Supreme Court Justice Refuses to Block Morning-After Pill Provision in Obamacare

WASHINGTON (TheBlaze/AP) — Supreme Court Justice Sonia Sotomayor on Wednesday denied a request to block part of the federal health care law, known as Obamacare, that requires employee health-care plans to provide insurance coverage for the morning-after pill and similar emergency contraception pills.

Hobby Lobby Stores and a sister company, Mardel Inc., sued the government, claiming the mandate violates the religious beliefs of its owners.

In an opinion, Sotomayor said the stores fail to satisfy the demanding legal standard for blocking the requirement on an emergency basis. She said the companies may continue their challenge to the regulations in the lower courts.

Company officials say they must decide whether to violate their faith or face a daily $1.3 million fine beginning Jan. 1 if they ignore the law.

Attorneys for the government have said the drugs do not cause abortions and that the U.S. has a compelling interest in mandating insurance coverage for them.

In ruling against the companies last month, U.S. District Judge Joe Heaton said churches and other religious organizations have been granted constitutional protection from the birth-control provisions but that “Hobby Lobby and Mardel are not religious organizations.”

      The fact that they allowed a judge whom openly supports Obamacare to judge on it’s constitutionality and the Republican congressman didn’t protect us by railing against having her on the bench in this major decision shows just how truely fake our two party system is . It’s a two party country that’s for sure pRIVATE CITIZEN TAX PAYERS HOST AND GOVERNMENT LEECHES
      Congress shall make no law respecting the establishment of religion or prohibit the free exercise there of…. Hobby Lobby need only invest in an insurance plan that doesn’t give morning after contraception or any other precedures that violate their religious rights. More over if the federal government is providing these services then it is within Hobby Lobby’s right to refuse to pay taxes that are used in violation of their religious beliefs. And fact is the government is in total violation of the the Constitution on alot of levels the DOE being the biggest offenders.

      To exempt religious organizations is to acknowledge there is a reasonable, viable, religious objection to the mandate. But they are also saying that Christians have no right to object. So apparently Christians should only found and work for religious organizations. And I think they’d like that just fine.

      This is the same as what the Freedom from Religion Foundation is doing. They are trying to drive Christians out of every corner of the public discourse and force us into hiding. Through measures like this, they are trying to convince Christians to leave willingly. Next they will deal with those who don’t go quietly.

      One glaring fault with this article is that it refers to this drug as a contraceptive. The word contraceptive means something that prevents conception. This drug does not do that. This drug works by making the endometrium hostile to an implanting embryo. The usual place of conception of a new life, is in the fallopian tubes. This drug does not prevent that conception if an egg was released just before or within a day of intercourse. That conceived individual enters the womb within 5-8 days, and by design would implant in the endometrium (that implantation is called “pregnancy”). But, this drug prevents implantation and the conceived individual cannot obtain nutrition and its life ends. That is called abortion. Scientifically speaking, this drug is an abortifacient and if conceived, a human is killed in the process.

      That is actually not true. Abortion is caused when an -implanted- fertilized egg is destroyed. A fertilized egg is not considered viable until it implants; as you mentioned, if it fails to implant, it will not develop. Pregnancy does not begin until this point, nor does abortion enter into the picture.

      As you referenced, most fertilized eggs naturally fail to implant. These are not miscarriages or abortions; a “life” is not lost because there’s no way for the egg to develop further without implantation. The fertilized egg will not proceed beyond about 100 cells without implantation and thus has no more of a chance to become a human than a sperm or an egg alone do.

      None of that really matters though, because Plan B and those types of medicines do NOT stop implantation; they only stop fertilization.

      Locked, you are obviously mistaken in your terminology. You need to educate yourself in the science of human embryology. Therein you will find the error of your thinking and will gain an understanding of how oogenenis and spermiogenesis create haploid cells, how those cells live and die, how fertilization takes place and how that new cell is completely different from the egg and the sperm, and from the maternal compliment and the paternal compliment, where fertilization takes place and the length of time and the number of cell divisions that take place prior to the entry of the zygote into the womb. Then study the mechanics and chemistry of the implantation process. It is termed a “pregnancy” only when implantation is complete. You will learn of the building and the function of the endometrium and then if you really wish to get educated, you will study the effect of this drug on the endometrium. Then and only then will you be able to correct your misconceptions about abortion, for you are currently very wrong in your understanding. I truly doubt you will do this, as you are a lefty, and truth is not a concern when the ends justify the means.

    Little by little our government is seizing power from the people. They think if they do this incrementally, it will prevent an all out war. They are probably right. So far, all I see are a few rants on conservative websites whenever another one of our inalienable rights is being threatened. I think conservatives will gripe and moan,but eventually they will bend to their will. Seriously, who wants to put themselves and their families in jeopardy? By now a great leader for the right should have shown up and started to rally the troops. We got Glenn Beck. No offense, but Glenn is no G.W. I appreciate that we are still allowed to have sites like this to sound off. Soon “The Blaze” will only be a fond memory for some.

