Pizza Hut Delivery Driver Allegedly Demoted for Defending Himself Against Teen Attackers

A college student delivering pizzas for a little extra cash has been demoted by Pizza Hut after defending himself against a group of teen attackers, Fox45 reports.

Sam Swicegood was in the Glen Burnie area of Maryland– where a friend of his was recently robbed at gunpoint– so he hid a fiberglass tent pole up his sleeve before approaching the residence.

“It’s a little fiberglass [rod] I had up my sleeve, not thinking I would actually have to use it, but more or less having a little comfort up my sleeve,” he explained.

But Swicegood was glad he had it when a group of teenagers attacked him.

After at least one of them punched Swicegood in the face, he reportedly beat them back with the pole before escaping.

“Five people against one is not a good situation to be in,” he elaborated for Fox News. “I thought I was going to die.”

But that’s only where the story begins.

Fox News continues:

Police later found three of the attackers – a 13-year-old boy and two 14-year-olds. They were charged with robbery, second degree assault and reckless endangerment, according to the Capital Gazette.

Instead of rewarding his quick thinking, Swicegood said he was punished by Pizza Hut. The college student said he was demoted to the restaurant’s kitchen staff. His hours and his pay were also slashed.

He said company officials told him he violated Pizza Hut’s ['no weapon policy'] – and apparently the fiberglass tent pole was considered a weapon.

“I’m not saying we should arm all delivery drivers, but I’m saying that punishing delivery drivers for defending themselves as they’re being attacked is unjust,” he told Fox News.  [Emphasis added]

Fox News aggregated a few of the story’s comments, one of which read: “There you go…Punish law-abiding citizens for protecting themselves against criminals.”

Pizza Hut has yet to comment on the matter.

they young thugs were redistributing the pizza… and that’s okay.

The local newspaper should publish a list of all the households with 13/14-year-old children. To be a little more specific, publish a list of government-subsidized households with 13/14-year-old children. Pizza Hut can use this list to know when to bill the feds or the individual.

Or, ban pizza because of the violence it creates. Demand a plan!

P.S. The problem here is that the company knows the drivers are going out to a possible dangerous situation but not allowing them to carry protection…It’s not a matter of providing a safe work environment…It’s a matter of the company demanding it’s employees remain ambush-able sitting ducks…This is the same bassackwards mentality that creates GUN FREE zones in our schools…

I used to work for Domino’s as a driver. We were not allowed to carry weapons of any kind on our person or in our car. We were told if someone tried to rob us to just let them do it. If we were robbed and our money was stolen (we were only allowed to carry $20 max at any given time) then it came out of our pay check. Decent money, although I wasn’t in an area of high crime and never once was robbed.

Of course here in Oklahoma nearly everyone has a carry permit and we went to open carry on Nov. 1ST. Pizza Hut, you have lost my business. I delivered pizzas back in 1986 & one of my coworkers was mugged on a delivery & put in the hospital. His money was taken, the pizzas too, & they took off with his car. It is easy to call for a pizza & have the driver come out to a dark and isolated location to rob them. It makes me sick that the company doesn’t support their own people. What a wonderful society we are becoming where criminals have more rights than the victims. Coming to you in 2013, Obama & Feinstein try to seize your 2nd Amendment rights.

Not sure if this was at an isolated location, but I know they are supposed to have strict policy (at least Domino’s does) that you aren’t allowed to deliver to people who don’t give you an address. No parking lots, roads, back allies, etc.

It’s not bad pizza but if the company policy is to turn the other cheek if an employee is attacked then I’ll turn the other cheek as to PH competitors. How can a company defer an employee’s ability to protect themselves? Lawyer up young man as there are plenty of good counselors that will take this case and those we haven’t heard about on contingency.

Pizza Hut, do not play PC games with the majority who are your customers. I agree that the results of this corporate policy will hurt your employees in the short term yes but I’m more concerned with their ability to defend themselves. The only way for an entity like PH to reevaluate their policies is after they see revenue falling. Don’t use “you’ll be hurting our employees” as an excuse because in the long run your employees will be much safer. One last thing to you Pizza Hut Drivers, good luck.

So many ways to go with this one, should we have a map of owners of tent pole, or should he have a permit for that thing. Let me tell you a little secret…in certain states, like Kalifornia, that tent stake would be a felony if used as a weapon. Kalifornians are actually better off if they illegally conceal a loaded firearm for use rather than use an improvised weapon. Canes, bats, belt with belt buckle, daggers, brass knuckles, axe handles and so on are all felonies even if someone just tells a Kalifornia Kop that they have it for protection and they never actually used it.

