect my family, also will ask for punitive damages……… this is a form of reckless endangerment…

    IMHO if someone went into the house when nobody was there and searched the home, not finding the gun, the paper can be responsible for pointing to the house where a gun might be found.
    IMHO if someone went into the house and confronted whoever lived there, and then was shot, then the person shot didn’t pay attention to the warning not to enter that home. S/he shouldn’t be able to sue the homeowner for shooting him/her.
    IMHO if a handgun was taken and then used elsewhere the person shot can sue the paper for pointing where to find the handgun used against him/her.
    Is this a NEWSpaper of a PROPAGANDApaper or AGENDApaper?

    If this is public information then it should be up to a person to go find the information. It is not up to a separate entity to make something public, public for everyone to see it. It would be like me going into the assessor records and publishing the name and address of everyone’s house info in the paper. It is not the business of anyone else. If they want to know, let them go look it up.

      That’s the idea. Now, their neighbors are to be looking at them askance, as though they are dangerous, unpredictable people. Their neighbors are supposed to be pressuring them to get rid of their firearms for the safety of the neighborhood. If they are good citizens, we all know they will give up their firearms and protect the children!!!
      What a crock of Bull.
      This so-called “News”paper (propaganda rag) has done a couple of really deplorable things here.
      First, highlighted which homes it is likely OK, to break into, because no one there has the means to stand up to you. Those non-firearms owners should feel really safe with that info out there.
      Second, highlighted which homes to break into while unoccupied, to try and steal the firearms that are probably there, to use for nefarious purposes–or to pawn for your next fix.
      Third, as OleFromMN points out, put the good, law abiding gun owners at risk for retaliation from their neighbors.
      Whichever one of these you want to address, it boils down to that waste of ink making efforts to incite crime and panic. Anything happens, a single Christmas light bulb goes missing, they should be held accountable.

      I disagree. Some burglars might try to rob a house while the people are gone hoping to find a pistol to sell on the black market.

      It all depends on the odds for pulling it off in reality & the perception in the crook’s mind.

      When the home owner is present at night or whenever it probably will make it less likely.

      If a known liberal is being attacked it is a real gut check to decide to help them. Will they appreciate the help, & turn over a new leaf or will they go meh?

      I think I would slow walk the 911 call.

      It’s sad that we are considering things like unregistered guns but I can sympathize knowing that our Government is out of control. There was an interesting “shop talk” conversation several of us Engineers had at the firm I work with recently. It revolved around 3D printing of firearm components. This is quickly becoming a reality. Other than the barrel, we surmised that everything else could be printed with current materials and equipment. One in the group already has a 3D printer in his house.We need to stay one step ahead.

    So, the Govt. can put a guy in jail for making a film that didn’t cause any riots or have anything to do with anything, but lets wait and see what they do to someone that prints this info that could incite real violence. Also, I bet robbers will use this list to know what houses they can rob!!!

      Let’s list the names/addresses/home phone numbers of everyone who voted for/contributed to Cuomo and/or Obama so the locals can know where the enemy lives. Also the home addresses and phone numbers of all the NY federal/state legislators, judges,county officials and NYC aldermen who support this intrusion.

      I’ll bet there is significant overlap of the gun owners and those who publicly decry gun ownership. Let them explain their hypocrisy in a public forum and wring their hands over their privacy being invaded.

      Also, how about printing the names of anti-gun politicians who own guns. That certainly happened in my state legislature. There was no mass release of names, only targeted people. This won’t get the people who can hire armed guards and speak against gun ownership and self defense but it does beg the question about people who left their homes because of the hurricane. Did they take their guns with them when that home was declared uninhabitable? So technically are they violating the law if the permit is limited to the premises? This might give the criminals a better list of safer locations to create future victims.

Having traveled all over the world in many countries and lived for 6 months in Russia, I have seen first hand that the biggest threat to people’s freedom is government, no matter what the ideology/Philosophy or religion is. Socialism, Islam, Communist, Dictatorships, ” Chirstian” it does not matter. Oppression is always greatest at the hands of those with the biggest and most guns. The only way to freedom comes in a balance to governmental power, citizens who can defend themselves. History is filled with “enlightened” ideas about gun control. The results are always the same. The government always takes power and oppresses someone. Stalin killed 20-60 million of his own people. I lived in Russia and spoke to people about the government and their oppresion of the people. Hitler 6 million Jews alone. I wonder how many Jewish people could have been saved had the citizens been able to protect themselves from Hitler. Pol Pot, 2 million dead. Communist China (? They are not finished yet) N. Korea (? they are not finished either). Your shallow comments show you are dumb as to what really happens when the government gets absolute power.       Same thing happened in Virginia a few years back with CCW holders database being posted. Someone posted up the personal info of the editors including financial infor and wasn’t long before the database cane down.
      The Memphis Commercial Appeal does the same thing with Tenn. carry permit holders. Democrats repeatedly voted down a bill to keep the info confidential for the state only and the RINO led legislature has not taken it up.

      This is perfect. Every gun owner in the country should put a sign in her or his front yard pointing out that they possess fire arms and know how to use them. The guy next door can’t prevent anybody from entering his house and raping him, or his wife and children, red and blue flashing lights in the street or not.