      Yo encinom, you continuously exhibit your ignorance. What you refer to as a clump of cells is actually proven by science to be a unique, living, human being. I thought you liked science. If so, go and educate yourself. I’ll help. The mother’s egg is a cell from her body. It contains half of her DNA compliment. Once released, if not fertilized, it dies. That is its design. The father’s sperm is a cell from his body. It is also haploid. if it does not fertilize an egg, it dies. That is its design. But if its DNA compliment penetrates an egg, it combines in the nucleus of the egg with the mothers compliment, and becomes a cell destined to multiply and divide and unless someone takes its life, it is destined to die approximately 80 years later of old age or some disease. Science proves that it is a living human. It is unique from its mother and from its father – and it has independent life. Certainly it is totally dependent on the mother it is growing inside, same as it is totally dependent on its mother for the first 2 years once outside the womb. When is it totally viable? When it turns 18 and becomes an adult. Lump of tissue? The only clump of tissue here is encinom. It’s time he used his own brain instead of relying on what his loony leftie friends and parents have pumped into the mush between his ears.

      The morning after pill uses the chemical levonorgestrel, which prevents fertilization. If you don’t have fertilization, you don’t have a zygote.

    Easy way around it gentleman {and I did it}

    Move your businesses out of the US. Only keep the retail end here and use part time workers so you don’t have to pay healthcare. Keep them under 28 hours a week and they don’t qualify.

    I don’t care about what people think about it! Maybe people will finally get the message and throw this government out and go back to a Republic run by Laws!

      Agreed. I have been looking for a country to setup businesses that Freedom and Rule of Law Americans can move and work. We should stick together and establish a free nation somewhere. If enough of us move there to have enough power to establish a free state we could grow rapidly because there are so many people that are craving freedom from the oppressive tyranny we face here.

      Good video, I sent the ’58 list of communist goals and link to the video to my friends which i have political discussions with which include an atheist militia oath keeper, non-religious hard core conservative Texan(Bush sort), self proclaimed fascist republican voter with Utopian ideals of social leveling and forced labor(Fabian sort), and a liberal christian(McCain sort)
      Im conservative religious libertarian if worldview can be boiled down to 3 words(and it can’t but for the sake of simplicity) and its wild that these are the friends i have, and they are more then merely friends, we all feel the country is doomed and we vote nearly identically, oddly. It’s a real problem when the only people who think anymore are classified as radicals, i try to talk to the other 90% of people i work with and they mostly have no clue, they are completely asleep. Under different conditions we would be all but enemies, but in these times we all feel threatened and band together(we all keep our eye on the Fabian guy, but ironically he has a good heart and we all hope he is simply misguided because he does actually think). It all comes down to respect for people i guess and we all share that amongst each other.
      I dread the future but i do appreciate how easy it is to tell the people who actually realize the world is shaking from those who are otherwise very intelligent but have no clue these days. If the world hadn’t shook i don’t know if i ever would have found ultimat

    It would be a good idea for everyone, including businesses, to transfer their assets overseas to banks paying more interest. Tax would have to be paid on the interest earned, but the principal would be safe from government taking taxes/penalties.

Of course, that will piss them off, and they will probably throw you in jail, which is another violation of the Constitution. But, hey, that’s what this is all about….removing the Constitution and installing Obamunism.

      Depends who you are. If you’re a juror who is purposely attempting to nullify a law, you’ll simply be replaced following the auspices of the Federal Rules of Criminal Procedure 23(b). If you’re a lawyer who is picking jurors specifically to nullify a law, you’ll be likely be disbarred and unable to practice law in the US any more (lawyers are officers of the court, and vow to uphold the law; advocating jury nullification purposely breaks that vow).

    Contraception generally isn’t healthcare! Rather, it is a social planning device that encourages risky behavior! If you’re going to hand out condoms and morning after pills, why not serve alcohol and provide day-beds so our youngsters can relieve their anxiety in a government-sponsored ‘waste-a-life’ program?

      The US actually used to do that, back before world war II we forcefully sterilized over 80,000 i believe. Eugenics is not the answer to where we’re heading, and angry urges for a quick fix will only hurt our side, we’re heading into a very dark age, and it will likely be a long one if we’re not near the end of this mortal phase

Not only was there a huge backlash (go figure, people don’t like it when you treat your employees like dirt), but after crunching the numbers it turns out that hiring additional employees to work along with all that is involved in the process (hiring, training, tracking, organizing) actually would increase costs more than Obamacare would.

      Might not be the same for all employers, of course.

