OKLAHOMA CITY (AP) — A federal judge on Monday denied a request by Planned Parenthood to temporarily block Oklahoma from terminating a contract with the agency to provide nutritional services to low-income mothers.

U.S. District Judge Stephen Friot ruled that although the state’s stated reasons don’t seem to be sufficient cause for ending agreements with Planned Parenthood’s three Tulsa-area clinics that have been in place for 18 years, the group’s response to the state’s concerns was insufficient enough to warrant ending the relationship.

The decision will likely mean that the group will have to close one of the clinics and eliminate six full-time staff positions when the contracts end on Dec. 31, Planned Parenthood of the Heartland’s President and CEO Jill June said in a statement.

“We are truly disappointed with today’s court ruling and the impact it will have on the women and children in the Tulsa area who have relied on Planned Parenthood for (the federal Women, Infants and Children program) and the many other services we provide,” June said. “While we are convinced of our claim, we will weigh all our possible options going forward.”

The Oklahoma State Department of Health notified Planned Parenthood in September that it planned to end agreements it had with three Planned Parenthood for the last 18 years, citing the uncertainty of federal funds, declining caseloads and a higher cost-per-participant rate at clinics in west Tulsa, midtown Tulsa and Broken Arrow.

A spokeswoman for the attorney general’s office, which represents the health department, said in a statement that she was pleased with the judge’s decision.

“Judge Friot looked at the facts of the case and understood that the decision by the health department was based on legitimate business reasons,” said spokeswoman Diane Clay.

But Planned Parenthood contends that the actual reason the state, whose leadership is among the most conservative in the country, decided not to renew the contracts was because the organization offers abortion services at some of its U.S. clinics, although it doesn’t at the three Tulsa-area clinics.

Terry Cline, the state’s health commissioner, testified during a hearing about Planned Parenthood’s motion last week that the group’s abortion-related activities should “absolutely not” factor into the state’s decisions on whether to renew or end the contracts. Cline and other Health Department administrators have said the contracts weren’t renewed because of a variety of long-term managerial and administrative problems, including a decline in caseloads, increasing client costs and a failure to resolve budgetary questions.

This year, the clinics received a total of $454,000 to provide WIC services and averaged about 3,000 client visits per month, or about 18 percent of all WIC client visits in Tulsa County, according to state Health Department data.

In his ruling, Friot wrote that while Planned Parenthood’s performance deficiencies, primarily its declining caseloads, do not appear to be enough to result in the termination of its contracts, he added: “But a routine, solvable problem can become a justifiable basis for strong action when it is compounded by persistent unresponsiveness in addressing the challenge. Moreover, the frustrations in getting information out of (Planned Parenthood) on what should have been routine administrative matters rubbed additional salt into the wound.”

Other conservative-led states have also taken steps to cut funding to Planned Parenthood.

Indiana passed the first law meant to deny Planned Parenthood federal funding for general health services, but a federal appeals court in October upheld a lower court’s finding that Indiana violated federal regulations when it enacted the law. A judge in Arizona blocked that state from applying a similar law to Planned Parenthood.

In Texas, the GOP-controlled Legislature passed a law last year that sought to exclude Planned Parenthood clinics that provide family planning and health services to poor women as part of the Texas Women’s Health Program.

In response to Texas’ decision to ban any clinic affiliated with abortion providers from taking part in its Women’s Health Program, federal authorities announced they would cut off funding that accounts for 90 percent of the program’s family-planning costs and half of its administrative costs. Texas tried to block the funding cut, but a federal judge last week sided with federal authorities, who say the state’s exclusion of Planned Parenthood violates U.S. Department of Health and Human Services guidelines.

      In case you should ever be interested in facts, it is illegal to perform abortions with federal money. Only 3% of Planned Parenthood services are related to abortions and it’s paid for with private money. The other 97% of their services include programs to prevent women from ever needing an abortion. Planned Parenthood does more than anyone to prevent abortions. They provide many medical services to low income families which will now be lost because of phony neo-Christians (you) that have allowed Satan’s minions (Beck, Rush, Foxnews, TheBlaze) to corrupt their views in believing that Jesus hated the poor, praised the rich and hated government.

      It never ceases to amaze me that those who claim to be the most tolerant can yet be the most arrogant and insulting. You pretend to having knowledge that the rest of “us simpletons” can’t seem to grasp. We are clearly not your intellectual equal.

      Since that is the case, you might use your amazing intellect to investigate the lobbying efforts that Planned Parenthood has exerted in order to legalize abortion across the board, and I might add, set themselves up to receive federal money for it. Right you said that you can’t currently use federal money for abortions, but Planned Parenthood would like that changed. Perhaps you should pay attention to the efforts of those you defend before you spout off. The point is that we don’t like the lobbying efforts of Planned Parenthood. As far as the “rest of the services” that Planned Parenthood provides on Taxpayer expense, fine – but they have used their power and the apparent saintly character of their organization to dupe the brilliant, such as yourself, into thinking that’s all they care about.

