Lawyer Suing for $100 Million on Behalf of Sandy Hook 6-Year-Old Withdraws Claim — For Now

HARTFORD, Conn. (TheBlaze/AP) — A Connecticut attorney seeking to sue the state for $100 million on behalf of a 6-year-old survivor of the Newtown school massacre has withdrawn the claim – at least for now.

The Stamford Advocate reports that Irving Pinsky withdrew the lawsuit, but says he might refile. He has apparently received new evidence on security at Sandy Hook Elementary School and is taking time to review it.

Pinsky last week asked to sue the state, saying his client suffered “emotional and psychological trauma and injury” during the shooting rampage that killed 20 children and six adults.

In his estimation, state officials failed to prevent his client from foreseeable harm.

According to Reuters, Pinsky was approached by the child’s parents within a week of the shooting.

But the state attorney general said Monday there appears to be no basis to support the suit or the state’s liability.

“Our hearts go out to this family, and to all the children and families affected by the Newtown shootings,” State Attorney General George Jepsen said. “They deserve a thoughtful and deliberate examination of the causes of this tragedy and of the appropriate public policy responses.”

However, he added: “The Office of the Claims Commissioner is not the appropriate venue for that important and complex discussion.”

    “You can’t put a price on human (child’s) life” —— Wanna bet?

    There’s a lot of lawyers that have been chomping at the bit since the very second the news came out on that shooting.

    Parent: “A tragic thing has happened, and my only thought is that my child is in Gods arms”………”And by the way…..WHERE’S MY FRICKEN MONEY!!!!!”

    There is a celebrity video making the rounds called “Demand A Plan”. Many celebs are seen on the video demanding laws that will curtail gun ownership and correspondingly gun violence. In an answer to said video, in a video of their own, those who see irony in the Demand A Plan video show corresponding clips from the “celebs” varied bodies of work wherein they are shooting guns and committing all sorts of mayhem as they make millions for exporting displays of violence all over the world. This is called talking out both sides of your millionaire mouths. Gun violence is like most behavior; it is learned. These murder training flicks do little to promote peace and harmony amongst mankind. To paraphrase a famous American preacher, “Americas chickens have come home to roost”. Decades of killings on the silver screen and on the screen in your media room have come home to roost. Just look at the dead. No self serving lawsuit bankrupting a town is going to help. Attacking our culture of violence, especially on the silver screen might. To stop the real murders, dramatized murder must be curtailed. Censorship must take place.

    The state needs to be sued for not allowing guns on campus to protect these kids. they failed ina BIG way. Their wrongheaded views about guns cost these kids their lives.

    I don’t think this gentleman is suing on behalf of the parents of a deceased child but on behalf of the parents of a living child that witnessed the event. Would be very traumatizing for the child. Not sure that money would resolve that issue, but it expensive to have to have therapy etc. 100 million appears to be rather excessive, but, I am sure he is looking at his share of the settlement. Lets see 50 million – Oh yeah, definitely reasonable.

      Umm… no. This is how you hold the local governments who make it impossible to defend YOUR kids from these attackers responsible. It is their policy of outlawing guns on school grounds which made this horrific tragedy possible. the only way you are going to light a fire under their collective asses is by hitting them where it hurts. Their wallets. I don’t see how you can’t see that.

      Searcher – I agree with you. I think that he needs to appropriately comment on that in the press. He could hurt or help the safety of our children depending on what he is suing for. Remember, case law gets utilized over and over even if it is poor case law. We still have poor outcomes today based on bad case law. Hopefully whoever sues will result in protection and not less protection for our children.

      Agreed. I was talking about suing for not furnishing the proper protection. How many more times does this event need to be repeated before these people will be held accountable for the danger they put our children in? I can’t see any kind of argument they can form to counter this.

      searcher619, my grandparents’ generation would have never dreamed of suing if something like this had happened to them. Then again, back when my parents went to school, my grandparents didn’t have to worry about gunmen massacring their children because the biggest problems in schools were chewing gum and talking in line. What’s changed since then… if we only knew. Oh, wait, I know, we started teaching children that life is meaningless and that they evolve from slimeballs, and we stopped teaching them things like “thou shalt not kill.” You know what searcher? You people made your bed, so stop blaming the murderers you created, stop whining and suck it up. You want a world without God? Get used to stuff like this.

    Well it sure did not take long before the lawyers started trying to cash in on this. This guys and others like him to are trying to make millions from the suffering of the parents who lost children should be disbarred. Lawyers like this are truly pathetic

      I don’t care if he is. What I care about is the inevitable outcome if he does go forward with his suit and wins. It will force local and state governments to take REAL steps in protecting our kids on school grounds. The only way things change is when they are forced to change by many lawsuits like this one. Look at all the required safety devices and warning labels on all kinds of items and locations that weren’t there before people decided to hold them accountable? Fact is these kids were killed and/or psychologically scarred thanks to the anti-gun policies in place.

      If the state forces us into a posi8tion where we can not defend ourselves and then fails to defend us, a lawsuit is justified, IMHO.

      However, the only one that was going to make any money off of this was this sleaze bag lawyer. Anyone else notice that the only people who win in law suits are lawyers?

      The Original 13th Amendment is waiting for Ratification by the States.

      the Titles and Nobility Amendment.

      look it up.. All Lawyers would lose their Citizenship under this amendment.