The drugs prevent a fertilized egg from implanting in the womb, and if you believe that life begins at conception, the fertilized egg is a life.       No, if you want to equate lack of fertilization with abortion then you have to accept the fact that the chemistry of the human body aborts fertilized eggs all on its own. For every one fertilized egg that manages to survive, hundreds are left out.

      First of all, “fertilization” occurs when a sperm cell penetrates an egg. This is called conception, and in many people minds, is when life begins. After that, the fertilized egg attaches to the wall of the womb.

      While it’s true that many fertilized eggs don’t make it to “attachment” for other reasons, this is caused by natural reasons or accidents. The Day After pill makes sure that the fertilized egg doesn’t attach, by unnatural means.

      Actually, it prevents fertilization. The morning after pill does not prevent implantation.
      An article from Discovery:
      ” In the last 13 years, research into Plan B’s mechanism has advanced, and scientists are now able to say with some certainty that the drug works by delaying ovulation, keeping the egg and the sperm from being in the same place at the same time, so the egg is never fertilized. Women who take Plan B after they’ve ovulated still get pregnant. And in lab tests using cultured cells, the drug does not keep a fertilized egg from attaching to a layer of uterine cells.”

    Just going to have to pay the penalty and raise prices or cut salaries, and not offer benefits. If their faith in fact means anything to them. This is not a free country. You cannot choose to offer the benefits you wish. Those are dictated by a central authority in the capital. We have no freedoms in this country, just what the State will allow and what they will not.

      Hobby Lobby isn’t such a small business that they wouldn’t already have to have a healthcare plan. I don’t know whether Obamacare will force them to pay more than they have already been paying, but buying a plan that covers contraception will not cost them any more than buying one that excludes it.     Just a thought…take it easy on me: Sooner or later, as Christians, we are going to face THOUSANDS choices the following years regarding our faith vs. The World. We are going to be rounded and cornered little by little trough laws and regulations. This very serious, our faith will be challenged even with the smallest things. For these owners, I don´t see other way that selling, but on the other hand, I just thought this: We all say here, day after day, that guns don’t kill people, knives don’t kill people, cars don´t kill people…..people kill people!…..wouldn’t be the same to say that pills don’t kill people, but mothers wanting abortion kill babies??….or it’s just me looking for a way to serve two kings at the same time??

      I would say that there is a difference between the arguments you’ve given regarding guns & the morning-after pill. To begin with, he morning-after pill serves no other function besides to abort a baby; while a gun (or car, or knife, etc) is not usually purchased with the intent of taking an innocent life. And, my employer is not being forced to buy ammunition for my gun if they don’t agree with my opinion; however, employers are being forced to pay for the morning-after pill regardless of their personal beliefs regarding abortion.

      While I agree that the root of the problem is that the hearts of the mothers (and fathers) need to be turned to their unborn children, there will be evil and sin in this world until Jesus returns. You’re right, as Christians in this age, we will face tons of decisions in which the world will call for us to compromise, though God’s Word requires that we stand firm. My thoughts, though, are that I live in a nation where I’m given freedom to voice my opinions…and I want to be found speaking for those who have no voice – the unborn.

      Ok, I agree with you, but I will push the envelope a little bit more. In essence, you are giving “something” to somebody, and it’s up to that person whether or not using it for doing good or for doing evil,…… or am I wrong?…let me give another example: What about paying taxes to an evil government?…you don’t want to do it, and you certainly know that that government will use your money for things that are against God. You don’t want to do it, you are basically forced to do it, and the gov’t is using YOUR MONEY FOR EVIL PROJECTS!!!….basically is the same, and this is not my idea, because some Christians are claiming that complying with a corrupt government makes you guilty of its sins too. For example, the government is killing babies with your money right now…and allowing the gay marriage, and etc, etc. But don’t think about this government; think about a future gov’t much worse…how bad do you think this is going to be at that point? This is a deep problem….

      I think we are going to need playing with the system to some degree, while we don’t lose our souls. To which point? I don’t know, and that’s why I’m asking these tough questions. I think that a line on the sand could be the free choice and the free will. I mean, since there is not collective salvation, so there is not collective condemnation. I’m not responsible for your sins, and because I’m not encouraging them either, I cannot pay for you, or along with you.

      The morning-after pill does not cause an abortion. Abortion is caused after implantation; Plan B and its ilk only prevent implantation. It was once theorized that an implanted fertilized egg could be aborted by Plan B, but several studies have revealed this does not happen.

      If you think an unimplanted (ie, non-viable) fertilized egg is equivalent to a living human, I disagree. As does the Bible, but that’s a discussion for another time.

    Wrong decision, in my opinion.

    If it’s a pending case, then there should be no penalty until it is decided.

    I truly hope that Hobby Lobby pays not one penny, whether it is upheld in the Supreme Court or not.

I noticed that Justice Thomas, the stupid one, is only assigned 3 states, all of which are in the South…how appropriate!