      As far as any of us on _this_ side not caring about the poor… maybe you should take a look at charitable giving. Liberals always claim the high road, but they take care of the poor with _other_ people’s money, not their own. They admit that they do not do mammograms, they refer for them. You don’t need a building to make a referral. Abbey Johnson formerly of Planned Parenthood wrote about the services. She pretty well covered the sleaze of PP. Now it is up to the government.
      Parenthood receives taxpayer money every year and got $487.4 million in 2009-2010. Where do you think the money is going?

    You think this is a victory? Lets see, a state is funding a group that moral people strongly object to, public outcry then shut this down. Planned Parenthood went to the Fed, and the Fed took up the case! Where in the constitution did the Fed get the authority to rule on this State case? Oklahoma should have told the Fed they have no right to hear this matter, and their opinion is of no value here. This may look like a victory, but we are allowing the Fed more and more control over the States, you are making Obama’s dream come true! WAKE UP!

      Infanticide is killing an infant shortly after the infant is born. Late stage abortions are a very small percentage of the total abortions carried out. Abortion aborts fetuses. This does not trivialize what an abortion is; just ask any woman who has undergone an abortion. However, it is certainly not the baby apocalypse the neo-republicans/Christians make it out to be while they applaud the cuts to the poor that always include children as they suffer malnutrition and treatable medical conditions that go untreated because the families are unable to afford it.

      It’s not overdoing it at all. It’s useful to compare something to an extreme in order to examine whether or not the logic behind the original statement stands up. The truth is that just because something might have some positive aspects doesn’t make it positive overall.     I know I’m old and ‘things have changed’ since I was in high school in the late 60′s but let me ask a simple question. Why has not the public school system provide basic nutrition education as part of ‘health education’ during the 4 years of high school? How hard is it to say don’t eat junk food, eat salads with out fatty dressings, and stay away from fast food & pop (soda).

      Well, the public school has done that. Not only that, but they are now also providing breakfast and lunch for many students who qualify for Title 1 funding. And if those students are enrolled in after school programs, they often will get “dinner”. And some students get backpacks with food in it for the week-end.

      Now the schools have upped the ante and are now monitoring how much food the students are given. High School students are limited to just over 700 calories and it is not being well received.

      With all the social programs that are going on, I can’t figure out why Planned Parenthood would be involved in nutritional issues. The word “unbelievable” comes to mind.

    I don’t understand how Planned Parenthood could bring this action against the state. The contract they have expires on 01/01/13. Isn’t the state entitled to contract with any organization or group to provide the services it wants or needs? I suspect that the State of Oklahoma may well have had political reasons for not renewing the contract with Planned Parenthood – use of taxpayer dollars for abortion services – but there is a very bad precedent being set if an organization, any organization, can bring a court action to compel someone to renew a contract. What’s next, the Salvation Army or United Way being able to sue a state for not giving them a contract? And why not a corporation suing to get a state contract to provide their goods or services that the state may or may not want?

      Born inTexas, raised in Oklahoma. Even stationed at both Tinker AFB and Fort Sill while in the service.

      After retired from military had to move to Pennsylvania for my business. While the central part I live in is not as liberal a i worried (Philly, Pittsburg, and Harrisburg are the enclaves) I can’t wait to someday get back to Gods country. Watched the election returns and kept an eye on my Okies. Proud of you all .

      Managed to swing 7 people here in PA to switch from Obama to Romney but still couldn’t take even this county. Loved however that OK panhandle went 85% and higher red. And you can see the votes all counted because even in Guymon and surrounding counties still 10-11 votes for Obama but no ‘perfect’ zero vote counties like in Philly and Cleveland

      TRI-OX, While I fully agree with you, I am not about to hold my breath yet. Some other judge will find a way to overturn this eventually. I can’t recall the case, but I do remember one some time ago where a judge not only reversed a similar case, but also ordered the city to raise its taxes to pay for the program in question.

      Are your words, “Sara Palin, is that you?” supposed to be hurtful? Because, it would be complimentary to a lot of us. Kind of like if I asked you, “Obama, is that you?” to you and your friends. Just as you probably think Gov. Palin is an idiot, I think Obama is an idiot. Just as you admire a lot about Obama, I admire a lot about Gov. Palin.

      So, that really doesn’t work. But, hey… the liberal mind is a shameful waste of grey matter.

    It sounds like their admin was hiding stuff-good enough to “terminate” their contract. Yeah! Hit ‘em where it hurts!