Ray…You hit the nail on the head…those jobs are designed to drive one to self-improvement. I have worked more than my fair share of hours in similar jobs and it was absolute motivation. Maybe if we applied that knowledge to the welfare program we could motivate those lazy good-for-nothings to improve themselves. Obviously handing them free food, rent, phones, utilities and cash every month without having to give anything back isn’t motivating them.

I stopped buying from them years ago. There pizza was CRAP! Order a mushroom pizza and you might get 2 or 3 pieces of mushroom on a slice. So I complained, they gave me a coupon for a couple of free pizzas, I called again ( home office both times) and I told them I don’t want another pizza even for free if it has no toppings on it. I would pay for the pizza just make it worth something. They suck!
Also that delivery fee that you think goes to the drivers?? No it does not go to the drivers. They suck!

Sounds like pizza hut is run by a bunch of brain dead liberal pus$$#s. I’m really tired of hearing about people getting in trouble for defending themselves. We really have to have some serious boycotts against these businesses. Pizza hut is crap pizza anyway. Should be an easy boycott.

Im with Ya! Im sick of this new mentality that somehow it is morally superior to be a victim then to defend yourself!!! Although their pizza may not be any better, papa johns is making a stand against obamacare so i think they deserve our business over a company that punishes a kid whom they should have given an award to!

I agree with your gut instincts.

      Boycott Pizzahut. Buy Papa Johns.

Fear of being sued for bodily injury is what drives Pizzahut’s motives. But at least they didn’t fire him for defending himself. The best thing Pizzahut could have done is “do nothing”.

The problem with boycotting Pizza Hut is that all the other pizza chains have the same policy. Workers are not to fight back in any way, for any reason. Almost all retail and fast-food chains have an identical or similar policy.

The reason? Lawsuits against the corporation. Doesn’t matter if the lawsuits are won or lost, or even have any merit at all.. They still cost the corporation money and negative PR

It’s much cheaper to send flowers to the funeral than it is to send lawyers to court. Dead defenseless employees can’t sue. Criminals who are stopped by force or threat of force often do.

It’s just simple math to the bean-counters. There is no column for human decency on a business accounting spreadsheet.

      @BLUESTRAT

You make a lot of sense and I think you are right about the “bottom line” is driving policy. Flowers are cheaper then libel lawsuits. However, I think if “we” are loud enough, our voice will be heard. I see it all the time when it comes to advertisers and tv programs, etc. The silent majority doesn’t have to and should no longer be silent.

Those who act like sheep, will be eaten by the wolf. – Barbary Coast Maxim

People who say don’t defend yourself are usually ensconced behind a desk in a building that has security. They are more worried about a liability loss due to a lawsuit than harm coming to employees down the ladder from them. That would make them putzes.

WALKABOUT, just take a look at our own govt attempting to disarm us. In their minds, none of us should be allowed to defend ourselves. Take a look at the UK, people have been jailed for defending themselves from criminals.

In other words, we are your protection, your mother, father, judge, jury & executioner. Democracy from the barrel of a gun. This is what theses psychos want.

No more pizza fron the Hut. Theres an outlet right up the road and I may just have to inform some ingoing patons of their policy.

Oh the justice of a boycott if drivers refused to deliver pizzas to specific areas or as a group nation wide. How would Pizza Hut handle that little bit of facts. Those who drive do so at their own risk also because I would bet that if he should get into an accident while delivering he might have to claim it on his private auto insurance since these corporations don’t have their own delivery vehicles. They use the personal vehicles of those hired as drivers and have them place a plastic device on the roof identifying them as Pizza Hut delivery.

If the corporation says don’t fight back & give the criminals the money, then if they do that & still get beaten up, the corporation should pay for all medical bills, pain & suffering & lost wages of all part time jobs.

If a lawyer can find a few dozen to a few hundred delivery people so victimized, then they should set up a class action lawsuit & sue. Maybe that will get the attention of the green eye shades sitting safely at corporate. They can do a cost benefit analysis of losing a class action lawsuit or fighting claims from muggers who assaulted their employees..

You are right they have to use their car. You also are required by most insurance companies to inform them you are using your car for said business so you rates go up.

… how is one demoted from pizza delivery person? driving the company beater Yugo instead of their own car?

Clearly another example of a company I do not need to support, given the myriad other pizza companies that offer solid product without getting lost in politically correct attitudes so much that they eat their own.

    Disgraceful.

I agree…no more Pizza Hut. Then again, after trying their pizza years ago I swore that I wouldn’t let their vile pizza grace my palate. The delivery guy did the absolute right thing and agree with those that said he should sue for not being allowed to protect himself (I’d even be cool with a concealed gun at this point) if the employer (Pizza Hut) cannot provide a safe work environment. Now I see that their company headquarters are in Texas; another reason to avoid the place!
